I know that sounds a little extreme but to avoid situations like this, it worked for us.
By the absence of cars in that area, I get the feeling that the tenants are at least advised to move their cars when the workers are coming. The association probably has a disclaimer that they're not liable for damages, too, which is why the plaintiff is going after the maintenance company.

No, this wasn't just up for a money grab. If he got a call that woke him up, and he got his phone and looked out his window and recorded this, he was actually functioning quicker than most people who were awakened by a phone call. In my mom's condo, you could quickly look out a window, but getting to ground level took a long time. You'd go through the apartment, out the door and down 3 flights of stairs before you'd get to the parking lot. The first floor was parking, the second floor was the first floor to live on, etc.
In fairness to the guy I had an incident where a car backed right into me in front of the police and they took one look at our bumper SAW the damage and scratches and just told us it'd buffer out while they drove off and away from the scene...in front of the Cops. So they're not exactly the people to look to when filing an insurance claim or for damages. That said, shame on the Plaintiff, this kid did a PHENOMENAL job around his cars, I've had plenty who just don't care, dust and leaves go everywhere and WE'RE responsible for cleaning it. As the owner of a classic car I can tell you that I would never leave something that I spent so much time and money on in a Common parking lot underneath the car cover. And if I saw somebody doing something that could damage it, I certainly wouldn't stand around and videotape. Before I owned my house I rented a garage at my apartment complex. I was in the middle of a dental exam when one of my neighbors called and said they were ripping the roof off of the garage that I was renting. I told the dentist I was going to have to reschedule and rushed back to the garage. I didn't immediately start taking photos. I confronted the general contractor who was twice my size and told him to stop immediately. That's what somebody who truly is watching their classic car getting damaged would do. This guy is just looking for a Payday and some money to restore his cars.

I once had a neighbor that insisted on blowing his grass and pebbles onto my driveway. He didn't keep his lawn up or dig weeds like I did and really didn't care what it looked like. He would mow every 4 weeks so the cut grass laid on the lawn like a field of fresh cut hay would look. I mentioned to him if he would just turn the mower the other way and blow the grass back onto his lawn there wouldn't be a problem. I really like my neighbors though so I didn't make it an issue. The city likes to blow rocks and sticks onto our boulevards and the snow plows push rocks and debris onto our lawns. It's just considerate to reverse the direction you're going so this doesn't happen. It's such a simple solution. I'm not sure how COVERED cars would get damaged but it did look like the kid got a lot closer than he needed to be. I would have given those vehicles a much wider berth. MOVE your cars in the future guys, it will avoid hassles like this.

It looks to me like the plaintiff was looking to make some money on this case. Of course the defendant was blowing the leaves toward the lawn and purposely turning at the end of each pass such that the blower never faced the vehicle. That's the smart way.

If there is a cover on the cars would it not have damage to it as well? I don't understand how the paint can be chipped and damage but the cover be perfectly fine.
Not necessarily. The impact of a rock may dent the car but not go through the cover. But this dude was just upset and I am pretty sure there was some minor damage that can be buffed out unless the car was metal. But minor to one person is an eyesore to another.

These were daily driven cars. Therefore, the damage could've occurred anywhere & anytime. If wanted his cars to be show cars. He needs to garage them in a storage unit, away from such communal activities. This guy couldn't even prove his wife's recent car paint job. If these cars are so precious and store them away properly. Don’t live in an apartment complex where there’s lawn guys, maintenance guys, neighbors, hundreds of other cars parking near you.
I once had a neighbor that insisted on blowing his grass and pebbles onto my driveway. He didn't keep his lawn up or dig weeds like I did and really didn't care what it looked like. He would mow every 4 weeks so the cut grass laid on the lawn like a field of fresh cut hay would look. I mentioned to him if he would just turn the mower the other way and blow the grass back onto his lawn there wouldn't be a problem.
I really like my neighbors though so I didn't make it an issue.
The city likes to blow rocks and sticks onto our boulevards and the snow plows push rocks and debris onto our lawns. It's just considerate to reverse the direction you're going so this doesn't happen. It's such a simple solution.
I'm not sure how COVERED cars would get damaged but it did look like the kid got a lot closer than he needed to be. I would have given those vehicles a much wider berth. MOVE your cars in the future guys, it will avoid hassles like this.

I disagree with the judge on this I don't think he should have got a penny he knows that the yard maintenance people come he knows they're going to be blowing leaves in the fall and because a little bit of dust got on his rims from them blowing leaves doesn't mean that he's entitled to be paid to have his car's detailed if you're that concerned about it find out what days they come and move your vehicles out of the area until they're done or pay to store your car somewhere like an enclosed garage
My dad was a total carnut! 💕He hand-washed, babied his sports cars, especially in the winter in our garage in Nebraska, three times a week! to keep the salt off them, to check for nicks & dings, any possible damage.
He would have told this guy get a garage, and more than one car, outdoors, living in a community property like that, you're crazy to leave your cars sitting around... covers are one thing but for goodness sakes if you have several cars, you can afford a garage or store them in a storage facility! 🤪
