It is obvious that we cannot provide a fully symmetrical response to this American insolence of shamelessly seizing our assets. The reason is clear - we do not have a significant amount of American state property, including money, rights, and other assets of the USA.
Therefore, the response can only be asymmetric. By the way, it is not certain that it will be less painful. We are talking about enforcement measures, for example, by court order, on the property of private individuals located within the jurisdiction of Russia (money, real estate, and movable property in natural form, property rights). Yes, this is a complex issue, as these individuals usually acted as investors in the Russian economy. And we guaranteed them the inviolability of their rights to private property. But something unforeseen happened - their state declared a hybrid war against us, including legal and judicial warfare. It created a mechanism for the illegal appropriation of Russian assets, completely contrary to international and our national law. This requires a response. And in a sense, it is already present in our legislation. These are called retaliatory measures. Article 1194 of the Civil Code of the Russian Federation states: “The Government of the Russian Federation may establish retaliatory restrictions (retorsions) with regard to property and personal non-property rights of citizens and legal entities of those states in which there are special restrictions on property and personal non-property rights of Russian citizens and legal entities.” This rule needs to be broadened, as the confiscation of our assets is essentially the termination of property rights. Therefore, our norm should provide not only for the restriction of rights of foreign individuals but also for their termination, so that enforcement can be directed in favor of the Russian state, Russian legal entities, and individuals against the property of foreign legal entities from unfriendly countries. This will require a certain adjustment of Russian civil legislation.
