Congratulations on your new employment. If you sponsor is cap exempt then they can file your H1B at any time during the year. Again how long it will take to process totally depends on your country, slot availability for interview etc.
Hi Pragnya, I have a question regarding salary of H1B Cap Exempt candidate. Suppose the candidate, when he/she left US used to get 90k. But that was in the 2018. Once his/her H1B gets renewed under Cap Exempt category in 2023, will he/she be getting the same salary or the wage should be revised based on market/experience increase? Will this aspect be considered in the new LCA?
The only compulsory salary under LCA requirements is the minimum wage currently 60k. After that it’s your negotiation skills. 90k is already qualifying. But having a look at current market trends and inflation I suggest you negotiate at least around 120k.

Hi Mam, I have this query, kindly see if you can answer. I had used 5 years of my H1B when in July 2020, I was laid off by employer "A". I returned India and joined an Indian MNC which just filed for H1B Cap Exempt visa so that I can utilize remaining 1 year of the 6 years of H1B. This processing will take at least 4-5 months and my visa will get transferred to current Employer. Kindly confirm, if this H1B Cap Exempt visa suitable for this situation ? Asking you to be doubly sure of it...
Yes it is suitable! Use the remaining 1 yr. and talk to your employer to file extension ASAP if want to continue further. Extensions are also taking some time these days

You should be able to switch employers in less than one year, there is still pandemic backlog because too many Indians

H1B cap exemption is not based on location. It's based on employer. If your employer is cap exempt then they can sponsor you cap exempt H1b.

@@dhirajdsharma If you have the i797 receipt number then you can check the status. It may show revoked if revoked.

1. Yes you need to go for interview.
2. After your H1B petition is approved, you can apply for H4 visa for your dependent. Cannot apply before that.
