Such much needed advice for my case, my accuser has told a complete lie at the pre-cause hearing and now the case is in federal court. I feel I can not solely depend on the court appointed lawyer. Hello Mrs Veronica, I have a friend that is falsely being accused of stalking. He simply smiled at a cashier lady in a store and then when he went back another cashier lady said: “See that’s the guy that was stalking Laurean(made up name)”! He was shocked and now he doesn’t Know what to do, as far as he knows no charges have been filed, but I did advise him to stop going into that store. In Sacramento County, the perpetrator cannot request a police report - only the 'victim'! So if your partner is lying, pretending to be the victim & falsely accusing you, then you CAN'T follow this advice or get the police records. This is huge hurdle when trying to refute what they said or reported to law enforcement!
As the accused, your attorney gets the police report when/if charges are filed. They then can redact certain information from it and provide it to you.

I contacted the dealership and informed his boss. Then The detective showed up at my door step saying that I was stalking him. I went to the police May 7 filed a police report of him stalking me. He filed the exact same report on May 10. Since then he has been threatening me, Harassing me and intimidating me. The prosecutor is not dropping charges and now I am going to trial. I was subsequently arrested based on their testimony that night for Felonious assult which I did not commit. Naturally I hired an attorney who never worked the case at all and would not get the discovery. Then I picked up two public defenders, one of them lied to the Judge and tried to pressure me with lies to plea. The prosecutor also backed up the lie. I fired her thinking I would be able to work with the other attorney that was assigned. Well when you fire one, you fire both I guess. So I asserted my right to take over the case and they offered me a better deal, the best deal yet. Primarily because once I had the majority of the discovery I knew I didn't have it all and made the judge of aware of this huge gaping hole of missing discovery. The missing discovery also revealed that someone tampered with the video evidence cutting almost 4 minutes from a 5 minute and 19 second video. He ordered the prosecutor to get it to me within two weeks. It took her 6 weeks. It's been 18 months now and I've had to deal wtih two different prosecutors and I know that I'm still missing critical evidence. I never thought I'd be ready for trial but im looking forward to it. I was also hit and run and driven over 10 days before the last trial was scheduled and 3 days after my 12 page motion to dismiss was filed. I was almost killed, both legs were crushed and my left femur snapped clean off at the knee severing the quadricep clean off. The left fibula and tibia were also both crushed and sticking out of my keg below the knee. But I survived and I still have two legs so I'm pretty happy about thay and I'm back on my feet with a walker now just 5 months out of four major surgeries.

And its ALL on video and shows while im inside the store, the video shows simultaneously as im inside shopping shows another person in a car in the parking lot open their driver door, and toss the gun out. I was inside and had no idea any that happened. Customer finds gun tells store employees, manager comes out and retrieves gun and calls police. Police come, im standing and walking around the store while the cops are all standing together, i have no clue they're there for me or investigating me. Finally officer comes up and says "whyd you buddy take off?" I didn't even know hed left let alone threw a gun out the car. I said "what he took off?! I have no idea!" At the moment i thought the officer meant there was an active high speed pursuit. Officer says "could it have something to do with the gun he threw out the windo" at which point i put my hands out, shook my head and said "Whoa idk anything about a gun and im not saying anything without a lawyer" to which the cop snapped at me "Thats fine! We have everything we need!" I said "okay am i free to go?" He says no but lets go outside. As we're standing outside im holding my phone and officer snatched the phone out my hand and went thru it, found a picture and showed another officer who agreed and they arrested me on the spot for B felony gun possession in 2nd degree. At the station detective asked if i wanna talk, i snapped "NO! I want my f*cking lawyer!" Detective said "okay calm down! That's no problem at all, you don't have to speak to me you dont want" okay cool. Im put in cell and next day judge RORs me. Couple weeks later i get my discovery and theres a written confession written in 1st person. They claim i gave a full verbal confession, the confession is not signed with my signature cus i never gave no dam confession, and they know signatures cant be verified. The video shows at no point was that gun in my possession. I been sick to my stomach, cant sleep, cant eat, cant think straight. I face upto 15 years in prison for a crime i did not commit. The prosecutor also chopped the footage up into pieces and removed two parts of the video. The part when the officer asks me about the gun and i visibly and verbally deny knowledge. That portion of video is missing and so is the part where the officer snatches the phone from my hand and unlawfully searches it. Those two portions of footage, that coincidentally would destroy the prosecutors case are missing. I filed a complaint against the prosecutor for brady violation and they removed her from my case and assigned a new prosecutor. He waited almost a year and half before bringing the case to grand jury which surprises surprises i was indicted! I have court tomorrow to he "arraigned" even tho i already was for this case and was put on a supervised release like ROR but i gotta call a probation officer once every week. We have a very good rapport, sometimes talk for an hour. Im working full-time and have so much going on, mother in laws in ICU and may pass, we're in middle moving and dont know where and how were gonna afford it. Im working myself to death and if the judge remands me or POS prosecutor requests a bail, i wont be able to afford it and the prosecutor has little to no case and the way he is i can definitely see him trying his hardest to get me remanded as to have leverage to get me to take a plea. I cant, their last offer which still on the table was 2 years, for a charge with max of 15 years! That should tell you everything you need to know about the strength of the states case. I cant afford a paid attorney and im stuck with legal aid whos done nothing but try to force me to take a plea deal. Any plea that involves me going to jail is out the question, i should not even have to plea to anything but i would simply to have this knot in my stomach loosen and for this nightmare to be over. Idk what to do, there are SOOOO MANY holes in the case, i went thru the discovery with a fine toothed comb and found so many inconsistencies, errors, lies and blatant contradictions its UNBELIEVABLE. I feel like the prosecutor is more than aware of what a enormous mess this case is and how bad it'll look if this gets out, not to mention a civil suit will absolutely be warranted. I think the prosecutor is playing damage control, trying to protect the cops and himself and his office by getting me to accept any plea i lose the right to sue. Anyone with advice please give it, I just want this to be over.
Well when you go to Court just plead not guilty and get a Public Defender and let them work out the best deal for you or it possibly we even be dismissed, They might want you to name drop and if so just take the best deal 🤝 I've been there and just took the best deal because I'm not telling they going to want to know who you was with. What y'all riding around with a gun for etc, Just take a couple years deal or shortest way out....I just ask for a ride I don't even know dude 💁🏿♀️
Isn't reliable. A person might be angry or anxious at a question - say they've been repeatedly falsely accused - which might signal a "positive" in the test but that doesn't indicate guilt. Plus how do they differentiate between event recall and imagination? They might imagine a scenario but that doesn't mean it occurred. Plus there's those who've found methods to cheat.

That portion of video is missing and so is the part where the officer snatches the phone from my hand and unlawfully searches it. Those two portions of footage, that coincidentally would destroy the prosecutors case are missing. I filed a complaint against the prosecutor for brady violation and they removed her from my case and assigned a new prosecutor. He waited almost a year and half before bringing the case to grand jury which surprises surprises i was indicted! I have court tomorrow to he "arraigned" even tho i already was for this case and was put on a supervised release like ROR but i gotta call a probation officer once every week. We have a very good rapport, sometimes talk for an hour. Im working full-time and have so much going on, mother in laws in ICU and may pass, we're in middle moving and dont know where and how were gonna afford it. Im working myself to death and if the judge remands me or POS prosecutor requests a bail, i wont be able to afford it and the prosecutor has little to no case and the way he is i can definitely see him trying his hardest to get me remanded as to have leverage to get me to take a plea. I cant, their last offer which still on the table was 2 years, for a charge with max of 15 years! That should tell you everything you need to know about the strength of the states case. I cant afford a paid attorney and im stuck with legal aid whos done nothing but try to force me to take a plea deal. Any plea that involves me going to jail is out the question, i should not even have to plea to anything but i would simply to have this knot in my stomach loosen and for this nightmare to be over. Idk what to do, there are SOOOO MANY holes in the case, i went thru the discovery with a fine toothed comb and found so many inconsistencies, errors, lies and blatant contradictions its UNBELIEVABLE. I feel like the prosecutor is more than aware of what a enormous mess this case is and how bad it'll look if this gets out, not to mention a civil suit will absolutely be warranted. I think the prosecutor is playing damage control, trying to protect the cops and himself and his office by getting me to accept any plea i lose the right to sue. Anyone with advice please give it, I just want this to be over.
Well when you go to Court just plead not guilty and get a Public Defender and let them work out the best deal for you or it possibly we even be dismissed, They might want you to name drop and if so just take the best deal 🤝 I've been there and just took the best deal because I'm not telling they going to want to know who you was with. What y'all riding around with a gun for etc, Just take a couple years deal or shortest way out....I just ask for a ride I don't even know dude 💁🏿♀️

What about the lie detector test?
They read anxiety levels and are not permitted for use in court. There is no real lie detector test.
Isn't reliable.
A person might be angry or anxious at a question - say they've been repeatedly falsely accused - which might signal a "positive" in the test but that doesn't indicate guilt. Plus how do they differentiate between event recall and imagination? They might imagine a scenario but that doesn't mean it occurred.
Plus there's those who've found methods to cheat.
