Whoever does not judge by Allah's laws is a kaafir. But regarding a Muslim ruler who judge by the Shariah of Allāh and infrequently (this rarely happens), he's is not a kaafir. And this is the case, for example, of a ruler that does not apply the death penalty over a person he loves. As for the ruler who REFERS the judgement to other than Allah's laws or worse than that He LEGISLATES laws, he's a kaafir. There is much evidence for this, although some Ulama today say otherwise, may Allāh forgive them. They are wrong in this matter. Some of the Ulama who spoke about the kufr of the one who does not judge by Allah's laws are (Not specifically in order): Ibn Hazm, ibn Taymiyyah, Shaykh Muhammad ibn abd al-Wahaab (and his family), Ibn Katheer, Muhammad ibn Ibrāhīm, Ibn Al Qayyim, aw-Shawakaani and others, rahimahumullaah.

The ACTOR who rulers by other than Allah's law should be investigated by the scholars: 1. He believes this other law to be similar or better than Allah's law, or 2. He believes Allah's law is best but due to desires still chooses to rule with another law. 1 is major kufr and 2 is minor kufr.

which Ali are you talking about bcs if you talk about Ali ibn abi talib radiAllahu anhu like that then that would be kufr
