    Thanks for making this video, I drive for Uber, Lyft and do work for a number of other app based services. I have a commercial insurance policy for my vehicle, but I believe I am more of the exception than the rule. Doing independent contracting work is the same as starting your own business and you would never open a business that involves the potential of a customer being injured without making sure you are properly insured. Before I contract with any app, my first call is to my insurance to make sure I can they will cover me using that app service. So for example, I recently contracted with InstaCart to do some deliveries and I called my insurance to make sure we could add on this service to my policy. My advice to drivers is never drive for any app based service on a personal auto insurance policy because you will not be covered as you can't use a personal insurance product for a commercial application.
    I know you wrote this from the side of a passenger or other party being injured, but just wanted to add there is a growing amount of Rideshare / Gig Economy Contractors that recognize this issue and are taking the proper steps to make sure they are properly insured.

    Thanks Jz I've been looking for anwsers everywhere and your videos gave me good insight on ubers policy. I drive for uber ive been in two non at fault accidents this year. The first one in February I was tboned gave me bulging disc in neck and a herniated l5. The second accident in August The other driver carelessly merged into my lane going over 70mph and side swiped me. There is little damage on my vehicle but mri shows I have a new bulging in the neck the previous bulging increased in prominence. and the L5 now has an annual tear and increased in prominence and also have lumbar spine stenosis. Before the mri the insurance company made a low offer because of car damage. My question to you is will I be able to sue uber for pain and suffering. I was online with no passenger they already offered me the 50k but I also pay for ubers optional Insurance through AON and i should be covered up to 1mil just being online. Once medical bills are added up will i possible be able to compensate from that million dollar coverage for pain and suffering and other damages? Thanks in advance

      Sorry that you've had two recent accidents. However, I'm happy to hear that you believe that you weren't at fault.
      My response assumes that the accident happened in Florida, which is where I'm licensed. Thus, this comment only applies to Florida accidents. Each state has different laws on suing for pain and suffering, and other damages. You should consult with an attorney in the state where your crash happened.
      This reply also applies for accidents starting July 1, 2017, which is when Florida's ridesharing insurance statute went into effect.

      If the other driver's negligence caused an Uber driver's injury, then an Uber driver can make a claim against the other driver for pain and suffering. The Uber driver can claim other damages as well, such as medical bills, lost wages, property damage, and more.
      In Florida, an Uber driver can also make a claim against the person who owned the at fault vehicle. The Uber driver may also have a claim against other parties as well. These include, but aren't limited to, the employer of the at fault vehicle's driver. There may be additional parties who the Uber driver can sue as well.
      You mentioned that you were online with no passenger. I assume that you hadn't yet accepted a ride on the Uber app, correct?
      If an Uber driver in Florida has the app on, but wasn't "engaged in a ride", then the Uber driver can't make a claim against Uber's uninsured motorist (UM) insurance for pain and suffering or any other damages. Thus, the Uber driver can't sue Uber's UIM insurer, the James River Insurance Company for UIM insurance benefits.
      In Florida, the Uber driver is an independent contractor and not an employee of Uber if all of the following conditions are met:
      (a) Uber does not unilaterally prescribe specific hours during which the Uber driver must be logged on to Uber's digital network.
      (b) Uber does not prohibit the Uber driver from using digital networks from other rideshare companies.
      (c) Uber does not restrict the Uber driver from engaging in any other occupation or business.
      (d) Uber and the Uber driver agree in writing that the Uber driver is an independent contractor with respect to Uber.
      Florida Statute 627.748(9)
      Thus, if all of these conditions are met, the Uber driver can't sue Uber for workers' compensation.
      If the Uber driver has the app on in Florida, but wasn't "engaged in a ride", he can make a PIP claim with Uber for lost wages, medical bills and more.
      If the Uber driver had rideshare coverage on his personal auto insurance policy, he may have UM coverage on that policy, which will allow the Uber driver the UIM insurer for pain and suffering (and other damages) if the at fault driver is uninsured/underinsured.
      Also, if the Uber driver had a commercial insurance policy, it may have UM insurance which will allow the Uber driver to the UM/UIM insurer for pain and suffering, and other damages.
      An Uber driver may also be able to access UM insurance from a relative's auto insurance policy who he lived with, or from the insurance policy that covers the car that he was driving.
      In regards to Uber's "driver injury protection" insurance through AON, Uber describes it as having these benefits for Uber drivers:
      "- Medical expenses: Up to $1,000,000 with no deductible or co-pay - Disability payments: Up to $500 a week in income replacements for lost earnings- Survivors benefits: Offering peace of mind for your family's financial security"
      However, Uber doesn't say that driver injury protection insurance pays for pain and suffering.

    I ride Uber and Lyft a lot. If I ever got into an accident, I need to know what to do especially since I have a recording device (smartphone) and many times the driver has a dash cam as well.

    Hi question, I am an uber driver in Florida, had an accident in Miami, I picked 3 passengers in Naples heading to Miami, I was about 10 minutes away from destination and I was hit from behind, passengers were ok but i hurt my back and neck, uber insurance wich in this case is progressive doesn't have PIP, I found out when i talk to them, I did went to the hospital to have myself check out and i try to go to the chiropractor but uber insurance doesn't have PIP, I called the other driver insurance, I have a claim number from them, the adjuster supposed to call me tomorrow cause I need my car fix right away, I did not call my personal insurance, I am afraid they will cancel on me for not tell them that i do uber, what should i do in this case, I'm planning to hire a lawyer, should i deal with the adjuster myself? Please advise thank you

      You're correct that Uber's insurance (Progressive) doesn't have PIP since you're in Florida and were injured while you were "engaged in a ride".
      If you can, please answer these 4 questions.
      1a. Did the other driver get a ticket?
      1b. What company insures the driver that hit you from behind?
      2. How bad is the damage to your vehicle, and the vehicle that hit you?
      3. Did the other vehicle's airbag(s) deploy?
      4. Do you have health insurance?
      Regardless, you should speak with a lawyer. Even if ultimately decide not to hire one.

      I don't the answer to this question with certainty. Additionally, in another comment you stated that you live in Canada. (I assume that the crash happened in Canada since it occurred while you were driving for Uber.)
      I am only licensed in Florida. Therefore, I usually only comment on Uber claims that happen in Florida.

    I got in a Uber accident over the summer in August I was a passenger and I was injured I got a concussion and hurt my neck I had to do chiropractor therapy for 3 months the accident wasn’t the Ubers fault it’s February now how much do u think the minimum I would get as a pip or in general

      I’m some circumstances, the injured person can sue Uber. However, Uber’s insurance policy is often big enough to cover most injury and property damage claims.

    I had an accident in 2016 it was not my fault I drove for Uber guess what Uber shut my account and the rental car charged my credit card.!
