It was because he was disobeying and obstructing the officer which to other Officers on the road is a little concerning if it called out. It’s not about him cleaning at all, that’s awesome he’s doing that. The officer stopped him, wanted to verify if he lived there and that’s it, case and point. You don’t get to just walk away and say “I’m done talking with you officer! This is bullshit!” You can’t do it. We the American people rely on law enforcement for protecting our communities right? Wasn’t this officer doing just that? He was making sure that he lived at the residence and nothing sketchy was going on. That’s it. Now, I think the officer should have got the hint that this guy wasn’t a homeless loitering and picking up trash but when you act like a jerk and don’t let the officer do their job, this happens and it sucks for everyone. The fact that he muted the body cam is called tampering with evidence. These body cams should be made mandatory among all jurisdictions both federal state and provincial. The police unions should have no say as to when they are worn nor can they have a day in the design ie power buttons and mute buttons. Furthermore Officer Smyly was allowed to resign even though he was found guilty of 2 counts of violating department policy. None of this is recorded on his record because he resigned. This allows him to simply move to a different law enforcement agency. This is common practice so even when "bad apples" are found they simply throw them back into the pile and they end up in a different bag.

Trespassers that clean up litter are the greatest. They are the most common type of trespassing encounter in this particular law enforcement officer's career. I've been watching more and more of these types of videos and it's really amazing how entitled and unethical police officers have become. It's no longer "Protect and Serve." more like "Bully and Harass." Also gone is "Innocent until proven guilty." Now it seems to be "Immediately guilty and treated like a criminal until proven (without a shadow of a doubt) innocent." It's tragic, but the USofA is no longer the land of the free. : (
Every single officer on scene needs to be disciplined for allowing this to happen and continue as well as supporting it without any idea what they arrived to.

The student properly identified himself, provided proof of his right to be there, and even offered to open the door using a key with his name and picture on it, all in the first 66 seconds of conversation. The officer broke multiple laws, violated two department policies, and violated the 4th Amendment twice, all in less than 10 minutes.

I sometimes wonder if these guys actually hear what they are saying. First, he essentially demands that someone on their own property prove that they live there. Then, he orders the man to sit down. It was because he was disobeying and obstructing the officer which to other Officers on the road is a little concerning if it called out. It’s not about him cleaning at all, that’s awesome he’s doing that. The officer stopped him, wanted to verify if he lived there and that’s it, case and point. You don’t get to just walk away and say “I’m done talking with you officer! This is bullshit!” You can’t do it. We the American people rely on law enforcement for protecting our communities right? Wasn’t this officer doing just that? He was making sure that he lived at the residence and nothing sketchy was going on. That’s it. Now, I think the officer should have got the hint that this guy wasn’t a homeless loitering and picking up trash but when you act like a jerk and don’t let the officer do their job, this happens and it sucks for everyone. The fact that he muted the body cam is called tampering with evidence. These body cams should be made mandatory among all jurisdictions both federal state and provincial. The police unions should have no say as to when they are worn nor can they have a day in the design ie power buttons and mute buttons. In my opinion the police have gotten away with way too much and now it’s time we as citizens take back our rights and put the police back where they belong. Working for the citizens.

This guy was most likely given a choice to resign so he could still get hundreds of thousands of dollars from the department in retirement monies and other benefits that he probably is still getting and that's in addition to all the money citizens had to pay out in lawsuits and settlements for this one idiot cop. He's not hurting by any means, actually financially he is probably doing better now than when he was actually out violating people's rights. No punishment for the idiot cop here has been handed out so nothing to celebrate at all.

Also, when a cop asks for ID, they want a driver's license, not some bullshit ID with no address. Their base pay is good, they get lots of overtime, they get paid to be on call for court when they seldom have to actually show for court. If no calls were made about trespassing they have no legitimate grounds to investigate. Police can't just approach and interrogate anyone on the street just because they feel like it

The cops job doesn't supercede the gentlemen's rights. Cops cost the taxpayer billions of dollars every year in lawsuits because of cops like this. Mean while racist and/or unknowing heavily biased individuals back the officer.

the man did nothing wrong! That's why he should not give any ID or anything else! He provided a college ID and it wasn't excepted. do not try and justify this harrassment with that trash.

The report would have read that the perp. Made threatening movements with the metal rod. And you can’t be serious. The officer was nowhere near professional. Do you understand your rights? 4th amendment dude. He was at his place of residence doing duties. But reguardless of if he was working or even if he was “acting shady” he wasn’t breaking a law. You can have officers come to your house and bully you around for no reason but we the people who care about our right will not.
