A Nintendo Wii, a fistful of cash, naming rights, and even a jet - all of these were prizes in contests that have gone horrible wrong for different reasons. Corporate errors and miscalculations are usually to blame but what happens when actual human lives are lost as a result?

@@Viteaification Apparently. That still never made sense to me either though. Yes they "signed a contract" so to speak. But just because you put something on paper and have someone sign and agree to it doesn't magically give you the right to break the law. I don't know the exact law, but I know that there are provisions in place with regard to contract law for just these sort of situations. By which I mean there are laws in place that can allow a contract/waiver etc to be considered void if that contract is found to be blatantly illegal or unethical. Doesn't mean it's likely but it is possible. I'm assuming the way this situation turned out had something to do with the fact that it was in Australia, and they obviously have their own judicial system and laws.

First: the lady in question had a rare condition that cause her death when all the water was introduced (see the chubby-emu video for details). Drinking lots of water *CAN* be dangerous but the vast majority of people pee long before they drink too much and in thos contest having a wee stopped the drinking. Sadly for this lady the amount she drank was enough to trigger her condition.0
"They signed releases so we are not responsible"
Yeah... that's not how that works. At least here in the Netherlands; If you dare a person to do something dangerous and encourage them to continue, knowing that what they are doing is dangrous, then you are responsible for the result.
Also: as a company you are responsible for what happens to the people in your building. That's a law and it is legally not possible to wave that responsibility (contracts cannot overrule law, "enter at your own risk" is not a thing). If you get hurt by an employee, the company is also resonsible because they had to make sure that could not reasonably happen. Letting this competition happen, when consulting a single doctor would tell them that's dangerous, makes the company responsible.
Also also: If you are aware, or could reasonabily be expected to be aware, that what you do to a person can cause serious harm or even death, then it does not matter what your intent was, you are responsible for the result. They knew drinking water was dangerous, they were warned several timeson-air; that makes them responsible for the result. A court has to decide wether her death was caused by the water or her underlying condition, but if I was a judge I'd make an example of these people and give them some serious jailtime for negligent homocide.

Therr are few important things to know about water and humans. If you are in a survival situation and only got food but no water, don't eat. Digestion uses water stored in your body. Lack of water will kill you way faster then lack of food. People can survive without any food for about 30 days. It can vary because of body mass, stored fat and quality of your muscles, general state of your health and so on. If you are properly hydrated but your water is finished but you know 100% that you get some water soon then eating is okay.
Water poisoning is a real thing. It should be common knowledge in my honest opinion. A lot of things can kill or hurt you when consumed in excess.

For the Pepsi stuff and also there was Marlboro Miles, I was a teenager at the time and my dad had a liquor store near detroit. I would take the bottle returns and remove all the blue caps, I got everything in that Pepsi catalog except for the plane. Same thing with Marlboro miles, our regular customers would bring me back all their miles and I would peel them off the cartons when we would break up single packs. I still have the camping backpack, it's awesome

Worse about the radio one, the hosts who were fired went on to be interviewed and have said they don't understand why people are so mad at them and they said it's been really hard getting another job. That is beyond sociopathic behaviour. Imaging replying to a nurse trying to warn you that the contestants will die with "yeah but we're not responsible" and you're shocked when people take that the wrong way. Baffling.

WOW! I recently told a friend who let's his dog play in the ocean for long periods of time about water intoxication. He laughed at first, then got the message. It must've been awful for the children growing up knowing she died winning JT tickets for them. Especially when they really wanted the WII.
I'm not trying to be funny. Joking is risky and sometimes dangerous, in this case, deadly.
The Pepsi contest was pretty interesting. It's horrible that people got violent and victims were killed just to sell soda pop! I never liked Pepsi, Coke cola is my choice on the rare occasion I drink cola. No amount of money can change that!
In the late 60s, Royal Crown Cola had a cap contest. They also sold 16 ounce bottles for a dime less than Coke and Pepsi's 12 ounce bottles. RC cola even tasted better than both and nobody died! Responsible marketing is essential when it comes to a contest. It must be thought through and leave nothing to be assumed.
In the late 70s, I listened to FM radio. I was only 19. Herbal Essence shampoo had a little song in their commercial. At the end of the commercial, a man's voice would say, " Send us your song about your Herbal Essence experience. " So I did! Being a songwriter and very young, I took it literally! I wrote, sang, and recorded a cassette of the song I wrote about a beautiful bath in the morning. I looked up the address for Clairol products and sent it to them. Two weeks later, I received a three item gift set of Herbal Essence products and a letter of apology for the misunderstanding.
The letter said that they liked my song but never expected anyone to send them one.

I can understand the Philippines being upset with Pepsi for getting the lottery numbers wrong and giving people false hope (I know I would), but to get extremely pissed off, protest in the streets, file lawsuits, and even resort to murder? They lost my love and respect.

@@PointNemo9I'm sure if thousands of working class people anywhere got the false hope that they could be rich enough to retire and got a 'Whoopsie!' And a compensation fee in return, they'd be more than a little pissed. Also way to exercise your self proclaimed sainthood there.
