    There is a lot of trouble over those rights of way 4 or 5 different farmers could have a right of way on a lane to access their land and then there’s fighting over who will maintain the lane ie cut hedges road surface. ectra Some of them might only use a small bit at the bottom others would use the full length of the lane.

    You often and correctly say rights are the fruits of duty , could you expand on what duties someone who has a right of way through a property have

      Someone who has a right of way has no duty, except to exercise the right

      @@terrygorry and if someone does not exercise that right they lose their rights, we live in a Republic with a constitution and have the Law of the land, but people don't bother with that stuff until they are effected. We are all equal and should be treated as such but as we know councils, government and the elite class do not care for that.

      would it be fair to say all rights come with the duty to exercise them
      If damage or a tort of some sort was inflicted would they have an duty/ obligation to make amends

    How do you know if a lane is already registered? I live on a lane that has been in use for various farmers for years, it's the main way to access the mountain. I think it was the main road back in the 19th century but another road was subsequently built. I don't about where you live but around me farmers don't like to sign anything to paper, there's a suspicion of authority.

      If it is Land Registry property it will be marked in yellow on the Land Registry/PRA map which you can check online here www.landdirect.ie/

      What about time, if land hasn't been used for 12 years for private and 30 years for state owned land the claim becomes null and void, l and my family are in and always have been in occupation of this lane without obstruction or objection from any other party. There is also a question about whether it was a right of way. Why now and not the last 8 decades are the county council interested??? Brown envelope?? The land is not registered and does not belong or ever belonged to the council or the developer so if remedy can be made and l am open to talks. People need to stand up for their rights because itcan effect me today but effect u tomorrow

    How would this work for people putting up fences on walking trails that were active for years , but due to covid no walkers were around to object .
