  • On March 15 at 3 p.m. ET, Lawfare Editor-in-Chief Benjamin Wittes will sit down with Lawfare Legal Fellow and Courts Correspondent Anna Bower to discuss Judge McAfee's order granting in part and denying in part the motion by Mike Roman to disqualify the Fulton County DA's Office from the 2020 Georgia election interference case. Judge McAfee’s ruling allows Willis and her office to continue to prosecute former President Trump and his co-defendants as long as special prosecutor Nathan Wade withdraws from the case.

Ben, did you have a fly in your office? 😂
(Also, I’m sure it’s exhausting for you all, but I appreciate the 3 lives this week to dissect this all!)

I got excited to watch this in a more timely manner than would be on the podcast feed but now I have faces to go with voices and my mental image is completely changed

Why is Ben's porch decorated like an office while his office is a high-rise potting shed?

Good question. Maybe Stephanie Pell (spelling?) can do an Arbiters of Style episode on this.

He did a nice job, it appears, of dancing through the miasma of crudely racist opinion that passes for "moral rectitude" in politically dominant segments of Georgia society.🙄

Can the judge nix the cert without the appeal court? Or do they both have to concur?

I appreciate Judge McAfee's courage to not cave to all the MAGA demands. I hope that he realizes the increased security he's now going to need. The shade he sent Willis won't help. MAGA is all or nothing.

Fannie Willis is a train wreck and were all lucky that she didn't blow up the case with her own hubris. This is not the first time that she's done something like this and it won't be the last. She should fire Nathan Wade (or accept his resignation) and hire an experienced and competent special counsel to run the case (someone that she doesn't know) and then recuse herself. If I were the judge, I wouldn't trust a single statement from Willis. The "odor of mendacity" was pretty damn strong and she should be thinking of ability of the case to survive further review and post conviction appeals. I doubt she will. She's got a little to much Trump like sociopathy going.
On Judge McAfee's response to Willis' speech in the church, McAfee is pissed off and has had enough of Willis' BS (see above) and is fundamentally trying to protect his case from appeal. I think McAfee would very much prefer that Willis not be in charge of this case going forward as he doesn't trust her and thinks she is unprofessional (I would agree). Again, if Willis was operating with the best interests of the case, she would recuse herself. She probably wont. I'm not sure if she is being challenged in the primary this year, but she should be.

@@rayrheault2406 the judge was her employee at one point and he contributed to her campaign and Fani hired her unqualified boyfriend AND she (and he) lied under oath, for starters. 🥴

What this whole case sounds like to me is, small town yahoos running amok of the system, creating their own fiefdoms looking at the people they're elected to serve as a bother. Suddenly, they get a shot at the big time, and they're all caught with their pants down. I'm sure that things like this happen in all small communities and it's unfortunate as citizens they are elected to serve, lose. Power is a drug that erases his all memories of righteousness, and exponentiates itself in wanting more. Unfortunately, Imperfection is an inherent part of the human condition.

@29:06 analysis of the “church speech”: Actually The Judge himself finds that their WAS an ACTUAL conflict & ACTUAL violation of forensic misconduct but avoids having to disqualify based upon that finding solely based upon the pre-trial status of the case and the length of time between the speech and when jury pools are formed, which is frankly , the biggest fatal flaw in the entire decision.

Don’t you think that the fact the plea offers have been SO generous, AND who were not signed into this motion to disqualify have not accepted pleas illustrates the shakiness of the DA’s & State’s case especially the RICOH portion (and sorry to say, their competence?)
