      Could argue that the equipment is needed to make a living and holding them you could charge it out to them at an hourly rate. Hell some RUclips videos payout hundreds of dollars and are only 30 min long, times that by however long they are holding them and you got a decent loss of wages claim to add to the amount.

      It is funny they never suspected Wayne Couzens or David Carrick or any other corrupt copper of anything before they were able to carry out their vicious vile attacks assaults on their victims where were the police then nowhere to be seen never ever speak to the police where you are liable or likely you could incriminate or coerce yourself into wrongdoing they are simply not your friends buddies they are there to potentially investigate you or investigate you where they are trying to rack up trumped up charges against you therefore never speak unless you have a solicitor present ever

      When I worked there that small gate was locked at all times and there was a security officer on the main gate during the day, and a bell for access outside those times.

      @@AbsoluteAudits Just curious why would this not be taken to court as the video clearly shows their mistakes. From a simple view I assume an out of court settlement is cheaper as less time spent on lawyers, but in that case you may not get your fees covered, whilst if it went to court I assume your fees would be covered based on the fact you can't lose with this evidence.

    The barrier was closed.
    You have photographic evidence it wasn't closed.
    Police officer at 31:05 is lying.
    That is now an offence because its breaks section one of the code of ethics, now adopted into UK law.

      Unfortunately he also has photographic evidence that despite the barrier being open, access is restricted. The copper was absolutely correct to assert that the auditor was not entitled to be there and it is not publicly accessible. This is the auditors mistake. He's lucky he will still be compensated though for the incorrect charge of Aggravated Trespass.

      yet detained @18:12 unable to leave meaning prisoner as AA Liberty has been taken away (art.5)
      but
      you can only be arrested s.69 (3) when told to leave ,,,,,, I also notice she arrests him on "(i)suspicion ONLY
      where section
      s. 24 PACE (2) has reasonable (ii)grounds to cover the (i)suspicion as section 24 requires (i) & (ii) BOTH have to be met @3:33 =
      "suspicion " on its own 🤔
      on arrest ,, also she/PC must then follow up with s.28 = Information to be given on arrest.
      s.28 (3) NO arrest is lawful unless the person arrested is informed of the 👉🏻(ii)ground for the arrest at the time,, after the arrest

      No, it's just common trespass if asked to leave private property and you refuse. Aggravated trespass is when you enter private property with the _intention_ to disrupt a lawful activity. It was originally to deal with such things as fox hunt saboteurs and in fact only applied to open air private property.
      Of course, no such disruption occurred here anyway.
      They _knew_ he was an vlogger, yet chose to completely misuse and abuse S43 TA just to keep him detained, then a BS aggravated trespass abuse as an excuse to arrest him, then S50 PRA misused in order to get his name.

      @@AbsoluteAudits You don't have to use the duty. If yours can't make it, and you are prepared to sit there for a day, free food. Make sure you have dietary restrictions? On any medication, you of course have to see the police surgeon to get replacement medication. You want a copy of PACE to read because you don't understand your rights. You want pens and papers so you can make Subject Access Requests there and then. Keep notes of police names, numbers etc. Always get their warrant card number. Two reasons. It means you know in most cases their email addresses at work. Second, its a form of demanding to see their warrant cards. If they refuse, you can bet they haven't got their card and you can escalate it.
      Basically, join the awkward squad.
      The three little pigs. Now that was very very funny. Oh to have been their to see their faces when the translation came back.
      The other one, AB has started using, is covert filming. Using the glasses with a camera because they assume only one.
      Another option would be audio/video recording that's covert that goes to the web. Imagine recording the conversations when they are talking about you when you are not there.

      They just make it up as they go along. There’s no law against filming on private property, the only way to stop it is to ask the person to leave (which they didn’t do once, and instead prevented him from leaving by detaining him).

      Being a private place and being not readily accessible to the public are not necessarily the same thing. I am fairly sure that anyone can enter property and go to the front door, and only then can they be asked/required to depart. The exceptions (from memory) are someone delivering legitimate items of mail and someone who is lost and seeking help.

    They’re so worried about security that they leave the gates wide open. If someone walks into your garden through an open gate, all you can do is ask them to leave. Aggravated trespass requires intent to intimidate, obstruct or disrupt which clearly wasn’t the case here.

      It was to the photographer's detriment to be detained and arrested and held for 13 hours and to have his property taken from him, with some of it never being returned.
      Any reasonable person would not expect a detainment nor arrest in the circumstances shown in the video.
      Therefore Section 26, all day long.

    There are only 3 occasions when you can be detained in England and Wales..this wasn't one of them!
    A easy win for H and K solicitors. The plods solicitors will drag it on, and claim they are happy to go to court to defend the force, but we all know they will drop it days befor the court date...and pay up!

    The tesco arguement was great, the way he said yeah but they have open barriers inviting entry.
    And so did they so that was an admission of invitation for your entry.
    Private property does not mean no entry, how many bridal ways are on private property granting public access, is as much your property as the owners and unless one has a map the person may not have awareness of it but an open gate could easily lead to a perception of implied access, now a sign saying no public access would imply as a member of the public admission is not granted.... bloody clowns!

      That property would have to lock the gates continuously more than 24 hours in 365 days to prevent it becoming a public right of way. Implied access is granted any other time the gate is open to land leased to the police by the crown.

      @@unionjack8463 There’s no legal requirement to close private land for 24 hours once a year, although it’s a good method for landowners to demonstrate that they don’t intend a permissive path to become a public right of way. It takes at least 20 years of uninterrupted use to establish a public right of way, but even if this criteria is met, it’s not automatic, and the landowner may be able to prove they never intended it to become a public right of way.

      No.
      Theft requires an intention to permanently deprive someone of something. This is potentially a civil tort (meaning he can sue them for the inconvenience of not having his things) if the police can’t justify taking the equipment, but this aspect of what they did isn’t criminal.

      I was told by an officer who actually thought the whole thing was a joke, that they were laughed out of the lab when they tried to submit it & led to embarrassment. I asked for my salt back, but was told it was disposed of. As was my Fake ID.

Keep of bottle of Coca-Cola in your bag and when they ask you about the contents of your bag you can say, just 7oz of Coke for personal use. I suspect that you were treated so badly was because these were not street coppers. Had they been they would have been more aware of possible auditing and more cautious. The response they gave is more like that given in the early days of photographing the police.

    These are the incompetent officers we have who are supposed to "SERVE. PROTECT. RESPECT" according to their own mission statement, who had a recent gunman enter 'their back garden' threatening them, can't even shut a security gate...misusing & abusing laws & public money to harass & abuse a member of the public for their incompetence is scarey especially if these same idiots are gun handlers..
