    As of Sept I'll be four years into my med mal case against a doctor. I have one of the best med mal attorneys in my state. My deposition is scheduled for Oct. This is a VERY long process so be prepared to exhibit infinite patience. My attorney is working contingent and my case is pretty strong with powerful experts backing me up. Still, this takes a lot of time. Don't be looking for a quick payday because that will NOT happen. Research and review whoever you choose to represent you. My attorney came very highly regarded and is well respected where I live. That's the kind of attorney you want representing you.

      @jollygreen79 - Thanks for tuning in and for your comment. You are correct - a medical malpractice case is a very long process and having a board certified civil trial lawyer, with trial experience on your side is very important.

    Great video. Also, I would like to add that if the Defendants try to file a Rule 9 then your looking at longer. Even if you win the Rule 9 the Defendant can file a Rule 10, which is even longer. If you survive the Rule 10 then you hope the case can finally move forward.
    This is what I’m experiencing currently and we are going on 3 years and still have not even had depositions started. We of course set them but the Defendant may or may not show. In my case the Defendants decided not to show banking on a win with a Rule 9 & Rule 10.
    My point is insurance companies have enough money to try anything and with a health liability claim they are in bolden because many times they win on procedural technicalities.

    I didn't even think to check that my lawyer was following the proper steps to protect my case or to even move it forward. What happens when your lawyer intentionally doesn't follow these steps and you miss the statute of limitations? How do you get the hospital to listen to your complaint when you have evidence that they didn't follow the standards of care and caused you harm?

      If a lawyer misses a statute of limitations it could result in a legal malpractice claim if your case would have resulted in a recovery had it been filed timely.

    I went into the hospital for severe stomach pains, spent a whole day in, the second day before I was released I received a shot for pain....by the time I made it out the hospital I was having trouble breathing & chest pains, a few hours later I went back to the hospital and was checked back into ER...a few hours later after running test they stuck a tube down my throat and now a couple days after this I have this nasty cough for months now😐 along with shortness of breath and chest pain...I don't know if its from the shot or if they torn something in my throat...it appears I have plastic bronchitis from the white worm looking stuff I'm spitting up...called a few law firms but it appears I don't qualify for a case....
    I wasn't like this until I came OUT the hospital 😕

    Is it true that the patients have to die for a malpractice case to proceed? If the patient is near death due to potential medical negligence or complete denial of medical access what can be done? If the patients elderly mother is affected by the loss of the patient’s assistance as a result?

      Thank you for tuning in and for your question: Technically a doctor can commit malpractice but if it doesn’t cause a death or permanent catastrophic injury then the malpractice is likely not worth pursuing.
      Medical malpractice cases cost law firms between $100,000 and $300,000 in expenses this is in addition to the 2 to 3 years of time and professional services. Since they cost so much to pursue it doesn’t make economic sense to pursue cases where the injury is not catastrophic or death. The ultimate award will not be sufficient to pay the expenses unless there is an catastrophic injury or death. Nearly dying without having a permanent and catastrophic injury would not justify pursuit.

      I want to know after hernia surgery, large intestines was sewed up by doctor. I was told it was gas, had to walk ot out. A week later went to ER and was told the doctor messed up and had repair surgery. Is that malpractice case??

      95% of cases settle before the trial, 90 percent of cases settle without the need for filing suit.
