    First of all the student should have given the man the money! That is what they are expected to do. Not fight them .the store will get , the money back. In most western countries you cannot beat someone ,with a bat or anything like that that causes death. We know in india this is common beating of people by police , netas , upper caste, rich people or others. Not in the west,The student had no right to chase him and beat him.
    Laws are not the same as in india.There is no self defense! When he ran after the man and beat him out side not in the store .This is excessive force .These are the laws in Canada . Not india .

But if student saw knife in hands of robber and felt he could have killed him today then he could become emotional for his life and in heat of the moment lost his sane judgement and smaked him in the heat of the moment.

    think when the guy left the store. Student shouldn't have gone after him. He should have locked the store and called the police. But instead he went after him and hit him from the back. Looking at the video the guy was already leaving the store. Why would the student went after him, He should have locked the door and call the cops.

    Indian student is new to Canada and young. I believe this is mistake of employer. He should train his employees what should employee do when these type of criminal people come to store. This Indian student must be protecting owners property. And protecting him. Canadian law should not spoil students life.

      Absolutely, you read my mind. The judge must look into training and induction and as a whole Canadian government also form a parliamentary committee to determine whether such employees are trained and made aware of what is and when it is considered excessive force.
      Police have levied charges but in my opinion this employee also saw a knife in the possession of the robber and probably in his mind wanted to disable him from attacking again without any understanding of what he is going to do is going to be force in access.

    What happened in the store was self-defense. But once the robber was out of the store TJ should have locked the store and called the police. 🤔

    If the culprit is in prison for 14 months, the student should also not be in jail for more than 14 months if he acted in self-defence. Like in another province, the convenience store's doors are closed at 11:00 pm, and window shopping should be implemented.

    Laws in some countries are ridiculous and people travelling to any country should make themselves aware of the laws of the land before travelling, and adhere to it, especially students, as they will have less experience and knowledge of such issues and lack the funds and support to help in such cases. Students should take an insurance policy that will cover such unforeseen situations before they leave India.

      Legally self defence would apply if TJ had done it inside the shop to protect himself. Since the guy was out of the shop and TJ assaulted him from behind self defence will not apply legally.
      A similar case happened many years ago in UK when a farmer was imprisoned for killing a burglar on his property. There also self defence did not hold up in court because he shot the burglar in his back when he was leaving the property.

    Actually the boy 22 yrs old student got scared 😱 which was normal. When someone is scared, he thinks to save himself from the attacker. As it is during the night someone comes in the store mysteriously, it is quite scary 😱. 14 yrs sentence is not fair to ruin an innocent person who was working to survive.

    In all stores in Us also the employees stand still usually in this case. Insurance will cover the losses and they are trained not to defend. But human instinct is to defend themselves and out of fear that they will get harmed people act in rush and tension. Still some Ind official can request to reduce duration for him but they may not involve.

    The police officers are right; he did use excessive force, and he should not have gone after the assault. He should have locked the door and called the police. Self-defense is until he was with him. TJ ran after him with a baseball bat. I feel sorry for this young man, I hope he does not get punished and have his life taken away.

    It's a complex case:
    1. Owner of the shop can be in question as the worker may be not fut for work ( eg alcohol etc)
    2. It's for sure this person will get time in prison as footage clearly mentioned the scenario but may get less time due to his past records and self defence.
    There will be time in prison for sure.

    He did in self-defense, but he shouldn't have used excessive force outside of the store because Jonathan was not a threat to him outside the store. But at the same time, the student doesn't deserve a conviction of 14 years prisonment.

    I'm also living in Peterborough, it all happened 3-4 days ago when I was coming to Canada. Critics says that homeless guys was having link with the cheif of police and people with high in power. Sad to say, all these employees working at Circle K work under the table, it means invading the tax.

    It is shopkeeper mistake, and he did a HUGE MISTAKE.....he followed him outside and attacked outside from the store, which is against the law........It is not India bro........might be you can buy the law or buy the police in India. But it is Canada......and in Canada laws are very strict.......Shopkeeper should not come out from the store.............

    You have to apply equal and reasonable force in self defense. In this case excessive force can not be justified as a self defense as the store associate could be seen hitting the guy even after his life was not in danger.

    When robber suspect is out. He need to call police . Law is not that simple as looks like. Both attorneys will present their case . If proof excessive force has been applied then shop keeper may face the consequences.

    It's not excessive, it's considered an attempted murder especially it's out the store in open public area. It's the stores responsibility for not properly training the employee how to handle attempted robbery. All company rules require not to confront a robber and give whatever he wants. This is to avoid loss of life. If the guy was not an addict he could easily suit K-Circle for millions of dollars for permanent physical injury.

Agar woh drug addict firse shop mein aakar student ki Jaan leta tha tab kya police uski Jaan lauta pati thi??????     Students come to Canada to study. Do not get engage in workforce. If you can not afford school fees and other expenses, just don't come. Canadian justice system won't be on your side especially in this case. It's ok to get injured but not to injure.

    This man should be jailed because there is no self defence in this case when he successfully throw him out of the store first he should lock himself in the store and should have call police. Only people should provide some food and asap he should be sentence whater it could be, then he can peace fully finish he punishment, and go back to India and start new life he is a young man, because if he go to jail which he would there is no chance he could start study or get a job or even he cant think about PR.

    There is a limit in self-defense, if a person leaves the shop then he has no right to attack on the road. If justice leaves it in the name of self-defense, no matter who you are, they will follow the thief and start attacking and killing with arrogance, so is that right?     length of sentences are disproportinate to both sides. The TJ should get some sentence - since he has wasted one year already, that should be the end of it. As for the drug addict in coma, I suppose that he has got also enough punishment as being immobilised. I hope that he is now out of coma. His responsibility goes to the state now. All this judicial circus has become difficult to stop in almost every western country. They should learn where not to waste the tax payer money. The parliament needs to bring laws to stop the law going astray. They could even bring emergency law for this case or similar cases.

    In India an entire village will attack. But in other countries due to humanity grouds the laws are very strict. A human life is valued a lot. If a Us citizen is struck in any part of the world and need help, they send flight for him if required. Their rules are inclined towards that protection and safety of any human’s life. That’s why if a dog bite, law will make owner lay some millions to victim, one guys got bug bites in custody and died and they paid 4 mill dlr to his family. This mush of importance is not there in Ind. Example: street dog attacks. No care or rule about it. Here it looks like he followed and bet outside and that is wrong according to
    Humanity and law.
