      I remember hearing that they did find 2 other male DNA’s at the scene but I didn’t know BK’s DNA was the only DNA on the sheath, I don’t think there was due diligence on the first responders….8. Hours. Later. Js

      @@a.mack16: It would be a lot more suspicious if other DNA WASN’T found. Also, the 8 hour delay was NOT the fault of the first responders and should have no effect on the DNA analysis.

      This trial is going to be public, and the case mostly has been, except for what is kept under seal to protect privacy of victims and witnesses and their families.

      whether it's working for you is a matter of personal opinion. Law is law and the judge will base sentencing on fact/evidence as well strength of the case too

      I never said that, and I am not on every channel like Andrea trying to cash in on fame off Kohberger's name. She's been on other channels including her own rambling on and on repeating herself and dogging the Prosecution's case.
      She actually sounds brainwashed and has the large wild eyed look as she tries to get a point across to prove it. Correct your grammar while you are at it. It's not "You is a deep thinker" it's "You are or You're a deep thinker.

    The most troubling part of the FACTS of this case is the 8 hour delay between the roommate seeing a stranger in the house and the phone call to 911. That’s bizarre. Why don’t they talk about that??

      her points were not great because she basically made 1 point that this DNA could have been transferred innocuously. No one is saying it's not possible, but you have to acknowledge that it is infinitely more likely that it was left there because he is the killer. That in combination with the fact that they know he drove by the house several times that night is very damning. Just because one piece of evidence has some wiggle room doesn't mean anything when you consider the totality of the evidence. Do you generally agree or disagree with that?

      @iansane1928 Yes, that is true, that the totality of the facts and who they point to is what matters --- which is why there is probable cause to try him. But this is not an airtight, "beyond reasonable doubt" case based on what we know _so far._ This woman is an excellent lawyer.

      Sounds like he is desperately trying to convince Andrea that BK is guilty, like he knows... and isn't he a lawyer? It surprises me he thinks what we know now is enough to prove BK guilty beyond a reasonable doubt, the end. Andrea is professional and always great.

    They should have left everything alone until the trial IS over, PERIOD! They need to test sound and sight. What did Dylan actually hear? She allegedly said she heard Kaylee say, " There's someone here" and then allegedly heard someone say "I'm going to help you". But she didn't hear any other noises after that? I'm not buying it! Before gutting the house, they should have tested sounds in the house and how did Dylan hear these things?

    great conversation. Emotively the evidence against Kohberger works for me, but Andrea's arguments about the problems with each piece of evidence is compelling.

    The defense doesn't have to prove an alternative explanation why the dna would be there, it's the state that has the burden to prove there's no possible alternative.

      I stumbled across a Georgia police news site that lists all the police officers & Correction officers in the entire State convicted of felonies & removed from their positions permanently (state, local, juvenile justice positions)👉there were ‘thousands’ on the list

    I think it's REALLY unprofessional that Jesse kept talking over his guest just because he didn't agree with her. Andrea is EXTREMELY articulate. The thing we have to be mindful of is that the standard for this (murder) is BEYOND A REASONABLE DOUBT. As Andrea points out, time and time again, is that it's not actually on Kohberger to prove his innocence; it's on the state to prove his guilt, and that this must be with no alternative theory to the facts of the case. Just because there isn't anyone else currently identified doesn't mean that he MUST be it. There is a PRESUMPTION OF INNOCENCE in our justice system, so the fact that a lot of these preconceived notions of guilt in spite of well-reasoned counterarguments just speaks volumes about the court of public opinion.

    Was a terrific show to watch, Andrea is very composed and intelligent. Though honestly Jesse really should let his guests on the show speak. Don't interrupt them repeatedly like this, I know that you're "prosecuting" to her "defense" here but seriously... let her make her points which is the whole reason you asked her on the show.

    Great show. Would be even better if Jess let Andrea finish the sentences. Honestly, I think was a lot of pressure to find someone to blame and there are way too many circumstantial evidences on this case. I think the media already decided the verdict on this trial and if Brian is the real murder or not, does not matter. People want justice and I am pretty sure a lot of money and effort was already put on this so he has no chance.

      @@stephanied6451 The most important aspect is the absence of DNA of the four students. Imagine, this was a brutal massacre. Therefore, there must exit plenty of blood but pounds of blood. So, Bryan must have transfer that, at least to his car. So, how on earth there is no Blood in his vehicle? How the prosecution will manage this?

    It was really interesting to discuss this with a defence attorney. I always love to see things from both sides. Just like shows like Middle Ground.

      Very interesting, that lady made some good points. Imo he is guilty and they will get a conviction unless the prosecution makes a big mistake. The host is loving some of the evidence, like the witnesses description, too much.

      Hes running a show and they have limited time....and at one point she talked for 8 min straight...... Jumping in after more than 5 min of straight talking is hardly interrupting.....at no point did he just not let her talk. Also, the times when he is interjecting and repeating what he says, its after she has talked for a while and he is trying to get his side in and she doesnt do what most people do which is stop talking for a min to hear him out. They are debating.....its going to be hard to remember a point after minutes of her talking and he still let her go on and on. The only points where he interjected forcefully is toward the end when they were running out of time and she just wouldnt stop to let him speak. Peoples perception is wild....

    This case and the Delphi one has turned into a circus. With accusations if misconduct, unfair treatment and zero privacy for the victims and their families. Imagine your child getting mur*dered and watching on international platforms as it's turned into a freak show.

    BK DNA blew through the wind from Pullman and landed in Idaho on that knife sheath button. Then for some odd reason his phone pinged next to the house and turned off during the murder window but he was actually never there. He is just a very unlucky guy set him free.

The entire prosecution’s case against Kohberger hinges on that time frame between 4:04 am and 4:20 am, so if they change that then all their evidence of the car driving around during that time is down the toilet. If there is evidence that shows it coulda been an hour earlier the case is sunk.

      The reason is, he knows crime but even the experts make mistakes. He cleaned it but guess what, it’s almost impossible to clean under that button into the stitching. Mind you, he wasn’t thinking he was going to leave it behind. In a struggle things happen.
      No doubt in the struggle with knife in one hand Sheath in the other, those girls would have fought and at least one of the girls, probably the 2nd deceased, would have woken and put her hands up to grab they knife or sheath or whatever she could while fighting for he life. In the frenzy, Jack the bloody ripper has just killed 2 girls and probably killed for the first time ever
      . His adrenaline is pumping big time . He’s not thinking in the way he may have thought he would be and was, just minutes ago, when cold and calculated.
      He leaves slowly and forgets the sheath exists in that moment. He comes into the path of the 3rd young lady who had just eaten and been online. He attacks her and her partner.
      He is exhausted and I am sure that you and I wouldn’t know how one would feel.
      . Whether he sees the next girl or not? We will never know. He was probably in a trance by then . She was in a trance herself when seeing him but after being initially scared and frozen, she lay there under the influence of substances and then sleeps and knows nothing until many hours later. What a horror to wake to. What a horror full stop.

      @@trudykennedy2380 we don't know that someone in LE isn't responsible (this particular police department has been guilty of framing innocent people previously), or have been instructed to cover it up to protect someone else (such as a certain nephew of a certain attorney general that was with the girls that night and fled the country straight after), or even when the sheath actually turned up or why, if it was supposedly under Maddie's body why her blood wasn't on it. Why didn't they bother testing the other 3 sources of DNA there? Why only hone in on one piece of partial touch DNA which may or may not have been planted? Why did the other roommates invite everyone over for a clean up party before someone eventually decided to call police? Everything is shady. Too many questions that haven't been answered.

Jumping in after more than 5 min of straight talking is hardly interrupting.....at no point did he just not let her talk. Also, the times when he is interjecting and repeating what he says, its after she has talked for a while and he is trying to get his side in and she doesnt do what most people do which is stop talking for a min to hear him out. They are debating.....its going to be hard to remember a point after minutes of her talking and he still let her go on and on.     Great and thoughtful discussion Jesse. I think your guest Andrea Burkhart presents some good points to consider for BK’s defense. I think she’s the only one I’ve heard so far that doesn’t sound far fetch. Unless there is anything defense has that would raise reasonable doubt that BK was there that night, I do agree that the DNA- coupled with the cell phone evidence and his activities when he was home is enough for a guilty verdict.

    The affidavit has contradicting statements... in one part they say his phone DID ping, but they don't believe he was at that location..... then in another part they say his phone DIDN'T ping, but they believe he was there.... so their contradicting statements PROVE their information isn't reliable or accurate. This lady was amazing... intelligent, using common sense and being unbiased. None of these pieces of "evidence" have been verified.

      @@notpub The state has never claimed that any GPS evidence exists. Base model Hyundai cars do not have GPS capabilities. Cell phone tower ‘pings’ do not give detailed geolocation parameters.

Before I go to lay down I usually just put a knife sheath on my bed and go right to sleep.     8:53, the man just said it himself it was placed there. So maybe it was sometime during the 10 hours before the police were called it could have been placed there. Too many people went in and out that house before LE was even notified. There is too much reasonable doubt on this case. That's my opinion.

    Thank you for adding some common sense to this case. There are too many tin hat communities who have hyper focused on minuet details they have zero understanding of. The simplest explanation is often the right one let’s not forget.

      Yes. Nearly every video I watch about this case there's several people who repeatedly post the same comment stating Bryan us innocent. Their 'facts' are starkly different from what I'm hearing from the evidence.

      Other than the trace DNA which is not reliable the Prosecution has no other evidence. The pings are not credible as LE admitted error on one ping in the PCA so all pings are questionable. LE cannot demonstrate that was BK Elantra no evidence to show he parked or even entered the house. There's no smoking gun all the evidence LE has is in the PCA and that is circumstantial. Seems you are the delusional one.

      yup all evidence shows 2 roommates are txting each other and clean up for 8 hours after the murder. its called Occam's razor..its sick the innocent Kohberger is dragged into this

    Jesse annoys me. He doesnt let people speak he overtalks people and interupts all the time. He needs to let people finish and not interupt there train of thought. Btw this defense lawyer andrea is brilliant.

    Great conversation! Totally disagree with the "expert" that if DNA is thrown out then there is no case. There is ALL the circumstantial evidence of him stalking the crime scene and the victims. That debunks any theory that he was being set up or it was someone else. She is doing some fantastic mental gymnastics to believe that the vehicle and the rest of the circumstantial evidence fits her narrative.

      We do not know what evidence the prosecution has to offer. Everything here is pure speculation unless based on the indictment and search warrant.

      It also requires some mental gymnastics to explain the roommates not calling LE for over 8 hours after the victims were killed. Also the total lack of DNA in his car, apartments, offices, storages etc. With no evidence of cleaning.

    There’s just something about this case and the Delphi case. Like something is missing in each one , but I can’t put my finger on it.

      Imagine BK taking on both E & X at the same time & not having his dna under their nails or on their hands 👉as for Delphi 👉they say RA controlled BOTH girls bc he had a ‘gun!’ Now, the girls would’ve known they’re going to die & you know darn well they’d take their chances & both either try & jump him or at least 1 run away for help👉they too were slashed to death & not shot (Why woukd RA have both a knife & a gun👉idk of one case where a killer brought both weapons) and neither girl had RA’s dna under their nails & both girls did not choose to allow RA to kill them one by one👉there are at least 2 killers in both of these cases👉RA didn’t have the health to kill one & then chase after the other & neither girl was shot 👉and so, you know E & X would’ve heard K & M being murdered & would’ve certainly gained the upper hand on BK bc they would’ve been ready so DM’s story line is BS in that E & X we’re slain last bc They had enough time to have heard the fight upstairs & be able to lock their door & call 911 bf BK had time to break down the door which wasn’t broke down & the fight occurred in X’s room so only someone trusted could’ve accessed their room👉what you can’t put ur finger in is that we have 2 people sitting in jail for murders that no victim has the killers dna on their bodies after malicious attacks, as if they were first incapacitated & unable to fight back…..or most likely, there was more than one killer which makes the most sense in BOTH cases (in the Delphi case: there were 2 females in the location the girls were last noted (Chyenne & Cheryl) & eye witness stated there was also a male & female arguing under the bridge near the crime scene👉this is within the hour of the estimated time of death of the girls👉Could the attack on the girls have been occurring under the bridge while RA was crossing & the 2 young ladies have Libby’s phone & recorded RA & that is why Libby’s phone was found on her instead of the killer getting rid of it?! 👉the scenario of these other 4 possibly being the killers makes more sense (fits the younger sketch profile) rather than loner RA, who allegedly couldn’t make up his mind to use the gun or the knife but ended up choosing the knife 👉who knows, maybe one of RA’s kids was involved & he’s taking the fall?! …and we know E & X we’re together & there’s no way BK took both on at the same time without escaping w some serious injuries let alone get his @&& kicked by the two👉I mean the four👉BK did not take out 4 to his 1👉There is no “beyond a reasonable doubt’ in either case👉and we all should keep in mind this could be one of us someday & Tis a great day, when cameras are allowed in court proceedings👉transparency is good & holding professionals accountable is even better

      LE in both cases has have extremely tight lipped. So yes, there is a lot missing! Bc a lot hasn’t been revealed to the public yet

    Loved this one! Glad they’re airing the trial on RUclips it should be made public. Crazy to think that if KB is exonerated the killer is walking amongst us. So so many questions still need answered. Ultimately hope justice is served for the victims and the correct person is put away.

    Andrea is intelligent, articulate, and knowledgeable. However, trying to make a case that BK's DNA happened to transfer to a knife sheath, which was found under a victim, is ludicrous. It's grasping at straws to trying to explain that away.
