- ABC15 Investigators have just received the first two police monitoring reports created by the City of Phoenix's Office of Accountability and Transparency. OAT was created by the city to monitor police use of force and misconduct allegations and can make recommendations for improvement. One report involved officers handcuffing a Wall Street Journal reporter, Dion Rabouin, who was stopped and handcuffed after he was interviewing people outside a bank. The officer involved was never asked whether race played a factor in his decision to detain the journalist, who is Black, according to the OAT report. OAT also noted a deviation from police policy for disciplining the involved officer, saying the officer received retraining instead of suspension because the incorrect policy was applied.

Juries need to be start handing out multi million verdicts for every false arrest, no matter how minor
Easier said than done. Juries are composed of regular citizens, with their own deeply held beliefs and personal biases.
There is no guarantee of any outcome with a jury composed of random people.

If Valley of the Sun is a newschannel you work for, I would expect both the editor to intervene with a lawsuit and a story to be published. If you're not a registered journalist you don't have the same protection against the authorities, but if your description is correct, it still makes the police-action unlawful.

Police get the trespass law wrong all the time! They have to tell the person they are being tresspassed and give them time to leave the PRIVATE property. Then if the person refuses to leave or returns to the PRIVATE property, then the person can be arrested.

A police officer can't be the plaintiff in a trespass complaint. The officer can't solicit a trespass complaint from a land owner. Doing so is a violation of law.
He doesn't have to ID until he comes back again after being trespassed.
He violated his fourth amendment. Unlawful search and seizure.
The bank can't trespass him from the whole shopping center. They can only trespass him from the bank. The shopping center owner has to trespass him from the whole property. If you are kicked out from one of those little stores you can still shop at all the other stores in the shopping center.

What is the point of OAT’s report if the officer isn’t properly disciplined and those who didn’t follow policy and tried to minimize this incident aren’t held accountable?
Its point is to make it look like they are actually doing something when just like the internal report, no one is held accountable for messing up.

No, that when Internal affairs can't even do a proper investigation, then the chief reduces what was already a slap on the wrist to a 4 hour class that the officer did not even complete tells you everything you need to know about that police department, from the people who leads it to the lowest patrol officer.
Fire the police chief, fire the Academy instructors, fire the training officers, fire every single officer, send the back to a proper police academy and only hire back those who can pass a proper police academy

The bank asked that he be trespassed and he refused to show ID to the officer. Just why would any legitimate reporter refuse to produce ID? Why didn't this reporter just research interest rates online rather than asking people walking in of they had an account there? Why didn't he just go into the bank and tell them what he was doing?

The reporter was told he was trespassing and the bank wants him to leave, he refuses to leave and also refuses to produce ID. Just why would any legitimate reporter refuse to show ID?

28 plus years in law enforcement myself, and the biggest joke played on the public is the illusion of fairness to citizens. How in the world can you have an organization self check and believe the outcome isn't bias? You have to be stupid to believe that, and I know that all law enforcement agencies consider public citizens to be just plain stupid. I know that the reporter was mistreated simply because of the color of his skin and nothing else. The lackluster response from the department comes because they all would have done the same thing as the police officer if it were them, and they don't believe he did anything wrong. How can anyone trust an organization founded upon bigotry, racism and jim crow laws of the past? Americans are so naive that they believe police officers have a duty to protect them even though the United States Supreme Court has ruled over and over again that police officers DO NOT have a duty to protect citizens except when a person is in their custody. The only difference between law enforcement and gangs is government approval.
HUGE numbers of citizens and some of us in law enforcement or former LEOs have been screaming about these abuses for YEARS. PPD, Mesa, hell ANY agency cannot do their own investigations. There MUST be an outside STATE agency that does NOTHING but hear complaints. And they must be allowed to recommend discipline, or even decertification.
What about criminal charges? For, say, aggravated kidnapping and the possession of a weapon in the commission of a violent felony, and violations of rights under color of law, such as we see here? Can they recommend capital punishment for capital crimes?

But we routinely have state , and federal, attorneys refusing to prosecute police for obvious deprivation of rights incidents ( which is a federal crime, and also usually a state one), so, are they going to do any better???

There is no state agency that can not and will not be corrupted. Let them stand the trial like the rest of us. Let them defend their actions to a jury and if they did nothing wrong, they will be found not guilty like the rest of us. If they are found guilty, let them pay for their crimes with their own money and their freedom like the rest of us. If they truly have done nothing wrong, then what are they affraid of, tell it to the judge, isn't what what cops always say to the victims of their crimes?

Trespass is a CIVIL offense. The OWNER OR HIS DULY AUTHORIZED REPRESENTATIVE MUST 1st ASK THE INDIVIDUAL TO LEAVE THE PROPERTY. The 1st rule of policing: EVERYONE LIES. For a LEO to make an arrest based solely upon heresy of a 3rd party is asking for trouble. The officer’s 1st responsibility is to investigate! That requires speaking to the complaint (reporting party or RP). Since the alleged trespass notice was not given in the officer’s presence, the officer should demand that the trespass notice be issued again by the owner/representative in the officer’s physical presence. LEGALLY, the WSJ reporter (or anyone who is issued a trespass warning) MUST BE AFFORDED THE OPPORTUNITY TO VACATE THE PROPERTY WITHOUT IDENTIFYING HIMSELF, w/o detention, w/o arrest, and w/o being physically touched or his movements restricted. If, and only if, the person refuses to leave the property, is he subject to arrest for criminal trespassing. Skip any steps, and the detention, identification, arrest and prosecution are all illegal.
Cops have to be taught that “Because I told you so” ain’t a legal order. One of our most basic civil rights is the right NOT to be disturbed by our government! Police have no power or authority to detain (4th Amendment seizure) an individual without REASONABLE ARTICULABLE SUSPICION THAT A CRIME HAS , IS, OR IS ABOUT TO BE COMMITTED by the person being detained! Terry v Ohio - basic Law Enforcement 101! Furthermore, investigatory detentions w/o RAS of a crime are unconstitutional and illegal. Because somebody called and complained doesn’t make the complaint rise to the level of a violation of the law. The RP’s feelings don’t trump the law nor our rights!

@erts2371robbing someone is a crime; it's not protected by the Constitution. Asking questions for a story as a member of the press is protected by the First Amendment. Your example makes no sense. Also, to be trespassed there are steps to be followed: first, a representative of the private business has to ask the individual to leave. If they don't leave, they would call the police. The police would issue a trespass warning. At that point, if the individual returned, they would be committing the crime of trespass and could be arrested. What happened to the reporter did not fall under any of that. The police violated his rights, specifically under the First Amendment and Fourth Amendment. Now, the citizens of Phoenix are likely going to have to pay to settle a civil rights lawsuit for this screwup.

By this point the PPD has clearly established they believe they are above local, state and federal law. There are so many cases involving so many officers over such a long time.
