Some people suggested judge is giving Blair so many chances because it will allow the judge to dismiss the lawsuit with prejudice. Which means she won't be able to sue again. It's an interesting theory, hope it's true.
At the very least, it'll easily kill any attempts to appeal it. She had three chances to be specific about her claims - the original complaint and two amended complaints - and refused to.
Yeah I've been watching a lot of live streamed court stuff lately (not just this) and it seems to be a thing with judges to let plaintiffs to talk as much as they want in order to provide as much backing for the judge to dismiss. From the perspective of a casual viewer it seems frustrating but ultimately it is letting them dig their own holes

As a former painkiller and opiate addict, I’ve never taken so many opiates that I had lapses of my memory. Never once. And I’ve taken many many many many many milligrams, we’re talking hundreds of milligrams, of heavy duty painkillers before I even took the harder drugs, and not once did I have a lapse in my memory. Sounds like bs to me. Thankfully almost 10 years clean
Ive definitely had moments on opiates where i could barely remember anything, but its because i was barely conscious and definitely would be in no state to make legal agreements (barely in a state to stand). She is definitely lying though
@@holdendewit7088 I could understand that each persons physiology could make them react different, and certainly if somebody was on other drugs while taking painkillers, like some sort of benzodiazepine for example, that would also possibly cause lapses in memory. Idk I never had a moment where I had lapses in memory. Judgement, absolutey but never memory. If anything my memory got better while I had that garbage all in my system.

IMO there are so many abuse red flags about their relationship that I feel the court stuff is just her trying to be the center of his life and control him for just a little longer.

I've never filed for defamation, but I've had to get a restraining order against someone before, and when the court says to be specific, they mean literally "Defendent said X on DATE via MEDIA and caused DIRECT OUTCOME" and then attach the links/docs/screenshots. It does not mean "They said a lot of untrue things about me and eventually I'll be able to show what happened, but it really tore me up judge 😢" lmfaooo
I had to file a protection order and because of PTSD, my memory is fuzzy. I did my best to write down everything but it was vague on dates. I managed to get it anyway because my ex boyfriend 1) was incredibly abusive; 2) he had a record; and 3) he didn't show up in court. Maybe my case was different.
@@dimitritucker1077 I'm not saying that being unspecific on dates for a PO will result in not getting it, or anything like that. I'm saying that in general the example I made is what the court means when they directly respond to a plaintiff's complaint and requests specifics to supplement the initial filing. I'm glad you got your order from the courts. I was also granted mine, but it's a really unpleasant and sometimes teaumatic process to have to fight against someone abusive in court. Hope you're well.
@dimitritucker1077 100% (imo) it was because he missed his court date. Default judgment. The record probably helped prevent another attempt to get him present. Depending on what it was. Being very abusive probably did not mean much to the courts unless you had some solid evidence. Non-biased witnesses, for example. I'm glad you got it, and stay safe.
Friendly reminder that this entire situation spiralled out of Blair waking up one day and deciding to try and call out an actual lawyer for supposedly plagiarising a couple of plugins for video editing... Like...yeah, it was all bound to come out against her sooner or later but I feel like we shouldn't forget that this whole thing had the most insanely stupid (on Blair's part) starting point.
Exactly. Some people were shocked by her behavior while others were like: Yeeeah, I'm not shocked because X happened. Etc, etc. She then got angry, made a video which made herself look WASY WORSE, spreading misinformation on top of it, which made people dislike her waay more very quickly from HER OWN ACTIONS. Only after that did many of the following videos come out of people and their experiences with her, now having some confidence to tell the truth, then final more timid or those who Blaire really intimidated finally had courage to tell their stories. It's so sad for everyone who had to deal with her, but a guilty pleasure seeing such a awful person fall from their grace built from abuse, lies, and manipulation.

Just show how much you were making before and after the post, then show off the comments in the videos referencing the post. It's not perfect but it's something. I work in an Emergency Dept and have done for decades. I am not aware of any pain medication that makes you lose memory like that, that is safe to be given outside of a hospital setting. To me, that means that we have one of three scenarios here: 1) She was misusing medication (taking something not prescribed or an incorrect dosage); 2) She was having a reaction to the medication and had this as a hefty side effect. She mentions that her sister witnessed this and, any doctor who wants to keep their job will have told her to report any side effects like that immediately so that she could be given a different medication. To go on for so long, after she'd realised what was happening, means she wasn't taking the medication as prescribed and was knowingly choosing to cause memory loss instead of just having the medication swapped for something else; 3) She's lying through her teeth. My money's on 3, although if she does try to argue it as 1 or 2, and it goes further, I would love to see her try and prove that medication side effect. This is because drug companies get *very* tetchy about their products being blamed for these things, so if she does try and push that claim and the drug doesn't have significant memory loss as a listed side effect, she could find herself on the receiving end of a law suit from a large pharmaceutical company. Either that, or the facility that treated her would essentially be being accused of malpractice, and they could send their legal dept after her due to the negative publicity. Either way, it's a dangerous game to play for someone who isn't paying her bills and is getting court judgements for defaults of less than $3,000...

I was a young homeless junkie for years, and tried a lot of drugs but I can say with confidence that the only time I have ever blacked out and "lost my memory" was after drinking far too much alcohol and then taking pills in order to get fvcked up. It was never an accident. It rarely is, to be sure. So I think she is definitely lying, or she is misusing meds with alcohol. Which, something tells me, I can see her doing. I was with a partner that sounded a lot like Blaire and they ended up turning physically and emotionally abusive. They were also incredibly vengeful, cruel, and sadistic. For whatever reason I see that similar thing in Blair, I was even drawn to her content long ago because of her charismatic personality. But now I see that it was a mask.
There is no Narcotic (crazy pain killers) in my current knowledge as a 3rd year nursing student (RN program) and CNA that would cause short term memory loss. Most Narcotics cause drowsiness, nausea, constipation, fatigue, lethargie, itchiness.
I've def had lapses of memory and generally horrible behaviour when I was using. But her behaviour is consistently like this. This isn't some drug fuelled oopsie, this is just her character.
Former CNA + recovered pk user wombo combo- No. if Blair means _actual_ painkillers, memory loss would come from losing consciousness (i doubt an unresponsive person could "agree" to anything). It's more plausible with other CNS depressants involved- maybe it was routinely mixed with alcohol, maybe an interaction with meds was ignored by the prescribing Dr...every body is different but opioid-induced amnesia would be a rare edge case imo. Whatever the case, she's omitting A LOT of necessary info...or lying
I think that the biggest blows to Blair’s sterling reputation as a “documentarian” were her own Exposed video and Click’s video. After her behaviour with Legal Eagle, these brought to light all sorts of issues and people reacted. Oz’s video came along quite late.

The Click's video was only proof to those already aware of the situation. hbomberguy's video catapulted her behaviour into the RUclips meta - and nothing in that video even had any relation to Oz, Wonder etc. It was all about her channel being like a content farm (which could undoubtedly cause those unaware of the rest of it to unsubscribe based on that alone).

Presently we don’t know which medications Blaire claims induced this phenomenon, however with opioids remaining a standard post-operative analgesia, that would be my educated guess. What is not standard though is the phenomenon which Blaire has claimed- an acute onset of anterograde memory loss in the setting of post-operative medications. It is well known that such medications adversely affects cognition, including: focus; wakefulness; cognitive performance; short & delayed recall abilities; disorientation. etc etc. And certainly, anterograde amnesia is associated with post-operative opioids. But _not_ to the extreme severity with which Blaire claims. The severity which Blaire lays claim to (be it opioids or another powerful narcotic) is associated with a marked drug toxicity e.g in the setting of fentanyl overdose Does that make it impossible? No. However, those around Blaire at the time (such as her sister and best friend) would have observed a marked cognitive deficit in Blaire to the extent that would have been deeply concerning. It would have been abundantly clear that Blaire was not forming/retaining any new memories, and consequently in a constant state of confusion & disorientation (particularly as it relates to time and place) Which makes me question why she’s alleging oz’ failure to provide care almost resulted in readmission, when it would have been abundantly clear to her sister & friend that: 1. Blaire was totally unable to care for herself and, more importantly 2. Needed immediate medical attention Surely Blaire isn’t claiming that her sister & friend saw her in such a state of delirium/disorientation, yet failed to get her medical help? This would not have been a subtle presentation. It’s hardly a great endorsement of the dire state she claims to have been in if they saw it and…just said ‘okay cool cool’ I find Blaires’ claims most sinister. She’s one pay check away from claiming that she was taken advantage of in other ways at this time but ‘doesn’t remember it’
Absolutely. I don’t like the idea of people saying ‘this didn’t happen to me when I was on medication so it can’t happen to anyone else’ because medicine is extremely complex, and everyone’s body is different. *HOWEVER* that doesn’t mean Blaire’s story makes sense either.

For a legal complaint of such an important matter (making a legal contract under influence), you'd have thought that the substance involved would be named, especially when it was _her own medicine_ taken for weeks, and her sister and friend knew about her situation all the time. I don't find her claim of not remembering things due to taking painkiller, or even the entire story, to be believable at all.

10:04 I’ve been on painkillers from brain surgery from medically administered Fentanyl, to laughing gas, to Percocet, to oxy. They’re very careful with pain meds in the US. They usually don’t prescribe memory erasing pain meds like that for people to take at home after a surgery. and even if they did you wouldn’t really be coherent enough to enter a legal verbal agreement.
I've never had anything as good as the morphine + aspirin combo I got right after delivering my first child. Only one dose, I'm afraid. Even then I still remember it all.
As a chronic pain patient myself, I believe that, if she is being truthful about not remembering, she likely had something other than just narcotics prescribed, But I don’t believe she is being truthful in the slightest.
"I don't remember" is the lie that's incredibly hard to prove in court. It also allows for you to be "reminded" when evidence that you did it/said it/were there comes to light.
As someone that lives in the US I’m not even surprised by all of the things she mentioned in her lawsuit. Very clearly just trying to trash Oz. Lawsuits here can easily be closer popularity contests than matters of fact.
I have had chronic pain for 13+ years. I have been on a whole slew of pain meds in that time, up to and including straight morphine. Never has my memory been impacted by pain medication. I would very much like to know how Blair is going to back up such a wild claim.
Devil's advocate: If her sleep patterns were impacted by the pain medications (either making her sleep too much or giving her insomnia), could that have resulted in a memory issue?
@tintinismybelgian Negligible, in my experience. I also work neurology, specifically with medications, and even the heaviest drugs we prescribe don't cause memory defects to the extent she would have had to have to make this kind of argument. It's always possible to have a severe reaction to medication, but I feel like issues like this would be EXTREMELY noticeable to a doctor and the med would be discontinued immediately to prevent any lasting effect.
Are we sure it was a narcotic? I was given gabapentin (I think thats how its spelled 😅) for pain, and it gave me hallucinations, let me experience dyslexia for the first time in my life, and gave me second long surges of intense rage (scared the sh!t out of me and put me off trying any kind of pain med since; I'd rather be in pain than 'insane'). No memory loss, but if it can do all that, it might do other things too? Not that I'm inclined to give Blair much benefit of a doubt...
@impposter560 I'm not just talking about narcotics - sure medications can have some nasty side effects (I had a full on psychotic break on duloxetine, myself), but like, you don't forget huge swathes of time like it seems Blair is claiming. It's entirely possible she had some side effects, but it is implausible that she was in a fugue state for months with no one noticing and pulling her off the offending medications.

I'm sorry, but a court is not dragging out a baseless claim when the system is so overworked already just so they can dismiss it with prejudice later when that still means they can appeal it in an apple at court. It's a stupid theory, although I get why people want to latch on to it @@BenSwagnerd
If they dismissed earlier, it would probs be without prejudice (aka you can try again). If they d/m with prejudice too early, she could very likely appeal and have it overturned. If she fails enough times, the court will have valid grounds to permanently bury her lawsuit and have that stand on appeal. Attempting to file a coherent claim also isn't the most complicated process for a court to review, so it's pretty normal for them to be lenient with extra chances. This isn't a complex issue that drains time and research, it's something that's pretty readily apparent on first glance.
I've had eleven surgeries because of cancer twice. The only time you don't remember is when you first come out of anesthesia. You would be at the hospital at that time. What kind of surgery did she have?

I have a very painful chronic condition. I've been on a lot of pain medication, from several different categories. But even on ketamine via IV drip, which is known to mess with memory, I would and do remember big changes, important decisions. I might forget if I'd had lunch or if a friend forgot to show up. But if one of my loved ones came in and wanted six months of rent, I can't imagine forgetting it. But if you ask my educated opinion: If she was at home, taking prescription drugs as they were prescribed, and did not supplement with OTC or drugs obtained through other means, she would have to have a very low tolerance for opiates to have a period of time more than a few hours be completely wiped. Her doc would not continue to prescribe a med that would keep her from caring for herself or impeding her that seriously. And even I"m talking out of an orafice, all she would have to do to clear things up is to name the med she was on.
Still love the apparent complete blanking of memory she is claiming. That the pain killers she has are either so powerful or she was pounding so many back at a time that she was making herself brain dead is just so goofy.

I've had surgery and been given strong opiods for various reasons. Cocodamol being the standard and morphine being for the more severe. If you don't have a tolerance they do make you a little loopy but after taking them for a few weeks like she implied you stop getting as messed up. Even then you still have some idea what's happening. Its like being drunk or high, you're aware you're not sober but you're still aware. To lose her memory completely she would have had to be abusing the drugs, taking more than she was supposed to. I only know this because I had my brain surgery at 19 and being a 19 year old I was like "lol what if I take like 8 at once." To say she lost her memory due to pain killer use would be admitting she took more than she should have.

She can't force the court to do anything, though. They've given her two chances to give actual quotes. She still hasn't done so. They could CHOOSE to accept this amended filing, but they can't be forced to.

I think she's trying to explain why she isn't more specific and set him up to be abusive. Honestly, this might work if she showed evidence of the drugs she was taking and filed a separate police report for a criminal case. Medical abuse is a real thing. The problem is she isn't doing that because then she would have to provide actual evidence, which she doesn't have. And she could be charged with filing a false police report.
Blair's whole complaint is a bunch of unsubstantiated assertions that even if provable, really are just a bunch of petty gripes with little legal relevance to the legal complaint being made. She also fails to understand that claims that can be documented with evidence, like say online conversations where she can be quoted directly, are not defamatory by definition. Things that are false or unsubstantiated are defamatory, things that can be backed up and make you look bad are just incendiary, and the law really doesn't get too deep into stuff like that generally.
That depends on your country. In places like japan, it doesnt matter if its true or not, if it paints someone in a bad light its considered defamation. However this case is in the us, so yeah the only way the defamation claim would hold ground is if he was lying about her wich he isnt as he can prove everything
*I’ve had 3 spine surgeries, and I was legally prescribed nearly every single opiate pain meds that exists.* I had a small memory loss incident but it was right after my surgery ended, because of all of the other meds they had me on. NOT from painkillers and NOT to last several days or weeks. Only way possible to have memory loss while taking prescribed pain medication, is IF SHE overdosed herself several times. I speak from personal experience. *SHE IS LYING.*
Chronic pain patient here. I've had most types of painkillers that exist. The only ones that messed with my memory were the ones I had while in hospital for major lifesaving surgery where I had a pump that automatically fed me drugs 24/7 and allowed me to push a button evert 8th minute to get more pain relief. It was the most painful surgery I've had out of all of them and while I had that pump I was so out of it that I only remember bits and pieces. I've never gotten drugs hard enough to fuck up my memory functions to use at home, not even after getting off that pump! Sleep meds on the other hand....😅😅 but never pain meds.
I was addicted to painkillers for 4 years. (Clean for 11 years now) and am now a certified pharmacy technician. Unless your overusing your opioids (painkillers) and are on some other medication as well, like a sleep medication or anxiety medication or something else along with the painkillers you will not have memory loss with painkiller
some things 1. the court expect you do the work to show that the people did what you say because theres hundreds of court cases going through the court and the court have no time to spend on this stuff. 2.The court doesnt like to be messed with.
I had a gum surgery in March and breast cancer surgery in December and took my painkillers (vicodin) according to the exact schedule on the label. I didn't drive while I was getting them into my system, but I waa never unaware of what was going on around me, or unable to make a decision.
Yeah, my stepdad was pretty damn cognizant when he was on strong pain meds while he was dying of cancer. He was so aware of everything that he begged my mom for more pain meds, which my mom and his care team carefully dosed and administered. And he still remembered what was happening
I've been on some really strong painkillers before, like, "You need to be hospitalized so we can make sure you don't die," kind of strong painkillers. While I was on them I was floating and everything was confusing and a haze, but once I was no longer on them, I could remember everything that had happened during that period, including when I was under the effects of anesthesia and started screaming because I was confused and thought someone was killing me.
The bottom line is, she ruined her own career, so now, instead of taking accountability and facing reality, her only idea is to sue people for money and blame them. Most logical, civil people would work hard to rebuild or get a new job. Some people would prefer to live off the backs of others.
The only memory wiping drugs I've ever been given were *in* the hospital itself. Makes me wonder if she just admitted to overdoing it on the meds she had to take at home.....
I fell down the stairs once and had to have some pretty significant surgery to sort of reattach my arm. I had a little pressurized bag of a nerve blocker injected into my neck, and was prescribed Percocet and oxycodone. Once the pressurized bag was finished, I felt good enough to do some chores, like laundry. It was really amazing what I could actually do without pain, and I was happy. I even folded my underwear. My roommate came home that night and asked me why my my underwear was in the refrigerator.
There arnt any pain killers that do that legally doctors cant send you home with stuff that strong. If Blair actually lost memory from dugs she was abusing them then.
The opioid crisis has been going on in the US for close to 30 years now. I have never, ever, ever, ever, ever heard someone claim that dramatic of a memory loss from opioids without having OD'ed. I've heard of dramatic memory loss with ODs, but NEVER from taking them after surgery. I've taken them multiple times after surgeries AND have a small prescription for chronic pain and not once have I lost memory because of them.
Oz's tweet only confirmed what other posts had mentioned and his video came out way after the damage was done. Blair was the catalyst for all this happening, both on Twitter/X and YT.
Hmmm to my knowledge, pain killers don’t give you an amnesia effect, for surgery, the amnesia is caused by the medication propofol and midazolam(Versed) and may last an entire day depending on length of surgery/duration of anesthesia. Neither of those are painkillers. I’m curious as to what she was taking…

Out of all the contracts and leverage she held over other people, I find it super hard to believe she didn’t remember when OZ asked her for money. Like I do not believe it at all. She is stretching the truth on that and expecting the courts to not know better
She would have to prove to the courts that she was unable to do ANYTHING during the time of this supposed ‘drug induced amnesia’ because that is a shoddy excuse at best. By that logic, I could just rock up to a court and say ‘um, this guy over here committed a crime against me but i was so high I can’t remember the details and there’s no proof but, it’s true’ she would have to get medical professionals to prove the validity of her claims and prove she wasn’t abusing them. I am 3 year clean of Oxycodon and Fentanyl now. I took a LOT for my pain and I still remember a lot. It might me vague at times, but complete memoryloss? No.
I’m on pain management due to spinal arthritis and the only way she was that zooted was if she was misusing those medications. Typically they only give you a low dose and for a short time period to avoid addiction. More often than not, depending on the surgery or procedure, they will just give you a high dose of Tylenol. But if she has no recollection of the conversation then it’s likely she was too out of it to even have a conversation as such. Also why would her sister and friend not stop the conversation and tell him to wait till a later date? My weren’t they helping to care for her? They were definitely around to have been there for the discussion
I always found something off with how strict their moderation team on her discord was before the allegations came out, almost as if she feels like she needs complete control of how her fans interact with each other.
i was an IV user for a decade, there's no such thing as a memory erasing nod, even if you're shooting straight china or opium. She's full of dog turds. You might get woozy and weak but I still remember all the important biz from those days (and even unimportant things, like the best episodes of extreme cheapskates we'd watch after dosing up, or my good MTG pulls, a real awful tray of muffins I'd made, rolling around on the lawn outside singing the Cheers intro, etc.) If anything opiates kinda sharpened the memories or made them more tactile.
I'm an attorney (not in the state where this lawsuit was filed though) - in my experience, it's pretty rare for a judge to not allow the plaintiff to submit amended complaints. It would have to be pretty egregious for the motion to amend not to be granted. Judges generally prefer to dismiss complaints based on dispositive motions (like a motion to dismiss) rather than because the complaint is insufficient. It's just better for everyone that the complaint be dismissed for substantive reasons.

After 30 kidney stones, 2 spine surgeries, and a shoulder broken in three places I can honestly say I have been on a lot of heavy duty painkillers, and never been where I couldn't form memories outside of general anethesia.

Then another youtuber, Click, who I watch a lot came out with his huge thing. Like by the time Oz got involved things were already very bad for her and she was dropping numbers.
Blair was losing subscribers before Oz said anything. I unsubscribed after she went after Legal Eagle. That was the final straw as far as I am concerned.
My dad's a pharmacist and I worked with him as a technician for nearly ten years. In terms of the medications available for post-surgery pain management, almost anything COULD cause delirium enough to negatively impact cognitive function and/or memory recall, but that would be an extreme and negative side-effect requiring medication review and replacement. Now, if you're on your own and that out of it, you might not think to do that, but she's gone to great pains here to imply that not only were her family members around her at this time, they were also aware enough of her medication issues to such a degree they were able to 'heroically stop her from getting scammed by evil Oz Media' or whatever. Those reactions are rare, though, and to be that out of it on post-op meds (I'm presuming it's morphine given her description) she would have needed to be taking a lot of it for continuous, comprehensive memory loss. If she was abusing morphine then I completely understand why she can't remember things, including what planet she was on during this time. I don't think she's telling the truth about what happened here though, we've seen her be far too comfortable lying to extend any kind of grace towards believing her now. And Oz didn't do that to her, she did that. (And if she was drinking while using the medication, that's a whole different can of worms. Don't do that, you'll end up circling one of Jupiter's moons, and not in the fun way.)

In the US you can't sue for damages like that unless it's slander which is defined as someone willingly and knowingly making untrue statements in order to cause harm to someone's (or a company's) reputation to anyone besides yourself and the other person being slandered.

Ive been on and am on a lot of pain meds over my life, and am pretty sure that I haven't resulted in memory dead zones. And I tend to get blank spots just randomly with zero medication. If anything my memory is better when I am not in constant blinding pain.

Well, I had orthognathic surgery that divided my roof of my mouth in half (Surgical Maxillary Disjunction in english, I believe), and I spent weeks manually enlarging my roof of my mouth. You can imagine I took a lot of pain medication. I remember everything, except the day I woke up from anesthesia that I remember parts of it.
Oz is still a clown. Boohoo. I'm crying. Mommy and daddy always use to buy me things like cars to fight for my love. Then my big meanie ex came along and it didn't work like that. Growup people.

I have chronic pain and have tried every painkiller under the sun and none of them completely wiped my memory. That sounds like benzodiazapines or barbituates. Those actually do interfere w memory formation.
I had a serious operation last year and spent 3 weeks off my face on Morphine. I still remember, it was a horrible period of my life and the withdrawal after even only 3 weeks was also awful. I do not believe a word of what Blair is saying about entirely losing her memory due to painkillers.
I don’t think its likely that one would be on painkillers so strong that they would loose their memory at home. I recently was on a series of painkillers that had me hallucinating, but I was in a hospital at the time, so high doses are more closely regulated. I doubt any doctor would prescribe something so strong that you can’t retain memory. Thay would be highly irresponsible.

Yeah I've been watching a lot of live streamed court stuff lately (not just this) and it seems to be a thing with judges to let plaintiffs to talk as much as they want in order to provide as much backing for the judge to dismiss. As a former painkiller and opiate addict, I’ve never taken so many opiates that I had lapses of my memory. Never once. And I’ve taken many many many many many milligrams, we’re talking hundreds of milligrams, of heavy duty painkillers before I even took the harder drugs, and not once did I have a lapse in my memory. Sounds like bs to me. Thankfully almost 10 years clean
Ive definitely had moments on opiates where i could barely remember anything, but its because i was barely conscious and definitely would be in no state to make legal agreements (barely in a state to stand). She is definitely lying though

I've never filed for defamation, but I've had to get a restraining order against someone before, and when the court says to be specific, they mean literally "Defendent said X on DATE via MEDIA and caused DIRECT OUTCOME" and then attach the links/docs/screenshots. I had to file a protection order and because of PTSD, my memory is fuzzy. I did my best to write down everything but it was vague on dates. I managed to get it anyway because my ex boyfriend 1) was incredibly abusive; 2) he had a record; and 3) he didn't show up in court. Maybe my case was different.

I'm saying that in general the example I made is what the court means when they directly respond to a plaintiff's complaint and requests specifics to supplement the initial filing. I'm glad you got your order from the courts. I was also granted mine, but it's a really unpleasant and sometimes teaumatic process to have to fight against someone abusive in court. Hope you're well.

I work in an Emergency Dept and have done for decades. I am not aware of any pain medication that makes you lose memory like that, that is safe to be given outside of a hospital setting. To me, that means that we have one of three scenarios here:
1) She was misusing medication (taking something not prescribed or an incorrect dosage);
2) She was having a reaction to the medication and had this as a hefty side effect. She mentions that her sister witnessed this and, any doctor who wants to keep their job will have told her to report any side effects like that immediately so that she could be given a different medication. To go on for so long, after she'd realised what was happening, means she wasn't taking the medication as prescribed and was knowingly choosing to cause memory loss instead of just having the medication swapped for something else;
3) She's lying through her teeth.
My money's on 3, although if she does try to argue it as 1 or 2, and it goes further, I would love to see her try and prove that medication side effect. This is because drug companies get *very* tetchy about their products being blamed for these things, so if she does try and push that claim and the drug doesn't have significant memory loss as a listed side effect, she could find herself on the receiving end of a law suit from a large pharmaceutical company. Either that, or the facility that treated her would essentially be being accused of malpractice, and they could send their legal dept after her due to the negative publicity. Either way, it's a dangerous game to play for someone who isn't paying her bills and is getting court judgements for defaults of less than $3,000...

I was a young homeless junkie for years, and tried a lot of drugs but I can say with confidence that the only time I have ever blacked out and "lost my memory" was after drinking far too much alcohol and then taking pills in order to get fvcked up.
It was never an accident. It rarely is, to be sure. So I think she is definitely lying, or she is misusing meds with alcohol. Which, something tells me, I can see her doing.
I was with a partner that sounded a lot like Blaire and they ended up turning physically and emotionally abusive. They were also incredibly vengeful, cruel, and sadistic.

I think that the biggest blows to Blair’s sterling reputation as a “documentarian” were her own Exposed video and Click’s video. After her behaviour with Legal Eagle, these brought to light all sorts of issues and people reacted. Oz’s video came along quite late.

To date, just 40 cases of opioid-associated-amnestic syndrome (OAS) have been documented in the medical literature. Presently we don’t know which medications Blaire claims induced this phenomenon, however with opioids remaining a standard post-operative analgesia, that would be my educated guess.
What is not standard though is the phenomenon which Blaire has claimed- an acute onset of anterograde memory loss in the setting of post-operative medications.
It is well known that such medications adversely affects cognition, including: focus; wakefulness; cognitive performance; short & delayed recall abilities; disorientation. etc etc.
And certainly, anterograde amnesia is associated with post-operative opioids.
But _not_ to the extreme severity with which Blaire claims. The severity which Blaire lays claim to (be it opioids or another powerful narcotic) is associated with a marked drug toxicity e.g in the setting of fentanyl overdose
Does that make it impossible?
No. However, those around Blaire at the time (such as her sister and best friend) would have observed a marked cognitive deficit in Blaire to the extent that would have been deeply concerning.
It would have been abundantly clear that Blaire was not forming/retaining any new memories, and consequently in a constant state of confusion & disorientation (particularly as it relates to time and place)
Which makes me question why she’s alleging oz’ failure to provide care almost resulted in readmission, when it would have been abundantly clear to her sister & friend that:
1. Blaire was totally unable to care for herself and, more importantly
2. Needed immediate medical attention
Surely Blaire isn’t claiming that her sister & friend saw her in such a state of delirium/disorientation, yet failed to get her medical help? This would not have been a subtle presentation.
It’s hardly a great endorsement of the dire state she claims to have been in if they saw it and…just said ‘okay cool cool’

They’re very careful with pain meds in the US. They usually don’t prescribe memory erasing pain meds like that for people to take at home after a surgery. and even if they did you wouldn’t really be coherent enough to enter a legal verbal agreement.

I have had chronic pain for 13+ years. I have been on a whole slew of pain meds in that time, up to and including straight morphine. Never has my memory been impacted by pain medication. I would very much like to know how Blair is going to back up such a wild claim.
Devil's advocate: If her sleep patterns were impacted by the pain medications (either making her sleep too much or giving her insomnia), could that have resulted in a memory issue?

I also work neurology, specifically with medications, and even the heaviest drugs we prescribe don't cause memory defects to the extent she would have had to have to make this kind of argument. It's always possible to have a severe reaction to medication, but I feel like issues like this would be EXTREMELY noticeable to a doctor and the med would be discontinued immediately to prevent any lasting effect.
Are we sure it was a narcotic? I was given gabapentin (I think thats how its spelled 😅) for pain, and it gave me hallucinations, let me experience dyslexia for the first time in my life, and gave me second long surges of intense rage (scared the sh!t out of me and put me off trying any kind of pain med since; I'd rather be in pain than 'insane'). No memory loss, but if it can do all that, it might do other things too? Not that I'm inclined to give Blair much benefit of a doubt...
@impposter560 I'm not just talking about narcotics - sure medications can have some nasty side effects (I had a full on psychotic break on duloxetine, myself), but like, you don't forget huge swathes of time like it seems Blair is claiming. It's entirely possible she had some side effects, but it is implausible that she was in a fugue state for months with no one noticing and pulling her off the offending medications.

I think we all know why.
If they dismissed earlier, it would probs be without prejudice (aka you can try again). If they d/m with prejudice too early, she could very likely appeal and have it overturned. If she fails enough times, the court will have valid grounds to permanently bury her lawsuit and have that stand on appeal.
Attempting to file a coherent claim also isn't the most complicated process for a court to review, so it's pretty normal for them to be lenient with extra chances. This isn't a complex issue that drains time and research, it's something that's pretty readily apparent on first glance.
I've had eleven surgeries because of cancer twice. The only time you don't remember is when you first come out of anesthesia. You would be at the hospital at that time. What kind of surgery did she have?

I have a very painful chronic condition. I've been on a lot of pain medication, from several different categories. But even on ketamine via IV drip, which is known to mess with memory, I would and do remember big changes, important decisions. I might forget if I'd had lunch or if a friend forgot to show up. But if one of my loved ones came in and wanted six months of rent, I can't imagine forgetting it.
But if you ask my educated opinion: If she was at home, taking prescription drugs as they were prescribed, and did not supplement with OTC or drugs obtained through other means, she would have to have a very low tolerance for opiates to have a period of time more than a few hours be completely wiped. Her doc would not continue to prescribe a med that would keep her from caring for herself or impeding her that seriously.
And even I"m talking out of an orafice, all she would have to do to clear things up is to name the med she was on.
Still love the apparent complete blanking of memory she is claiming. That the pain killers she has are either so powerful or she was pounding so many back at a time that she was making herself brain dead is just so goofy.

I've had surgery and been given strong opiods for various reasons. Cocodamol being the standard and morphine being for the more severe. If you don't have a tolerance they do make you a little loopy but after taking them for a few weeks like she implied you stop getting as messed up. Even then you still have some idea what's happening. Its like being drunk or high, you're aware you're not sober but you're still aware. To lose her memory completely she would have had to be abusing the drugs, taking more than she was supposed to. I only know this because I had my brain surgery at 19 and being a 19 year old I was like "lol what if I take like 8 at once." To say she lost her memory due to pain killer use would be admitting she took more than she should have.

I think she's trying to explain why she isn't more specific and set him up to be abusive. Honestly, this might work if she showed evidence of the drugs she was taking and filed a separate police report for a criminal case. Medical abuse is a real thing.

Blair's whole complaint is a bunch of unsubstantiated assertions that even if provable, really are just a bunch of petty gripes with little legal relevance to the legal complaint being made. She also fails to understand that claims that can be documented with evidence, like say online conversations where she can be quoted directly, are not defamatory by definition. Things that are false or unsubstantiated are defamatory, things that can be backed up and make you look bad are just incendiary, and the law really doesn't get too deep into stuff like that generally.
Also, to prove defamation, it has to be shown that you KNEW what you said was untrue.
That depends on your country. In places like japan, it doesnt matter if its true or not, if it paints someone in a bad light its considered defamation. However this case is in the us, so yeah the only way the defamation claim would hold ground is if he was lying about her wich he isnt as he can prove everything
*I’ve had 3 spine surgeries, and I was legally prescribed nearly every single opiate pain meds that exists.* I had a small memory loss incident but it was right after my surgery ended, because of all of the other meds they had me on. NOT from painkillers and NOT to last several days or weeks. Only way possible to have memory loss while taking prescribed pain medication, is IF SHE overdosed herself several times. I speak from personal experience. *SHE IS LYING.*
Chronic pain patient here. I've had most types of painkillers that exist. The only ones that messed with my memory were the ones I had while in hospital for major lifesaving surgery where I had a pump that automatically fed me drugs 24/7 and allowed me to push a button evert 8th minute to get more pain relief. It was the most painful surgery I've had out of all of them and while I had that pump I was so out of it that I only remember bits and pieces. I've never gotten drugs hard enough to fuck up my memory functions to use at home, not even after getting off that pump! Sleep meds on the other hand....😅😅 but never pain meds.

Unless your overusing your opioids (painkillers) and are on some other medication as well, like a sleep medication or anxiety medication or something else along with the painkillers you will not have memory loss with painkiller

I had a gum surgery in March and breast cancer surgery in December and took my painkillers (vicodin) according to the exact schedule on the label. I didn't drive while I was getting them into my system, but I waa never unaware of what was going on around me, or unable to make a decision.
Yeah, my stepdad was pretty damn cognizant when he was on strong pain meds while he was dying of cancer. He was so aware of everything that he begged my mom for more pain meds, which my mom and his care team carefully dosed and administered.

I've been on some really strong painkillers before, like, "You need to be hospitalized so we can make sure you don't die," kind of strong painkillers. While I was on them I was floating and everything was confusing and a haze, but once I was no longer on them, I could remember everything that had happened during that period, including when I was under the effects of anesthesia and started screaming because I was confused and thought someone was killing me.
The bottom line is, she ruined her own career, so now, instead of taking accountability and facing reality, her only idea is to sue people for money and blame them. Most logical, civil people would work hard to rebuild or get a new job. Some people would prefer to live off the backs of others.

I fell down the stairs once and had to have some pretty significant surgery to sort of reattach my arm. I had a little pressurized bag of a nerve blocker injected into my neck, and was prescribed Percocet and oxycodone. Once the pressurized bag was finished, I felt good enough to do some chores, like laundry. It was really amazing what I could actually do without pain, and I was happy. I even folded my underwear.
My roommate came home that night and asked me why my my underwear was in the refrigerator.
There arnt any pain killers that do that legally doctors cant send you home with stuff that strong. If Blair actually lost memory from dugs she was abusing them then.
The opioid crisis has been going on in the US for close to 30 years now. I have never, ever, ever, ever, ever heard someone claim that dramatic of a memory loss from opioids without having OD'ed. I've heard of dramatic memory loss with ODs, but NEVER from taking them after surgery. I've taken them multiple times after surgeries AND have a small prescription for chronic pain and not once have I lost memory because of them.
Oz's tweet only confirmed what other posts had mentioned and his video came out way after the damage was done. Blair was the catalyst for all this happening, both on Twitter/X and YT.

I’m on pain management due to spinal arthritis and the only way she was that zooted was if she was misusing those medications. Typically they only give you a low dose and for a short time period to avoid addiction. More often than not, depending on the surgery or procedure, they will just give you a high dose of Tylenol. But if she has no recollection of the conversation then it’s likely she was too out of it to even have a conversation as such. Also why would her sister and friend not stop the conversation and tell him to wait till a later date? My weren’t they helping to care for her? They were definitely around to have been there for the discussion

I always found something off with how strict their moderation team on her discord was before the allegations came out, almost as if she feels like she needs complete control of how her fans interact with each other.
i was an IV user for a decade, there's no such thing as a memory erasing nod, even if you're shooting straight china or opium. She's full of dog turds. You might get woozy and weak but I still remember all the important biz from those days (and even unimportant things, like the best episodes of extreme cheapskates we'd watch after dosing up, or my good MTG pulls, a real awful tray of muffins I'd made, rolling around on the lawn outside singing the Cheers intro, etc.) If anything opiates kinda sharpened the memories or made them more tactile.
I'm an attorney (not in the state where this lawsuit was filed though) - in my experience, it's pretty rare for a judge to not allow the plaintiff to submit amended complaints. It would have to be pretty egregious for the motion to amend not to be granted. Judges generally prefer to dismiss complaints based on dispositive motions (like a motion to dismiss) rather than because the complaint is insufficient. It's just better for everyone that the complaint be dismissed for substantive reasons.

So for me it was HER directly who caused me to unsuscribe, I learned about it and then went up to look for more info and started looking at her actual personality behind the scenes, decided to drop her. This was way before any of the people sued released videos

My dad's a pharmacist and I worked with him as a technician for nearly ten years. In terms of the medications available for post-surgery pain management, almost anything COULD cause delirium enough to negatively impact cognitive function and/or memory recall, but that would be an extreme and negative side-effect requiring medication review and replacement. Now, if you're on your own and that out of it, you might not think to do that, but she's gone to great pains here to imply that not only were her family members around her at this time, they were also aware enough of her medication issues to such a degree they were able to 'heroically stop her from getting scammed by evil Oz Media' or whatever.
Those reactions are rare, though, and to be that out of it on post-op meds (I'm presuming it's morphine given her description) she would have needed to be taking a lot of it for continuous, comprehensive memory loss. If she was abusing morphine then I completely understand why she can't remember things, including what planet she was on during this time. I don't think she's telling the truth about what happened here though, we've seen her be far too comfortable lying to extend any kind of grace towards believing her now.
And Oz didn't do that to her, she did that.
(And if she was drinking while using the medication, that's a whole different can of worms. Don't do that, you'll end up circling one of Jupiter's moons, and not in the fun way.)

In the US you can't sue for damages like that unless it's slander which is defined as someone willingly and knowingly making untrue statements in order to cause harm to someone's (or a company's) reputation to anyone besides yourself and the other person being slandered.

Ive been on and am on a lot of pain meds over my life, and am pretty sure that I haven't resulted in memory dead zones. And I tend to get blank spots just randomly with zero medication. If anything my memory is better when I am not in constant blinding pain.

Well, I had orthognathic surgery that divided my roof of my mouth in half (Surgical Maxillary Disjunction in english, I believe), and I spent weeks manually enlarging my roof of my mouth. You can imagine I took a lot of pain medication. I remember everything, except the day I woke up from anesthesia that I remember parts of it.

I have chronic pain and have tried every painkiller under the sun and none of them completely wiped my memory. That sounds like benzodiazapines or barbituates. Those actually do interfere w memory formation.

I had a serious operation last year and spent 3 weeks off my face on Morphine. I still remember, it was a horrible period of my life and the withdrawal after even only 3 weeks was also awful. I do not believe a word of what Blair is saying about entirely losing her memory due to painkillers.
From what I know about NDAs (I am not a lawyer) you are allowed to break that contact if you’re reporting a crime.
I don’t think its likely that one would be on painkillers so strong that they would loose their memory at home. I recently was on a series of painkillers that had me hallucinating, but I was in a hospital at the time, so high doses are more closely regulated. I doubt any doctor would prescribe something so strong that you can’t retain memory. Thay would be highly irresponsible.
