Nice video Frank, as usual. What the police officer did what totally un-professional and you should send a complaint to his department.

Well I was between the NS and the CN. There is about 100 feet between the two.

I think that police really don't understand railroad wise, what is safe, not safe, legal, or illegal. They just wanna get some money out of ya. I hope that you never have to go through with all that again. I have gone through that same type of situation. Hate cops sometimes! Well anyways...great video Frank! *****

Grade crossings are kind of a gray area. The Railroad owns the land (Right-Of-Way), and the grade crossing is an easement, or Permit, to cross the Railroads land. Crossing Gates do not mark the edge of the Railroads land( in rare cases in could, but I would not count on it.), but marks a point that the Railroad has determined is a safe distance from the tracks, that a Train going through would normally not hit a vehicle, or person along side the tracks.

Funny about the GEVO's LED Number boards. I had commented on a video of a GEVO with a number board burnt out a couple of months ago, wondering why they didn't use LEDs there to go with all the other hi-tech stuff in these units. Maybe someone at GE saw it? I want my cut! :-P LOL

Were you between the gate and the rails? If so He can write you up. Any public road area in the railroad right-of-way belongs to the railroad, when the gates are down, or a train is going to cross the road. Besides it's hard to prove a Cop wrong in the eyes of the Court.

You know you could of told him he was actually breaking the law by hindering railroad operations by committing illegal gate running.
It's really sad there are some cops outhere who use the badge as a way to show how much bravado they have.
It gives the good cops a bad name!
The hogger pretty much nailed it when he said the cop should of been the one getting the ticket.

And no I am not a Cop, lawyer, or a Judge. Now the chances that anything the Cop charges you with sticking are mighty slim, but the fact that you may have to, spend time in jail, go to court, post bail, lose time from work, hire a Lawyer, go back to court (so many times you will lose count), and more time off work (remember you have to pay the Lawyer, and your bills). And then even if the charges are dropped, or you are found Not Guilty, then you have to clear the arrest of your record.

So yes you can be stop at a crossing gate, and be on Railroad property. The Police, and the Railroad, understand this, and consider it normal because you are crossing over the Railroads property at a designated crossing. Now here comes the fun part, or the Gray area, doing anything else other than crossing the Railroad's property, can be considered 'Trespassing' under the law. So yes you could be arrested for taking photo's as long as you are on Railroad property.

All of that is just not worth telling the Cop to take a spin on his nightstick. At least they cannot arrest you for thinking it, yet.
Good Lord have I ranted or what. Sorry about that People, I just got carried away.
Sorry Frank, I am not trying to start anything.
Xyzchisquared, I am not trying to start anything, just pointing out that a few details.
I do apologize if I offended anyone.

@BoxcarFrank I worked as a Land Surveyor, out here in California, and most of the Railroads out here like to use 100' right-of-ways. On single track lines the ROW is centered on the tracks. Had one survey that had 300' of ROW, Yep 3 different Railroads. When you have multiple track you have to get the ROW maps for the Railroad Co. to see how the tracks are aligned in the ROW. More than likely you were trespassing, if you were in between the tracks.
But still the Cop was an asshole.
