    If we separates from organization before completion of 5years , can we claim back our salary deducted gratuity in FNF ?

    Dear sir my uncle worked in an organisation for 17 year now they calculated graduity on only basic salary which is 35 percentage of gross salary in pay slip they mentioned basic salary is 35% of gross ,hra is 95% of basic salary and other special allowance..and graduity amount is very very less ..can i file complaint against company ..

      You may seek for the clarity on this breakup, and check if it's done internationally to keep the cost low when it comes to statutory liabilities.

    If employee opt-out for PF and completed 10 years will he be able to eligible for gratuity

    So how much amount will employee get on leaving after 5 yrs.
    Actual CTC deducted amount for 5yrs
    Or
    Calculated based on formula based on Basic of salary.

    So basically an employee should be self aware about this fact otherwise it looks misrepresentation right? This cannot be later discussed after the employee learns this fact their gratuity was actually a part of their CTC

      It means gratuity additionally showed in ctc ?, but in total ctc if u remove gratuity what remains that is the exact ctc ??

    If I asks for 10 LPA CTC and the gratuity amount will be deducted from CTC? If that is the case then the CTC will be less.

    Sir agr kisi employee ki basic salary 40 thousand he to kya hum use gov act ke according hum use 8.33 % ka bonus de sakte hai kya

      In that case employee gets nothing as Gratuity.

    2 year as voucher and 4.1 year appoint on payroll
    So please suggest

      Voucher payment duration will not be counted as employment period as you were not on the payroll of the company.

      @@saurabhgogwami Its illegal, till the time company is payment you on voucher they are not consider as employee of the company and cannot claim benefits of an employee.

    (1)Gratuity kitne % deduct hoga employer ka , example jaise esi 1.75 percentage hota hai.
    (2) LWF deduction ki kitne % deduction hoti hai

    Sir ji maine apne contractor se gratuity k bare me poucha to wo bole salary slip me gratuity deducted nahi so I'm not eligible after service more than 5 years it's correct or not

      Its wrong, salary slip me Graduity ke hone ya na hone se koi farak nahi padta. 5 saal ek company me continues job karne se Graduity dena company ke liye compulsory hai.

      Yes, for gratuity you need to complete 4 years and 190 days. So you will get it.
