Great video!! I was just approved for the borrower defense (sweet VS cardona)! $65k to be discharged! BLESSING! I do still have $35k in private loans (Sallie Mae but now Navient) as I ran out of FAFSA funds. Anyway to get those discharged as well? Any information would be greatly appreciated!

As for private loans, unfortunately federal loan forgiveness only covers federal loans, not private ones. 🙁 If they are a hardship, and I'm not necessarily recommending this course of action, just informing you it is an option as many people don't know this, you may be able to have them discharged through bankruptcy - see this article for more details (www.consumerfinance.gov/about-us/blog/busting-myths-about-bankruptcy-and-private-student-loans/) and speak with a bankruptcy attorney to learn what would be best for you. I have FFELP loans in illinois and I went to school on the 90s. Found out a few years ago, the school I went to closed because it defrauded its students. When I look at my loans in their app or website it says FFELP but if I talk to someone from navient, it's private loans so I was not given a break on payments during the pandemic. I feel like I am screwed by the at every turn with no relief. I have complained to the state attorney and navient blatantly lied to them. I just so frustrated and broke.
Hi @kimekitty - I'm so sorry to hear of your plight. That sounds *incredibly* frustrating. I guarantee you aren't the only one dealing with this kind of BS. If they are still federal loans you would see them in your account in studentaid.gov. Try logging in there to see if they are still federal. Hi, I attended the art institute of Tennessee: Nashville from 2011 to 2013. The school was shut down for fraud several years ago (2015ish?) I still owe 15k and I have been struggling to afford anything since. What can I do? The school doesn't even exist and student loan fraud is exactly why. It was previously in forbearance via the phone call you are talking about but over the years the loan has been transferred several times with no notification on who they were even transferred to. There's now 4 separate overdue reportings on my credit that are completely running it into the ground.

Luckily (sort of) for you the art institute schools were named as some of the worst offenders for misconduct and the government may be able to have your loans discharged through Borrower Defense to Repayment. I checked the Student Aid website and found this: "On Aug. 7, 2023, a federal court issued an injunction delaying the effective date of the latest regulations governing borrower defense and closed school loan discharges until at least November 2023. The Department will not adjudicate any borrower defense applications under the latest rule unless and until the effective date is reinstated. While this injunction is in effect, borrowers may still apply online for borrower defense relief. The Department will continue to adjudicate borrower defense applications using an earlier version of the regulations where required under a court settlement. The Department will provide additional updates here when there are further developments." - studentaid.gov/manage-loans/forgiveness-cancellation/borrower-defense It looks like the Dept of Ed is encouraging applications but it may be a while before they're processed. Mine originated with Sallie Mae in 2009; then Navient in 2014; then Federal Student Loan Services. Payments were delinquent and put into forbearance for the last five years. How do I find out if my original loan was a subprime student loan?
Hi @David Ramirez! If you qualify for the Navient suit they'll contact you. To be subprime you would have had to have a credit score below 640 at the time. Good luck - I hope you get your loans forgiven!
They steered me into forebarance twice when I was working making about 21,000 annually, then when I was terminated I was receiving unemployment they had me pay $5 monthly, I paid that until my unemployment ran out they only give you six months on the income based repayment that ran out at the top of 2021, I was bout 8 months behind, n they put me bk n the income based repayment in April 2021. N my original loans were through Sallie Mae which they have no record of any payments I've made so the loans total around 55,000. What's my options?

As I understand it, Sallie Mae's student loans got transferred to Navient, then five years later, Navient's loans got transferred to Aidvantage. It's dumb and confusing. Ok so here’s my wife and I’s deal. We meet EVERYTHING on the Navient private loan EXCEPT the for profit school. However my wife did attend a trade program at a college/school but the program is nonexistent now. But all else applies to us. Would this slight difference disqualify us?

Doo you know anything about private loans through Bank of North Dakota that funded tutition for Wyotech? My son has a private loan through B of ND from when he went to Wyotech from 2013. B of ND is suing us for this money and I'd like to try to stop it.
Hi @Antoinette Correia - The *federal* student debt from Wyotech was forgiven by the Biden administration, but that only covers *federal* loans, not private. So, am i understanding... If i was guided to the forbearance plan versus income driven plan... Which would have been way better and helped me not accrue as much interest, i might get a check for meesly $260? Being guided into forbearance led to drastically accumulated interest 20 times more than $260! So Naviant still profits from scamming us.

It's horrible that someone moves out of a state. I moved overseas because I can't afford to live in the us. Shouldn't it only matter where you attended the school, not where you are currently living

I had no clue my naviant loan wasn't government and was private. I was so misled during my consolidation. I've been with them since they were sallie may. Last summer i assumed my loan interest and in payments were frozen with the cares act. When i called abed they said no. There are 2 lenders named Naviant. One is gov. and this is one is an LLC and it is not covered. So last summer I moved them over to Great Lakes which is government lender. If i had qualified meeting the 5 things listed- will i still get them deleted? Am i out of luck ???

On my Navient account, it reads that Ascendium Education Solutions paid my on 19Apr 2022. My loans were the subsidized & unsubsidized Stafford Loans from Devry. Was Navient allowed to do that?

I doubt they cancelled mine. I was told by my school I had to pay Salliemae/Navient since day one. It's a private loan and I always had it on auto pay so I'm almost done but would be nice to cancel the last few payments. I've had my loans since 2002 and been paying on them since 2002, so yeah.

I’ve done some digging for you and according to this Yahoo report from about six months after this video was posted, Westwood is now on the Borrower Defense list - meaning if you attended between 2002 - 2015, and meet some other criteria, you can apply for Borrower Defense and get loans discharged!! I went to a for profit college by the name of Everest Institute a Corinthian college. Some of my school loans were partially discharged through the borrowers defense however the rest of my loans are what they call a FFELP or FFLP through navient. I tried contacting a lawyer, several and no one can help. I have contacted Navient and they've told me to contact the new loan servicer taking over Navient, aidvantage and aidvantage can't provide any information. I have also contacted federal student aid and they tell me to contact my loan servicer Navient. I'm so confused, frustrated and extremely depressed about this. I just want to know if I can get the rest of my loans discharged or forgiven? I cannot apply for the PLSF because I never worked in public service. If you cannot help can you please advise me on whom to contact?! I'm in need of desperate help!

Hi, I've been looking into this. I feel completely lost and not sure what I'm doing. I don't know what direction to go. I haven't received a letter but I believe if i remember correctly I started in 2014. I was with Steven Henegar- independent university. Ok, I applied for narrower defense discharge back in 2015. In 2019 I received a letter stating that because it took so long for them to make a decision that they cancelled about $22k in interest charged. Can I still apply again for the borrower defense discharge?
I wasn't so lucky, they denied me because I didn't file a lawsuit or take legal action?!? I thought that's what the Borrower defense act/application was supposed to do for me!

question i went to a local technical school in 2010 after a month it was bought by kaplan i was supposed to be charged 10k (federal loan ) i ended up with a 6k loan because I didn't finish my question i did end up paying the loan do i get something back ?

With the private loan and the complete forgiveness, if my Navient loan was just sold to Aid Adantage within the month, if my loan was with Navient during that time frame it should still qualify correct?AND also, with the address on file, how does it work in regards to moving due to being a military spouse? Currently the state that I am currently residing in as well as the one that I was in prior is not on the list, but we are military. TIA!
Hi @leree white! Your loan going to Aidvantage shouldn't affect whether or not you get the settlement. Here's what I was able to find, according to the settlement website concerning the private loan cancellation, "Generally, to qualify, the borrower’s mailing address on file with Navient as of June 30, 2021, must be within one of the restitution-participating states listed above, Arkansas, Kansas, Michigan, Rhode Island, South Carolina, Vermont, West Virginia, or associated with a military address postal code." This Navient settlement isn't a program you apply for, if you were eligible they would have tried to contact you last summer. According to the CFPB, if you're having trouble repaying a private student loan "you should contact your lender or servicer as soon as possible. Hello, thank you for the info. Quick question, my loans with Lincoln Tech were about $8,000 right now I owe according to navient $40,000. I have been dealing with them first years but they always gave me grief about lowering key payments big stop paying my loans for may years so every few years they will roll me in forbearance. I am currently paying but the balance never goes down.

Hi @Adam V - because this was a case brought by the individual states and not a federal case, then only the states listed are part of the settlement. If you lived in Utah as on June 30, 2021 then you wouldn't qualify for the total loan forgiveness, if you lived lived there Jan 2017, then you wouldn't qualify for the federal loan check. Question My original loan was through sally may then they transferred to Navient. However the school I went to was Apollo university of phoenix. My loan was never delinquent but I did have my loan in a forgiveness program the barrow defense program its been there for 8 years with no payments. Do I qualify ? I do live in Illinois also will it be erased ? my loans were taking out 2006 through sally may I got finical aid and had to take a loan out for the rest through sally may I do see my loan on federal student aid is that a federal loan or a private ?
Hi @Elizabeth Jones! Sounds like you have a bit of a complicated situation. The Borrower to Defense program discharges some or all of your student loans, so I don't know why it would still be there 8 years later. Sounds like you need to call the Department of Education and get that cleared up to find out what's going on with your loan. As for the Navient settlement, you'll hear from them by July if you're eligible. When you log into studentaid.gov, it only shows federal loans. Hi @Elizabeth Jones - - If I'm understanding you, you took out federal loans to attend U of Phoenix. 8 years ago you applied for Borrower to Defense to discharge these loans. In the past 8 years you haven't paid on the loans but they also haven't been discharged. They're just in loan limbo. If the loans are in the process of getting discharged through BtD, i don't know if they would be part of this settlement - they might, they might not because of their odd status. I can only recommend calling the Department of Education and getting a straight answer through them as 8 years is BONKERS long to wait! received attorney generals letter for qualification, early days paid the first half of the loan off all of it should have been grants anyway, major headache, heart attack and disability left me in a place where ill never be able to replay any of this anyway. I have a Private Student Loan with Navient (Tuition Answer). I started attending Nova Southeastern University (For-Profit institution) in Ft. Lauderdale, FL in 2007 - 2008. I was told that I needed to get a loan from Sallie Mae KNA Navient along with a co-signer because my credit score was low and did not meet their criteria. So I secured a co-signer, my son. I’ve never been late on my student loans because they are on Auto Pay. I’m originally a resident of Florida until November 2020 and now reside in Texas. I retired in January 2021 due to my preexisting conditions of Covid-19. I’m now disabled. What are my options for discharging Private Student loans due to disability? And my Co-signer if I’m granted a discharge?
Hi @Latanya Sanders - I’m sorry to hear you’re still paying off these student loans and you’ve had to retire due to disability ❤️. You’ll need to speak with your student loan servicer to find out what options you have for private loans. Unfortunately student loan forgiveness is only available for federal student loans, not private. A lot of people confuse having a private company as their student loan servicer with having private loans (understandable- it’s super confusing) I’d double check that they are indeed private by logging into studentaid.gov and looking at what loans it says you have. If your loans appear on that site it means they are federal, in which case there is forgiveness if you can prove total and permanent disability (more info here: studentaid.gov/manage-loans/forgiveness-cancellation/disability-discharge). How is it possible people were in past due status when payments were frozen since 2020? Were past due statuses carried over from 2019 & early 2020 although student loan payments were frozen?

If you aren't in past due status and your loans are held by Navient, it sounds like you have federal loans with them. You can check if you have federal loans at this website: studentaid.gov Otherwise, whoever holds your student loans should be listed on your credit report which you can get for free here: www.annualcreditreport.com/

I have an address on navient from CA so I qualify there.. but now I live in TX. My mom still lives there but if I change my mailing address to TX will I not qualify anymore since TX doesn’t qualify?

Hi @Millennial Art - From the website "The private loan debt relief will primarily go to borrowers who took out private subprime student loans (made to borrowers with low credit scores) through Navient’s predecessor, Sallie Mae, between 2002 and 2014, and then had more than seven consecutive months of delinquent payments prior to June 30, 2021." so it would seem you do not. HOWEVER, this is a simplification; the settlement is complicated and you may still qualify under another part of the settlement. Navient will contact you by July if you are eligible.
I also thought I would qualify for this settlement. I attended a For-Profit School, ITT Tech, I'm in a qualifying state, Florida, I received a sub prime private student loan from Salle Mae now Navient in 2007, and I was in "Past Due" status for like 8 consecutive months in 2016 - 2017 BUT because I was able to make a payment as some point..... I no longer qualify per Navient. :( ridiculous. I read a Court Document that stated "In order to qualify for Categories 1 through 3, below, a private education loan must be charged-off as of the Debt Relief Forgiveness Date (“Past Due Status”); and (1) have reached Past Due Status no more than seven years prior to the Debt Relief Forgiveness Date, or (2) be within the applicable statute of limitations based on the borrower’s last known address as of the Debt Relief Forgiveness Date." So I guess the loans had to be charged off to be considered, not Active loans. I don't know. It's all very frustrating.

What stinks is that in 2025 I will finally pay my student loan off which I have had since 2005 with them. First 7yrs. was a struggle and I worked my butt to make sure I paid my loan on time every month. Now with COVID is has been a struggle again but I’m making sure I don’t miss a payment. I wish I could get my last few years paid off, but I don’t qualify for any assistance I’m aware of. I do feel feel sorry for those who were wrong. But at the same time I’m tired of making just a little to much for assistance and still struggling.

Do you know if the Navient Tuition Answer loans (private loan) are included in the forgiveness? My loan has been in default since 2018. I had a low credit. And it was in 2007. But I didn’t attend any of those schools

I got my loan since 2005 or 2006 and have been in delinquent years after on and off. In 2021, I have been put on forbearance and is not on charge off status. Will I still be qualified?

For the private loan cancellation, the closest I can find is it says the loan had to be taken out with Sallie Mae/Navient between 2002 and 2014 but it doesn't mention when the loan had to be serviced by. Yeah I get booted out of this one too. I have always paid when required and when not required (during school and during this pandimic). I have never, other than during this had a forbearance. The only thing she mentioned that pertained to me was University of Phoenix and loans between 2002 and 2014. Seen someone comment the other day that when us ethic people follow the rules we get screwed, and those who do as they please and make no efforts win. Starting to think they are right cause I am stressing to no end about my $1244 student loan payment I will have come May. And I have even paid off around $40k over the yrs inschool and out. Bout to pay off a 3rd on next month since this pandemic. The interest rate hurt me so bad when they put me on the income driven and I could not afford to pay much extra.

I just got a pending litigation review letter from Navient. I set my loan up in 2008 when I was 19 with Sallie Mae, when I had no idea what it would mean for the rest of my life. I am still waiting to hear from them, hoping they wipe it out.

I just came across your video, thank you so much, I’m trying to figure out what steps I need to take to get my loans with Naviant (original with Sally Mae) forgiveness started, I graduated in 2005, but I’ve been in both “income based repayment” which was zero with 3 kids… and I’ve been in forbearance… I believe this should be forgiven since ITT tech closed, the credit are not recognized/transferable… but who do I take this up with? Hi @Alaric Karczag - What kind of loan forgiveness you qualify for depends on many factors. It sounds like you could be part of the Navient settlement, in which case they'll contact you within the next two months. Although you went to ITT tech, you had to leave without a degree after 2008 to get your loans forgiven so that particular settlement won't work for you. BUT you may be able to get forgiveness through the Borrower Defense program or Income Driven Repayment, depending on the plan you're on you'd have your loans forgiven in 20 or 25 years after you started paying. Hi @Alaric Karczag - since Navient knows much more about your situation, they would know better than me what you should do. If your loans are federal loans, then consolidating them with the department of education would allow you to benefit from the current pause on student loan payments. I don't know how it would affect IDR forgiveness. It sounds like your next step is to call the Department of Education to find out what consolidating with them would do for you and what your options are. I wish I had an easy answer for you!! There is a Total and Permanent Disability Discharge (studentaid.gov/manage-loans/forgiveness-cancellation/disability-discharge) you may be eligible for. You can contact the Department of Education and talk to them to find out about your specific case and/or you can contact your student loan servicer. I met all of requirements minus the seven consecutive months (I was in bankruptcy at the time, and Navient says it does not qualify as a default) therefore the $70k in Private Loans I still owe, will be the death of me forever. =\

The organization that comes to mind when you ask for someone to help you is the National Foundation for Credit Counseling, they're usually very cheap or free to talk to. I have FFELP loans in illinois and I went to school on the 90s. Found out a few years ago, the school I went to closed because it defrauded its students. When I look at my loans in their app or website it says FFELP but if I talk to someone from navient, it's private loans so I was not given a break on payments during the pandemic. I feel like I am screwed by the at every turn with no relief. I have complained to the state attorney and navient blatantly lied to them. I just so frustrated and broke.

Hi, I attended the art institute of Tennessee: Nashville from 2011 to 2013. The school was shut down for fraud several years ago (2015ish?) I still owe 15k and I have been struggling to afford anything since. What can I do? The school doesn't even exist and student loan fraud is exactly why. It was previously in forbearance via the phone call you are talking about but over the years the loan has been transferred several times with no notification on who they were even transferred to. There's now 4 separate overdue reportings on my credit that are completely running it into the ground.
Hi @Brandon Walker - I’m sorry to hear student loans have been dragging your credit down. Luckily (sort of) for you the art institute schools were named as some of the worst offenders for misconduct and the government may be able to have your loans discharged through Borrower Defense to Repayment.

"On Aug. 7, 2023, a federal court issued an injunction delaying the effective date of the latest regulations governing borrower defense and closed school loan discharges until at least November 2023. The Department will not adjudicate any borrower defense applications under the latest rule unless and until the effective date is reinstated. While this injunction is in effect, borrowers may still apply online for borrower defense relief. The Department will continue to adjudicate borrower defense applications using an earlier version of the regulations where required under a court settlement. The Department will provide additional updates here when there are further developments."

Mine originated with Sallie Mae in 2009; then Navient in 2014; then Federal Student Loan Services. Payments were delinquent and put into forbearance for the last five years. How do I find out if my original loan was a subprime student loan?
Hi @David Ramirez! If you qualify for the Navient suit they'll contact you. To be subprime you would have had to have a credit score below 640 at the time. Good luck - I hope you get your loans forgiven!

They steered me into forebarance twice when I was working making about 21,000 annually, then when I was terminated I was receiving unemployment they had me pay $5 monthly, I paid that until my unemployment ran out they only give you six months on the income based repayment that ran out at the top of 2021, I was bout 8 months behind, n they put me bk n the income based repayment in April 2021. N my original loans were through Sallie Mae which they have no record of any payments I've made so the loans total around 55,000. What's my options?
Hi @Donna Clay - Sallie Mae losing the record of your payments is not unusual at all 😠. They are going to do a recount of your payments which will show on studentaid.gov beginning next year.

As I understand it, Sallie Mae's student loans got transferred to Navient, then five years later, Navient's loans got transferred to Aidvantage. It's dumb and confusing. Ok so here’s my wife and I’s deal.
We meet EVERYTHING on the Navient private loan EXCEPT the for profit school. However my wife did attend a trade program at a college/school but the program is nonexistent now. But all else applies to us. Would this slight difference disqualify us?

From the website "The private loan debt relief will primarily go to borrowers who took out private subprime student loans (made to borrowers with low credit scores) through Navient’s predecessor, Sallie Mae, between 2002 and 2014, and then had more than seven consecutive months of delinquent payments prior to June 30, 2021."

Doo you know anything about private loans through Bank of North Dakota that funded tutition for Wyotech? My son has a private loan through B of ND from when he went to Wyotech from 2013. B of ND is suing us for this money and I'd like to try to stop it.
Hi @Antoinette Correia - The *federal* student debt from Wyotech was forgiven by the Biden administration, but that only covers *federal* loans, not private. If you are part of the Navient settlement I don't know why you'd need to pay $2,000 but there is A LOT of information I'm not privy to concerning the details of your loans. If i was guided to the forbearance plan versus income driven plan... Which would have been way better and helped me not accrue as much interest, i might get a check for meesly $260? Being guided into forbearance led to drastically accumulated interest 20 times more than $260! So Naviant still profits from scamming us.

It's horrible that someone moves out of a state. I moved overseas because I can't afford to live in the us. Shouldn't it only matter where you attended the school, not where you are currently living

I had no clue my naviant loan wasn't government and was private. I was so misled during my consolidation. I've been with them since they were sallie may. Last summer i assumed my loan interest and in payments were frozen with the cares act. When i called abed they said no. There are 2 lenders named Naviant. One is gov. and this is one is an LLC and it is not covered. So last summer I moved them over to Great Lakes which is government lender. If i had qualified meeting the 5 things listed- will i still get them deleted? Am i out of luck ???

On my Navient account, it reads that Ascendium Education Solutions paid my on 19Apr 2022. My loans were the subsidized & unsubsidized Stafford Loans from Devry. Was Navient allowed to do that?

I doubt they cancelled mine. I was told by my school I had to pay Salliemae/Navient since day one. It's a private loan and I always had it on auto pay so I'm almost done but would be nice to cancel the last few payments. I've had my loans since 2002 and been paying on them since 2002, so yeah.

I’ve done some digging for you and according to this Yahoo report from about six months after this video was posted, Westwood is now on the Borrower Defense list - meaning if you attended between 2002 - 2015, and meet some other criteria, you can apply for Borrower Defense and get loans discharged!! I went to a for profit college by the name of Everest Institute a Corinthian college. Some of my school loans were partially discharged through the borrowers defense however the rest of my loans are what they call a FFELP or FFLP through navient. I tried contacting a lawyer, several and no one can help. I have contacted Navient and they've told me to contact the new loan servicer taking over Navient, aidvantage and aidvantage can't provide any information. I have also contacted federal student aid and they tell me to contact my loan servicer Navient. I'm so confused, frustrated and extremely depressed about this. I just want to know if I can get the rest of my loans discharged or forgiven? I cannot apply for the PLSF because I never worked in public service. If you cannot help can you please advise me on whom to contact?! I'm in need of desperate help!

Just last month the Biden administration announced that anyone who attended a Corinthian college (including Everest), more than half a million people, is getting the balance of their loans discharged!!

Hi, I've been looking into this. I feel completely lost and not sure what I'm doing. I don't know what direction to go. I haven't received a letter but I believe if i remember correctly I started in 2014. I was with Steven Henegar- independent university. I'm lost on how to do this. does anyone have any suggestion on what I need to do. like step by step or can anyone else help me. Ok, I applied for narrower defense discharge back in 2015. In 2019 I received a letter stating that because it took so long for them to make a decision that they cancelled about $22k in interest charged. Can I still apply again for the borrower defense discharge?

With the private loan and the complete forgiveness, if my Navient loan was just sold to Aid Adantage within the month, if my loan was with Navient during that time frame it should still qualify correct?AND also, with the address on file, how does it work in regards to moving due to being a military spouse? Currently the state that I am currently residing in as well as the one that I was in prior is not on the list, but we are military. TIA!
Hi @leree white! Your loan going to Aidvantage shouldn't affect whether or not you get the settlement. Here's what I was able to find, according to the settlement website concerning the private loan cancellation, "Generally, to qualify, the borrower’s mailing address on file with Navient as of June 30, 2021, must be within one of the restitution-participating states listed above, Arkansas, Kansas, Michigan, Rhode Island, South Carolina, Vermont, West Virginia, or associated with a military address postal code." Hi @Josephine Marie - I'm sorry to hear you've got a loan in default. You aren't alone! This Navient settlement isn't a program you apply for, if you were eligible they would have tried to contact you last summer.
According to the CFPB, if you're having trouble repaying a private student loan "you should contact your lender or servicer as soon as possible. You may be able to negotiate with your lender to set up a repayment plan or otherwise settle your debt."

Hello, thank you for the info. Quick question, my loans with Lincoln Tech were about $8,000 right now I owe according to navient $40,000. I have been dealing with them first years but they always gave me grief about lowering key payments big stop paying my loans for may years so every few years they will roll me in forbearance. I am currently paying but the balance never goes down.
Is this legal? Navient kept me in forbearance without my consent?

You may want to look into getting on an income driven repayment plan, it will base your payments on your current income and after 20/25 years the balance is forgiven. If you lived in Utah as on June 30, 2021 then you wouldn't qualify for the total loan forgiveness, if you lived lived there Jan 2017, then you wouldn't qualify for the federal loan check. Question My original loan was through sally may then they transferred to Navient. However the school I went to was Apollo university of phoenix. My loan was never delinquent but I did have my loan in a forgiveness program the barrow defense program its been there for 8 years with no payments. Do I qualify ? Hi @Elizabeth Jones! Sounds like you have a bit of a complicated situation. The Borrower to Defense program discharges some or all of your student loans, so I don't know why it would still be there 8 years later. Sounds like you need to call the Department of Education and get that cleared up to find out what's going on with your loan. As for the Navient settlement, you'll hear from them by July if you're eligible. When you log into studentaid.gov, it only shows federal loans. But yes, I did talk to the department of education and yes my loans have been sitting in the forgiveness program for 8 years because Apollo university phoenix did me wrong and they just have not approved my loan to be erased yet, So I am hoping this law suit can help get it erased. Hi @Elizabeth Jones - - If I'm understanding you, you took out federal loans to attend U of Phoenix. 8 years ago you applied for Borrower to Defense to discharge these loans. In the past 8 years you haven't paid on the loans but they also haven't been discharged. They're just in loan limbo.
If the loans are in the process of getting discharged through BtD, i don't know if they would be part of this settlement - they might, they might not because of their odd status. I can only recommend calling the Department of Education and getting a straight answer through them as 8 years is BONKERS long to wait! received attorney generals letter for qualification, early days paid the first half of the loan off all of it should have been grants anyway, major headache, heart attack and disability left me in a place where ill never be able to replay any of this anyway. I have a Private Student Loan with Navient (Tuition Answer). I started attending Nova Southeastern University (For-Profit institution) in Ft. Lauderdale, FL in 2007 - 2008. I was told that I needed to get a loan from Sallie Mae KNA Navient along with a co-signer because my credit score was low and did not meet their criteria. So I secured a co-signer, my son. I’ve never been late on my student loans because they are on Auto Pay. I’m originally a resident of Florida until November 2020 and now reside in Texas. I retired in January 2021 due to my preexisting conditions of Covid-19. I’m now disabled. What are my options for discharging Private Student loans due to disability? And my Co-signer if I’m granted a discharge?
Hi @Latanya Sanders - I’m sorry to hear you’re still paying off these student loans and you’ve had to retire due to disability ❤️. You’ll need to speak with your student loan servicer to find out what options you have for private loans. Unfortunately student loan forgiveness is only available for federal student loans, not private. A lot of people confuse having a private company as their student loan servicer with having private loans (understandable- it’s super confusing) I’d double check that they are indeed private by logging into studentaid.gov and looking at what loans it says you have. If your loans appear on that site it means they are federal, in which case there is forgiveness if you can prove total and permanent disability (more info here: studentaid.gov/manage-loans/forgiveness-cancellation/disability-discharge). How is it possible people were in past due status when payments were frozen since 2020? Were past due statuses carried over from 2019 & early 2020 although student loan payments were frozen?

Hi @Merv Charles - It's possible, but you would have been notified. Navient is a student loan servicer, so they can hold both federal and private loans. If you aren't in past due status and your loans are held by Navient, it sounds like you have federal loans with them. You can check if you have federal loans at this website: studentaid.gov
Otherwise, whoever holds your student loans should be listed on your credit report which you can get for free here: www.annualcreditreport.com/

Hi @Millennial Art - From the website "The private loan debt relief will primarily go to borrowers who took out private subprime student loans (made to borrowers with low credit scores) through Navient’s predecessor, Sallie Mae, between 2002 and 2014, and then had more than seven consecutive months of delinquent payments prior to June 30, 2021." so it would seem you do not. HOWEVER, this is a simplification; the settlement is complicated and you may still qualify under another part of the settlement. Navient will contact you by July if you are eligible.
I also thought I would qualify for this settlement. I attended a For-Profit School, ITT Tech, I'm in a qualifying state, Florida, I received a sub prime private student loan from Salle Mae now Navient in 2007, and I was in "Past Due" status for like 8 consecutive months in 2016 - 2017 BUT because I was able to make a payment as some point..... I no longer qualify per Navient. :( ridiculous. I read a Court Document that stated "In order to qualify for Categories 1 through 3, below, a private education loan must be charged-off as of the Debt Relief Forgiveness Date (“Past Due Status”); and (1) have reached Past Due Status no more than seven years prior to the Debt Relief Forgiveness Date, or (2) be within the applicable statute of limitations based on the borrower’s last known address as of the Debt Relief Forgiveness Date." So I guess the loans had to be charged off to be considered, not Active loans. I don't know. It's all very frustrating.

What stinks is that in 2025 I will finally pay my student loan off which I have had since 2005 with them. First 7yrs. was a struggle and I worked my butt to make sure I paid my loan on time every month. Now with COVID is has been a struggle again but I’m making sure I don’t miss a payment. I wish I could get my last few years paid off, but I don’t qualify for any assistance I’m aware of. I do feel feel sorry for those who were wrong. But at the same time I’m tired of making just a little to much for assistance and still struggling.

I got my loan since 2005 or 2006 and have been in delinquent years after on and off. In 2021, I have been put on forbearance and is not on charge off status. Will I still be qualified?

Does Navient have to currently be servicing the loans?
Hi @Michelle Murray! For the federal $260 check, the loan had to be serviced by Navient as of January 2017. For the private loan cancellation, the closest I can find is it says the loan had to be taken out with Sallie Mae/Navient between 2002 and 2014 but it doesn't mention when the loan had to be serviced by. According to the main website, "Generally, to qualify, the borrower’s mailing address on file with Navient as of June 30, 2021, must be within one of the restitution-participating states listed" This is because it wasn't a federal ruling, this lawsuit was put on by 39 state attorneys general, so only the people in those states get the loan forgiveness. Yeah I get booted out of this one too. I have always paid when required and when not required (during school and during this pandimic). I have never, other than during this had a forbearance. The only thing she mentioned that pertained to me was University of Phoenix and loans between 2002 and 2014.
Seen someone comment the other day that when us ethic people follow the rules we get screwed, and those who do as they please and make no efforts win.
Starting to think they are right cause I am stressing to no end about my $1244 student loan payment I will have come May. And I have even paid off around $40k over the yrs inschool and out. Bout to pay off a 3rd on next month since this pandemic. The interest rate hurt me so bad when they put me on the income driven and I could not afford to pay much extra.

I just got a pending litigation review letter from Navient. I set my loan up in 2008 when I was 19 with Sallie Mae, when I had no idea what it would mean for the rest of my life. I am still waiting to hear from them, hoping they wipe it out.

I just came across your video, thank you so much, I’m trying to figure out what steps I need to take to get my loans with Naviant (original with Sally Mae) forgiveness started, I graduated in 2005, but I’ve been in both “income based repayment” which was zero with 3 kids… and I’ve been in forbearance… I believe this should be forgiven since ITT tech closed, the credit are not recognized/transferable… but who do I take this up with? Naviant declined and said I have to consolidate my loans through the US department of Eduction… I’m not sure where to turn. Any suggestions are appreciated!
Hi @Alaric Karczag - What kind of loan forgiveness you qualify for depends on many factors. It sounds like you could be part of the Navient settlement, in which case they'll contact you within the next two months. Although you went to ITT tech, you had to leave without a degree after 2008 to get your loans forgiven so that particular settlement won't work for you. BUT you may be able to get forgiveness through the Borrower Defense program or Income Driven Repayment, depending on the plan you're on you'd have your loans forgiven in 20 or 25 years after you started paying.

Hi @Alaric Karczag - since Navient knows much more about your situation, they would know better than me what you should do. If your loans are federal loans, then consolidating them with the department of education would allow you to benefit from the current pause on student loan payments. I don't know how it would affect IDR forgiveness. It sounds like your next step is to call the Department of Education to find out what consolidating with them would do for you and what your options are. I wish I had an easy answer for you!! There is a Total and Permanent Disability Discharge (studentaid.gov/manage-loans/forgiveness-cancellation/disability-discharge) you may be eligible for. You can contact the Department of Education and talk to them to find out about your specific case and/or you can contact your student loan servicer. I met all of requirements minus the seven consecutive months (I was in bankruptcy at the time, and Navient says it does not qualify as a default) therefore the $70k in Private Loans I still owe, will be the death of me forever. =\

Hi @Arlene Garza - I'm so sorry to hear about your situation, it sounds frustrating to say the least. The organization that comes to mind when you ask for someone to help you is the National Foundation for Credit Counseling, they're usually very cheap or free to talk to. Because student loans are such a huge issue, they have lots of experts on student loans. They may be able to give you direction or assistance : www.nfcc.org/agency-finder
