Is suing for discrimination or sexual harassment even worth it?

    I was nervous and I'm new to this. I got discriminated, assaulted, harassed, and so much at work, I looked for lawyers around San diego and was very disappointed. No lawyers took my case. I had to go northbound and a great lawfirm took my case finally. I was discouraged and sad because I thought my case is trash or useless but now I have hope. I'm trying to settle this case vs a hospital but if they don't, my lawyers will do their best and we're going sue for millions and millions for damages. Punitive damage coming too. :)

      When you say wrongful termination do you mean something motivated by workplace discrimination, sexual harassment or retaliation? Or do you mean just an unfair termination?

      @@JobAttorney like Im trying to unionize my work place but Im a bit afraid that they might let me go for it and just say its for any othe reason bc this is an at will state

      @@kieleleron85768 Well if you engage in lawful union organizing activities and document it well then you should be able to make a solid argument that you were targeted as part of a union busting campaign. Could file that with the NLRB.

      @@JobAttorney I would do that after I get fired tho? The other thing I'm worried about is the whole store shutting down. In this state Maine two stores have unionized & then those locations were just shut down. The Chipotle & Starbucks just pulled those locations instead of having a unionized workforce. Is that legal? Seems like it shouldn't be but how could someone fight that?

      @@kieleleron85768 That's a complex question that is going to be litigated. If it can be proven that locations were shut down purely to bust union organizing efforts, then I would expect the NLRB to take action.

    What happens when you have - hostile work environment, sexual harassment, defamation claim and then also a federal retaliation and harassment claim ? All of those combined

      Retaliation is only the bi-product of an action after you engaged in protective activity. This could be an email contesting illegal activities, helping a co worker as a witness in protected activity, being a family member of someone that engaged in protected activity (Third Party Retaliation) or you filed a claim yourself with a government agency. Most claims must first be filed through your state agency or the EEOC, then you’ll receive a right to sue letter. As far as defamation you’ll need to speak to an attorney but it’s always good in general to speak to an attorney. Go ahead an offer $500 for a hour or two of their time and see where that gets you. I would suggest you hire the attorney short term to help you draft your complaint to your state agency or EEOC. Then wait until you get the 90 day right to sue letter and hire said attorney.

      I got sexually assaulted, stalked/harassed, told that I was fired for doing something I didn't, and fired after retaliating to go over their heads.

      I've just gone through this process and all I can say is save your money and let the bastards continue with what they do. I had good documentation, there's even a video of situations and it still didn't make a difference. Two years into the EEOC process I was given the right to sue letter, and my attorney has decided it's not happening.
      I hate to say this, but save your money, find a new job and create a new life. I am still wrapping my head around the green light that has just been given to the abuser.

    How much should a person ask for in an eeo settlement against a major government agency. The case involves threats, threats with physical attack, racial harassment, sexual harassment, hostile work environment, victim shaming, all retaliation for reporting a sexual assault on an employee by 3 supervisors.

    Hi I am Jim and a US Army and US Marine vet, I worked as a Special Police Officer for the Washington DC government for 5 years . I was placed on leave with out pay because of my service connected disability for a little over 2 years Later I was fired. The DC Field office of EEOC refuse to investigate the matter can I file a claim against the EEOC Investigator?

    What if plaintiff has social anxiety disorder is dyslexic And has basic anxiety? How do they tell their story?

      Carefully. Dyslexia isn't a significant issue when it comes to testimony, but anxiety conditions can be significant obstacles to having ones day in Court. You prep, prep, prep and then prep again. But you also have to have conversations about the additional risk the anxiety condition can introduce at trial and have real world talks about if settlement should be considered in a given situation.

      My advice would be to address this with your attorney; in addition, honestly consider settling instead of going to trial. Here’s why, the defense has the right to cross examine you. Therefore, all the coaching, and carefulness your attorney is utilizing with you will be unraveled by the defense. Thus- settling may be the less stressful and damaging route.

    I think I may have a situation but instead of work it come from my university used my intellectual property without paying me teachers trying to sleep wit me making feel extremely uncomfortable and pretty much slandered my name and black balled me not sure what to do

    Currently going through a disability discrimination, retaliation, and sexual harassment case. I work at a college, so it's now a Title XII investigation. I haven't been able to find an attorney to take my case in MN. I have anxiety, which has grown into selective mutism due to the experiences, which makes it extremely difficult for me to speak at work. I've been preparing and writing, but I wish I had an attorney to assist. Would it even be worth it, especially with Title XII investigation? You are correct in that it affects one's well-being. It's not an easy road, but standing up is how change happens. Minnesota. Thanks for the info.

    If I have audio and video evidence that I was discriminated against and of the person who sexually harassed me admitting and apologizing about it,can I use that as evidence especially since I have no witness because I’m new to this job and they’re all friends.I already filed discrimination charges against my company yesterday I haven’t mentioned the video and audio evidence yet.I live in Pennsylvania.

I was sexually touched by another employee,there were 2 witnesses there that seen it happen.and 2 other witnesses that witnessed stalking,They didn't fire him for assaulting me, ignored my complaints of him following me around the store, asking me to come to his house while his wife wasnt there to have drinks and swim in his pool,We reported the incident and they didn't take it too seriously. They threw away our notes we made each time wed complain but we still have pictures of the notes. I was fired after threatening to go everyone's head , do I have a case.

    Hi I am a disabled person who was discriminated on under title 7 and the at how can the EEOC help me in finding a issue of notice of right to sue I been though the initial video conference and was just wondering because they did not find evidence yet of anything does that mean that I will be able to get a notice of right to sue in the end what is the outcome here?

    Is mediation on handling employment law are negotiation between mediator and other side employers with your attorney why my attorney didn’t allow me to be present or passed down what was discuss just to get a call about the only offer that was provided.

      Your attorney did not allow you to attend mediation? Are you saying you were split into two different rooms or that you were not allowed at mediation at all?

      @@JobAttorney yes, had mediation check in on Zoom video call, was told it be resume and was just set waiting online mid way thru mediation was told they be taking a 10-15 break request if there was any updates at time mentioned Requesting would like to be involved in the negotiating mediation resume and continue to be kicked out from conference room . No agreement o offer was done after two weeks there’s a settlement but is low attorney recommending to take it . Sounds like he want it to be over no effort to continue

    It seems to me that in a city like New York your best option, with all the "wokeness" in that area, would be to go to the media with your story. That would surely get your employers attention!
