Unfortunately, while most don't do much actual legal research (best to actually consult the laws and discuss with an attorney rather than just what some person with no legal training uploads on social media without showing any laws), there are a number of people that at least know some of their rights better than officers. I had some time in the mental section of the jail and sent to the state hospital because my attorney (who after nearly 2 years of demanding it, I did get replaced, part of the challenge was because they had to bring in an attorney from another state because the domestic terrorist ["victim"] had already been represented by everyone else, including the first attorney they gave me I guess since he bailed on grounds of conflict of interest after I told them I'm not the person those charges are presented for) was claiming I wasn't legally competent, which during all my evaluations, I was commended for being so well versed in law. Eventually I got the Sherrif's Department to state they would include in their training (which by law, the training is supposed to be written by the DA, the guy that was prosecuting me) that under the first clause of Amendment I of the Bill of Rights, and under Prisoner's Rights, I have liberty to freely exercise any religion of my choice, including dietary restrictions which they must accommodate for. The police in my home state didn't know we had religious freedom, even after their training at police academy, they still didn't know the very first liberty addressed in the Bill of Rights.

It's to make the person they are arresting look bad. In my second arrest, since it's a bad idea to talk to the police, I had a gang of them show up on me, all I had was the clothes on me, because of something that was going on, I wasn't in a good mood and was heading back to my car barefoot, so I didn't even have shoes to use as a weapon. This one with a USMC veteran badge over his name tape had his TASER pointed at me and told me to stop and talk to them or he'll tase me, so, I literally stopped walking, turned around, and told him "Fine, but I'm sitting down, my feet hurt." and turned to go sit on a ledge very, very close by. His response was again to threaten to tases me if I don't stop and talk to them, which I just did, so, I was being threatened to be tased for being cooperative. Again, bad Idea to talk to the police, especially about whatever they are asking, so, after sitting down, since the guy was wearing a badge claiming to be a veteran, I asked him simple questions, has he been to Washington, D.C.? What do you do at the Tomb of the Unknown Soldier? Stuff that even a JROTC student should have the answer to, but this USMC veteran didn't know anything about Drill & Ceremonies, and D&C is the core of our training. Even in peace time (which is rare for the U.S.), while there is no combat training then, the training at Basic/Boot would still be all D&C, and this guy didn't know any of it. And then when I finally got my POS "Public Defender" to give me the police reports I requested for over a year, the officer only wrote in their police report saying I was rambling incoherently, talking about the end of the world and some other stuff he couldn't understand. They gotta escalate it to make you look bad.

Mr. James, here is a tip for you and whoever will try to do the right thing:
You are arrested for nothing. If you don't get a attorney and fight for your rights, they will keep doing it until someone is willing to stop the criminals.

He doesn’t have to show him his Uber request. He has no reason to suspect this man committed a crime. Until then he’s not required to answer any questions. They can ask all they want but you don’t have to answer, it’s a consensual encounter.

He could have asked the veteran respectfully how many minutes the Uber will take to come and waited to verify if he was truly telling the truth while protecting him from harm. Idiot cop.

"Public intoxication laws are designed to prevent individuals from disturbing others in public when they are intoxicated and to restrain individuals who are unable to control their own behavior when they are intoxicated. *A charge of public intoxication necessitates the following factors:*
    a) The person appears to be to be intoxicated.
    b) The person is in public.
    c) The person is acting in a manner that is disturbing or threatening to others or oneself.
    d) The person’s behavior is a key component to determining whether the person is intoxicated in most cases.
    e) The determination of what actually constitutes “being in public” is made by the court in the specific case. There appears to be no legal definition of what constitutes a public place that is applied over all circumstances. Appearing to be intoxicated can also be a subjective determination if the person was not required to take an objective test that measured their BAC."
*Only a & b above apply as the navy vet' was disturbing nobody! These two factors do not allow a cop to detain or arrest a member of the public!*
*So ... simply put, being intoxicated in public is not a crime nor a misdemeanour!*
*The navy vet' DEFINITELY should sue these tyrants! The BS coming out of the dumb cop's mouth is cringeworthy!! He knows he screwed up!*
