I think you’ll find that if you physically assault a work colleague, that’s gross misconduct and grounds for instant dismissal. So he wouldn’t have had grounds for unfair dismissal at all.

I suppose technically he could have, but I’d be surprised if he could have won.

Might be a bit controversial. But anyone who is accused of something ILLEGAL should be suspended at most until the police have investigated it and determined whether it is or not. If it is controversial but not illegal, especially when it comes to racist or sexist comments, you might not like them but that is why we have freedom of speech and freedom of expression. What goes on in someone's private life as long as it's not illegal shouldn't be fired over such matters. Otherwise, you are being hypocritical over what people are allowed to say and do i.e have an affair. Not illegal but is comprovincial.
