      He was, more likely, aiming in the general direction of the car, and probably hadn't focused on the occupants.
      Normally, I'd be harsh with a Negligent Discharge. However, this Negligent Discharge occurred while the homeowner was seeking to preserve his own safety, and ensure the preservation of his property.
      As the trespassing teens instigated the entire situation, they are the ones at fault, NOT the homeowner.

    I'm a retired urban ghetto cop. It is a very easy one to figure out. Someone with a bad temper, a firearm, and a sense of entitlement encountered some teens on the wrong day. The Shooter/Councilman was going to teach them a lesson. Just a hunch but I'm guessing alcohol was involved.

      Because he did not attempt to murder anyone.
      Of course, as he was seeking to ensure his own safety, as well as the preservation of his home, in the face of strange and unwelcome trespassers, he should not be charged with anything at all. That he HAS been charged, is a travesty of justice. The arresting officers should be stripped of their badges and jailed. The DA should be disbarred, and also jailed.

      @@cindydott452 According to the report on the Jefferson County website, the teens had pulled up to the gate. That would put them in the mouth of the driveway, which was private property. Although, I will concede that being at a driveway entrance does, by the nature of driveways, put one pretty close to the side of the road. Still, though... Private property.
      Also, according to that same report, the young men jumped the fence, went to the door, and when no one answered the door, they began to roam the property. That's A LOT of trespassing. The young men did admit to this trespassing behavior.
      Mr. Metz was well aware of the trespassing in progress. Again, according to the Jefferson County report, he had received a phone call from his girlfriend, advising him of the trespassing. That's why he showed up when he did.
      His intent was to figure out who the trespassers were, and gauge the threat level. While it may currently appear that the threat level was zero, Mr. Metz had no way of knowing that.

    The #1 thing that I was taught is to never, ever, point a weapon directly at or in the direction of anyone unless you intend to, and need to, fire in self defense. A weapon does not recognize the difference between a careless or intentional firing. The result is still the same, which is why accountability of actions comes before their use. This is also why I say that this was no accident or unfortunate mistake. JUST SAYING...

      Ya, you got a point, but in today's world, I hope you were taught to not trespass on other people's properties, also...Guy didn't know what they were up too and kids shoot up their own classmates in high school shootings almost every week, nowadays..Kids ain't innocent...Easy to take the kids side, but would you or I reacted any differently? Impossible to tell the real threats nowadays...Neither party is innocent in this situation, is my belief, but I'm only a Pissed off at the world, U.S. Marine Veteran, so what do I know...That's why, on my property I have No Trespassing signs, posted and I don't give warning shots...Off property to him, you, or me, could have meant that they'd already stolen property from him and were attempting to leave...If these had been black kids, instead of white, we could all claim, that we felt threatened...Just saying.....

      They were kids sitting in.a car on a public road. In Ohio, and in many other States, just crossing a property isn't even considered trespassing until you tell them to leave.

      What proof do you have that there is more to this story? Or, is it a belief?
      Beliefs are not tangible proof/evidence. Beliefs are bias and have no place in a discussion dependent on facts. However, if you have proof that there is more to the story, I would appreciate you sharing the information as I am always willing to keep an open mind.
      This is the time of year when students/parents begin taking homecoming photos. The kids were in the process of writing a note asking for permission. Depending on where the students pulled off, they may very well have been on a public easement and not on his property. But, even if they were on his property, I struggle to justify/rationalize a student being shot in the face when there was no threat present. That falls into the category of shooting first and asking questions later, which rarely has a positive outcome.
      I’m from rural PA and grew up around guns. We are all trained to never draw and aim a firearm unless you absolutely intend to use it. Here, the councilman drew and aimed upon exiting his vehicle. That shows intent. Whether or not the trigger pull was accidental is irrelevant because he still drew and aimed.

    So these kids were sitting in their car outside of his property. He never knew they had trespassed. Then his first instinct is to pull a gun, take off the safety, aim it at the kids face? It is no darn accident, he put himself in that position where his finger was on the trigger and the gun fired and has to absolutely be held accountable. Attempted Murder is attempted murder, charge him as such. Whatever happened to asking why they are there before drawing your weapon.

    This man will likely be sentenced to prison. There was a similar case with Kevin Monahan. Look it up. He shot at a car that drove into his driveway in rural New York. Sadly he murdered a young woman with that shot. He was sentenced to 25yrs to life.

    They are carried separately.
    The fact that he arrived armed and loaded means he knew his weapon was already HOT! Which means he deliberately loaded live ammunition before arriving and pointing a loaded firearm in an unsafe direction.
    With his finger already on the trigger, he left no room for mistakes, only lethal intentionality. He was locked, loaded, and itching to
    drop the hammer!
    He did not care about gun safety at all. He didn't even care which direction his rounds traveled or what stopped their forward velocity.
    As the sheriff correctly eluded, it was an unnecessary, unprovoked, unjustifiable use of extremely lethal force on an unarmed, underage minor.
    It just doest seem like an unfortunate mistake to me. To be completely honest, to me it seems more malicious and leaning more towards premeditation to commit murder.

      In attempted murder is a failed effort to unjustly end someone's life. That is not what happened, here.
      What happened here, is that an armed homeowner went to confront trespassers at his home, and a negligent discharge occurred. Since the homeowner was clearly seeking to ensure his own safety, and seeking to preserve his rightfully owned property, in the face of these unknown and unwelcome trespassers, the negligent discharge doesn't matter.
      The teens were trespassing, and one was injured in the process. That's their fault, no the fault of the homeowner.
