  • A bailiff is an enforcement agent that has the legal right to collect debts on behalf of a company or council. They can visit your home, take your belongings and sell them in order to pay the debts.
    Bailiffs collect a wide variety of debts. They also collect County Court judgments (CCJs), council tax arrears, parking fines, and child maintenance arrears.
    Nevertheless, it's important for you to know your rights and things that Bailiffs can and can’t do. It will stop them from taking advantage of you.

    Don't open the door its as simple as that. Don't leave your cars parked close by especially if they are not on finance. Park them out of sight preferably far away at a friend's or relatives property or garage.

      Just put the car in a sons name like I have, then you can park it at home. If you are on PIP get a blue badge and again they can't take it.

    Most Debt Collection Agencies take on Debts without 'wet signatures'. They get stamped instead. We have the right to demand a copy of the Debt Transfer with THREE WET SIGNATURES from all parties in agreement and without that the debt is null and void.

      Yes it has to have a wet dog at or it’s not valid and then they’re breaking the law! You can have them removed by the police!

      Debt collection agencies are not bailiffs and have absolutely no rights whatsoever. they can not take, clamp or impound anything.

    A bailiff cannot enter your home for a private parking fine and the only official that can issue a fine is a judge.
    A bailiff cant enter your property over a non payment of council tax as long as you dont offer " joinder "by engaging in conversation or denial of the debt as they have no idea if the person they are after is the person in the house and therefore you simply ignore correspondence and i have ignored them for 15 years.
    A bailiff cant remove a car if it is used by a disabled person.

    An enforcement officer from the high court visited my residence on two occasions within the past fortnight. During the initial visit, he presented himself as "Crise" from West Yorkshire Water, gaining entry. Subsequently, a letter was left in the foyer of the flats, which had previously been opened. On the subsequent visit, another letter was left in the foyer, also having been opened, without direct delivery to my door. I have apprised them of their infringement of the Data Protection Act, noting that one of the bailiffs falsely represented affiliation to gain entry to the flats

    So if one have a fine of 100 for bus lane and I didn’t pay it because I live at different address and I didn’t know, now after almost 1 year this agent enforcement Jocobs they charge me with 409 £ , really?
    How come this is legal?
    For small amount 100 now 400 ?

    I have just had bailiff's knock my door about a traffic defensive I no nothing about my husband died ten weeks ago i think it was him who got the traffic offence and we have disabled car what can I do

      oh no, that's awful, sorry you had to experience. You can try and call the bailiffs if they left their contact details and try to investigate exactly what the offence is. Plus see if they sent you other letter previously. You can also explain that your husband has died and that these are difficult circumstances for you.

    A bailiff can only force entry to your property for a criminal debt, if it's a civil debt like council tax, they can't force entry

      I’m not too sure who owns TFL, whether it’s a private company or whether or not it’s a government so I can’t really answer that. I recommend that you call a debt company like step change and doublecheck

    Not sleeping over visits, my van is clamped and a old car. Suffer from depression and anxiety which I take medication for. Debt was for £2000 which will be increased by £400 if car and van are taken. I have nobody who can help me out . Only thing I have is some cameras, and tee shirt heat press machines with a value of £800 but they want £500 last Friday, then £500 on each of the following Fridays. I am now thinking drastic measures as a easy option out is the boxes of medication I have. Stomach is knots and can not think straight and now not able to eat.

    I moved into my property last year and when I moved in I had letters straight away saying I owed 2000 for tax from 2020 to 2021 and I only moved in in November 2021 and iv set a payment plan up right now so I’m paying 190 a month and I have the letters to show this and I’m still getting letters and bailiffs showing up but I’m paying loads monthly and I’m only 20 in a tiny flat it’s so hard

      That sounds so hard but I just wanna give you credit for how well you’ve handled it. Also, if the monthly payments are too much, maybe have a chat with the creditor and reduce the amount you’re paying monthly?

    Didnt get notice, said they called on bank holiday. As first visit. Charged 195. Then came again said this is there second visit and charged £495. Is this legal?

      They should always notify you before visiting. I recommend that you speak to Citizens Bureau for some more advice about the situation

      Your credit score will be negatively affected but if you can pay off the fines, then there's no need for it to lead to bankruptcy.

    Couple weeks ago I was woken up by a bailiff banging on my door repeatedly.
    He must done it for 40 mins - I’m very venerable and disabled. He stated I owed £560 and if not paid, he’d take my car away.
    I panicked and payed- I challenged his right of payment.
    As I have an account with traffic london, to which he had be sent and no intention of leaving without payment.
    Could he really of taken my car?

      I’m so sorry that it happened to you. Sounds awful! I don’t know your full circumstances, but yes bailiffs can take your items if you haven’t repaid your debts and if they’ve given you sufficient notice. I suggest you get professional advice from a debt advisor such as stepchange or Payplan

    Thanks I'm dealing with rent payments.because the law change some rules where there is increase of salary's and some company's don't want to sign contracts with the increase in minimum wage. The landlord also in same condition and he still wants money from me and tells me he sending bailiff for me.and I have to pay them 40 dollars extra with the rent. I talked with him already he said ok. Then returns after again. I haven't got paid since January 2022 month end . And they also decided to give us the backup pay from since September 2021 the law past.not my fault every person in the country has to go through this. I'm currently I'll back pain on sick leave plus have a twist leg. I watch him this morning in my eyes remembering he saying his a nice guy .shake my head yes

      There are some awful people out there, who only make our situations worse and your landlord sounds like that awful person. Have you seeked help in other ways, such as seeing if you're eligible for a sickness benefit? And I hope you feel better soon 💕

      Hi, Bailiffs can only clamp your vehicle if they find it parked at your home, business or in a public place like a road or car park. To stop them clamping your vehicle you can: park it in a locked garage or move it to a friend or family member's driveway

    They put a letter on my partners car. I suffer with PTSD, Also high levels of anxiety. Also my partner didn’t receive a letter of enforcement. But they stuck a warning on our car saying they put a tracker on the car. So we’ve Parked it on my mother-in-law’s garden as it is private property. We haven’t came to them yet. Also in the process of speaking to citizens advice. So there presence is causing some distress, Elevating my PTSD to a point of paranoia. Also have my son in the house n he’s only 4.

      Oh no that's awful I'm sorry. They should have sent a letter of enforcement before putting a warning on your car and you can challenge that. And I hope you're seeking help for your mental health...things are hard enough and you need every bit of mental strength you can get xx

      I think a lot of people have kids...they don't give you a layer of super powers preventing those delightful bailiffs from coming to your house and asking you ever so politely for your money 💸💰....
      Arrahh baliffs the reason why I've been sat in the dark for the last 30mins too paranoid to turn on the TV / main lights.... perversely watching BALIFFS destroy people's lives on RUclips 😳🤯

      Well done 👍😁 for foiling the Baliffs by placing your car onto another person's legal property !
      They have put a letter on your partner's car 🚗 as it is probably registered at this address ?! And of course to make things easier they will claim that they can remove your partner's car to be held for 14(?) Days before it can be sold at Public Auction... UNLESS... you can prove that it's NOT your car... they don't make it easier for you 😉

    Hi,
    Can a high court bailiff, sent from a private company for overpayment for work i did. They have tripled the debt and no way i can pay it. They said they will take my car which is on finance, they said doesn’t matter if its on finance we still will rake it. I’m not working i said theres no way at all i can pay.     Bayliff that came last week was very aggressive and abusive and he forced the back garden gate open next visit il video the visit and and post it my daughter who's the debtor was terrified so I delt with him

    Just say NOOOOO have had 6 visits all left empty handed . I don't respond to there letters .I don't fill any forms they send got no intention in paying them the council can take out of my wages that way you don't pay the baliff fees. The only reason I've done this is due to the bayliffs being totally unreasonable and using bully tactics. You are under no legal obligation to give them friendly entry , to communicate with them or fill in any forms they send you .They only got 90 days to collect after a year they will return it to the council and I will get attachment of earning order and no bayliff fees😁

      Absolutely spot on, and the best way to do it. There are only two things to remember for council tax and similar debts:
      1. Never answer the door or reply to them, ever.
      2. If you have a car, move to private land somewhere else, a friend or neighbour's drive if you can. If you know when they're coming, even a supermarket car park will do.
      You may have to pay the initial £75 fee but as long as you make some regular payments the council may scrap the extra £75 - or just pay the bill except the last £75, they're not likely to bother chasing you then for that last bit.

    Bailiffs coming in 10 days possibly wouldn’t agree a payment plan they were asking for 800 out of 1069 pounds I have an admin order filled out but courts can’t sign it till 3rd of feb which would spread all my payments over a couple of years ,I’ve got another one which has given me 14 days grace and another which I have to contact as I’ve come out of my breathing space and can’t get the admin order signed quick enough, you have just possibly given me more time as I am a official carer for my girlfriend who’s classed as disabled with mental health if she’s with me where I live that stops them coming in until the 3rd of feb she wants to help and is going to be glad to get a straight couple of weeks all up in my grill lol🤦🏽 admin order was advised by step change but courts moving slow as a week in jail please advise sistrin ❤️

      Bailiffs do not have to agree to a payment plan but they absolutely do have to put the offer to the creditor, it is the creditor you owe, not the bailiff.

    A lot of what you have said is true. Except for the not allowed to use forced entry. Our courts are split into two categories. Criminal and civil. If you have committed an offence that’s resulted in a criminal warrant issued by her majesty’s courts and tribunals services an enforcement agent can most definitely force entry via the use of a lock smith. I should know I have done this. Be careful when getting advice off the internet.

      @@Tembie483 I have a fake debt agency threatening to force entry to my property in a civil court. As it is civil it’s not legal for them to force entry! It is done with a warrant without a wet signature as well!! I am being threatened so any advice would be welcome!!

      For debts any debt they’re done I civil courts with fake rented rooms! Fact!!! I’m under common law not fake made up by a corrupt government law! Electricity,gas, water etc are all civil and fraudulent!

      @@louisebellawilliamsq1032 you absolutely do not need ‘a wet signature’ anymore. We are in 2022 not 1960’s. Everything is electronic now. Including the authorisation from the judge for enforcement to occur. You are correct however about the use of forced entry for a civil warrant. If your case is a civil matter (and not criminal) all the enforcers will be able to do is help themselves into your property “if you allow them to”. Do not do this as once they are in your property they have every legal right to stay there. All you have to do is keep your door shut and they will never gain entry to your property. Or if you own a vehicle that is on the roadside they will remove your vehicle to reclaim the money for the debt so if you own a vehicle and you have agents chasing you keep your vehicle well away from your property until the heat dies down. The only reason why I know this is I myself was an enforcement agent for some time for a company called Marston. Thankfully I quit the job however after a few months because it was horrific.

    Just so you know the UK includes Northern Ireland. You should have said Great Britain. Also I’m not 100% sure but I’m sure Scotland has different rules also. And if it’s a high court order they can gain access in certain circumstances 👍

    Recently bailiffs turned up at my house and forced me to have a smart meter because I was in debt ,and they said if I wasn't in they would have got a locksmith to gain entry

      I had the same happen for my electric meter recently! They showed me the warrant with no wet signature! And it was done in a civil court! They even had a locksmith with them to break my lock! Now I know from watching this that it was all totally illegal and I will stop them doing it for my gas meter!! I will call the police to have them legally removed from my property!!

      @@louisebellawilliamsq1032 Wet signatures are not required any more. Cna't say more without all the details but that's definitely not a legal requirement now.

    if got disabled badge in your car bailiffs can't take your car but try and lie about it just keep your disabled badge in your car...look on RUclips
