Asahi Metal Industry v. Superior Court | 480 U.S. 102 (1987)
In Asahi Metal Industry Company versus Superior Court, plaintiff Gary Zurcher brought a product liability suit after he was injured in a motorcycle crash caused by a tire blowout. Zurcher originally sued the manufacturer of the defective tire, Cheng Shin Rubber Industrial Company, in California state court. Cheng Shin sought indemnification from its Japanese supplier, third-party defendant Asahi Metal Industry Company, from which Cheng Shin had purchased the valve assemblies used in the problem tires. All other claims, including Zurcher’s, settled out of court, leaving only Asahi and Cheng Shin in the action.

So why is cheng shi not punished ?? im not getting something here
They were. Cheng Shin was subject to jurisdiction and may have settled or had to pay a judgment. The lesson of this video is that Cheng Shin attempted to drag Asahi into the lawsuit so Asahi would have to pay all or part of the damages (indirectly through indemnification) but the court ultimately found Asahi was not subject to personal jurisdiction.
Cheng Shin should be liable, then Cheng Shin should have sued Asahi in China or Japan for their losses .
