Hi. Just wanted to respond to why some of us haven't done this. Unfortunately I have been saving up for years to get my first EV and with the interest rates where they were I sacrificed other things to save up enough money to buy my Ocean outright. Savings all gone but felt it was better than paying so much more over the years in interest and now it's possible that all of you that financed may get some protection/reimbursement for that decision. Very happy for you but I will still be stuck with this car for a few years till I can save up enough for a downpayment on another car. I do love my ocean and love driving it. Hopefully with all of yours and Matt's great tips and links to parts etc I will be able to keep my car going. Appreciate all of your info and please keep the tips coming!! I just had to buy a new brake pedal cover today as mine broke this week.
I filed with Hagens Berman but haven’t heard back, other than acknowledgement of my filing. Nothing to loose here that I can think of…I don’t know the law but hopeful there is some justice in taking this action.
HB will still review your loan paperwork even if you didn’t use Chase. The holder rule still applies to any loaner. It all depends on the T&C’s on your loan.
I did both the proof of claim and went through HB. I agree with you, I really don't see the downside. I haven't had that many issues with it, but recently, my air vents are not opening, and I keep seeing horror stories about 2.2. Hopefully those are the exceptions and not the norm, but I would most likely give up the car. Not having access to timely service or support, not having certain features that were the reason for getting the car in the first place (V2H capabilities for example), and not even having basic features that are standard on other cars (like smart cruise control with the distance following) are reasons why I would move on. It is a beautiful car and a lot of fun to drive and I was hoping to enjoy it for a long time. But the unknown weighs too much on me for something I shouldn't have to think about. i have sequence number 137! yep ordered Jan 2020, wanted for the solar , enough said, i am concerned that HB if the settlement is not enough and turn around and come after me for the additional funds!..once you sign that form, THEY determine THEIR fees...PS i reached out to chase about the warranty they gave me an 800 number for their "resolution" desk to talk about my situation...very interesting, haven't called yet
Here is from the FAQ If Hagens Berman prevails and my loan is discharged, will I have to pay Hagens Berman out-of-pocket, putting me in a worse financial situation? We considered that possibility carefully as we would very much prefer for our clients not to have to write us a check, even if they do benefit substantially from the outcome of this case. We will seek a cash payment for at least part of the judgment that we obtain in order to fund our fees. But such award is ultimately at the discretion of the arbitrator. We do not receive any fee unless we obtain a benefit for you. There is no scenario in which case you come out worse. By contrast, if you were to hire an hourly rate firm, you would owe their fee - win or lose at arbitration. ______________________________________________________________If the firm’s fees are more than my potential payout, am I responsible to pay Hagens Berman? The firm’s fee is a percentage of your recovery and cannot be more than your recovery.
I used Chase. I haven't reached out to HB but I also havent made a payment since February. I still have the car and my credits taken a hit. Im not sure if i should i don't want to own HB any money. I was also a contest winner that won a trip to Graz and the catch was i had to buy an Ocean One. I wonder if i can sue HF personally for that.
It will be interesting to see what happens to peoples cars if Chase loses. Do the collect the cars and sell them to American Leasing to recoup some of their loss or do the owners get to keep the cars? Interesting Fisker saga.
I want to keep my Fisker Ocean. I prefer to get the software update and the possibility to purchase parts and an extra key if possible. Do somebody know where I can order an extra key-fob ? Happy with my car.
I sent my info in and haven't heard a peep from HB... Hoping chase will just see the err and pay back all that has been paid. Like my FOO, but it can rot with the rage O have over all of this... should be able to be compensated for all of the stress/anxiety this has caused
We are not all in the same boat! So tired of hearing people claim to speak for everyone. I have not contact them because like most owners I did not use Chase, but if I did, I still can not understand the upside of giving away my dream car and paying someone 30% of the value. You will not get the money and keep the car.

Most did not use Chase because there rates were much higher then other bank offers ,prior to there 1.99 % special they ran for 6 eeeks or so.

I'm waiting for the call from HB, but I'm taking time compiling my paperwork. I love the vehicle... But I can't wait to get rid of it

I have turned my info but have not filled out retainer form. But i will take care of that soon. I was waiting for them to call.
The 1,000 Chase buy backs will end up as taxi's in NYC for the leasing company. Logical.

My understanding is that you only pay if they win and you accept the offer from Chase. I wouldn't pay a penny to HB if it's a shitty deal.
