  • ಅನೇಕ ಜನರು ಆಸ್ತಿಯ ಜಂಟಿ ಮಾಲೀಕತ್ವವು ತುಂಬಾ ಸಾಮಾನ್ಯವಾಗಿದೆ, ವಿಶೇಷವಾಗಿ ಇದು ಸ್ಥಿರವಾದ ಆಸ್ತಿ ಆಗಿದ್ದರೆ ಅದು ಕುಟುಂಬದ ಒಡೆತನದಲ್ಲಿದೆ. ಸಹ-ಮಾಲೀಕರು ತಮ್ಮದೇ ಆದ ದಾರಿಯಲ್ಲಿ ಹೋಗಲು ನಿರ್ಧರಿಸಿದಾಗ, ಆಸ್ತಿಯ ಮೇಲಿನ ಒಟ್ಟು ಮಾಲೀಕತ್ವವು ತಮ್ಮ ಹಕ್ಕುಗಳನ್ನು ಮಿತಿಗೊಳಿಸುವುದರಿಂದ ವಿಭಜನೆಯ ಅವಶ್ಯಕತೆ ಉಂಟಾಗುತ್ತದೆ.
    ಈ ಬದಲಾವಣೆಯ ಮೇಲೆ ಪರಿಣಾಮ ಬೀರಲು ಬಳಸಲಾಗುವ ಕಾನೂನು ಸಾಧನವನ್ನು ಕಾನೂನು ಪರಿಭಾಷೆಯಲ್ಲಿ ವಿಭಜನೆ ಅಥವಾ ವಿಭಜನಾ ಪತ್ರ ಎಂದು ಕರೆಯಲಾಗುತ್ತದೆ.
    ಸದಸ್ಯರ ಷೇರುಗಳನ್ನು ಆನುವಂಶಿಕ ಗುಣಲಕ್ಷಣಗಳಲ್ಲಿ ವಿಭಜಿಸಲು ವಿಭಜನಾ ಪತ್ರವನ್ನು ಹೆಚ್ಚಾಗಿ ಕುಟುಂಬಗಳು ಬಳಸುತ್ತಾರೆ. ವಿಭಾಗದ ನಂತರ, ಪ್ರತಿಯೊಬ್ಬ ಸದಸ್ಯರು ಆಸ್ತಿಯಲ್ಲಿನ ತನ್ನ ಪಾಲಿನ ಸ್ವತಂತ್ರ ಮಾಲೀಕರಾಗುತ್ತಾರೆ ಮತ್ತು ಅವರ ಇಚ್ಚೆ ಪ್ರಕಾರ ಕಾನೂನುಬದ್ಧವಾಗಿ ತನ್ನ ಆಸ್ತಿಯನ್ನು ಮಾರಾಟ ಮಾಡಲು, ಬಾಡಿಗೆಗೆ ಅಥವಾ ಉಡುಗೊರೆಯಾಗಿ ನೀಡಲು ಮುಕ್ತರಾಗುತ್ತಾರೆ.

    ನಮ್ಮ ಪಿತ್ರಾರ್ಜಿತ ಕೃಷಿ ಭೂಮಿ ವಿಭಜನೆ ಪತ್ರ 2 ಕುಟುಂಬ,6+3 ಜನರ ಹೆಸರಿಗೆ 11/11/2021 ರಂದು ರಿಜಿಸ್ಟ್ರಿ ಆಗೀ J slip ಭೂ ಮಿ ಕೇಂದ್ರಕ್ಕೆ ಹೋಗಿ ಅಲ್ಲಿ 40 ದಿನ ಆದ್ಮೇಲೆ ಸಬ್ ರಿಜಿಸ್ಟ್ರಾರ್ ಕಚೇರಿ ಯಿಂದ ಕಳಿಸಿದ cheklist ತಪ್ಪಾಗಿದೆ ಎಂದು ಖಾತೆ ಮಾಡುವುದನ್ನು RI , TAHSILDAR ತಿರಸ್ಕರಿಸಿ ಆದೇಶ ಮಾಡಿದ್ದಾ ರೆ..
    ಇದಕ್ಕೆ ನಾವು ಏನು ತಪ್ಪೂ ಮಾಡಿಲ್ಲ ಆದರೂ ಕಾವೇರಿ ಆನ್ಲೈನ್ ನಲ್ಲಿ ನಡೆದ ತಪ್ಪಾಗಿ ಬಂದಿದೆಯಂತೆ.. ಬರೀ ಕಳ್ಳಾಟ ಆಡುತ್ತಾರೆ..
    ನಾವು ಎಸಿ ಕೋರ್ಟ್ ಗೆ ಮನವಿ ಸಲ್ಲಿಸಬೇ ಕಂತೆ .. ಅಲ್ಲೀ 1,2 ವರ್ಷ 9 ಜನಾ ಯಾಕೆ ಓಡಾಡಬೇಕು..ಈ ಕಚದಾಗಳು ಮಾಡಿರುವ ತಪ್ಪೂ ಇದೂ..

    ಸರ್ ನಾನು ಒಂದು ಸೈಟ್ ನೋಡಿದೀನಿ ಅದು 60*40 ಅವರ ತಯೀ ಹೆಸರಿನಲಿದೆ 45ಲಕ್ಷ ಆಗುತ್ತದೆ ನಾನು ಅ ಸೈಟ್ ತೆಗೆದುಕೊಂಡರೆ 30*40 30*40 ತರ ಎರಡು ಸೈಟ್ ಆಗಿ ವಿಭಾಗ ಮಾಡಿಕೊಳಭಾವುದ. ದಯವಿಟ್ಟು ತಿಳಿಸಿ

      ಗೊತ್ತಿರುವ ಖಾಸಗಿ ಆಗಿ ಕಾರ್ಯ ನಡೆಸುವ ವಕೀಲರು ಅಥವಾ ಡೀಡ್ ರೈಟರ್, ಹತ್ತಿರ ಹೋಗಿ .. ಸಲಹೆ ಪಡೆಯಿರಿ ಅವರೇ ಎಲ್ಲಾ ಹೇಳುತ್ತಾರೆ.. ಇಲ್ಲ ಮಾಡಿಸಿಯೇ ಕೊಡುತ್ತಾರೆ. .. ತುಂಬಾ ಸುಲಭವಾಗಿ ಮಾಡಬಹುದು..
      ಸಬ್ ರಿಜಿಸ್ಟ್ರಾರ್ ಕಚೇರಿ ಯಲ್ಲಿ ಮರೆಯದೇ ನೋಂದಣಿ ಮಾಡಿಸಿ.. ಕಾನೂನು ಮಾನ್ಯತೆ ಇದ್ದರೇ ಮಾತ್ರ ಮುಂದೆ ಯಾವುದೇ ಕಾರಣಕ್ಕೂ ಸಮಸ್ಯೆ ಆಗದು..

      ನೋಂದಾಯಿತವಲ್ಲದ ದಾಖಲೆ ಆಧರಿಸಿ ಆಸ್ತಿ ವರ್ಗಾವಣೆ ಮಾಡಲು ಬರುವುದಿಲ್ಲ. ಆ ದಾಖಲೆಗೆ ಕಾನೂನು ಮಾನ್ಯತೆ ಇರುವುದಿಲ್ಲ

      Sir , our ancister property (which was in the name of grand father by nane Amasaya.It is granted land since we belong to s.c may be in 1963's. Since then my father has he was educated and govt offecial took over the responsebility of both the family that is my fathers elder brothers family and our family by making my grad mother to stay there in the village .Along with my grand mother her brother and my fathers children amd my mother stayed there alternatevely and my grandmother would manage every thing has my father would send Money order for cultevation and there expencesess. Everything was smooth going untill my grandmother was managing it ,but latet when my father made my fathers elder doughter and son_in_law to stay there by claring there loan which had come for action.Both my fathers brothers wife and her daughter started quarling each other by there greadness and selfishness by seeing her mother seling the grains grown in the feild without either concent of my grand mother,or my father. Every thing was messmarised and uncontrolabe for my father. Because my father was handling the sitevation very smothley both my fathers brother and daughter tried to encash the setevation , this was in year 1985 i suppose.my grand mother was insisting my father to sell the land but father could not do so at that moment thinking that my grandmother may fell sad by that attitude of selling the land,and an ammendment was also passed by the govt stating that SC/ST land cannot be sold certen years may be rules was pass in 01/01/1978_1979 My father tried to manage it to his extrem posible extent,but he was utterley failur due to non _cordenatio,and irresponsebelity of our copasenars.they not only quqrreled inside the family they also quareled with the enemie family of us and complant was lodge by these copasenar sister in police station and grudges grew in between them and ultematley they left the village stating that our life is grater than saftey of our property. My father was also fedup struggling with this cheater in the family and irresponsible fellows least bothered to spend single NP stating that his brother family and 6 childrens and he was not going to facter due to age facter he was may be above 56 years giving this reason from the day one my father managed both the family.But ultematly understanding the reality of them my father asked his brother for the partesion of the property .But they couldn't digest it they went on bluffing my father goving one or theother reasion .My father tolarated them to the extrem extent But he was very much worried and asked me suggesetion with stating that that our land cannot be sold at this juncter becouse it is granted with condetion not to sell it certion years and his bother that is my uncle is notwilling for the partesion.how to solve this problem stating he asked me suggesetion. MYSELF without knowing the sitivation at that time i suggested it is equal responsebelity of you brothers to manage it why you alone are worried about it ,if he is illiterate he should atleast come to concluion has you had told .He was not ready to come to any conclusio and they left my father to WORRY and fathet was left no other way .He was blind they strted cuting huge trees (Halada mara) which nearly many many years old due to this may be quarel arrised in between them and this issue she took it to police station , any how they stayed has loang and untill my father was sending money order later when my father stoped sending money they left that village without any materials from that house like that they are staring it God knows weath they are telling truth are lie. My father fell ill kerping all this worries in his mind in1994 i discontinued postgraduation studies and tried to take care of my father. BY That time it was too late my father was not telling aneything with me thinking that i will be worried. When i studing in 9Th standerde a marrage was done with m mothers brother at the under age at my mothers mother that is grandmothers compltion request since many years. He was elder to me of 15 years , my some of relatives brain wased me to give my consent to marriey him . In the beganing i did not aggrey ,but has the days went on for my missfate once Astrologer came to my house he told all of the members good fortune for and for my father he told male baby will be taking birth in your family it came true bynext year ,and for me they had told i am dull in my studies and i wont studey well, for my copasenar they told he will studey well. Keepin this in mind insted of being burden to family according to my grand mothers wish and will i agreed to marry my mother's brother-in-law even knowing he had an illecit relation wirh his brothers wife and it was true too. My Aunties daughter brain washed my mind and made me to aggrey him to marriey.But on one condetion i aggried to marry him if they alove me to continue my education. But he blufed me and even after my marrage he had an illesit relation with her by this attitue of hom myself and my father were very much worried wirhiin one year of our marrage he married his brothers sister. We seperated after this insedent myself and remaing small sister and brother of 3 years where taken atmost care of my father. On other side my mother didnot acompaney my father and childrens. Even to this day i could not understand what kind of immmetured, and innocent mother she was. Encashing our innocence all our relatives played a duel roll for the property sake. I foolishly belived them ,they created a cercumstance to make me to belive them.My inner mind was aware of their actuality and i was cocious of cruiality and tried make my family realise the actual dual roll thry are playing in our family.Unfortunatly after discontinuing my postgraduation studies i arraged for dialysis of my father untill the kidney operation .we were not havng single Np in our hand but by the time i arrange for kidney doner and operation it took very long time of 8 month's, my father was scared of even small injuction ,but it was our bad luck he had to undergo all this pain. Some times he would pullout the needle when it untolarable to undergo the pain. Any how i was able to arrange kidney operation after a prolonged period of 8 to 9 months may be.No relatives kith and kin had curtise on us and lended help for us.But my collage few friends and HOD of my collage help us handle my troubles. my fathers officer was also very kind harted any how by the time operation aranged my father was attacked by jandice and laterTB .To regain his concious it took 3 to 4 months he had gone to como stage.with God's grace after regaing concios he was again under dylisess twice in a week .Dring this period my father after long time of hospetalizaton he requested docter leave to go and join duty , my father made up his mind to attend duty for 2 to 3 days and apply leave. When father was at home my copasenar came and spoke to my father, he tried to misslead my father telling him we shall sell the land without notice of others in the village.telling that has it is S.C land we cannot selling it. By lisening this i objected it i will come and see to it. Thinking that he is nnocent to this issue. One grater mistake i had done unaware of backstabing attitude of our copasaners i gave all the documents of land in my copasenars had. Insted of paying tax of land he made consperesey againt us and made arrangment of selling our land without partesion totaly. Myself and my father where unaware of there consperasey we went to taluk office.By the time we reach taluk office from shimoga to Nagamangala next day he had forgery sighned the signatur of my father and sold 6 ackers of land for 18,000/_ Rupees i each hacker of land for 3000/ rupee. I QUESTIONED MY COPASENAR HOW DARE HE FORGER THE SIGNATU OF My Father. Showing inocence in front of my father he question my father is this not the way of sighning. MY father being aware that ifwe complain he will have to go to jail my father excused him saying that he is also my brothers son. I to did not want to raise any complication at this crutiol period ,i only wanted partesion of property according to my fathers wish and will.and i did not prolong the issue because unknowlingly he might have done this,if he is excsed he would not take chance of cheating us.But again was inocence and immaturetey was missused by

      him and he took the leading roll in selling the property at an exorbitant rate by hiding the actual rate he had told for 1 hacer of land he had spoken for 3000/_ Rupees and for totaly 3 hackers it would be 9000/_Rupees in 1994 so i told ,fist let the land be partesiond first .Earliar to this previous day equal partesion was done in katha book . By excusing his missdeed, i thought he will never be dare to do the same mistake again. After partesion in the katha book next 2nd step partesion deed has to be done in the village and in front of villagers.But he alone come for each and everything has he was the whole and soul care taker of his family even his mother was alive at that time. Why dint he bring his mothet while making partetion in katha book . Was he elder than his mother or my father.next day or after 2,3 days he himself raised an issue h the actual prize to us also if it was aggrable for us even at that movement i would have taken extara risks and tried to purchase the land instad of taking such a risk throught my life to save that land. He has left uncultavatable barran land by 10 years than 1994 his date of birth is 1984 he never know that we are having land in village because due to my marriage in our family we whare facing crusial problem.My father was whole and soul for us. I myself raised an issue that he will ask his mother which land is better and which land he will afford for himself , this question arrised when he suggested for us to take the barran uncultevatable land. After that i asked purchaser not to purchase our land ,taking advantage of our sitevation and our inocence. We have never seen the purchaser of our land because he was real estate business man he never meat us only his brother whom i could identefie him whi was resident of that village i spoke to him. And explaned the matter and warned him not to purchase our land before justfull partesion within us, for which he moked at me and if had to return back our land i have to give him 700000/_ Rupees i was totally cofused and could not understand what was consperacy done? Who is playing dual roll in it at that movement.Later i come to realise very late that both have played vital roll in it. Since 1994 they trying to encroach our land in each and every survey number of us. In one of the survey number they have constructed house i had to suit a file in manday court and protect our land fighting with these upper caste people who has purcased our land from our copasenars. My brother or sisters can ever think of living in this village because my grandmother by my mother and my ancister s have gone through very regares hardship to survive in this village. Even after facng hardship in every steps of my life i have updated all the land documents by survaing it .except the land sold by my copasenar.pl give us your number or else make a vidio for our problem.
