Also, according to that same report, the young men jumped the fence, went to the door, and when no one answered the door, they began to roam the property. That's A LOT of trespassing. The young men did admit to this trespassing behavior. Mr. Metz was well aware of the trespassing in progress. Again, according to the Jefferson County report, he had received a phone call from his girlfriend, advising him of the trespassing. That's why he showed up when he did. His intent was to figure out who the trespassers were, and gauge the threat level. While it may currently appear that the threat level was zero, Mr. Metz had no way of knowing that.

The #1 thing that I was taught is to never, ever, point a weapon directly at or in the direction of anyone unless you intend to, and need to, fire in self defense. This is the time of year when students/parents begin taking homecoming photos. The kids were in the process of writing a note asking for permission. Depending on where the students pulled off, they may very well have been on a public easement and not on his property. But, even if they were on his property, I struggle to justify/rationalize a student being shot in the face when there was no threat present. That falls into the category of shooting first and asking questions later, which rarely has a positive outcome. I’m from rural PA and grew up around guns. What happened here, is that an armed homeowner went to confront trespassers at his home, and a negligent discharge occurred. The reporter at 1:50 in the video says the sheriff's office is saying they're unlikely to be charged.
They also said “the teens jumped the fence” meaning they ignored the no trespassing sign. Not saying they should be charged and definitely not shot, but they jumped the fence/gate.
No trespassing means no trespassing. If there is a sign and you trespass it is considered criminal trespass.

Although, I will concede that being at a driveway entrance does, by the nature of driveways, put one pretty close to the side of the road. Still, though... Private property.
Also, according to that same report, the young men jumped the fence, went to the door, and when no one answered the door, they began to roam the property. That's A LOT of trespassing. The young men did admit to this trespassing behavior.
Mr. Metz was well aware of the trespassing in progress. Again, according to the Jefferson County report, he had received a phone call from his girlfriend, advising him of the trespassing. That's why he showed up when he did.
His intent was to figure out who the trespassers were, and gauge the threat level. While it may currently appear that the threat level was zero, Mr. Metz had no way of knowing that.

This is the time of year when students/parents begin taking homecoming photos. The kids were in the process of writing a note asking for permission. Depending on where the students pulled off, they may very well have been on a public easement and not on his property. But, even if they were on his property, I struggle to justify/rationalize a student being shot in the face when there was no threat present. That falls into the category of shooting first and asking questions later, which rarely has a positive outcome.
I’m from rural PA and grew up around guns. We are all trained to never draw and aim a firearm unless you absolutely intend to use it. Here, the councilman drew and aimed upon exiting his vehicle. That shows intent. Whether or not the trigger pull was accidental is irrelevant because he still drew and aimed.

What happened here, is that an armed homeowner went to confront trespassers at his home, and a negligent discharge occurred. Since the homeowner was clearly seeking to ensure his own safety, and seeking to preserve his rightfully owned property, in the face of these unknown and unwelcome trespassers, the negligent discharge doesn't matter.
