- On June 21, 2023, officers responded to a case of identity theft. The caller reported that a male subject had attempted to use two credit cards to make large purchases that were not in his name. The caller also informed dispatch that the suspect was still sitting in his car in the parking lot. The man wasn’t ready to provide any information to the officers and kept circling around, only making things worse for himself. Shortly after, the officers found the suspect’s partner hiding in a swamp behind Best Buy. The other man still refused to comply with the officers. The officers had no choice but to arrest the man due to his behavior. He continued to argue with the officers. Meanwhile, the other suspect was transported to jail. Isaiah was charged with resisting arrest and obstruction of identification while Jaylin was charged with use of credit card to defraud, possession of another’s credit card and possession of firearms.

So the officer said you can leave, but because you want to stand there and argue with them, telling them what you will and will not do, it leads to an arrest. Make that make sense😕
Arresting someone simply for arguing in the absence of any probable cause is called first amendment retaliation. However the arrestee may have committed failure to comply with a lawful order but that is not what they charged him with. Obstruction is a catch all charge which may include failure to comply on some states. It is debatable whether he actually failed to comply but 13:15 was clearly resisting. Up until that moment he may still have had a chance to be turned loose or beat the obstruction rap. I give the male officer a C minus because he unnecessarily escalated the situation to an arrest and got the suspect riled up but they were within their rights to order him to stay out of the car and preserve evidence. Once the male officer went hands on he had to accuse him of something to make the detention appear valid. The female officer was doing a better job at convincing the man to comply and probably would only have detained him. The man gets an F because he lost his cool and resisted after being handcuffed which made the prosecution's job much easier even if the obstruction charge should not stick. Had he not resisted he may have beat the obstruction charge and even had a civil rights claim for first amendment retaliation.
To get a pass to leave knowing ur committing a crime then stand there and argue back and forth with the cops is diabolical I would have been walking my happy tail home knowing I just ducked an arrest😂😂😂
