You just know some of the folks on Twitter are going to be upset with Sayu for not pursuing a lawsuit against Nijisanji, not because they want her to seek justice for how she was treated, but because they want to see more drama. I can’t help but feel for Sayu for all of the two faced “friends” that turned their backs on her when the incident occurred and tried to crawl back when all of the things she said was proven to be true.
People acting as friends then when things go bad they act against you but when its proven you were right all along after time goes by then they want to act supportive. That's the worst period. I'd rather have someone flat out hate me than act like a friend. I didn’t watch Zaion much mostly because I watch so many other vtubers but I was of the opinion at the time the termination notice sounded like BS so subbed to Sayu as soon as I knew who she was. I’m glad she has received some redemption after all this time. I’m glad also that she won’t forget the people who change sides for clout. Frick those people.
In some countries (i.e. not the United States or Canada), the losing side of a civil lawsuit pays the legal costs for the winning side as part of the judgement. If that were the case in the US and Canada, Sayu and Doki would likely at least consider filing suit. It's unfortunate that we don't have "loser pays" laws everywhere, since that would help keep corporations from dragging out lawsuits to bankrupt the other side.
Good old fashioned problem solving in court is one of the last things left of good old America in the modern USA. Unfortunately, if the defendant is too influential, you will really have to try to restore justice.

That's exactly what corporations do. They win these kind of lawsuits by attrition, meaning that they drag things out until the party filing the lawsuit/affected by the lawsuit can't afford their legal fees. For example, Nintendo will do this same thing against the developers of Yuzu, the Switch emulator. Nintendo has no chance of winning the lawsuit from a purely legal standpoint, but it's not their intention to win. Their intention is to bury Yuzu in legal fees, until they force a compromise, or decide to not develop any other emulator. Sayu is wise by not doing this.
Uploading "member only clips" is still FAIR USE as long as you're playing the clip in order to critique what is being said. Yes they could sue you but they can already sue you for playing any clip at all or even having any image of their IP on your screen. It would still be a frivolous lawsuit but they can always sue for anything. Talking shit behind a paywall doesn't make you immune from criticism.
When she was terminated, some of the livers were guilty of some of her termination reasons and others seemed a little over the top. Assumed like all cases like these the answer is probably somewhere in-between. Then NijiEN livers themselves started feeding into rumours like merch cuts and after reading Sayu's twitlonger I was thought well she's probably right but big corpos like to bullshit sometimes shocker (also Sayu admitted she wasn't perfect in this situation either so I was definitely sympathetic towards her at that point). Shame it took Dokibird almost dying for people to listen. Also yes Sayu has a habit of remembering everyone so anyone clout chasing after they shit talked her can stay away from her ❤🍰
Exactly. People shouldn't bother Sayu or Doki about the Nichi drama. They probably don't want to keep talking about it and move on, which is understandable. If they want to talk about it, so be it. But it's up to them.
She said how it really works. People with more money will technically abuse the lawsuit to the point you cannot continue it. She'd have more chance if that would include other person. If Sayu and Doki would co-work in this case then financially they could handle the case way longer than one person. So usually class-action lawsuit has way more chances to success.
So many times a person can win a lawsuit, but the amount of time and money it takes to win makes it not worth it. Then there's the amount of stress, both from the actual legal process and the online harassment that would likely increase in this case. Then there's the fact that appeals courts happen, which drag things out far longer.
It was pretty clear even around the time Zaion first got backlash for her dark humour joke that things were being blown way out of proportion. People that were actually offended were the minority. As per usual, the loudest naysayers were the ones pretending to be offended on behalf of people who actually couldn't care less. And I would have thought that more people would be aware of that...but then came the suspension, and later that ridiculous termination notice. I'd been annoyed at Niji many times before because of how hurt their livers looked when their projects got cancelled, but that was when they jumped the shark and really raised eyebrows. As far as I was concerned, Zaion had done nothing wrong, but they fired her. It was bizarre and, reading through that deranged notice, clearly hostile. So many unnecessary and minor details were included that anyone with a brain could see that they weren't just firing her for bad behaviour, they wanted to drag her name through the mud in any way possible. So it wasn't too surprising to me when 'Zaion' clapped back, and given how villainous Niji's notice felt, it was very easy to side with Zaion/Sayu even back then. The fact that the public was so divided back then to me was retarded, I couldn't believe how many people were harassing her when, in my eyes, it was so clear-cut that Niji were the assholes in that situation. Like, even if you don't like her content or brand of humour, all you have to do is simply not watch it. Why go out of your way to bother her and kick her while she's down? The internet is so stupid, man...
She'd honestly get more milage out of suing those unnamed people for slander/libel compared to suing a massive corporation, and even that wouldn't be worth the headache.
Guys, one thing that must be said is that Sayu is very clearly done with this subject being brought up again and again in the chat, she does not want to reprimand anyone for displaying support for her with the situation or timeout people, but people only being there for her to talk about Nijisanji, being there solely for drama and not to actually support her, being there to try to stir things up or try to bring the drama up and try to see if they get more info, these kind of people are appearing many times in the chat and its very draining. If you want to support Sayu, please do so without mentioning Nijisanji unless she brings it first, because most of the times she has to talk about it because so many people will not stop talking about a certain situation and they will keep flooding chat about it. This clip was about the stream before yesterday, and I saw people flooding about Legal Mindset talking about her for hours on end until she finally decided to talk about it. Please don't do these things, Sayu is way more than a martyr, she is way more than just this drama, she is a great person and she deserves to be loved by the person she is, not as a symbol of drama or Nijihate, so please try to refrain from bringing such subjects to her livestream's chat.
I wrote this by the start of the video, I am glad that Rev also talked about this as well, it is something more people need to be aware, its good that you want to support her, but talking about wounds that still hurts is not the way to support. I wish I was more present for her in the start, though I did give my support I didn't give commitment to her streams because my attention spam made me really dislike streams in general at the time, and now I am following her more and closer, though it is too late because the situation is done, I will still give my support for the future path she makes, and that's the mindset I want most new people to have as well. Don't support her due the dramas in the past, support her because you want to see her shine more and more in the future, be there to be one more presence for her, she reads her chat very often so you can at least feel heard from time to time, she is a great streamer and entertainer and I think she deserves so much more. As all of us in the end she is still a person, and even if there is thousand others supporting you, if you ever have been in a dark place, you know that every new voice count, it is something I didn't value enough at the time, but even if there are thousands of others, your words could be the ones to make the way through and make her day a little happier. So please, don't bring that past anymore.

I admit, I thought sayu was in the wrong in the beginning when we only had Niji’s side of the story. After she released hers tho, I’ve swapped sides and never went back. I didn’t really know or watch her, but that’s not an excuse to immediately think less of her with just one side of the story. Well some people in the Indie scene are opportunistic. I didn't even know when i discovered her as Shrine Maiden Sayu at the time she was Zaion or even affiliated by Niji. I watched that video on the copyright strikes. Only 2 of the 4 clips was from member only streams. Even with the members only clips, they weren't struck down for being members only, but because they used Enna's "image".
I honestly think also there is a "so what" aspect of this all. If you take it to court, and it isn't dragged out, and you do win. So what? The toxic people in their fan base won't acknowledge that you won, and in all reality they will just be 1000X more toxic to you in the future. You just know some of the folks on Twitter are going to be upset with Sayu for not pursuing a lawsuit against Nijisanji, not because they want her to seek justice for how she was treated, but because they want to see more drama. They want to see a dogpile on someone they hate _(in this case: Nijisanji.)_ But she's right. It's best to just move on, not bankrupt yourself trying to take the giant on & focus on your own future & success.
I can’t help but feel for Sayu for all of the two faced “friends” that turned their backs on her when the incident occurred and tried to crawl back when all of the things she said was proven to be true.
People acting as friends then when things go bad they act against you but when its proven you were right all along after time goes by then they want to act supportive. That's the worst period. I'd rather have someone flat out hate me than act like a friend. I find it amusing we humans eh some of us, can act with a false face and live everyday normal even after attacking a person's character when you don't have all the acts. I didn’t watch Zaion much mostly because I watch so many other vtubers but I was of the opinion at the time the termination notice sounded like BS so subbed to Sayu as soon as I knew who she was. I’m glad she has received some redemption after all this time. I’m glad also that she won’t forget the people who change sides for clout. Frick those people.
In some countries (i.e. not the United States or Canada), the losing side of a civil lawsuit pays the legal costs for the winning side as part of the judgement. If that were the case in the US and Canada, Sayu and Doki would likely at least consider filing suit. It's unfortunate that we don't have "loser pays" laws everywhere, since that would help keep corporations from dragging out lawsuits to bankrupt the other side.

Good old fashioned problem solving in court is one of the last things left of good old America in the modern USA. Unfortunately, if the defendant is too influential, you will really have to try to restore justice.

I pride myself in knowing that I supported her from day 1 of her termination. I hope all those horrible people who harassed her feel ashamed and, if possible, leave the internet forever.
That's exactly what corporations do. They win these kind of lawsuits by attrition, meaning that they drag things out until the party filing the lawsuit/affected by the lawsuit can't afford their legal fees. For example, Nintendo will do this same thing against the developers of Yuzu, the Switch emulator. Nintendo has no chance of winning the lawsuit from a purely legal standpoint, but it's not their intention to win. Their intention is to bury Yuzu in legal fees, until they force a compromise, or decide to not develop any other emulator. Sayu is wise by not doing this.

Uploading "member only clips" is still FAIR USE as long as you're playing the clip in order to critique what is being said. Yes they could sue you but they can already sue you for playing any clip at all or even having any image of their IP on your screen. It would still be a frivolous lawsuit but they can always sue for anything. Talking shit behind a paywall doesn't make you immune from criticism.
When she was terminated, some of the livers were guilty of some of her termination reasons and others seemed a little over the top. Assumed like all cases like these the answer is probably somewhere in-between. Then NijiEN livers themselves started feeding into rumours like merch cuts and after reading Sayu's twitlonger I was thought well she's probably right but big corpos like to bullshit sometimes shocker (also Sayu admitted she wasn't perfect in this situation either so I was definitely sympathetic towards her at that point). Shame it took Dokibird almost dying for people to listen. Also yes Sayu has a habit of remembering everyone so anyone clout chasing after they shit talked her can stay away from her ❤🍰

Exactly. People shouldn't bother Sayu or Doki about the Nichi drama. They probably don't want to keep talking about it and move on, which is understandable. If they want to talk about it, so be it. But it's up to them.
She said how it really works. People with more money will technically abuse the lawsuit to the point you cannot continue it. She'd have more chance if that would include other person. If Sayu and Doki would co-work in this case then financially they could handle the case way longer than one person. So usually class-action lawsuit has way more chances to success.

So many times a person can win a lawsuit, but the amount of time and money it takes to win makes it not worth it. Then there's the amount of stress, both from the actual legal process and the online harassment that would likely increase in this case. Then there's the fact that appeals courts happen, which drag things out far longer.
It was pretty clear even around the time Zaion first got backlash for her dark humour joke that things were being blown way out of proportion. People that were actually offended were the minority. As per usual, the loudest naysayers were the ones pretending to be offended on behalf of people who actually couldn't care less. And I would have thought that more people would be aware of that...but then came the suspension, and later that ridiculous termination notice. I'd been annoyed at Niji many times before because of how hurt their livers looked when their projects got cancelled, but that was when they jumped the shark and really raised eyebrows. As far as I was concerned, Zaion had done nothing wrong, but they fired her. It was bizarre and, reading through that deranged notice, clearly hostile. So many unnecessary and minor details were included that anyone with a brain could see that they weren't just firing her for bad behaviour, they wanted to drag her name through the mud in any way possible. So it wasn't too surprising to me when 'Zaion' clapped back, and given how villainous Niji's notice felt, it was very easy to side with Zaion/Sayu even back then. The fact that the public was so divided back then to me was retarded, I couldn't believe how many people were harassing her when, in my eyes, it was so clear-cut that Niji were the assholes in that situation. Like, even if you don't like her content or brand of humour, all you have to do is simply not watch it. Why go out of your way to bother her and kick her while she's down? The internet is so stupid, man...
She'd honestly get more milage out of suing those unnamed people for slander/libel compared to suing a massive corporation, and even that wouldn't be worth the headache.
Guys, one thing that must be said is that Sayu is very clearly done with this subject being brought up again and again in the chat, she does not want to reprimand anyone for displaying support for her with the situation or timeout people, but people only being there for her to talk about Nijisanji, being there solely for drama and not to actually support her, being there to try to stir things up or try to bring the drama up and try to see if they get more info, these kind of people are appearing many times in the chat and its very draining.
If you want to support Sayu, please do so without mentioning Nijisanji unless she brings it first, because most of the times she has to talk about it because so many people will not stop talking about a certain situation and they will keep flooding chat about it. This clip was about the stream before yesterday, and I saw people flooding about Legal Mindset talking about her for hours on end until she finally decided to talk about it.
Please don't do these things, Sayu is way more than a martyr, she is way more than just this drama, she is a great person and she deserves to be loved by the person she is, not as a symbol of drama or Nijihate, so please try to refrain from bringing such subjects to her livestream's chat.
I wrote this by the start of the video, I am glad that Rev also talked about this as well, it is something more people need to be aware, its good that you want to support her, but talking about wounds that still hurts is not the way to support. I wish I was more present for her in the start, though I did give my support I didn't give commitment to her streams because my attention spam made me really dislike streams in general at the time, and now I am following her more and closer, though it is too late because the situation is done, I will still give my support for the future path she makes, and that's the mindset I want most new people to have as well.
Don't support her due the dramas in the past, support her because you want to see her shine more and more in the future, be there to be one more presence for her, she reads her chat very often so you can at least feel heard from time to time, she is a great streamer and entertainer and I think she deserves so much more.
As all of us in the end she is still a person, and even if there is thousand others supporting you, if you ever have been in a dark place, you know that every new voice count, it is something I didn't value enough at the time, but even if there are thousands of others, your words could be the ones to make the way through and make her day a little happier. So please, don't bring that past anymore.
