  • On Monday, the Supreme Court ruled that former President Donald J. Trump is entitled to broad immunity from criminal prosecution for actions that he took while in office.

      In 124 days from the date of this post Americans will go to polls to decide if democracy is worth keeping. Of course, the opposition is perfectly happy to divert your attention to all manner of irrelevant information about the wide range of troubling issues that face us. They say reading is fundamental. More Americans need to start or go back to reading. There is a boring as hell blueprint that the Republicans have been publishing for years. The 2025 edition as always outlines their plans for "day one" execution by the transition team.
      I can't bias things by offering my opinion. What I can say is that the direction they are planning is there for you to see but I'm pretty sure that they are confident that you WIL NOT read t and/or if you do, you won't be able to detect the very, very obvious.     What I seriously miss here is a valid discussion on how the SCOTUS is corrupted, and by whom. And, what impact this may have had. In particular, but not exclusively, on justices Thomas and Roberts. Also, whether and how a criminal investigation into such payments and gifts to justices could happen.
    In Germany, where I live, a an official, public servant or judge can not accept or welcome any gifts by third parties, it is a crime.

    The majority of my colleagues seems to have put their trust in our Court’s ability to prevent Presidents from becoming Kings through case-by-case application of the indeterminate standards of their new Presidential accountability paradigm. I fear that they are wrong. But, for all oursakes, I hope that they are right. In the meantime, because the risks (and power) the Court has now assumed are intolerable, unwarranted, and plainly antithetical to bedrock constitutional norms, I dissent

      The ruling also applies to Biden, Obama, bush, Clinton, Reagan, Carter, and all future presidents.
      This is propaganda simply because they isolate the decision as if it ONLY applies to Trump.

      I read all the time. Congress won't impeach a criminal POTUS because SCOTUS has declared that all that POTUS has to do is frame everything as his 'official' duty in order to get away with it. Lucky for us, Trump didn't know that and committed a crime outside the official duty protection.
      There is no role for POTUS to play in the election process. What Trump did by calling Georgia officials to try to pressure them into finding votes for him was a personal demand from candidate Trump for more votes. He can be prosecuted by the state of Georgia and by the federal government for that criminal act.

      The Supreme Court majority has reserved for itself the power to determine what is and is not an official act and has no requirements to apply rulings evenly. Biden and Trump could do exactly the same criminal acts and be judged differently. The only Constitutional recourse would for for Congress to force reforms on the Court which would require nearly unimaginable majorities.

    Judges and agents have immunity in a similar capacity. It just means you dont sue or charge them directly in those cases but instead the agency they work for takes on the liability of whatever actions.

      No. This is completely different. The president has far more latitude in what they can do, and with this, nothing they do can ever be called into question, so long as they say it’s official. Imagine a police officer being able to do a mass m… and having complete immunity. That’s literally the ruling that was passed, but for the president.

      Presidents have already had that.
      We have had no criminal prosecutions of presidents for committing acts of war which could be interpreted as war crimes, for example.
      The case here wasn't about shielding presidents from criminal liability in performing acts necessary to the office of the president.
      Trump was claiming blanket immunity for all acts as president, committed before holding the office, and prosecuted after leaving office, which he didn't get.
      But he got the next best thing: the Supreme Court as the final (and really only) arbiter on what actions a president performs which falls under protected behavior and what doesn't.
      Trump's argued that because he was sitting in the Oval Office when he signed checks from his private buiness account to pay his lawyer for campaign violations, that criminal action should be considered official. If Trump "relocated" highly classified national security documents to his private residence and business while in office and showed them to unvetted guests, that could be deemed an official act, despite legislation which already says otherwise.
      The SC just needs a majority willing to say so and there is no need for justification and there is no check on the SC. They even wrote away the ability for Congress to set legislation defining "official acts" or disallowed acts. They could even rule inconsistently in favor of a same-party president and against an opposite-party president for the exact same acts. There is no direct recourse for uneven application of this ruling, unless Congress gets enough of a majority agreeing to force Court reforms.
      This is why this is being called granting the president status as king: anything the king does is legal simply by the act of doing as long as the SC majority favors the president.

    The ruling was not complete immunity but specified what items were immune.
    Trouble with all these cases the democrats waited until an election year to begin them thinking that it would tie him up during campaign season. All of these cases dated back to 2021 or earlier. If they had filed them in 21 then perhaps most would have been decided by now. When your motivation is political then justice finds you.

    Nothing changed. Impeachment was always the mechanism to handle charges against a President. Some people, especially the ones proclaiming to be experts, need to read the Constitution. It doesn't take that long to read. Give it a try. Then remember what they were trying to tell you and compare it to what you read for yourself.

      If this were true, then presidents have an automatic statute of limitations for all actions which ends when the president quits the office. The Senate can't convict an ex-president because Senatorial conviction is just removal from office.
      Ex-presidents are not granted special status in the Constitution; the impeachment process applies to sitting presidents who have already been enjoying immunity for acts committed while carrying out presidential duties.
      That's why "the most persecuted president" got hit with multiple charges in the term after he left office: it's broadly understood that you don't press charges against a sitting president because that's Congress' job.
      The reason that the Constitution doesn't fully flesh out legal liabilities for ex-presidents is because the Constitution wasn't written for criminals to be elected president. When presidents leave office, they return to the same status as every other citizen and can be prosecuted for crimes the same as everyone else.
      The untested boundary is what acts can be considered official and unofficial; the ruling grants exclusive power to the SC to decide that by whatever basis the majority chooses and is not required to apply the ruling evenly. The SC also removed Congress's ability to enact legislation to define presidential immunity.

Trump’s lawyer literally said, he could ass… his political opponent and still would be immune. The court literally ruled that to be valid as long as the president says that it they classify it as “official”, which as the ruling reads, is up to the discretion of the president, and cannot be questioned.
