Mr. Mike, I filed for CFS in March 2024. I also have degenerative arthritis in one knee. My private Dr. did not appear to make it clear if other things were ruled out. I may need your assistance in filing an appeal.
If a claim was denied in 2012 for neck condition, saying it wasn't caused by the service (no HLR, or appeal was filed) and I found new and relevant info in 2024 (service medical records) that indicates otherwise, should I file this as a supplemental claim, or a possible CUE claim?
@@shepatown ide still file a supplementary. Because its not really a CUE when they don't service connect you. But it seems like you have more new evidence. That's what a supplemental allows you to do it allows you to supplement your old claim with new evidence.
My husband is SC for Hyperten. w/ Chronic Kidn. Dis., Paresthesia of Skin & toes w/ 5th toe Dystrophy rt/ lft , Paresthesia of Skin, rt/ lft hands all assoc. w/ in-serv. frostbite (All together, 60% after VA Math). His Code Sheet shows all conditions as “Static,” w/ “No Future Exams.” VA later, also determined he has gout and degenerative arthritis: toe joints, lft knee, shoulders, elbows, lumbar sp., pes planus & possibly plantar f. Will I be risking P&T status if I file gout secondary to CKD and the others, secondary to frostbite? I found credible supporting articles. Also, do you agree I need a DBQ? Thank you.
My private psychologist has done her assessment. Im at 70% va rated. She has assessed me total and social impairment. Should i send my packet now or wait for the new schedule for mental health. Intent has been filed

Can you tell me if these conditions are also “Static?” I’m trying to achieve P&T for him & don’t want to risk P&T. Thank you.
I selected a hearing lane (traveling judge under the Legacy Appeals System) and it took a total of 8.6 years, Feb 2007 to Aug 2015. This includes a remand and a C&P exam. The claim was granted, and I learned a lot about the VA claim process while waiting.

you will have to file a supplemental claim. You can't ever file a denied claim as a new claim. This is exactly what supplemental claims are for lol.

im not an expert but I really doubt it. And CKD really is well documented to cause gout. I would file if I were you.
