    Sir can you please tell paying fee from "2nd year onwards" from which date ? either date of publication or priority date?

    Sir you have replied many time but i did not get, can an ordinary filed application in india consider to become pct application when application file PCT in IB within 12 months from ordinary filled application. As well as The filing date of ordinary filed application in india becomes international filing date of pct application. Or international filing date and ordinary filing date will be different or same.

      Ordinary application and PCT applications are different.
      After filing an ordinary application in India, you can file an international application (PCT application) by claiming priority of the ordinary application within 12 months.
      Now the filing date of PCT application is when the application was filed with PCT (directly at IB or with any receiving office such Indian Patent office).
      Now, once the PCT application (international application is filed) you can enter national phase ( in any country of your choice).

    Hi sir,
    Can you please tell, if sec 35 and sec 157A are relatable??
    During secrecy direction is the application not taken for any further processing ?? Or it is processed and not disclosed to public ?

      Kind of yes, but section 35 is more about the process at the patent office.
      During secrecy direction - no action/drama happens with regards to the application at the patent office.

    Controller is also issue secrecy direction??controller allow without central govrn??

      @@AbhayPorwal i thought it is notified by central government then appears to the controller without central government knowledge he can't issue any direction?

      @@preethipreethu5381 it is the duty of the controller to issue such directions. In cases where it is missed and is observed by central government, the controller is directed to issue such directions. The revocation is decided by central government.

    As per section 36, if secrecy direction imposed patent published in outside India,then it's revoked in India by giving notice to the controller abt publication in foreign, whether my statements ryt?
