It is correct that classification status is irrelevant to the charges when national security is at risk and safety procedures were breached. And if the documents were not cleared for the public perview, the espionage charge could still apply.

They don’t know or care what’s in the boxes. They will pack coffee pots full of fresh coffe not just grounds. But will wrap it up nice so it doesn’t break. Here's what I haven't heard, and maybe it's implied. If they know some of the top secret files went with Trump originally and didnt come back June 3, and then the lawyer signs a document pledging it has all been returned, then the FBI MUST do a subpoena because if the lawyers statement is true, then the FBI has to determine if it's not there then who broke into Maralago and stole top secret info?! That's terrifying.
Regardless if he declassified them or not, these are state secrets that contain our most sensitive info. If he declassified it, the info isn't any less valuable to foreign adversaries. For instance, say some of it was a list of our spies in a certain country, even if 45 declassifies it that info still has extreme value for that foreign country.
Here's the thing: we still don't know if the FBI found every Top Secret file Trump took meaning they could be comparing what was gone to what was recovered. Meaning some of the info could still be missing.

Why was he allowed to take the documents when he left the Whitehouse? If the documents were declassified there would have to be a record of the declassification change in order for it to be legal and above board. If there is no record of that anywhere then it didn't happen.

Went to grocery store today there was a freshly scrubbed family with 3 pre-school kids sitting at a Play school plastic table eating ice cream sandwiches. The husband was playing the accordion. The song was "Yesterday" The wife stood by to collect donations. The large well made sign read "Hard times trying to pay rent." I cried, handed them $10 and wished them luck. Another reason why I will never vote Democrat again. I can't imagine how anyone with a conscience could?
There was an excellent point made about Donald Trump receiving special treatment. The request for these top secret documents had been made months ago, then they were forced to subpoena Trump, then they were forced to search. I wonder if you or I would get the same treatment?

Fun story: I was document custodian for a building on a military base (Special Security Office). A Captain walked in and dropped a classified document on my desk and asked me to sign it back in for him in the log book and he left the office. My First Sgt caught my eye and shook his head NO. A few days passed and my First Sgt picked up the checkout log in the morning and walked over to the Captains office in the secure building and ask him for the document and pointed out where he had signed it out several weeks earlier. The captain had forgotten that he had placed it on my desk and asked me to sign it in for him. The captain and his entire team spent the rest of the day looking for that document in their office area. Back then it was 5 years and/or 5k$ fine, plus loss of military career. My First Sgt finally, at the end of the day, told the captain that the document had been located and that he had been irresponsible in turning lose of the document without ensuring his signature was in the log book returning it to me. The captain was very conscious of any classified material in his possession from that point on.
The fact that trump is so cavalier with classified documents says he doesn't understand the peril he is in. This isn't one of those situations where he can tie it up in court until the prosecution runs out of money. He is getting special treatment, as I dare ANYONE else to abscond with a single classified document and see how long they can stay out of federal prison.

After working cordially with Trump and his lawyers for several months but not getting the documents that were missing from the National Archives, documents that the NA subpoenaed, the Justice Department issued a subpoena to the former president for those documents, which they have a duty to retrieve. They gave him more time to comply, but he STILL didn’t hand them over. Hence the search and retrieval process.

It reminds me of Alex Jones in the recent Sandy Hook defamation case. He claimed under oath to have no pertaining documents that he was to send to the opposing lawyers. When later he was confronted with that, through a mistake by his own lawyers, the opposing lawyers did have the requested documents in possession, he said "well, now you have them" and assumed that would be the end of it.
He committed perjury and I'm certain that sooner or later he will get indicted and sentenced for it.

I thought the biggest issue is that His lawyer stated all of the "Classified" documents had been returned, and in fact had not, and the the President doesn't have the authority to "De-Classify" nuclear documents, AND that "De-Classified" documents are specifically re-stamped as "De-Classified" and the Top Secret or SSI stamp is stamped through, and it is reclassified throughout all of the Departments that were original recipients of the "Classified" documents.
