  • There are some contracts that come with a built in time frame for you to change your mind before it becomes final. There are some loans that you may take out which have the same type of clause. If you have one of these types of situations or you want to otherwise cancel a contract- this video sets out the things you should do.

    I like how she gets to the point. Most of these you tube people have to give you 20 minuets of not topic related information. If I'm 5 minutes into a vid and they haven't got to the subject, I leave.

    That was a horrible directive. What needs to be said is informing the Seller that why they are obligated by law to cancel and accept you, the purchasers purchase or face legal ramifications. It comes under UCC 1-308 ( Formally UCC 1-207) it says you have 72 hours by law, from the date of purchase, during regular Business days (meaning Monday through Friday). And return the Original contract or receipt of purchase. KEEP a Photo copy and send back under registered Mail to prove the time of return. The mailing Date is the time recorded as to be the date of return.

    Signed up for an Unlimited Hair Removal contract with a laser hair removal clinic backed up with a third party loan lender. Some financial emergencies unexpectedly came and now I want to opt out. I really want to get out as I rather not deal with any repercussions of not being able to make my monthly payments on time. Please help!!!

    What about getting a deposit back for remodel that was not started? We cancelled the next day and they refused to give the deposit back. There is no start date on contract and I was led to believe this entire “remodel” would be within our budget which was said multiple times. Realized afterward that the additional costs were extensive and would be out of our budget and also found out unable to obtain financing.
    The gentleman went to the bank with our check the very same day and cashed the check.

      HI @Dina banks can stop payment on checks that aren't returned when due. The contract would provide the terms of what the deposit is for and when it is to be returned. Depending on the terms of your agreement and amount you may be able to go to small claims court on your own to recover what is owed.

    This is regarding home improvement contract. What if the promised dates didn’t happen. For example the estimated completion date was supposed to be on the 24th of November and didn’t get any notification from them on whats going on. And then all of a sudden you received a phone call from them 20 days later after the promised date of completion that they want to start the work. Is there any way that i can back out from that contract?

      HI Purdskies We are doing new videos on this subject - you always look first to your contract. When That sets the terms of what each side will do. When one side doesn't do their part they other has to agree to any changes. If something never started - one could say they considered the contract rejected, abandoned and so of no further effect. If the contract sets out how each is to notify the other - then follow those directions to state your position.

    Hi and thank you for this really good information. I have a question. What if you got a air conditioner unit installed already, are elderly and was not told or given any 3 day cancellation policy? I feel taken advantage of, some things are missing like discount are not in the contract. Only total price not even taxes are there.

      Hi @Cali Check the terms of the contract and see if there is something there that can help you work it out with the seller. Check with legal aid in your area or hire an attorney to check into it for you. There may also be assistance on your state's attorney general's website.

    I singed the loan document through Escrow, but I didn't receive money when I signed. On the same day, I texted the loan office I would like to cancel the loan before they remittance the money, but they stilled remitted money to me. As soon as I received the money, I remitted to them in 30" I received. The loan office charging me 0.5% of loan amounts. Do I need to pay?

      Hi @Wenli it depends upon the terms of the agreement and what type of loan it was - what you stated in your text and if that was an acceptable form of communication to cancel the loan.

    mine is not a home purchase, it is a business purchase. will i be protected if i cancel during due diligence and get my deposit back? do i give reason? how can i make a new lower offer?

      Hi @Jay You would need to look at your documents. Some rescission (cancel) rules are laws set by the state and there are others that are prescribed by the contract itself or the common law. The rules on those would then also have to be looked at to answer your question on whether they can 'voice' your rescission notice. If you gave a notice of rescission that sticks if it is within the rules that apply. If you are asking if the paperwork/documents can be signed that waive or give up your right to rescind that again depends on the law of the contract or the law where you are.

    Hello, a fellow worker at our company has signed the wrong contract and the cancellation time is already over. The company may be bankrupt soon because it takes money and now we are in a bit of a pickle. How can I solve this problem? Its in Germany btw and help would really be useful.

      Sounds like it was a mistake- so should be revoked and the parties can start over.
