      @@Anon69357 I'm curious, how does it not make sense? Companies are increasingly becoming more anti-consumer, especially video game companies. They say that if you buy a game, you don't own that copy, you only have a license to the game that they can revoke at any time. So, if buying the game isn't owning it, then pirating the game isn't stealing it.

      Gonna play Devil's Advocate here, regardless of my opinion. Buying has never been owning, it's always been a licensing agreement. Difference is now it can be enforced, whereas in the 90's nobody was going to show up to your door to enforce the license. Imagine if Netflix licensed a show, the licensed was revoked, and they streamed it anyway. It'd be theft.

      That is not new.
      The issue is that bow the revoking is arbitrary.
      If I buy a game boy game, I'm taking from a pool of limited but indefinite licenses. The agreement is that I don't own the game in the sense that none of the ip belongs to me. I can't profit of it, make merch of it, anything. The license is for me to play the game, and I can do it as long as the physical hardware can manage it. Porting it to alternate media is a bit of a grayer zone, but you can make the argument there that if I own a came cartridge and then play suing a rom, as long as I don't sell the cartridge or lend it away I'm still following the spirit of the agreement, which is that one cartridge=one license to play.

    “Piracy isn’t good” in 20 years certain digital games wont on the marketplace, and the physical edition will cost 1k. I’ll be pirating whatever game I didn’t have today in the future

      Why would anyone be idiotic enough to think that because something was produced and sold for a period of time, that it should be available to buy forever? Seriously, try applying that logic to everyday items, and see how ridiculous it is. Ownership is ownership, whether physical or intellectual property. If you legally own the rights to something, YOU get to decide what to do with it, not some bunch of idiots with a misplaced sense of entitlement. You act like this because it's some faceless organisation, but you'd soon complain if it was YOUR product being illegally ripped off. If you decided to make a unique product available in batches every two years, like anybody else, you'd sue those making knockoffs. 🙄

      There's a common misconception of the purpose of Libraries. The stated purpose is to further research of *any and all subjects*, regardless of time or nature. Most libraries limit their collection to allow for better support of a given subject (literary, for example). Preservation of out-of-print works is one of the primary purposes of a library, to allow for cultural research. This, in fact, is why the Library of Congress, the defacto library of the US, is granted two copies of every copyrighted work under their custody. And being the head of Copyright registration, most officially copyrighted works fall under that category. The reason for that is explicitly to allow the work to survive past it's creator and it's copyright expiration. They are even the ones responsible for setting DMCA exceptions, so that works can be preserved.
      Nothing should be forced to be sold forever. But cultural works *are* expected to be preserved.
      As of right now, there *will* be a gap in the early 2000's that history will *never* remember. And that is a tragedy that wasn't supposed to be allowed.

      The reason why everything is not available for sale is cause there's hurdle in their product. You had to realize, in the physical world there's not enough shelf space for everything and then in the digital world not enough server to keep everything in one place.
      Also everything in the internet is not free, a server that host and preserve data base and digital files had expiration dates and must pay a price to stay a float. Ever wonder why some websites are gone and some still stay, that's cause of revenue they make help kept that website a float.
      Websites that had no ads like GameRankings and GameWinners are gone, GameFAQs are lucky they are own by GameSpot now and could generate ads so they could exist otherwise they would be gone too as their website use to have no ads.
      Wikipedia would had been gone a long time ago, luckily their ebegging for donations help them stay a float.

      So you the hypothetical person disagree about Nintendo being wrong, for releasing DK Country Returns on 3 different consoles and gave all those availability options for the person who still wants to buy a new one. Or somebody who re-monetized their old version and waived any rights to that old one and can now buy a recent version for recent platforms.
      OR let me guess. You'll be a hypocrite and disagree with YOURSELF playing both sides and crying about Nintendo no matter what, like some person who can't even organize a lunch plan.
      But it's GREAT that overtaxing forces stores with physical copies to regularly fire sale their stock at a loss, because you know, that's "capitalism". And Gaben on Steam Does it For Free without even being forced to, because those digital options are HEAVILY subsidized out of the public cost like startup money, and funding internet infrastructure instead of roads and shelf space.
      "Physical copies" like a DVD disc cost 50 cents and NOTHING to lie around. Internet servers burn energy 24/7. The only reason it's "expensive" is tax loopholes or lack thereof.

      That’s what I believe is ethical. If Nintendo no longer sells the console anymore. Then people should have the right to do whatever with that game.
      For example I wouldn’t touch Nintendo Switch games as it still Bening sold.
      But I would touch the Wii U and below as that is no longer sold and Nintendo allready made their money.

      @@Atropos148 it might not have back in the day but nowadays with physical media disappearing you either have to buy games on stores the console maker controls or you pay a monthly fee for something like gamepass or PS plus to play games and for them to provide you with the privilege to play online

      This is why piracy is never going away, because you legally have licenses to those digital games (regardless of what the terms and conditions say) so you downloading them from a piracy site is 100% legal because Nintendo has gone against their legal duty to ensure you've got access to your media, to which you've paid them.
      These companies think that just because they put something in the terms that they have a legal way to fuck it's customers over, but in her in Canada it's illegal to sign away your rights, for anything. They can try and sue you, but it will be dismissed before it even hit's a judge.

      You had to be a fanbase of something or else the market is boring. They are one sided defending Nintendo just like how you are one sided defending the opposite. Corporations exist to dreadfeed you of contents, you exist to get consume by those contents and to get more you must pay them your dues. When you choose to consume their stuff without paying your dues, that's when you and them had issues.

      Even Disney+ which was promised to be like a vault for their old content turned into a unpopular dumpster fire to the point that they are buying Hulu to cover the losses from it. If they just stuck to what works and what people wanted they may have made some money.

      I tell this to people all the time, the fact that Pokemon game carts go for $150+ and there is a huge bootleg market for these games specifically. Nintendo must be allergic to money if they want to squander this kind of revenue opportunity

    Pirating current media is wrong! But old media.... Nah that's crazy, I can't buy it from a store and I'm not buying real carts and discs just to dump them myself. And if I want to mod my property it's what I'm going to do, don't tell me what to do. Also also the official Nintendo service center refused to repair my switch so it means that my console is no longer supported right?

    Im with Matt here i do not understand for the life of my why Nintendo gets such a pass. Please remove the nostalgia goggles that seem to be surgically attached to your head and see that Nintendo has sucked ass for a long, long, stupidly long time. From region locking, refusal of price drops, suing people, they have done it all. The fact that they sell you the same GOD DAMN GAME FOR FULL PRICE baffles the hell out of me or that they sell you incomplete GARBAGE like the last 3 pokemon games (im looking at you Austing this legit is i cant believe people willingly buy have some self respect) i just dont know man. They shut down a smash tournament just because they were using a way to play online that used some mods and nintendo said "haha... no stop before my lawyers come". i Hate nintendo and just pirate their stuff or jujst buy preowned when i can as i would like to limit as much of my money i give them.

    Of course there are people who want to jailbreak PS4 and PS5 (and it's actually possible with PS5s, too), but for a lot of these people it's not for piracy. I personally jailbroke my PS3, because that gave me PS2 support on my PS3 Slim and have also considered getting a jailbreak-able PS4, until I realized that it wouldn't give me anything useful (for me atleast). I have absolutely no reason to jailbreak my Series X, because a) I can already play a bunch of emulators on it and b) it has backwards compatibility with most Xbox 360 games and can even play a lot of OG Xbox-games. At this point in time I am considering hard not to get the next version of the Switch, because Nintendo is just a pain (it will be the first Nintendo console I won't own in it's original lifetime since the N64). Their price policy is just terrible, they keep re-releasing the same old games over and over again with way too little new games in the mix (and the Mario All-Stars edition was a bloody joke, including their ridiculous time limitations). And they don't care about their fans and customers. When Sony announced that they'd shut down the stores for PS3 and Vita, this lead to an uproar by their fans and Sony kept the stores open for two more years. Nintendo just switched them off. And a problem with this is, that there's actually stuff that was never released physically, that's gone now. Like for example the levels created for Mario Maker for WiiU and 3DS. Gone forever.

    I have a new analogy for piracy.
    Say you wanted to buy a poster with really cool artwork on it, so you go to the shop that sells it. But they've stopped selling that poster you wanted. You had your heart set on getting that poster. Then a friend who owns one says they can print you a copy of theirs so you can have that poster for your wall. Did you steal a poster from the shop? Was anything you did theft?
    Now say you have a friend print you a copy of a poster that the shop still sells. This is actually damaging to the shop, they aren't making a profit off of their artwork. But you didn't steal it, you took nothing from that shop.
    If you pirate a game that the company still sells it IS damaging to them, but not truly theft, it's just like taking a copy of an artwork from a friend. I would say it is morally unjust to pirate a game that is still sold. But not one that isn't, at that point it should just be freeware.

      How is it damaging for a game to be pirated that's currently available, if I had ZERO intentions of buying it to begin with? Especially when it's digital. A poster is a physical object that's much different than piracy, which is digital and has no cost associated to it.
      The games been made, the people have been paid, the only individual making money on the game being sold is the publisher, which is often owned by a board of share holders, who surely won't notice $80 out of their billions, again when there's no tangible asset to be accounted for their is no loss. Because I would never have paid for it in the first place.
      BUT I'm going to take it one step further! You buy a game on Steam, play longer than 2 hours but the game has some major bugs that don't present until later, or the game makes a 3 hour long "tutorial" so when you get into the game a realize it's nothing like you though it's too late for a refund... no you're out that money and this company gets to laugh at you while you have a broken game or a shitty game...
      NOW I pirate a game, turns out to be amazing and is created with no bugs, the story is great and even the free play is good, I go and buy the game because I KNOW it's not a piece of crap.
      Back in the day we could rent games we wanted to buy to see if it's worth it, then we'd buy them if it's a good game. Now we can't do that as all our rental stores have been taken over by digital media... almost seems like the studios and developers wanted to create a platform that they can distribute their media with zero cost or logistics, while being able to control WHAT media you've got access to because you never actually own it.

    Modding is not illegal insofar as i understand it. Didn't the courts rule that once you own the hardware it is yours to do with as you please? (I am certain that they did so over here in the EU at any rate)

      It depends on what the modifications do and what you do with it. It's not black and white. You have to balance your rights against the rights of other parties. It's like the right to free speech that people want, yet those same people want protection against deformation of character, false accusations and malicious persecution. They are polar opposites. Or the right to play loud music against the right to not have your life made a misery by noisy, inconsiderate neighbours. There's a point where the two opposing ideas meet.

    My only thing with the Modded Hardware situation though is that Nintendo gave him a warning to stop operation for 3 months, and he refused even after he signed an agreement of wrongdoing. Last minute he tried to lawyer up after he was already distributing pirated games on various switch consoles. I think at that point its a bit on him.

    Technically, archiving isn't piracy. If a product is no longer for sale, the law protecting the product is mute. HOWEVER, the games in question are for the switch which still has most if not all games for sale.

    Here's my argument for having my switch oled. I have one. I don't care for pirating games especially if they're from the most recent console. If it's from the wii or older, that's 100% okay to pirate imo. They're going to bring back 10-20 games on the next switch from that era. 3ds games, maybe 5 at max.
    I have no need for a steam deck with its poor battery life, when I have my $500 gaming laptop which does pretty well and plays most games better than the steam deck. I don't need super high end graphics. I just need to play my games.
    The argument that Nintendo isn't a scummy company wasn't in question. They are scummy, but they have good games that people want to buy. I don't have to wait for a game to download if I have a physical copy of it. I don't have to buy nso+ to play online games. It'll suck not having gba games and stuff, but that's where my first argument comes in. I'll play it on my laptop. The base nso allows you to have online capabilities (even if you have to pay for it) for a stupidly cheap price. Not great that you have to pay for it, but with physical nintendo games, I have a higher sense of owning the game.
    What happened to all the people who got the crew 2? Isn't there some issue where even the physical copies are garbage now due to no online connectivity? Nintendo at least allows you to keep your physical games, with most not needing some sort of online capabilities.

    I am still annoyed at Nintendo for paywalling cloud saves. Sure other console(s) do the same thing but the Switch is a portable system, and Nintendo envisions is having multiple Switches, so cloud saves are a very very good thing to have. They don't let us legit back up saves in any other way.
    As for Nintendo and the topic of selling or not selling games... Oh boy do I have a lot of spicy words on the matter.
    I purchased a Steam Deck OLED, loaded it up with emulators and a fine sampler of good old games.
    And now if there is a cross platform game, and I am trying to decide if to get a Switch version for portable gaming now (and wait for a Steam sale later for a PC version) I will likely just go Steam only now.
    I will probably still get a Switch 2, but it will better come with enough 1st party titles that I really want to play, before I consider getting.

      Still a remake... is easier to work on something already made and adding some additions then making a new game from scratch... The problem is Nintendo is not the only one doing this and asking full price for basically a reskin with some additions, it is not like they would not have the source codes of their own products....

    I'd prefer them get rid of the online cloud gaming with their Online service and bring back the virtual console. 100% they could implement a way to play those classic titles online with others, while still charging for online.

    Don't pirate indie games and I personally am against pirating games still being sold. But 3DS, ps3 or any console no longer supported or games no longer being sold? I'd say it's fair game because you're keeping someone's passions alive. Those devs worked so hard to make something they loved and they deserve to have their work cherished.

    Best Pokémon game being from 20 years ago is both completely true and crazy at the same time. Emerald was peak and we haven't truly been able to see that replicated since. At least not truly. We had black/white and diamond/pearl. They were decent, but even they sucked. Then the 3ds just ruined the entire series with the dumbed down gameplay and rehashing old stories. Even ultra sun and moon were just rehashes of the SAME GAME! It sucked.
    Honestly, I don't even pirate the original games anymore. I get rom hacks that are WAY more imaginative and creative than anything Game Freak has made since gen 3.

      NGL Legends: Arceus was pretty good (It was easy to mod on emulator too!). But Emerald with basic rom hacks was very good.

    I'm on Linus side with the "Don't be a fan". I can like a company for making a good product and look at their new offerings first when they bring out something new/improved. But I'm not going to go ahead and just buy it because "oh new shiny from company X".
    If they screw up then I'm not gonna look at them (as) favourably any more, unless they show that they are willing to correct and keep that for a good while.
    As for piracy: If company X can offer me a way to play my games I bought and pay for, even after they pulled the plug, then I'm good. If they pull the plug, stop selling and hit someone's hand with a hammer if they try to keep the old library alive (from which they won't make a cent any more either way), then I'm not.
    Like so many before: If buying isn't owning, than piracy isn't stealing.

    According to Nintendo, you are not allowed to have anything other than original games and hardware. @5:26 Nintendo positions themselves in a place where a baked potato can run their games. Then modders and hackers figure out how to emulate their 10 20 30 year old consoles, and OFC the games run just as well as on native hardware.
    With my desktop PC, I play two emulators at once, sharing my station with a second person. They will play Super mario Galaxy while I play BOTW or something. Two games, at the same time. On the same hardware. And then when I go and spend $300 on hardware to play the same games for $60 ea, I get a worse user experience at lower resolution with worse textures.
    I don't want that. And I don't want to pay a monthly sub just to play a dumbed down port of a rom you're going to emulate with a 3rd party emulator via your own hardware. No thanks. You don't get to recycle old IP for premium access like that. I'll just play it on my phone for free.

    After Nintendo took down Yuzu, I decided I will never give Nintendo my money again.
    They crossed the line when they took down an emulator. Not to mention citing it for "circumventing" when all they did was show people how to legally dump keys and Roms they owned.
    This is what I using Yuzu for on my steam deck because I didn't want to carry two devices with me.
    Nothing Yuzu did has been proven illegal in a court of law in the United States of America.
    So... Nintendo can eat my entire ass. Rereleasing their own games, pulling an Apple forcing you to run them ONLY on their hardware? No other game system company has ever been this litigious including Sony who is also Japanese.
    Perhaps if they didn't use an ARM processor and instead did what Valve did, their games wouldn't be so easy to emulate.
    Instead it looks like the Switch 2 is going to be ARM based again in a world where have efficient x86-64 based handhelds that are much more powerful. An other opportunity. I am impressed with how far ARM has come, but Nintendo could do better.

      That will never happen, Nintendo doesn't own every games in their library and the ones they do own are bound by their decisions. Just cause other companies make their stuff available most of the time doesn't mean they will. These lawsuits are scary yes but these modders can change the whole perspective of something if they could only fight.

    I think nintendo as a company is very disorganized. Metroid prime remaster was a big upgrade but only 40$, dk is “HD” now and 60$. Theres no consistency in quality and pricing. Mario 3D all stars changed a bit and should have been 40$ but was 60$. So nintendo for me is everywhere and i will probably skip the switch 2

      As long as you know what you're buying, what's the issue?
      If they want to sell a single game and watch title for $900 only for the wii u in 2024 and the the sequel to Tears of the Kingdom for $3.99, I see 0 issues with that. You're not forced to buy it, nobody is. Nobody is being scammed.
      Is it weird? Absolutely, but the things are known in advance. You can make an informed purchase. It's not like you're giving them $60 a month for a "AAA game", and then they give you Mario is Missing and you just have to suck it up.

    I agree so much. It's why I stay away from playing anything on the Switch that I don't have to (plus, ports are often pretty ugly lol).

    I already decided that I'm never buying another Nintendo console again. I rode the Switch train for a little while the first year or so it was out, but I never liked them as a company. I find it even worse that, like you guys mentioned, Nintendo always gets a free pass when they do something stupid.
    So yeah. I'm voting with my wallet and I'm never buying a new Nintendo console ever again. If I decide to ever get a Switch 2, it will be on eBay via the used market.

    I've given up on Nintendo. Full stop, this would be solved if they released their own emulator or released ports of their games. I'm not paying $250 for a console for one game. Especially a game I'm not allowed to mod. Rom hacks have extended the life of games I love like Pokemon. So on the seas I shall stay.

    I do both tbh, I will buy Nintendo's consoles and buy the games I want to own to show support to games I want to see thrive but also pirate other games to see if I would like them because their selling points are too steep which unless you're making six figures Idk how you're able to buy all their first party stuff because they never go for less than 40 and some never go less than 50. Their business practice is crappy for sure, I think if they're unable to make the next console come across as "we want you to play your Switch 2 the way you want to enjoy it," it will probably regress in sales. The market will be too flooded with handheld consoles more than it already has and the components gradually being normalized will become cheaper, where they can cut their selling point to a similar price as a Switch 2 but more powerful.

DISCOUNT YOUR FCKING GAMES and even discount the switch, how long had the switch been out its been so many years and yet the Nintendo switch has stayed the same price this whole time and the games rarely if at all go on discount to old games or on sale once a month or more I'm not going to sit here and pay 60$ for a Pokemon game that's been out since the switch launch 7 years ago lol that's just straight up stupid and that's not just for Pokemon that's all their games compared to Xbox, PlayStation, steam you get discounted games all the time not discounting your stuff if what's causing piracy or finding other means to get it cheaper

    I don't understand why people hate Nintendo like this, I mean obviously, they are coming for the people who mod or pirate the games of the current console generation, they are a company and have to protect their assets, but on the other hand, they don't care if you mod or pirate past consoles, because that doesn't hurt them at all. And I understand Matt's point about the games being just re-releases, but do people not buy Fifa or CoD? which is basically the same game, just "better" graphics every year. And to finish my point, people complain because Nintendo sues people (which as a company they are in their right to do so) but remember all the studios and jobs lost to Microsoft. So yeah, other companies do even worse, but people complain because Nintendo protects their business.

    Yeah, I'm with Austin... I gave up. I play games to relax and tune out the day. I don't care about emulation, I've already been through the grinder of being an adult. If I have to choose between being stressed like Matt on everything Nintendo does or, I could be "Hay, Nintendo I just did a triple shift at my job because my rent increased last month, shrinkflation is happening to my food, my vehicle needs a part because it's manufactured in F**KING Bing Bong -stan/-zou/-xco and they don't sell that MF thing at an auto parts store I have to get it at the dealership, OH F**K! My medical bill came in... WTF?! I HAVE TO PAY HOW MUCH?! Here's $60/$70 Nintendo, give me a game that I can fall asleep to."
    BUT... F**K Nintendo Switch Online, not enough money in the world will ever get me to pay for that DOG S4IT service.

    The biggest reason piracy should be justified, is Banjo Kazooie. BS licensing making games disappear forever can be seen in full force there. Now we have companies attempting to permanently scrub games like Forza because... gasp, Ferari isn't being paid enough to let you keep looking at a **Virtual Car**. Games being "licensed" being the reason to destroy content, is the biggest load that companies ever pushed. Super Mario World on my SNES is a cartridge I can pass or sell to a friend *whenever I want.* The idea that it contains music made by nintendo being a reason to destroy it is utter garbage, and the fact that that is even a consideration *is* the end of the slippery slope argument. We're already there. There is no falacy, we already took the plunge, and it's clear companies would absolutly jump at the opertunity to license *everything*. If they could license memories, you *know* they would.

      bad example atm, as banjo kazooie is still technically playable and purchasable in the modern age (via Rare replay). People just forget that, you know, xbox exists. It's actually how Sakurai played Banjo for inspiration when they were included in Smash Ultimate, but that fact flew past too many peoples heads.

      In japan its typical that companys look the other way... till you pirate stuff they actually still can sell. And that excacly what nintendo is doung most of the time.
      Also in japan its considered dishonorable to use someones else ip. Its often more like out of spit as of buisness:)
