I’m a probate litigator in Michigan and I can tell you that my judge would not have let this hearing go this long. She removed the person representative (what we called them here) and appointed a neutral attorney to take over and finish the estate. That that attorney would probably have filed a suit to surcharge Melody, and make her payback anything she took from the estate

But I just hired a lawyer to do everything and they charged a fee upfront then took the rest of the cost out of the estate is that still the way things can be done. I only ask because I am at the part in the video where she is saying she can't afford a lawyer and that doesn't make sense to me. Help me understand if you wish, ignore me if you want. I’m assuming an attorney didn’t remain on the estate because Miss Patton squandered the funds, and even selling the houses, would only bring profit from the smaller home on Braesheather. Which after fees, might give each son $100k. Also, she had granny sign a lease on the million dollar home, so she can live in it and not sell. It’ll be sold, and she can then sue granny’s estate for the remainder of the lease. She deliberately used those 8 weeks to screw granny over, I’m sure it was her husbands idea. He seems like a crook.
Let's all take note what a beautiful example of proper judicial demeanor we saw here. She was respectful, fair-minded and far more patient with all the parties, including the pro-se Independent Executor, than I would have even thought possible. Not to mention she stayed on the bench (with her court reporter) hearing the case until past 7pm on the Friday before Xmas. The folks in that county are lucky to have her.

Im a respiratory therapist and I worked in critical care for 20 years I have seen this a million times. Some sleazy family member tries to swoop in to "care" for the patient at the end of life to try to get their claws on the family assets. This stuff never fails to disgust me.
Yup. I'm an RN. The opposite can also be true: keep Mom alive forever for her check. I've seen patients wanting to go hospice and a family member trying to stop their will and keep them alive. One time a little old lady was terrified her kids were going to stop the hospice nurse from visiting. So she had us anonymize her status in the hospital, change her room number and call security once the family arrived to tell them they were no longer welcome. It's so gross how lazy/poor people take advantage of old people.
My mom did this with my grandma. It was so bad I took her to court. She agreed to "allow" me to be her Healthcare conservator when I signed away all financial rights. It was a huge win for me. Families suck.
I had POA for both my FIL & MIL. I handled all of their medical, financial, and every other aspect of their lives for almost a decade. When they were revising/updating their wills, they said ‘well you know how to do everything and already know all of our information, so we will just list you as executor…’ and I JUMPED at interrupting. I, very QUICKLY AND FIRMLY denied that role. I’m married to their eldest son, they have a middle son, and an adopted youngest son who has always been the ‘golden child’. They didn’t want to make the difficult choice to choose when end of life were the most humane action I could take with my MIL…The sons had no problem with me having to run myself ragged and it almost physically killing me to take care of them in all the ways I was, BY MYSELF, (my husband is disabled and the other two sons never could spare the time for their parents…not even for calls…) but I knew that the moment dollar signs got involved, it was going to be a $h1tshow unlike anything they’d experienced. I NOPEd on out of that and my husband said he wouldn’t accept the responsibility either. Middle son has been gifted the responsibility that he THOUGHT he wanted. I am relishing the fact that I’m able to sit back, relax, and watch he and the golden child LOSE. THEIR. MINDS with all of the rules, responsibilities, and time being spent on the succession. 😂😂😂

My mother’s siblings had the opposite fight when my grandparents passed. She was named executor and due to her heart condition she didn’t want to do it and her sisters didn’t want it either and her lawyer nephew even passed on it. So, my dad took care of the legwork while she did all the signing of documents. It’s sad because my grandparents estate wasn’t even worth $10k after creditors and legal costs. Just headaches.

It says she was removed and Lauren Smith was appointed by the court, and the newest cause was to turnover estate property on April 25th, 2024. She didn't show up to court, and the order was granted. So I'm hoping she had to leave the property.

My mother was the executor of my grandfathers estate, luckily it went easy but she had SO many meetings with lawyers, still to this day, 3 years later.. and SO much paperwork. This lady is insidious.

Hey Mike This should be a wakeup call to everyone. PLEASE GET YOUR END OF LIFE BUSINES TAKEN CARE OF!!!! Had do deal with similar ullshit when my mom put off finishing her will and trust stuff. LUCKILY before the cancer quickly took her she got me appointed as POA. But still the process for me to take care of everything was mad a thousand times more difficult because she put it off and her condition deteriorated way quicker than doctors expected. We went from having several months to a year to only a few weeks before she passed. Yes these conversations are DIFFICULT.... BUT ITS WORTH IT!!!
So sorry for your loss. And agree 💯. Thankfully my dad was an attorney and made sure a trust was set up long before he passed. He also guided me when my biological (sperm donor) passed and i was made his executor. Also thankfully my grandfather (father of sperm donor) had a trust in place also. Hope that all made sense lol. It’s difficult enough to lose your loved one. No one should have to deal with this ish afterwards. Especially when it leaves it in the hands of someone like Miss Patton. Which is why i have already taken necessary precautions for my children. It’s just sad that many don’t understand the importance of these things.

We just about have wrapped up my mother inlaw estate. THANK GOD, she hired a trust company to handle EVERYTHING. It took so much work and stress off of us . We just had to sign a few papers, they handled everything else.
As someone who is 8.5 years in recovery, I can promise you they are both DEFINITELY on drugs and were so excited about banking off her grandmothers death. I knew people like this and they are disgusting. I can guarantee the next executor of the estate is going to find they stole lots and lots of money.
Idk if it’s necessarily drugs. It’s a very good possibly, but it’s not uncommon for sober individuals to become truly greedy/unhinged in these situations. It’s like a person passes, and they were the ONLY thing holding everyone together.

As someone with extreme fibromyalgia myself and extreme anxiety and depression, I can only imagine what the stress of dealing with Melodie and her husband has done to David. What stuck in my craw and I hope they look into it - the bank account Melodie claims the lawyer made a mistake and there was no such bank account as stated in the will. My guess somehow Melodie and Matt found a way to get any funds from that account and squirreled it away or used it to feed their addictions. Melodie had the tweaker look including the raccoon eye patches and Matt was higher than a kite. I can't imagine her not being removed as executor. She didnt seem to understand the court was not interested in the state of the property -- that was an excuse for cutying David off. The fact she called the cops on his old warrant - shows just what a snake she is. Not to worry - karma will catch up to Melodie and Matt. They are beyond stupid.
Melodie emotionally manipulated her grandmother into naming her executor. It sounds like grandma had assets, she should have made her attorney the executor. People choose family to try and save their kids legal fees, but it's worth it to prevent these kinds of messes.

She is hiding the money they have stolen, living rent free, and only wants the fee paid for being the Executor because it could be anywhere from $125,000 to $150,000, she/ they need that big pay day. I hope the Judge pulls her from her roll, orders a full accounting at M. Patton’s expense and if she has stolen or miss appropriated any funds/assets, then put her in jail! Lastly kick her out the home she is in ASAP and sell it and let this family have peace.
@@gatsby66 Yes and they do! Even when they say they won’t, trust me I see it ALL the time. In most States they have up to 5% of the amount that passes through the Estate. Some can be less or more and others may divide it out as ( kinda like first in and first out) but in TX it’s up to 5%. It was hard for me to completely follow the numbers here because of the them and me getting ready for Christmas but if the properties are 2.5 million ( the one she is living in) and $400,000 to $500,000 ( the one they kicked the brothers out of) then you take 3m x 5% and you have a pay day of $150,000. If you can get them or the State to only pay them 2% then that’s $60,000. Still a BIG payday for really doing very little. Sadly if the heirs need or only feel like the fee should be less than the 5% you have to go to Court for it and that cost adds up really fast and that’s why the fee is not challenged that much. Also, I’M NOT AN ATTORNEY I just work with people who go through this day in and day out.
@gatsby66 yes. I wasn't my father's executor, but after the estate was administered, I was trustee of the testimentary trust since my siblings were minors. I was entitled to a fee, but I didn't charge them. When my mother and grandfather died, I was the exec and there was considerably more for me to do, so I collected my fee. Under the probate laws of my state, the executor is entitled to an admin fee, regardless if it's a family member or 3rd party.
This is *definitely* a grift. If Ms. Patton had *no interest* in the estate beyond executing the will, she'd have hired an attorney to help with probate (since she's *clearly* in over her head), an auction service to help remove saleable goods that neither son wanted from David's house (since that would've *quickly* generated funds for the estate *and* helped "clean the place up"), made inroads into getting the house *she* was living in sold, and hired a real estate agent to help with the sale of *both* properties. The fact that she wouldn't do *any* of those things can can *only* be attributed to the fact she's planning to skim as much as she can *for herself* - (she's *so* transparent!) - and doesn't want any of those expenses coming out of the estate.
👍👌💯absolutely spot on. My ex’s siblings, 2 in particular, they did the least for my amazing in laws 😢💗but their hands outstretched, just waiting…my loving, lovable MIL passed last fall, at 97yo. She was the best lady despite her greedy kids.

Watched this whole thing…I have recently been appointed guardianship for both of my parents. The reasons are horrible, it was to prevent further elder abuse from my brother, but I still have anxiety about doing my job as guardian. This case has alleviated my worries
We had a family member that hoarded. When they passed, the house was in good condition, but it took dumpsters to remove the stuff, and dog poop all over the house was filthy. Had to remove the carpet. Once the clean up was done, which took A LOT of time and work, the house was good to sell. So I get that part. No one was booted out, and no one e moved into it though.
My grandma asked me to be her conservator. I said HELL NO! Happy to be her Healthcare conservator and hired a 3rd party to do the Financials. Families are nuts when $$$ is involved

I'm in Texas not far from the Woodlands, and they need to speak to another realtor on the Dobbins house. Homes in that area are currently selling for more than a million dollars. They have to know if they listed it for $400,00 it would sell in heartbeat and they would have to move.
I looked it up. Judge removed her, appointed a successor (not Joshua) and order Melodie to turn over all assets within 10 days.

My mother’s siblings had the opposite fight when my grandparents passed. She was named executor and due to her heart condition she didn’t want to do it and her sisters didn’t want it either and her lawyer nephew even passed on it. So, my dad took care of the legwork while she did all the signing of documents. It’s sad because my grandparents estate wasn’t even worth $10k after creditors and legal costs. Just headaches.

Hey Mike This should be a wakeup call to everyone. PLEASE GET YOUR END OF LIFE BUSINES TAKEN CARE OF!!!! Had do deal with similar ullshit when my mom put off finishing her will and trust stuff. LUCKILY before the cancer quickly took her she got me appointed as POA. But still the process for me to take care of everything was mad a thousand times more difficult because she put it off and her condition deteriorated way quicker than doctors expected. We went from having several months to a year to only a few weeks before she passed. Yes these conversations are DIFFICULT.... BUT ITS WORTH IT!!!

So sorry for your loss. And agree 💯. Thankfully my dad was an attorney and made sure a trust was set up long before he passed. He also guided me when my biological (sperm donor) passed and i was made his executor. Also thankfully my grandfather (father of sperm donor) had a trust in place also. Hope that all made sense lol. It’s difficult enough to lose your loved one. No one should have to deal with this ish afterwards. Especially when it leaves it in the hands of someone like Miss Patton. Which is why i have already taken necessary precautions for my children. It’s just sad that many don’t understand the importance of these things.

As someone who is 8.5 years in recovery, I can promise you they are both DEFINITELY on drugs and were so excited about banking off her grandmothers death. Idk if it’s necessarily drugs. It’s a very good possibly, but it’s not uncommon for sober individuals to become truly greedy/unhinged in these situations. It’s like a person passes, and they were the ONLY thing holding everyone together.

When Melodie was talking about the dog breeding business, she said she didn’t own any part of it but then when she was talking about the payments the business was making to the estate, she said, “We are making payments”. Seems like she is part owner.

What stuck in my craw and I hope they look into it - the bank account Melodie claims the lawyer made a mistake and there was no such bank account as stated in the will. My guess somehow Melodie and Matt found a way to get any funds from that account and squirreled it away or used it to feed their addictions. Melodie had the tweaker look including the raccoon eye patches and Matt was higher than a kite. I can't imagine her not being removed as executor. She didnt seem to understand the court was not interested in the state of the property -- that was an excuse for cutying David off. The fact she called the cops on his old warrant - shows just what a snake she is. Not to worry - karma will catch up to Melodie and Matt. They are beyond stupid.

Lastly kick her out the home she is in ASAP and sell it and let this family have peace.

@@gatsby66 Yes and they do! Even when they say they won’t, trust me I see it ALL the time. In most States they have up to 5% of the amount that passes through the Estate. Some can be less or more and others may divide it out as ( kinda like first in and first out) but in TX it’s up to 5%. It was hard for me to completely follow the numbers here because of the them and me getting ready for Christmas but if the properties are 2.5 million ( the one she is living in) and $400,000 to $500,000 ( the one they kicked the brothers out of) then you take 3m x 5% and you have a pay day of $150,000. If you can get them or the State to only pay them 2% then that’s $60,000. Still a BIG payday for really doing very little. Sadly if the heirs need or only feel like the fee should be less than the 5% you have to go to Court for it and that cost adds up really fast and that’s why the fee is not challenged that much. Also, I’M NOT AN ATTORNEY I just work with people who go through this day in and day out.
@gatsby66 yes. I wasn't my father's executor, but after the estate was administered, I was trustee of the testimentary trust since my siblings were minors. I was entitled to a fee, but I didn't charge them. When my mother and grandfather died, I was the exec and there was considerably more for me to do, so I collected my fee. Under the probate laws of my state, the executor is entitled to an admin fee, regardless if it's a family member or 3rd party.

If Ms. Patton had *no interest* in the estate beyond executing the will, she'd have hired an attorney to help with probate (since she's *clearly* in over her head), an auction service to help remove saleable goods that neither son wanted from David's house (since that would've *quickly* generated funds for the estate *and* helped "clean the place up"), made inroads into getting the house *she* was living in sold, and hired a real estate agent to help with the sale of *both* properties.
The fact that she wouldn't do *any* of those things can can *only* be attributed to the fact she's planning to skim as much as she can *for herself* - (she's *so* transparent!) - and doesn't want any of those expenses coming out of the estate.

Watched this whole thing…I have recently been appointed guardianship for both of my parents. The reasons are horrible, it was to prevent further elder abuse from my brother, but I still have anxiety about doing my job as guardian. This case has alleviated my worries

We had a family member that hoarded. When they passed, the house was in good condition, but it took dumpsters to remove the stuff, and dog poop all over the house was filthy. Had to remove the carpet. Once the clean up was done, which took A LOT of time and work, the house was good to sell. So I get that part. No one was booted out, and no one e moved into it though.

She "lost" - we say lost because we think she found some assets and stole them, but we couldn't prove it. She so deeply reminds me of how two-faced that woman was. I will never understand why my family allowed that lady to show up at the funeral, after EVERYTHING she did.
