- Alec Baldwin claims he never pulled the trigger from the gun that killed Halyna Hutchins on his “Rust” movie set in New Mexico. Despite witnesses saying he was practicing shooting techniques, some firearm experts are now backing Baldwin saying he could be telling the truth. Law&Crime’s Sierra Gillespie spoke with Hollywood armorer Dutch Merrick about why Baldwin may be innocent ahead of trial.

I get it that it could be a "workplace accident" but there absolutely shouldn't have been live ammo on the set of a damn movie...period
Hannah is only responsible if she brought those rounds to set, otherwise it's all Alec. The lowest of the low budget producers. I mean, shot his own DP with a gun handed off by a first AD while the 'armourer' was off doing three other jobs, acting as her own assistant, planning the next location, etc. while somebody from another department was handing off a firearm to a principle under the direct supervision of the executive producer with forty, really?, years of experience.
I still think sabotage is a one of two most likely reasons, considering the low life's that work low budget and that they had labor problems including having the only unionized department bail the call. Which is unheard of.

With first interview, how she pulled bullets out of pockets and fannypack... Just horrific. Did she have maybe also bullets in her car? She did have in her hotelroom...
Six live rounds were found on set.
Hannah was an assistent armorer, first job, movie 'The old way'. Hired because of her last name. All the props were send back to DP. And given again for movie Rust. Shortage of ammo. Sarah got ammo from different places. Hannah also got ammo from her father. Box.
After 'The Old Way', Hannah did a radio interview, proudly telling that her father gave her a Peachemaker for X-mas. I still wonder: also with real bullets? They were already filming for a few weeks. Alec was just there a few days. His gunbelt & the gun were especially for him.
Somewhere in this story: I still don't understand: when Alec Baldwin shows up, the big boss, the so called 'A listed' moviestar, why not check & doublecheck & triple check his props?? Hannah even had more time that morning, because cameracrew leaving. A delay. To check every gun and every bullet. Her job was, to rattle every bullet. Every single time...But she got careless, because whomever expects a live round....
It will stay a mystery, how 6 live rounds ended up on set....What we know for sure, it wasn't Alec Baldwin...
@@belleblaas3843 I only saw the interview with Baldwin. I would have had to be there and see her work to know, but she definitely would have a hard time being outside and inside at the same time. She could not watch the set cart (outside) and work the set (inside) at the same time. Production was fatally flawed and her department was not a one person responsibility under props but a department which required at least three people. Department heads are also responsible for inspecting the next days shooting location and planning for that. They have seconds and thirds and apprentices.
And The Live ammo was not his fault... the money paid to this prosecutor for wrongfully charging: now the community loses...
So everyone elses failt but Baldwin? Is Baldwin paying this guy cause him blaming the victim is digusting

Gun experts from FBI can't get gun to fire without trigger pull. Several independent experts found same. Dude who admits to no experience with single action guns say they are wrong. What do you have to say about that?
He even downplays that the trigger still needs to be manipulated by a human finger to achieve it.
It seems to me this guy got paid by someone to talk about this, other than the Law & Crime Network. Guns are mechanical and only designed to be used one way. If guns could go off on their own we would have heard about countless scenarios where this happened over decades. The Colt was extensively tested.
What about the actors who were complaining that the guns were going off while in their holsters or otherwise misfiring?
@@rixvspinnerthe Colt was patented in 1873. It was vastly superior to previous revolvers because it held a modern cartridge. It had no safety features. It was safe because you could shoot it faster than the guy who was trying to kill you with another gun.

Baldwins team seems to be releasing it as a PR move or to chcek how many people will fall for this narrative. Baldwin should have been aware that even dropping a hammer on this gun could make it fire. And he broke one of the simplest rules: he aimed this gun at people. This "expert" also seems to not know the fact that we already know from Gutierrez trial. Or he chooses to omit them.
Law and Crime, I know you would want to have access to defense team for future interviews, but you might lose credibility with the viewers if you just spread this propaganda.
Calling this a "workplace accident" is dubious at best. Several basic firearm safety rules had to be ignored for this to occur. A reasonable and prudent person would be aware of the danger if you don't...

A woman died as a result of extreme negligence. Baldwin as well as everyone involved in the extreme reckless handling of the prop firearms need to be held accountable.
The FBI literally broke the gun into pieces trying to recreate the scenario. How do we know Alec pulled the trigger if the FBI BROKE THE GUN TRYING TO RECREATE IT. It obviously was a faulty gun. Just glad ppl like you aren't the juror.
Baldwin being so experienced in the field knows well what is right and wrong on a. Set. His own ambition to succeed in the movie and himself at the cost of ignoring safety concerns is what we see . And after knowing the dangers of the set , he still kept pressing to continue at his control

I used a browning hi powered in the army and I would never ready it unless I was going to use it because they will go off if you bump them, our medic had his readied and it fell out of the holster and went off into the wall
Which army was this? The US Army has never used the Hi-Power as an issue weapon. They also required that the Colt .45 ACP be carried with an empty chamber.

The only problem with this “expert’s” theory is that this was a custom made firearm from Italy, which had no inherent flaws with it at the time of the shooting as claimed by defense. This was already verified by several people on set during the HG trial stating that they saw him using it with each position of the hammer cocked at each specified interval without it slipping (i.e., only the pulling of the trigger around 2-3 ft-lb of force) will make it discharge as it was designed. The two firearms experts in this case also said the same thing. The prosecution will dismantle this nonsense in 30s if the defense even goes down this road of fantasy and make believe if they elect to bring in one of their own experts who testifies and makes this absurd claim.
Everything this guy says all assumes that the armorer is COMPETENT. The fact that there is no “certification” for this profession is mind blowing. The stupidest, most mundane jobs have certifications. Why can’t a union require armorers to be certified? That doesn’t seem to be asking that much.
Exactly, this female was not certified and completely incompetent. She was promoted just to pander to feminism. She should not have been anywhere near the armoury let alone being lead armourer.

This guy's opinion is just that- an opinion. I believe Baldwin should have been charged. It was his pressure to keep costs down that led to an inexperienced drug user being hired as an armorer. It was Baldwin's pressure to hurry up that made the set unsafe. He should be charged with something.
We still does not have a footage with the gun firing. The one with the so called shooting footage does not have recoil, flash or smoke or any indication that the gun went off.

There is no such thing as an “expert Hollywood armorer.” THAT’s the entire point and the problem. AND yes, it’s possible for some types of firearms to discharge based on an inadvertent hammer drop, but that does not necessarily mean anything. The prosecutor seems to think there is more to this case and probably knows more than this guy.

I don't believe that this could reasonably be brushed off as a workplace accident. That really minimizes the seriousness of mishandling guns. A gun is not a toy. It is not a mere tool. It is a deadly weapon. Even guns that are designed and used solely for sports or for movies are serious business, and "not following proper protocols" when handling a real gun is, in fact, criminal negligence. Baldwin should absolutely be held accountable for his actions, and in a way that is befitting the seriousness of his failures.

Dave Halls is one of the few to have put his hand up to accept responsibility. Calling him overbearing tells me this so called 'expert' knows very little about the inner workings of that particular set. "I've seen cases..." has nothing to with this case especially since there is an eye witnesses standing a few feet from Baldwin who will testify that he watched Baldwin pull the trigger. Armorers are responsible for the transport, storage, and safe use of all weaponry and firearms on film sets. This case should not even be happening, he is the Actor.

I remember at the time this all happened, one story about why Alec Baldwin was charged was because safety protocols were skipped to save money and Alec Baldwin was somehow responsible for the skipping of those safety protocols.

"without the trigger 'technically' being pulled" i disagree with this characterization. the trigger HAS been pulled, if the trigger cannot engage the sear. that is not optional. just because it doesn't have a sear reset like a self loading firearm doesn't mean it "isn't being pulled". it's the same thing used for hammer fanning and in other guns like the 1897 for slamfiring. it is known, utilized, and often desired. trying to re-goalpost it because he may not have MEANT to pull the trigger is disingenuous.
"my understanding of the scene" is incorrect, he was not supposed to be pulling out the gun, let alone pointing it. that was for a later wider shot. testimony is that he was only supposed to be partly drawing it, but was going further.

well yeah it was a mistake that doesn't negate the fact that incompetence was at play, but I don't think Baldwin is at fault here even if he did fire the weapon, he didn't realize how ignorant the team behind him was and he trusted his team. I don't think he will be convicted. OSHA never mentioned Baldwin name once in correlation to the events that led to the incident occurring instead putting fault at the team around him, they should be charging those who ignored standard safety protocols.

@@carrollsanders9376 The reason for the tragic outcome was because of ignoring standard safety practices that had already been established by previous production companies when using firearms and blanks. They had two other events of the weapon "misfiring" and no action was taken to make sure procedures were being followed to ensure safety. Dave Halls, the "Safety Coordinator" and "Assistant director" who only shared authority with two other people on set, was the one who took a plea deal. On the day of the incident, Dave, handed Baldwin the gun without checking it assuming it was filled with blanks.

OSHA focuses on employers and companies not the names of individuals. Their testimony in the Gutierrez trial revealed this.

So what if he didn't "pull the trigger"? It is a distinction without a difference. If he pulled the hammer back enough that when it dropped the firearm discharged then he has some responsibility. He also had to be pointing the firearm at the persons injured. No one failure caused this death and injury.
Why didn't they investigate the Prop house that provided the ammo? Didn't an employee of the prop house, on the set, admit to destroying ammo, evidence? Weren't they given immunity to testify? The pictures of that place looked like a hoarder house. A total mess, seems very possible they messed up.

The gun he was holding was pointed at Halyna. He's responsible for where the gun is pointed. The hammer wont drop unless the trigger is pulled. Dutch says "16 people on the set but not the armorer.....Alec is pointing a gun at someone....maybe someone should say "hey, were pointing a gun.....you gotta move". If that is true than it is also true Alec shouldn't have been so loose with the gun and thus culpability falls on Alec. What Dutch is trying to describe "no trigger pull" would mean Alec had the hammer pulled back about 1/4". a very small amount and it aint gunna float.

It's workplace negligence. Which is manslaughter not murder. Murder requires INTENT to kill. There's no evidence of that. But yes he should be charged with manslaughter.
