  • A juror in the Alex Murdaugh murder trial told Judge Jean Toal she was influenced by the testimony of court clerk Becky Hill. However, she was asked by Toal if an earlier statement that she was influenced by other jurors was more accurate, and she said yes.

      Have private time with jurors. that's a seperate issue from whether she tried to influence jury. She is an elected official so wonder who would fire her? She should at least be given different responsibilities so she couldn't have private time with jurors.

      Criminal charges may be applicable.
      As an elected official, there is in mechanism to remove a SC county level elected official. Next election is November 2024.

    Juror is easily influenced and admitting she is weak and can’t make up her own mind. She should have not been on the jury in the first place. And the court clerk was entirely wrong to talk. Both have no right to being in a courtroom. Regardless Alex is where he should be and hopefully for a very long time

      True but likely he didn’t understand the question her words affirmed his decision. Hard to say if that would have changed his decision however we don’t have an alternative timeline where she didn’t do that

      But Juror Z said her decision was influenced. If that’s the case than the defendant did not receive a fair trial and this should come down to a mistrial.

      @@insilence6156 I mean I think Alex Murdaugh is guilty but a conviction needs to be fair. If there was jury tampering which according to Juror Z there was. Then the conviction was gained through dishonest and unfair means and this defendant should be given a new trial. This should be the viewpoint of anyone who wants are courts and Justice system to work fully.

    As someone who works in the NYC court system- I cannot imagine a clerk acting this way, they’d be arrested for felony jury tampering as should she!

      Unfortunately in SC for elected Court Clerks the training is a couple day seminar with zero prior education or clerk experience requirements.
      Clerk Hill was elected in Nov 2020 (took office Jan 2021). As there is no mechanism to remove the County level elected official. Re-election is November 2024.

      Because the clerk of the court is in charge, and already got another juror thrown out. The clerk is arranging your meals, your breaks, even wether you can smoke during the evening after court. She's controlling the press, the guards, the jury, and treats the whole building like she owns it. The judge treats her like she's in charge of the jury, the cameras, the press, the security, and the building, down to what time it gets unlocked.
      You're a juror watching this go on, and you don't actually know what the clerk is allowed to tell you. Do you tattle to the judge? The judge told you to ask the clerk for anything you need, and you're going around the communication chain the judge ordered you to follow? And you don't even know what the law says about the clerk giving you general advice about how to tell a lie from the truth.
      I don't think you say anything until you have a chance to ask a lawyer about it, and guess what: you've been ordered not to even tell your spouse about anything you see in the case.
      I think I would be afraid to get a contempt charge for even asking my attorney about it, and I'm going to look really stupid if it turns out she's allowed to give you general advice like get a good night's sleep, pay attention during testimony and don't look at your feet, look at the witness. Maybe she can say, watch all witnesses to see how certain or how uncomfortable they are as they answer certain questions.
      No, I think it's perfectly understandable that you keep your mouth shut until the judge releases you talk about your experience. Then when someone tells you that was crossing the line, or just says you should ask the defense if it's allowed, knowing they will tell you if it is and what to do, free of charge.

    The judge sounds like they may be a veteran who was in leadership with, “At ease.” The jurors and such better tread carefully in that courtroom.

    Huge screw up by Harpootlian - first by drafting para 10 of the affidavit that says juror z was pressured by other jurors, then by asking that the affidavit be given to juror z for questioning!!

    To me it appears the judge asked some intimidating questions at first, for instance, when the judge asked each juror if it was their true verdict, and some more questions that can be viewed as making the juror afraid to tell the truth about Becky’s behavior

    This judge is great and i wanna see her in a trial lol but shes so wrong about that affidavit. Wanting someone to review prior statements does not mean that it's admitted as evidence. I'm not sure what's wrong with this state but they need to stop giving reasons for new trials and appeals

      It should. The constitution guarantees any defendant a fair and unbiased jury. If one juror’s verdict was influenced by the clerk of court than that would mean that this juror’s verdict was biased, and that the defendant did not receive a fair trial. Remember all juror’s must vote unanimously to convict. If one holds out than it becomes a mistrial

    But… was he really guilty of killing the wife and son? What if it was someone else?
    Edit to add that knowing he owed money to people, that he must have had enemies, what if they wanted to hurt him in a manner that he would suffer enormously, then they hurt him killing the wife and son.
    He isn’t a healthy guy to perform physically all what it took to kill, run, dispose of clothes, guns, go here and there, hmmmm, as much as I dislike this man, I have been thinking how fit he would have to be to do all what it took to commit that heinous acts in super fast time?
    I believe he was considered guilty before the verdict, for his despicable character, his arrogance, his status and for his physical appearance.

      I agree that I don't think they proved him guilty. There is so much more going on with the whole story. The man had an addiction and mishandled others' money that doesn't make him a murderer. He should be given a new trial and Becky Hill should have known better.

    This judge wants the truth until the truth is not what she expected to hear. At 2:38, after getting the bad news, for the state, the judge starts using her right hand to point while asking questions. At 2:59, after getting the really bad news, for the state, the judge starts moving her jaw and mouth around as she did not expect that getting the truth would get these answers. She is possiby on the side of the state.
