I believe op is referring to the VA not rating claims correctly the first time, which leads to appeals, and appeals tend to be time consuming for the VA adding to the backlog.
Couldn’t agree more. The VA ties to give you the lowest rating possible in hopes you won’t appeal or they just deny it outright even though you have all the evidence

That's the rule that age is not to be considered in service connected conditions (www.ecfr.gov/current/title-38/chapter-I/part-4/subpart-A/section-4.19)....I wonder if that is really happening.
@ in my experience they blow smoke up your ass and day they are working on it. When I got a good VSO they were able to pull out legalities in the system that pushed things along almost magically! It’s like having a lawyer in a court room that know the laws vs representing yourself.

Yes, but when they ask for paperwork they already have and use it to start a whole new claim identical to the one they've had DTA, then they can say that they don't owe for those 2 years. That's what's happening to me.

@macdaddy2727, I don't know, but there are a couple things about your comment that might be red flags. The big question is: "Did the claim actually get submitted?" In most cases, the person making their claim mails the paperwork to the Veteran's Administration. But in the Commonwealth of Virginia, there is an electronic option for submission. I was just speaking to my co-worker about this very topic this morning. There is no rhyme or reason why some BDD claims hit the VA the next day and others take a month or two. I can say the VA has received your claim successfully, now we are just waiting for them to uploaded your BDD claim. Your claim will be considered a BDD claim because it was successfully received in December 180-90 days from retirement. I check on it every week to see if it has been uploaded. I do apologize for the delay, but we are just waiting on the VA to do their part, you/we did our part successfully. Thank you and stay safe this weekend we are supposed to get more snow."
Thank goodness the VA changed my BDD to a regular base claim..now I get to wait an extra 12-24 months for my claim to be approved! Yayyyy! 🍻🥳 300 days and counting…😃
C&P contract companies “holding DBQs in QA” forever doesn’t help either. It prevents VA from timely adjudication as well. 148 days and counting with that issue for my claim
That's an interesting point...you're saying that the C&P company's response time factors into this time line. Should have been obvious to me and I'm glad you pointed that out.

My wife died on July 14, 2024. VA changed to step 2 on August 1, 2024, and it is still step 2 today January 8, 2025. There is debating she died, I sent them the death certificate in July 2024. What is their problem? I called them to complain and they told me they are working on it!
I finally moved to step 6 today Jan 14. I was in step 5 for 3 months. It only took maybe a month to go from step 1-4 all in September. Then stopped at 5 till I called and said it was causing a hardship otherwise it would probably still be in 5.
That seems pretty par for the course. I'm not sure I'd get worried yet. And it seems like all of you submitted your claims just before the beginning of the holiday season.

Question about HLR.. Is it normal to have multiple C&P Medical Opinion review only exams during the process? I’m on my second Med review now. Has anyone else experienced this?
@@coribanks4847 I had this happen to me for Sleep Apnea. They delayed decision after 1st C & P, then ordered a 2nd C & P. It went in my favor, but took 7-8 months to adjudicate.
You know...I haven't paid much attention to their "accuracy" numbers, but you raise the issue that even if the errors are not intentional, they have an impact on the delays vets experience.
@@the_bureaucrat You don't have the experience I have dealing with the VA.Have ever filed a VA claim before if not you have no idea how the VA operate.Talk to Vets have there claims delayed an denied you have a lot to learn how the VA Operate.Something else you missed remands back to VA from the Board.You have a lot of reviewing to do .Depending on the VA Website you will always get it wrong.
My claims last year were submitted on 7 March and completed on 10 December. So, mine took over 9 months. Now, I had a couple of supplemental claims that processed fast.

IF I had a do over, I would have filed for 1 or 2 conditions at a time. The way it went, I had six C&P exams and two of them were really duplicates. They fought EVERY condition that I was clearly diagnosed with.. but in the end, verified all but one, which I requested a higher level review. They also misclassified my main nervous system condition (dysautonomia), which I appealed.
Plus, when they give you an average, you never know what the real distribution of wait times is...there might be dozens of people getting finished in 1 day...so the average looks good.
If they did it correctly the first time there wouldn’t be near the backlog.

Have you filed with an accredited VSO (veteran service officer) like the American Legion?

The only consolation is that the effective date of any payments will be backdated to when you submitted your claim.

I'm a bit curious if a claim with lots of conditions moves slower than several claims with fewer conditions.
