      He rubbed me the wrong way immediately when JM asked if he lives there, and his was like "How does she know I'm not there? Is she spying on me?" Sounds like it was pretty obvious he wasn't around if his dogs were constantly walking around unsupervised.

    Defendant shouldn’t even have those dogs if he’s never home. Obviously the brother isn’t taking care of them or keeping an eye on them.

      yea they are left in the yard alone all day so trying to go off and make their own fun. cant really blame dogs for doing what dogs do and without a lot of human interaction they are acting more as pack animals

    I do not understand how Animal Control felt they did not have enough proof if she was able to leash the dogs and they had blood on them. And this Defendant should not even have animals if he has the type of job he stated and is hardly even home or gone for such long periods of time. Obviously, his brother, who lives there is not doing a great job.

      Animal Control is part of police departments.

      you'd be surprised at what animal control deems sufficient. the people who lived behind me at first had 8 hunting dogs in an elevated cage, excrement throughout it, animal control was called out several time because of incessant barking, then some time after they were taken out of the elevated cage and given 5 gallon buckets with hay in them to sleep on. Once again animal control says everything was fine. the barking continued and more neighbors complained. the next door neighbor called a tv station and they came out and did a story, I was one of the many neighbors who complained. WHen the animal control guy came back out and then was interviewed by the tv crew he stated that no one had every complained about the dogsbefore,

      It could have been coyotes that did it like he said. And his dogs came over and saw the dead animal and raw meat and came over to eat.

    That defendant has no remorse and obvious no heart. No emotions towards a death of a pony. The Plaintiff was not prepared. She should have gotten the receipt of the fence and also a quote for a pony. This is just so sad, poor pony.

      @@thatlisagirl71 Not a chance. The husky would have kept the coyotes at bay, and they wouldn't attack an animal as large as a pony. It was 100% the dogs found in the yard covered in blood.

      @thistles, huh? A family member horse was attacked on two separate occasions by a pack of Coyotes. The horse didn't survive the second attack. The dogs on the property alerted the owners and that's how they knew it was Coyotes

      The horse was her personal responsibility to make sure the fence was adequate to prevent a neighbors dog from getting in or her hose from getting out. If you aren't going to provide that, then you shouldn't have an animal. She failed to. If there is no city or county ordinance that says he has to keep his dogs chained then why would she build a weak fence and take a chance of some animal getting at her horse. And if there's an adequate fence, why should he need to chain up his dogs?

    Someone commented that the defendant lacked compassion as a firefighter (wildfires, not civic). Not so strange. It pays very well, high profile, and is a preferred profession for narcissists, as they get massive attention and live on the edge, an enormous ego boost. IMO

    I live out in a rural area where people have a lot of land, and some have livestock, and all I can say is that most folks out here wouldn’t have hesitated to shoot both of those dogs, had things really happened the way she says they did. Either way, that guy sounds like an irresponsible pet owner, and he needs to take better care of his animals, or relinquish them to good homes where they will be properly cared for.

      I agree that the dogs would have been "taken care of" if they were actually vicious. Boxers aren't big. And if the dogs were getting under the fence, coyotes definitely could have. I think the pony got attacked by coyotes, and the dogs smelled it when they came outside. They got over the fence, and took a bite.
      But for the husky to have superficial damages tells me there wasn't a huge fight over the pony.
      Also, a husky in the desert is just rude. Also, they're not really livestock guardian dogs. So that seemed fishy to me that she would have a husky as their LGD.
      She also said that ponies live to be 40. But their lifespan is really between 20-30 years.
      She conflated a lot and took advantage of the judge not knowing much about the subject.
      The guy definitely needs to be held accountable for his dog's getting out at all, though.

      Exactly this. Those dogs were not a threat. Coyotes killed the pony and the dogs probably helped chase them away.

      @@deanwinchesterinthedarktower I think you are overestimating the size of coyotes. They aren’t wolves. Not much bigger than boxers and they weigh less, especially coyotes that live in desert regions. Of course a pack of coyotes could take down a pony. But why would they not eat almost any of it. They have very sharp teeth and would have pulled away much more flesh. The muzzle of the horse looks chewed on.

    She wasn't "spying on him". Most people can tell if a neighbor is home or not. The lights aren't on, their cars aren't around, etc. Plus, this idiot leaves his dogs in 100 degree heat! What are they to do when the water runs out(I don't think the brother is really taking care of them)? There is something about the Defendant that is just not right, I can't put my finger on it.

    Defendant has this excuse, "I was never there, but I lived there. Then the dogs were moved into the Media backyard, and then another park of the backyard. And with no shelter and no water or food."

    Defendant is awful. He couldn’t care less. He’s also a crap dog owner. Leaves them out in the yard. Plus, I don’t understand how he would not be responsible for half of the fence? Isn’t he legally obligated to contain his dogs? The previous fence wasn’t containing them

    Animal control is useless! Shame on them! My dog on a leash was attacked by a neighbor dog that jumped over his fence! Animal control in San Diego did NOTHING but take a report! They are overpaid!

    A pony named Sugar Puff lived in the UK & reached the age of 56 by the time he had to be put down due to health issues, in May of 2007. Wikipedia describes a boxer as a medium-to-large German breed of Mastiff "with a powerful bite, ideal for hanging onto large prey".

    To the question of whether two Boxers can kill or mutilate a pony 🐎 the answer is an absolute YES! I actually witnessed this as a child when the neighbor's Boxers came into our pasture and killed one of our goats and a pony. 😭
    Decades later, my father-in-law was attacked in his own yard in Yuma. There is no animal control in that area and the Sheriff's Office refused to do anything. Those two dogs came really close to killing my elderly father-in-law and would have if my mother-in-law hadn't come out looking for him.

    WHAT? Why is he not responsible for the fence? He is responsible for retaining his dogs on his property and if he doesn't want to put up a fence, then he should pay for at least half of the cost of the new fence that she has had to put up. And even if she fed 'his' dogs it doesn't mean that would encourage them to come on her property to attack (and kill) her pony...

    Absolutely Boxers can kill a pony. There are several cases of them doing so. Boxers are an aggressive and dominant breed. And those pictures of the dogs don't show "friendly" animals. I've had neighbors with boxers, while living in rural areas as well as the city. I always am on high alert when walking my dog with a boxer in the area.

    Sorry I feel the judge was wrong on this one. You have three large animals dogs that killed….. a horse?!?? that’s dangerous because it could be a small kid next time. Plus this guy said he’s gone for long stretches and can’t take care of them?? You can’t put a pallet and think that’s going to fix a problem. I have 1 Chihuahua and I have to be there every day… with food, clean water and walks. I I can’t imagine someone with FOUR dogs just taking off like that “for long stretches”. And him not paying for part of the fence that can hold a chihuahua back? come on!! she even said that fence is bad.

    I'm glad the plaintiffs were able to obtain some compensation for the loss of their beloved pony. My heartfelt condolences to them. I'm appalled at the arrogance of the defendant, especially given his professional occupation.

    Ponies generally do not live to 40; even 26 is old age.
    She’s exaggerating wildly about the pony’s value because she does not approve of how her neighbor cares for his dogs. She may have a point, but sticking to the truth and using hyperbole to shine up a claim is distasteful.

    The couple ought to feel a sense of shame for possessing numerous animals without providing a proper enclosure to ensure their safety. It is distressing that the poor pony had to suffer due to their inability to adequately care for and protect their animals. The defendant, too, should experience a deep sense of shame for failing to exercise control over their animals, as this negligence has tragically resulted in the death of an innocent pony.

      @@oldageisdumb Yes, it's not her responsibility to contain her animals BUT between feeding the dogs which entices them to come over, as well as not doing anything to prevent them from getting in, she failed to protect her animals. She knew the dogs were dangerous and were getting in and she took absolutely no action to block the fence or the holes they were using. It's the same with a dead tree that overhangs your property, even if the tree isn't in your yard, if you know it's a dead tree, you have the option to have that limb removed and if it falls and breaks something, that's because of your own inactions. Yea, the defendant was a dick but the plantiff also never took any action; she's not guiltfree.

      That would’ve been proof. Blood on the dogs. I didn’t know that breed was vicious but I would not have awarded the plaintiff anything without more proof. Like defendant said they live in the desert. Coyotes or something else could’ve done that damage to the horse especially if dog and horse were used to each other.

    If you have horses, and dogs, it is your responsibility to keep them safe with a strong fence that other animals can't dig under. The best way is to install a strong fence and pour a concrete wall several feet deep on your side of the fence to prevent animals from getting under your fence by digging. And be sure to keep your fence in good, strong, condition.

    I actually disagree with the judge. Any animal is the responsibility of the owner to ensure it's under control. The pony owner was silly not to bring proof of the costs she was claiming, but she was also silly to not sue him based on his lack of control of his dogs. He was responsible for the dogs, he should have been made to pay for the whole amount of the fence.

    A Welsh pony costs, at a minimum, $5000. This price can increase by tens of thousands depending on age and training. This was a personal loss for the plaintiff regardless of cost. The defendant seems unmoved by the whole ordeal. The dogs killed the pony and the defendant feels no compassion whatsoever.

    I feel she should have been awarded the cost of the fence. If it wasn't for his inability to contain the dogs within the secure area, the dogs wouldn't have been a risk. Ongoing they could get to her, or another pet so she needed that fence, it wouldn't be a choice but a necessity. I would have made him pay the lot 😊

    First off, I didn't hear anything about any violence from the dogs before the pony attack. It seems that's a good reason to not be terribly concerned.
    That pony being trained the way it was was worth much more than $1000.
    As far as guilt goes.... She found the dogs there at the scene covered in blood. Pretty damning evidence in my book. Wish she had taken pictures. But I'm sure she was more concerned about her pony and dog than a future court case.
    Someone else mentioned the income loss from losing the trained pony. Good point.

    While I feel bad for the plaintiff there are hundreds of ponies in every state that are free. So many people buy ponies for the kids or grandkids only to ride once, realize they are too much work and not that much fun and then they will give them away. I live in the country and have actually helped rehome 3 in my life for that exact reason.
