    that act is so broad and vague you could be arrested if you walk or drive across that kind of land, and leave with dust on you or your vehicle, or a pebble stuck in your shoe or wheel.

    This ban also makes sense as a prominent mining company close to wedderburn and Charlton have been doing areal & ground scanning looking for the reefs of gold apparently still underground.
    I was visited by a representative of a company witch offered to buy my land for $150k, but when I queried the land titles office I got a bit of a shock as my land value has increased 4 fold in 5 years.
    My land estimated to be at $228k & this is the reason why the state government has changed the mining/fossick laws as to grant big mining companies exemption from the rules so they can mine land once allocated for prospectors.
    It is a blaintant disregard for the average Aussie just trying to earn a dollar or two so the State government can fill there pockets with pay bonuses.

    Victoria has had a Socialist/Communist/Globalist problem for years, as has all of Australia. Expect these "Blue Zones" to expand over the years, just as the Green Zones have done around our shores and prime recreational fishing areas. Our Rights and Freedoms are slowly being removed. Incrementalism is the Modus Operandi of Fabian Socialism.

    My friend you ask what to do about this disgusting situation.
    I just go anyway, anytime and any place I want ,bare those places that uniquely protected and always have been.
    National parks,heritage areas ect.
    This is our country and our right to prospect for minerals and this is the crux of what it is to be Australian.
    That small chance to make it as a prospector is what I live for and I will never give up on this dream,never,ever,ever !!!
    I say to anyone who willing to listen that I will go prospecting in my country anytime and anywhere I want,I suggest you all do the same.
    I will live under the guise of the eureka agreement that diggers died for in 1854.
    So no improv government will tell me where I cannot prospect in our own home.
    We will do what we’ve always done and you can’t stop us !!!!
    We are the prospectors and we will not obey

      To my ancestors who travelled from Scotland 🏴󠁧󠁢󠁳󠁣󠁴󠁿 as stone masonry workers. Yes all those amazing sandstone buildings you see in every big city and towns were made by them and from the gold dug up. Eureka will forever be remembered and I'll build another just to prove a point

      This was only made possible when they enacted the work health and safety laws in 1992 as that was the beginning of removing the laws the Eureka Stockade forced the government to enact in the first place

    I’m nearly 70 been prospecting for many years panning and detecting keeps me fit keeps me healthy mentally and physically. I have collected many kilograms of lead shot and a lot of mercury in the creeks panning always fill my holes an never leave rubbish in the bush and just love it . there’s probably 1000s of others out there just like me . The funny thing the government allows mining companies to exist even 60 klms from Melbourne Sunday creek. Mt disappointment. We have to protect our rights Miners Rights Ftg

    Been prospecting since the early 90's. Anyone that's been doing it since back then knows the BS rule changes they try on from time to time. Always had a miners right/fossicking license (depends on the State). I don't jump private fences or leases. But I'll be damned if some Greenie desk jockey is going to tell me what part of public bush, that I'm a part owner of, I can do my thing on. I don't wreck the place, you won't even know I was there after the next rain.
    In practice... most of the Rangers I've crossed paths with don't know all the rules either, and are pretty reasonable to talk with. Can see I'm not destroying the place and tend to leave me and my dogs alone. I've only had one be rude and threaten fines years ago... but he found out real quick that I was on private property and I bark louder than him.
    If some of what looked like mostly under the towns of Ballarat and Bendigo are no go zones... meh I say. I don't go looking in town anyway.
    The 'Great National Park' is a bigger threat to what I do down there I believe. I could be wrong though... wouldn't be a first ;)
    Good to remember we all need to resist desk jockey bureaucrats trying to stop us from using our bush in our traditional way. F them.

    So I guess the burning questions for me are: When did the "blue boxes" excluding Ballarat/Bendigo/Castlemaine come into play? Have they always been there under the 1990 act and The Department has taken 34 years to get around to making it public knowledge and enforcing it? OR has The Department recently used Delegated Authority to declare new S6/S7 areas? OR has the incumbent government whipped through a new Act that piggybacks the 1990 act to create these exclusions. Whatever the answers to the above, it's rubbish legislation in my view - such that, had it been in place ahead of the Victorian Gold Rush, would have prevented the 3 richest Victorian Goldfields from ever existing. Ironically, therefore denying the wealth that built the very House of Parliament in which this awful act was passed. And yes, rendering the "Heroes of the Ballarat Goldfields", The Eureka Rebels, way more illegal than they ever were for objecting to the extortionate mining license cost . That's about as dumb as it gets.

      I think this is something that could probably be sorted out reasonably easily by getting the minister/local MPs (ie. the Premier) and the opposition involved. If you get the right people's attention, they could probably get some VPS grunt to sort it out, especially if the Premier gets embarrassed and is then motivated to make the issue go away.
      Write some letters, the more the better. Might be good to get an MP who has a bit of time on their hands (backbencher, independent) with an interest in the issue to hassle some people in committees for a bit. Doesn't seem like the most complex problem to solve, more like whoever is responsible isn't doing their job properly and possibly needs reminding that there are consequences to that.

    If the Greenies were really worried about 'Sustainable Use' they could supply some local native seeds to prospectors. I, and most I've talked to, would be happy to drop some seeds in the holes I dig then refill when removing mostly trash from the bush. Wouldn't be hard to work in with prospecting gear suppliers, most of them would help out too.
    But it's not really about protecting the bush. It's about control of people. :(

    Oh, and comically, under this Act, it would appear that EVERY tourist who has "panned" and harvested gold at in the fake creek at Ballarat's premier Gold Rush Tourist Park, Sovereign Hill, has broken the law and is potentially subject to prosecution, as perhaps is The Park itself. Farcical! And of course the question still begs, why was this act even called into existence? What is the problem we were solving?

      The Victorian government under Andrews borrowed an absolutely ridiculous amount of money from global banks after scomo ditched the belt and road initiatives, under which he started construction of the tunnel extensions and rail overpass projects.
      What do you think he might have put up as collateral for all the billions borrowed?
      Dig deeper and you'll probably find something to do with a heritage register, , maybe unesco? Seems most of all these bids are centred around mineral rich regions that are easy to rezone for offshore corporations to come in and rape .
      Did anyone notice the traditional lands section on geovic , that was part of the gig I believe. They'll probably drive these indigenous corporations into the ground and inherit their assets.
      Could this have been the motivation for Voice ( fail), and now something about a treaty ? .
      If the aboriginals believe they were hard done by , , they ain't seen nothing yet .. fair to say that the creditors don't want us scratching around and stealing all the value of their collateral.

    They're doing exactly the same thing against fishing, hunting and various other recreational activities (including bushwalking) in various state forests by combining multiple state forests and national parks into one large national park. Some (only some) of the previously permitted activities are being made available via tourism companies that will be approved to operate in the areas, taking fees and restricting access for activities which were previously unrestricted and free of charge.
    The government says they've done public consultation, but considering how it has been shown that there are companies on the consulted opinions list that are for the proposal that either have never existed or have long been out of business, it appears that something fishy has happened with the consultation process.

      It's absolutely bs everyone who likes doing any outdoor hobbies needs to band together even if you agree with it or not as fisherman/bow hunter I'm disappointed for the guys that like rock climbing and protecting and so forth if we don't stand as one front everyone will loose their hobby

    Correct, it comes down to the ministers discretion, as detailed under the mining register, if the minister is asleep at the wheel and has failed to clarify, you run the risk.

      It would be great if we could access this register readily. I have tried to confirm whether the minister has reported to the register as is required for certain exemptions, but I have been sent in circles and told blatantly wrong information.

    being a person that is not good at reading or on computor would it not be easy if you have a miners rite they send you a detailed map of all victoria where you can detect pan and high bank that you can down load on phone for free and use with out phone signal shows where you are and if you in correct area, we have this iS NSW THROUGH THE dpi for Hunting which for me its easy to know if you in the corect area or in a exclosion zone , cheers

      You cannot, unfortunately. Anything under section 6 is listed as unavailable to people with a miner's right. S7 is listed in section 6.

    Whats the rationale for the borders of the blue box. I'm most familiar with the bendigo gold field and the borders of the box don't make any sense. They don't follow any sort of logic that I can see.

    Our local towns are flying the Eureka Stockade flag in protest of the proposed mining law changes and the only difference between what’s happening now and the Eureka Stockade, is, environmental impacts, according to the qld government, and now that same government wants to bring in nuclear power as if they weren’t the environmental problem in the first place, sabotaging each others projects and poor maintenance.
    Our government is lead by followers not leaders, it’s embarrassing that we allow and pay them to be there too

      @@melbournesubtropicfruits9474the satellites have the capability of detecting various different wavelengths of light. With suitable analysis software, they can tell what types of plants are growing in areas to the sub-square-foot resolution. There's no hiding it from them with a camo tarp.

      Write to your local member of parliament also ask to see them in person.
      Next, I'd be making contact with others like you who are impacted by this current law.
      The key to winning is to gather supporters & groups - that way you and your group can't be ignored.

    OzGeology, what about emailing Andrew Bolt &/or Chris Kenny of Sky News Australia about this? They occasionally interview ordinary citizens affected by woke/oppressive issues e.g. the Vic rock climbing bans, wind turbine enviromental damage and identity politics in education are three recent interviews that come to mind (Bolt and Kenny are continuing to follow up the first two). Subscriptions to SNA's youtube channel are now over 5 million, so could be good exposure at a time when people are increasingly resistant to government overreach.

    The miners right was fought for to be fairer. Eureka Rebellion and all. So what did they fight for? among things they fought for Freedom to prospect, on there own land and crown-public land and a fairer license cost.
    So what are we paying for by obtaining a license these days?
    We have the right to prospect with hand tools to the states regulations, but we are essentially locked out of our own land, and public-crown lands by a Section 7 policy, that requires not only having a miners right, but that we all must obtain permission through the minister.
    Would there be anything stopping groups like that of PMAV members ect flooding the minister with emails of land requests to prospect the areas we should be allowed to prospect?

    I dunno why this popped up in my recommendations, because I don't know the first thing about prospecting or geology, so these are just the thoughts of a layperson/general public hearing about it for the first time... The argument that fossicking and prospecting built the gold towns, therefore it's good? Yeah, that doesn't hold much water. We've done a whole lot of destructive, exploitative and downright dangerous stuff in our history to grow our towns and economies, and that doesn't make those things good... I'd want to know what makes those activities good now? In modern times? What value do fossickers and prospectors ADD to these areas that are now crown protected lands? Because you're sharing the land with other walkers, dog owners, bushcrafters, deadwood gatherers, etc. And I'd wanna know this because the bit of video you showed seems genuinely scary to me. If people were digging random 6ft holes like that in the areas where I camp and bushcraft here in Tassie, I'd want the government to put a stop to that real quick. Not only is someone gonna break their neck stumbling into that, I've watched enough Sopranos that if I saw it happening my first thought would be "criminal prepping a mass grave" not "rocknerd looking for gold". I'd leg it.

      Nah, people aren't allowed to leave holes like that open. You are required to fill in all holes after prospecting as part of the miner's right's rules. You could get away with doing that and leaving it open on private property, though. In general, prospecting does little damage. And people normally do it responsibly and leave no trace when they're done like the law requires. What prospectors add to these areas is the payment for a miner's right and a stimulation to the economy by selling off any gold they find along with cash injections to businesses in small towns as they journey through them.

    Hey @OzGeologyOfficial, want to make this controversy a series? Find a source for the exempted streams list. Comes down to the department regarding recreational prospecting as 'occupatuon' of land. Which is a bold interpretation not shared by any other department I have spoken to regarding occupation of land.
    Its also curious that the webpage is always referenced as the authority on the matter despite not being mentioned in the MRSDA nor printed on the miner's right itself. You are just expected to find the webpage without direction.
    I could speak ad nauseum about this. If you care to hear more, feel free to message me; I can send you the details or I can rant about it over a beer or a pan.

      It was definitely unintentional haha. I was just trying to express my outrage over Ballarat being banned but some people have taken it and hit back at the messenger rather than the law. It's not like I wrote em :P

Therew seem to be a lot of people very upset with a lot of hang the Goct talk which will prove very foolish if indeed the law is written to stop MINING and not PROSPECTING in those areas. I don't know who's right and who's not but there seems to be a lot of people just assumning it's all banned without anyone seeming to get a PROPER LEGAL OPINION on the matter.
      So please, if you are proven right, great, rally the people get them to join their voice to a petition or a protest BUT if you are wrong, please make sure you put a video up correcting it otherwise EVERYONE stays misinformed. and that to me is nearly as big a crime as being banned from a hobby like prospecting and detecting!

      ​@@DoubleDummy I'm sure he would rectify the issue if it was shown to be wrong. But sadly, what he has shown here is about as concrete as it gets with the MRSDA, there are other things that are vague in the legislation, but the exempt lands and miners rights being an authority are both as clear as it gets.
      I think the denial and flack that this has caused is just poorly directed distress.

    Petition when?
    They really shouldnt be able to restrict surface stuff and panning, I could understand restricting any big digging work. But surface stuff doesnt hurt anyone.
    I see other people here complaining about left green people restriciting this, but as a far left anaracho-socialist and vegan, who consistantly votes for the Animal Justice Party, people like me dont want this restrictive crap. This restriction isnt from an invronmentalist lens, this is in support of corporate greed.

    I hope everyone with a Miners Right can correctly download the no go zone's ie: Section 7 with the relevant co-ordinates, then correctly use a GPS and navigate around the affected areas so they don't get a B.S. fine. Be sure you're using the correct Navigation Datum also, I would hate to confuse anybody because of this bull sh1t Law.
