Don’t make the mistake of thinking you’re P&T so life is peachy... it’s not. I’m 90% with IU @100% P&T. There are realities to this. I’ve been on disability since I was med retired after my last deployment (10 years ago). I STILL sit around wondering “what if they just take it away one day?” I know it’s unlikely, but when you depend on someone else, it’s ALWAYS scary. That will hang over your head forever, because the government is not your friend. There’s nobody to feel guilty over screwing you... The other HUGE reality, is that now you know you’ve been thoroughly checked out, and you will most likely NEVER get better. This means your TBI/PTSD/Injuries/illness/etc... will probably never go away. So I personally try not to get discouraged, but it’s hard. I know the pain and my issues will be there tomorrow, the next day, the next day, and on and on. Then there’s the sitting around. Sure, you can find a hobby, but let’s be real... most of us with 100% or IU can’t get out and do stuff, or we lack motivation, or both. It’s hard. One day you’re lacing up your boots, feeling proud and full of purpose. The next day you’re a broken man/woman and everyday is a struggle. I hope beyond hope that many of you never HAVE to be P&T. If you are, prepare your mind for those realities. I didn’t and it has exacerbated several of my issues.....
Wow... “lacing up your boots” that line hit me deep. I know that feeling... lots of ups and downs in and out of service. I also feel that way, what if one day they take away the help. Family and I have been thru the homelessness, thru the barley making it. Thru living with people cuz we had no place to go. Stress, depression, anxiety is always with me, even right now that we are doing ok. 5:23 am, awake mostly all night every night, this is my life now. Plz be safe to each and every veteran.
You know what's worse.. when you ex wife is now trying to get more child support money... after you've been awarded 100% p&t.. the question now is do I quit my other job or pay her a ridiculous high amount of child support just because I have a higher income now... women out here trying to take advantage of my disability/money.. ridiculous ...don't get married folks
@@paulnightwolf9043 it’s less likely, but there are circumstances where you can be reevaluated. Anything from a pack of seeking care, to fraud suspicion. The longer you’re rated though, the harder it is to reduce benefits....
@@paulnightwolf9043 I haven’t heard of any va doctor doing that, they could be putting themselves or their patients in danger. The part about seeking care is because they VA has a habit of thinking, “Well they aren’t getting treatment so they must be better.” It’s a flawed concept because some people forget (TBI), don’t want to leave their home (PTSD, Etc) or just don’t want to be in a crowded VA clinic (half the vets in the country). So yeah....
As always a professional, understandable, to the point and friendly presentation. I concluded my own recent P&T decision with VA actually! In fact it was decided for me with no further questions or evidence needed. I watch all of your broadcasts and have seen most of your youtube videos including some that are non applicable to my situation. I am absolutely sure the knowledge I gained from CCK help me gain an insight to better prepare my very simple and straightforward service connected disability resulting from active duty. If it had been any more complex I would have done anything in my power to save any amount of money to reach out and get in touch with one of you to represent me. I'm that impressed. Keep doing what you all are doing! You do a great service to Veterans like myself! You should be proud that the information you pass down changes lives.

Everyone give this a thumbs up so it’s up top. I’m going to drop some knowledge on you all and answer all these questions. First there is a difference in rating. Scheduler and TDIU. Scheduler is your disability ratings calculate to you getting 100%. TDIU is when someone is NOT 100% but meets the criteria to apply for 100%. Scheduler you can still work another job. TDIU you cannot work another job because you are stating that your disabilities make you unemployable and you need that 100% to survive. Secondly if you receive a 100% p&t rating then your case is closed and you receive the max rating. Because your case is closed they cannot reopen it and lower your ratings. The ONLY way you could lose your rating is if YOU reopen by filing another claim. So if you don’t file any more claims then your disability case will remain closed.
If a veteran is nearing retirement age and is determined to be TDIU P&T then has a surgery that could improve her condition, could the VA reevaluate her and remove her P&T designation?
@@aioshi24 Thank you for the reply. The VA needs to be involved since the condition is service-connected. Either the VA will have to perform the surgery or the VA will need to send it to Community Care so that the veteran won't have to pay for the surgery. If this is done, can the VA reevaluate the veteran for P&T while in her 60's?

He was wounded in veitnam and in combat and he had a purple 💜 heart he was a Sharp shooter and a guner . When he found ! He only lived nine months after he found out. He had cancer ♋♋🦀♋🦀

However if qualified, a veteran can collect BOTH VA disability & Social Security disabilty (SSDI) at the same time. Know that the VA rates disability by 10% increments. Social security is cut & dry. You are either disabled or not! No percentage increments! The VA & Social Security have different rules/regulations to determine disability.
Would be terrible of the VA to take away your P and T then you lose your champ va for your family, dis-enroll your dependents from their college, have to reverse all the state benefits like property taxes,etc etc.. and they wouldn’t lose a minute of sleep. No wonder vets commit suicide when their benefits are stripped.
Hi. I hear that for P&T the VA doesn't SCHEDULE you for a future exam. However, it doesn't state that they will NEVER schedule you for a future exam. They can whenever they want, its just not scheduled. Is this true? What are the odds that they will schedule me for a re exam (even if I do not open a new claim myself)?
If you don't ask some very particular questions, on both the Medical AND Administrative sides, they will never give you pertinent information about anything. If they did, it would create a larger outlay of funding annually. Their(The VA) viewpoint is the REAL, Don't Ask - Don't Tell. I was retired at 70%, years later Depression added at 50% = 80%. I became unable to work a few years after that, a VSO assisted me in getting IU. I was granted 100%. I also assumed that was it. Until I asked for a benefits letter to obtain a fishing license... First comment I made was, "What the #=(_$?+/ is, Permanent and Total, and why am I on it? The VA is not in existence to provide benefits. They simply sit and wait for you to ask the correct questions.
Almost forgot. The Central Texas VA Healthcare System is forcing, "Eligibility Evaluations", on Veterans. I've been getting healthcare from the VA since 1990. Anybody care to make a bet what that's about?
I’m rated 100% IU with P&T. Is that rating mine for life or will the VA take it from me? I saw that P&T don’t have to get re-evaluated again, I’m assuming that’s me as well
VA, loses, "records" Back, in 2005, I took chest , xrays, into VA , to check, on my Asbestos exposure, in service, when I re-entered the ,VA, health system in 2018, asked, after they determined I had COPD, were, my results, from those Xrays, were they said "We don't have any, of you're scans on file !" Or results. Ummmm.
I am an AF vet and experienced MST “military sexual trauma” during my entire active duty service. I was rated 100% temp, 100% TDIU and now I am 100% P&T….Then I retained lawyers and fought for an ‘earlier effective date’ to go back to my original date of my claim. My case went to the ‘Federal Court of Veterans Appeals’ and won my case there and also created case precedent. Then The VA had to pay my lawyer fees and I was awarded back pay to original date of claim since I never missed any appeal dates. I also won my SSDis benefits. With this I am able to assist other female vets and all other vets to file their claims for service-connected disability. It was a long fight, but I have been 100% P&T since 1995. I also study to become a Veterans Advocate. I was told by the VA that I could obtain employment if I choose BUT MY 100% P&T will never be reduced. I qualify for VOC Rehab and other benefits but will never be reduced. I thank The Lord that I am able to be a conduit and a testimony for other SEXUALLY TRAUMATIZED female veterans and also site my case from the FCOVA so they will be awarded their 100%!
Hi, I have a couple of questions to ask being 100% disabled veteran myself. I receive disability from VA and ssi. But with ssi although I receive disparity it's not 100% which I do not understand. My second question is because of my disabilities I have limitations. But recently I applied for a 3-4 month tech school for nail tech/training school. I think I qualify for Chapter 31 under vocational rehab. The issue is I don't want to open pandora's box either because the VA once informed me of their way of thinking meaning they feel if a disabled veteran can go to school then they can work. But in my opinion each case is different depending on each individual circumstance. School starts November 6 for the class I'm trying to attend and I submitted my claim on 12 September. My time for attendance is getting close. I don't know what to do to expedite the process. Can u assist?
Hi Question - I was awarded P&T but I have a scheduler 70% rating for depression and awarded TDIU - so is the P&T just for me not to get anymore C&P exams? I don't understand the purpose of P&T with 70% .My condition is not stable nor has it improved but I need to go back to work I can't live off 3146 a month (2021 VA TDIU rate) and I was denied SSDI. When my state disability terminates I will ask the VA to terminate my TDIU. Just knowing I need to do this makes my depressive symptoms worse. I understand I can work with TDIU but I cannot earn more than 13k (poverty level for single person). Thank you

I had Hodgkin's on active duty in the 1980s, and two years ago had carcinoma of the tonsil (deemed service connected). My VA ENT doctor who has treated me from the beginning of the carcinoma of the tonsil for post treatment problems such as neuropathy of hands and feet, lymphedema of the interior of throat, and fibrosis of the throat and tongue base told me he put in a consult for palliative care clinic. I was told by someone associated with the VA that palliative care would entitle me to a P&T award within a few months. I have researched until I have exhausted places to find an answer without finding one. Would you know whether the VA person was correct or not, and if you know anything about palliative care entitlements and or compensation? I appreciate your professional opinion.

@@niinarku5696 Multiple Disability Injuries with one them rated %40 or higher and totaling %70 or more. Taken in account of the numerous types a rating of %100 MAY be awarded. I have 4 at %10, a "K" award and 1 at %50.
I just went from 100 temp to 100 P&T for a mental health issue. The letter said no more further examinations but I've been hearing that the rating can be reduced if their is proof, and can second, should I still stay engaged with the VA because the letter says that no further examinations are needed. I still will stay engaged with the va, just not weekly like I've been doing.

@Ebelen Tafoya, P&T ratings are protected from being reduced and veterans are guaranteed to continue receiving such benefits for the rest of their lives. VA does not require those assigned a permanent and total disability rating to undergo any further medical examinations.
@Kevin Patrick, generally speaking, if you receive a 100 percent rating on a schedular basis, employability is not factored into your rating. As long as your disabilities continue to meet the rating criteria specified. Well I ask because I am married with 5 kids. My 100% doesnt cover all of my bills to support my family. I have to have additional income or I’m screwed. Work is hard mentally, I am currently on short term disability thru my employer because of current events.
Total OCCUPATIONAL and social impairment is the criteria to be rated 100 percent. Therefore you SHOULD not be working and if you are able to then you SHOULD not be rated as such. Learn to read I didn't say he cant work I said he shouldn't be and if able to then should be rated lower since the 100 percent rating is saying TOTAL OCCUPATIONAL IMPAIRMENT.

Let say you have a combined rating to grant 100% P&T and are awarded. Now lets say for example you have physicals therapy for one disability and were seeing a psychiatrist for PTSD treatment once a month including prescribed medication. Will this hinder the rating granted? Now let say you are continuing with physical therapy but your psychiatrist has not scheduled you more monthly appointments and need more meds. Will this hinder your rating? finally, if you do request for more appointments to see your psychiatrist, and request more meds, will this hinder the rating?
It will not hinder anything because you said in the beginning that you already have a combined rating to grant 100% P&T and are awarded, unless you are talking about reductions.

@sealgryhnd, If you fail to attend, and do not call to reschedule or explain why you are unable to make it, then it is likely that VA will reduce or terminate your disability benefits. i have a tough one. im considered t&b disabled i have un earned income from fers disability i work 2 days a week to get out the house. will i still be able to work 2 days when they combine earned income with unearned income?

I always get different answers when I ask if 70% TDIU (individual unemployable), P&T (permanent and total disability) veterans paid at the 100% rate can get a DV plate in Florida.
That’s a good question.. I would go to the DMV and ask them. Or go to your nearest Veteran Service Center. I got my DV plates but they wanted proof of my 100%. Not my pay but my actual 100% disability. So maybe they won’t but it wouldn’t hurt to just go check.

I was rated at 90% in 2017 and wanted to increase to 100%. Along with my ongoing medical issues I filed for TDIU. Well I ended up getting my TBI rated @ 100% (P&T) and it says IU is "moot". Does that mean I can technically work? any information would be helpful and greatly apricated
@@TheJoshua61840 hey I actually found my answer. So yes I am able to work. If you get any condition rated at 100% then you’re considered P&T. If you get TDIU then it will say that (of course). Moot being that my IU was irrelevant given my 100% rating. Hopefully this info helps.

dear sirs ; I received 100% disabilItyPTSD in the letter from VA finding it said it was 100% P&T 20 years ago in Arizona. Later the VA office would upon request issue me a disability letter to use for various State programs like license plates. These letter always stated a 100% rating and P&T. Later I moved to Oregon and requested the same type letter from VA office there.(Portland). However this time THE LETTER stated I was CURRENTLY RATED 100% and no statement that I was P&T. I brought this up to a VA social worker, she replied that information was not available to me. I,ve always wondered about this. What if anything should I do?

Hey in doing the math you don't reach 100%, but in just glancing at your conditions, I have no clue why you are not 100% P&T. And it all depends on who is reviewing your documents. I submitted several claims, requested a higher rating, and disagreed with the effective date and finally someone sat down and reviewed my record in its totality and came to the conclusion I believed was correct. Fortunately I didn't wait as long as some but I did everything within 1 year of separation. Well I hope you get what you want and deserve.
I have a question. I was med boarded out of the Air Force and given temporary 100% disability for Schizophrenia. I don’t have an evaluation until 2021. I don’t see my condition getting any better. Do you think I will get 100% Permanent and Total?

I have a Question if you don't mind answering. If someone is rated P & T, how long will it take to lock that in to where the VA can never change it? There's no "written in stone" rule for it at the VA and no one at the VA can give a definite answer, not even the multiple service organizations I posed the question to.

@@CCK_Law I had a similar situation. I am P&T, and I called to ask if I was allowed to try to work, and the VA said yes. Then I asked about the vets who were volunteering at the VA and lost their benefits, (Presumably TDUI) But then they told me "It's on a case by case basis, but you SHOULD be ok." So, I asked for a rulebook, to make sure that they aren't going to take my benefits if I try to work. They said that they don't have one. It's case by case. I bet I could call 10 times a day, and get 10 reassuring guesses. So, what's the deal? Am I allowed to try to work? (I've seen other military lawyers say that they can in fact cut your benefits if they choose to, but it doesn't usually stick, in the mean time, they've destroyed your life by making you legally fight them.) Also, Blakeds1, if you end up in jail for 30 days, or in a psych ward for 30 days, they can and will cut you off completely, and you'll have to re apply.
@@TheRavenCapitalTCapitalR Thank you for the answer, but there is one part you got wrong. Because two of my conditions are psych related (PTSD and a TBI), they can't cut me off at all because my disability put me in the psych ward.
@seethebeauty Well, I knew a guy from the military psych ward, who ended up getting 30 percent disability, he was allowed to work, and in fact made over 100,000 dollars a year driving. He was not penalized for being able to work, later, he was at 70 percent, making 70 percent income from disability, still making over 100,000 a year. If a person is rated at 100 percent, it shouldn't be different for being more disabled. It would be quite unfair. P&T SHOULD mean that you simply don't require re-evaluations. I was considered 100 percent disabled for 10 years or so, before they gave me the P&T. Basically, just because you get disability doesn't mean you can't work, and vice versa, it's more along the lines of the military admitting that they caused you life long harm. It's not like with social security, or unemployment, which typically limits your disability to income ratio.
The difference would be P&T TDUI, which would imply that you are making FAAAAR more from your disability by granting you the 100 percent income rate, even if you only have 30 percent disability, which is the based on your ability to work, which would make your question, "If you can work, why would you want disability?". Well, 100 percent TDUI would likely make more money NOT working. The real question is, if 100 percent P&T, if you are collecting disability, why not work?
@kenndeaux317, TDIU is permanent in certain circumstances. However, VA must make this finding. If that is the case, VA will indicate that in your rating decision. @@kenndeaux317, yes. Once you are 70 years old, you will no longer have to submit VA Form 21-4140: Employment Questionnaire, which VA uses to determine your employment status and whether you have worked in the past 12 months.
I am 90 percent scheduled rated but I am 100 percent p & t because I’ve been unemployable for the past 5 years... I am having a problem with receiving my I.d. Card what should I do?

@Jim Burnett not true I have my ID now. Some of the employees are still misinformed but as long as you get your 100 p & T status your scheduler doesn’t matter. A great indicator of P & T is chapter 35 if you receive this then you can receive all the benefits and percs

I have a question. Can a veteran get an increase on his regular rating to make it to 100% and get rid of the P&T? They want you to stay active and continue to move or find a hobby, but you're not allowed to make an extra income for your family on the days that you feel somewhat ok. Was offered a job subbing at the school (on my good days), but I can't even do that which is something that I used to do and enjoy doing, would keep my mind off of everything else that makes it race, and keep me somewhat moving. So being on P&T to some can be a silent killer in my opinion. I've developed more mental health issues because I "can't" do anything. So, again my question is can a veteran get an increase on his regular rating ( I'm rated 90%, but considered 100% P&T) to make it to 100% regular rating and get rid of the P&T?
You can work a civilian job and still keep the 100 P&T, lots of people do. Now the SSDI (social security disability insurance) is different, you can't also work if you receive that.
if the vertigo is related to the service and there is something you can relate it back to the service then you will get a rating based on how severe the vertigo is. i have multiple sclerosis and vertigo is one of the symptoms. it is tracked back to my time in the marines and is rated on my va records. i get 40% for the entire illness and all that encompasses its symptoms.
@@JohnJohn-co9yz sorry for the late reply. what you need to do is make a physical appointment with your doctor and tell them you have balance problems and double vision. then get a referral to see a neurologist to get a neurologist to give you a neurology physical and a blood and mri and lumbar puncture. the mri will find scars on your brain. the lumbar puncture will find oligoclonal bands in your brain and spinal fluid.
I just had my exam for my severe persistent chronic asthma. It stated that my asthma precludes me from any physical occupation. Does that mean they find me totally or partially disabled?
Unless they state in writing you are "Totally" disabled or you are rated at "100%" you are not ""totally"" disabled. It will be on your award letter. Until then you will not know what you are. As of now it doesn't look like total. I would imagine you could find work sitting down in an office setting for example. That would not be total occupation impairment.

I am going for another c and p exam next year. I was awarded 70% but a week later 100% tdiu in 2016. Ptsd, anxiety disorder, panic attacks, flash backs. Serious memory loss problems, dissociation issues. I have been diagnosed sleep apnea since also. And no change in my condition even with medication and such. What are my odds of becoming permanent on my exam next year?
Samuel Hargrove they back dated me in 2017 to 2016. I reapplied since 2013 instead of appealing. Thought I was appealing. I got out in 1999 general under honorable conditions. But only have records of my medical problems since 2005. My va rep told me I’m going for another c and p next year. I guess they can re examine anytime but I thought it was 5 years. My psychiatrist at the va doesn’t know why they just didn’t make me permanent from the start. Don’t know if any of this is needed to tell but figured o would give you a little history. What action should I take if on 9/26/2013 I received a 100% rating only, but still had 6 pending claims overlook, and later they're withdrawn by the VA. My chronic insomnia, PTSD, Endometriosis, chronic groin pain, and left knee meniscus tear. I put in a NOD and they were all denied. Now my VF9 form is still pending at the VBA board. Well on 1/29/2021 I received a 100% P&T with an effective date of 9/26/2013. How can the VA give me an effective date of 9/26/2013 with this P&T but in the year 2013 I was only issued 100%. I missed out on all of the back taxes that I paid from 2013-2020 on my home and state taxes. Please advise thank you Wilson

Hello Larry, veterans who are rated Permanent and Total may work if they are able with no effect on their VA benefits. Veterans who receive Individual Unemployability are restricted in the amount they can earn in relation to continuing to collect VA benefits. Hope this helps!
im 100% for schizo service connected. its my understanding that after a couple reevaluations for disability rating if you are still found to be 100% without your disability not improving you can be rated p&t. i dont know how many reevaluations you need or how many years you need to wait but thats what i learned from research. keep seeing your dr for appointments. your reevaluations will rely on those records + any hospitalizations you may have.
Best advise from a currently disabled veteran: If you have 100% P&T, I don’t care if your arm falls off, DO NOT FILE ANOTHER CLAIM! It is just an opening for the VA to look at EVERYTHING in your file and they WILL go after a reduction. Someone who worked at VBA informed me that there are claims specialists there that specifically go after one hundred percenters that file for more. They are backed up on work and get pissed off be cause they see it as a “greed”move. Word to the wise LEAVE IT TF ALONE or you’ll be kicking yourself for poking the bear. You’ve been warned.
100% P&T Navy Vet here. They usually give you a paper called an Award Letter after you’re found service connected. If you have that you don’t have to prove anything, it’s all there on that letter
@Frank Gonzales, VA categorizes amputation in terms of traumatic amputation or amputation by surgical removal. There are different VA disability ratings based on the different types of amputations. @bigmills525, to qualify for permanent and total disability, VA must determine your service-connected condition is totally disabling (rated at 100%) with zero or close to zero chance of improving. I became 100% T.P. in 2005 I ask the Social Security about S.S benefits. They said I need to quarts to qualify for S.S benefits. Is that the law or should I apply for S.S benefits?. HEEP!.
Don’t make the mistake of thinking you’re P&T so life is peachy... it’s not. I’m 90% with IU @100% P&T. There are realities to this. I’ve been on disability since I was med retired after my last deployment (10 years ago). I STILL sit around wondering “what if they just take it away one day?” I know it’s unlikely, but when you depend on someone else, it’s ALWAYS scary. That will hang over your head forever, because the government is not your friend. There’s nobody to feel guilty over screwing you... The other HUGE reality, is that now you know you’ve been thoroughly checked out, and you will most likely NEVER get better. This means your TBI/PTSD/Injuries/illness/etc... will probably never go away. So I personally try not to get discouraged, but it’s hard. I know the pain and my issues will be there tomorrow, the next day, the next day, and on and on. Then there’s the sitting around. Sure, you can find a hobby, but let’s be real... most of us with 100% or IU can’t get out and do stuff, or we lack motivation, or both. It’s hard. One day you’re lacing up your boots, feeling proud and full of purpose. The next day you’re a broken man/woman and everyday is a struggle. I hope beyond hope that many of you never HAVE to be P&T. If you are, prepare your mind for those realities. I didn’t and it has exacerbated several of my issues.....
Wow... “lacing up your boots” that line hit me deep. I know that feeling... lots of ups and downs in and out of service. I also feel that way, what if one day they take away the help. Family and I have been thru the homelessness, thru the barley making it. Thru living with people cuz we had no place to go. Stress, depression, anxiety is always with me, even right now that we are doing ok. 5:23 am, awake mostly all night every night, this is my life now. Plz be safe to each and every veteran.

You know what's worse.. when you ex wife is now trying to get more child support money... after you've been awarded 100% p&t.. the question now is do I quit my other job or pay her a ridiculous high amount of child support just because I have a higher income now... women out here trying to take advantage of my disability/money.. ridiculous ...don't get married folks
@@paulnightwolf9043 it’s less likely, but there are circumstances where you can be reevaluated. Anything from a pack of seeking care, to fraud suspicion. The longer you’re rated though, the harder it is to reduce benefits....
@@paulnightwolf9043 I haven’t heard of any va doctor doing that, they could be putting themselves or their patients in danger. The part about seeking care is because they VA has a habit of thinking, “Well they aren’t getting treatment so they must be better.” It’s a flawed concept because some people forget (TBI), don’t want to leave their home (PTSD, Etc) or just don’t want to be in a crowded VA clinic (half the vets in the country). So yeah....
As always a professional, understandable, to the point and friendly presentation. I concluded my own recent P&T decision with VA actually! In fact it was decided for me with no further questions or evidence needed. I watch all of your broadcasts and have seen most of your youtube videos including some that are non applicable to my situation. I am absolutely sure the knowledge I gained from CCK help me gain an insight to better prepare my very simple and straightforward service connected disability resulting from active duty. If it had been any more complex I would have done anything in my power to save any amount of money to reach out and get in touch with one of you to represent me. I'm that impressed. Everyone give this a thumbs up so it’s up top. I’m going to drop some knowledge on you all and answer all these questions. First there is a difference in rating. Scheduler and TDIU. Scheduler is your disability ratings calculate to you getting 100%. TDIU is when someone is NOT 100% but meets the criteria to apply for 100%. Scheduler you can still work another job. TDIU you cannot work another job because you are stating that your disabilities make you unemployable and you need that 100% to survive.
Secondly if you receive a 100% p&t rating then your case is closed and you receive the max rating. Because your case is closed they cannot reopen it and lower your ratings. The ONLY way you could lose your rating is if YOU reopen by filing another claim. So if you don’t file any more claims then your disability case will remain closed.
If a veteran is nearing retirement age and is determined to be TDIU P&T then has a surgery that could improve her condition, could the VA reevaluate her and remove her P&T designation?
@@amaznjohn Not unless you inform them about said surgery. If your case is closed, I'd leave it at that.
@@aioshi24 Thank you for the reply. The VA needs to be involved since the condition is service-connected. Either the VA will have to perform the surgery or the VA will need to send it to Community Care so that the veteran won't have to pay for the surgery. If this is done, can the VA reevaluate the veteran for P&T while in her 60's?

The VA sends a benefits letter to the veteran that state you are P&T, and the date you became P&T and the rate
However if qualified, a veteran can collect BOTH VA disability & Social Security disabilty (SSDI) at the same time. Know that the VA rates disability by 10% increments. Social security is cut & dry. You are either disabled or not! No percentage increments! The VA & Social Security have different rules/regulations to determine disability.
Would be terrible of the VA to take away your P and T then you lose your champ va for your family, dis-enroll your dependents from their college, have to reverse all the state benefits like property taxes,etc etc.. and they wouldn’t lose a minute of sleep. No wonder vets commit suicide when their benefits are stripped.
Hi. I hear that for P&T the VA doesn't SCHEDULE you for a future exam. However, it doesn't state that they will NEVER schedule you for a future exam. They can whenever they want, its just not scheduled. Is this true? What are the odds that they will schedule me for a re exam (even if I do not open a new claim myself)?
If you don't ask some very particular questions, on both the Medical AND Administrative sides, they will never give you pertinent information about anything. If they did, it would create a larger outlay of funding annually.
Their(The VA) viewpoint is the REAL, Don't Ask - Don't Tell.
I was retired at 70%, years later Depression added at 50% = 80%. I became unable to work a few years after that, a VSO assisted me in getting IU. I was granted 100%. I also assumed that was it.
Until I asked for a benefits letter to obtain a fishing license...
First comment I made was, "What the #=(_$?+/ is, Permanent and Total, and why am I on it?
The VA is not in existence to provide benefits. They simply sit and wait for you to ask the correct questions.
Almost forgot. The Central Texas VA Healthcare System is forcing, "Eligibility Evaluations", on Veterans. I've been getting healthcare from the VA since 1990. Anybody care to make a bet what that's about?

There's also an added protection for disabled veterans who are 55 yrs old.
55 yo thing is criteria the VA looks at for consideration but isn’t law.

I am TDIU my total rating is 90 percent. They pay you at 100 percent compensation, but they don't rate you 100 percent.
VA, loses, "records" Back, in 2005, I took chest , xrays, into VA , to check, on my Asbestos exposure, in service, when I re-entered the ,VA, health system in 2018, asked, after they determined I had COPD, were, my results, from those Xrays, were they said "We don't have any, of you're scans on file !" Or results. Ummmm.
I am an AF vet and experienced MST “military sexual trauma” during my entire active duty service. I was rated 100% temp, 100% TDIU and now I am 100% P&T….Then I retained lawyers and fought for an ‘earlier effective date’ to go back to my original date of my claim. My case went to the ‘Federal Court of Veterans Appeals’ and won my case there and also created case precedent. Then The VA had to pay my lawyer fees and I was awarded back pay to original date of claim since I never missed any appeal dates. I also won my SSDis benefits. With this I am able to assist other female vets and all other vets to file their claims for service-connected disability. It was a long fight, but I have been 100% P&T since 1995. I also study to become a Veterans Advocate. I was told by the VA that I could obtain employment if I choose BUT MY 100% P&T will never be reduced. I qualify for VOC Rehab and other benefits but will never be reduced. I thank The Lord that I am able to be a conduit and a testimony for other SEXUALLY TRAUMATIZED female veterans and also site my case from the FCOVA so they will be awarded their 100%!
Hi, I have a couple of questions to ask being 100% disabled veteran myself. I receive disability from VA and ssi. But with ssi although I receive disparity it's not 100% which I do not understand. My second question is because of my disabilities I have limitations. But recently I applied for a 3-4 month tech school for nail tech/training school. I think I qualify for Chapter 31 under vocational rehab. The issue is I don't want to open pandora's box either because the VA once informed me of their way of thinking meaning they feel if a disabled veteran can go to school then they can work. But in my opinion each case is different depending on each individual circumstance. School starts November 6 for the class I'm trying to attend and I submitted my claim on 12 September. My time for attendance is getting close. I don't know what to do to expedite the process. Can u assist?

I can't live off 3146 a month (2021 VA TDIU rate) and I was denied SSDI. When my state disability terminates I will ask the VA to terminate my TDIU. Just knowing I need to do this makes my depressive symptoms worse. I understand I can work with TDIU but I cannot earn more than 13k (poverty level for single person). Thank you

I had Hodgkin's on active duty in the 1980s, and two years ago had carcinoma of the tonsil (deemed service connected). My VA ENT doctor who has treated me from the beginning of the carcinoma of the tonsil for post treatment problems such as neuropathy of hands and feet, lymphedema of the interior of throat, and fibrosis of the throat and tongue base told me he put in a consult for palliative care clinic. I was told by someone associated with the VA that palliative care would entitle me to a P&T award within a few months. I have researched until I have exhausted places to find an answer without finding one. Would you know whether the VA person was correct or not, and if you know anything about palliative care entitlements and or compensation? I appreciate your professional opinion.

@@niinarku5696 Multiple Disability Injuries with one them rated %40 or higher and totaling %70 or more. Taken in account of the numerous types a rating of %100 MAY be awarded. I have 4 at %10, a "K" award and 1 at %50.

I just went from 100 temp to 100 P&T for a mental health issue. The letter said no more further examinations but I've been hearing that the rating can be reduced if their is proof, and can second, should I still stay engaged with the VA because the letter says that no further examinations are needed. I still will stay engaged with the va, just not weekly like I've been doing.
Only if there is proof you lied about your disability. Other then that, P&T is protected

@Ebelen Tafoya, P&T ratings are protected from being reduced and veterans are guaranteed to continue receiving such benefits for the rest of their lives. VA does not require those assigned a permanent and total disability rating to undergo any further medical examinations.

If you're 100% for PTSD you should not be working and if you are then you shouldn't be rated 100%
Well I ask because I am married with 5 kids. My 100% doesnt cover all of my bills to support my family. I have to have additional income or I’m screwed. Work is hard mentally, I am currently on short term disability thru my employer because of current events.

Total OCCUPATIONAL and social impairment is the criteria to be rated 100 percent. Therefore you SHOULD not be working and if you are able to then you SHOULD not be rated as such. Learn to read I didn't say he cant work I said he shouldn't be and if able to then should be rated lower since the 100 percent rating is saying TOTAL OCCUPATIONAL IMPAIRMENT.

Let say you have a combined rating to grant 100% P&T and are awarded. Now lets say for example you have physicals therapy for one disability and were seeing a psychiatrist for PTSD treatment once a month including prescribed medication. Will this hinder the rating granted?
Now let say you are continuing with physical therapy but your psychiatrist has not scheduled you more monthly appointments and need more meds. Will this hinder your rating?
finally, if you do request for more appointments to see your psychiatrist, and request more meds, will this hinder the rating?
It will not hinder anything because you said in the beginning that you already have a combined rating to grant 100% P&T and are awarded, unless you are talking about reductions.
It will only be reduction unless you are P&T, you are something else

I always get different answers when I ask if 70% TDIU (individual unemployable), P&T (permanent and total disability) veterans paid at the 100% rate can get a DV plate in Florida.
That’s a good question.. I would go to the DMV and ask them. Or go to your nearest Veteran Service Center. I got my DV plates but they wanted proof of my 100%. Not my pay but my actual 100% disability. So maybe they won’t but it wouldn’t hurt to just go check.

I was rated at 90% in 2017 and wanted to increase to 100%. Along with my ongoing medical issues I filed for TDIU. Well I ended up getting my TBI rated @ 100% (P&T) and it says IU is "moot". Does that mean I can technically work? any information would be helpful and greatly apricated

@@TheJoshua61840 hey I actually found my answer. So yes I am able to work. If you get any condition rated at 100% then you’re considered P&T. If you get TDIU then it will say that (of course). Moot being that my IU was irrelevant given my 100% rating. Hopefully this info helps.

dear sirs ; I received 100% disabilItyPTSD in the letter from VA finding it said it was 100% P&T 20 years ago in Arizona.
Later the VA office would upon request issue me a disability letter to use for various State programs like license plates.
These letter always stated a 100% rating and P&T.
Later I moved to Oregon and requested the same type letter from VA office there.(Portland). However this time THE LETTER stated I was CURRENTLY RATED 100% and no statement that I was P&T.
I brought this up to a VA social worker, she replied that information was not available to me.

Go to V.A. gov and look at your benefit letter. If it say your're P&T then you are. If it doesn't then your're not..simple

Hey in doing the math you don't reach 100%, but in just glancing at your conditions, I have no clue why you are not 100% P&T. And it all depends on who is reviewing your documents. I submitted several claims, requested a higher rating, and disagreed with the effective date and finally someone sat down and reviewed my record in its totality and came to the conclusion I believed was correct. Fortunately I didn't wait as long as some but I did everything within 1 year of separation. Well I hope you get what you want and deserve.

I have a Question if you don't mind answering. If someone is rated P & T, how long will it take to lock that in to where the VA can never change it? There's no "written in stone" rule for it at the VA and no one at the VA can give a definite answer, not even the multiple service organizations I posed the question to.

@@CCK_Law I had a similar situation. I am P&T, and I called to ask if I was allowed to try to work, and the VA said yes. Then I asked about the vets who were volunteering at the VA and lost their benefits, (Presumably TDUI) But then they told me "It's on a case by case basis, but you SHOULD be ok." So, I asked for a rulebook, to make sure that they aren't going to take my benefits if I try to work. They said that they don't have one. It's case by case. I bet I could call 10 times a day, and get 10 reassuring guesses. So, what's the deal? Am I allowed to try to work? (I've seen other military lawyers say that they can in fact cut your benefits if they choose to, but it doesn't usually stick, in the mean time, they've destroyed your life by making you legally fight them.) Also, Blakeds1, if you end up in jail for 30 days, or in a psych ward for 30 days, they can and will cut you off completely, and you'll have to re apply.
@@TheRavenCapitalTCapitalR Thank you for the answer, but there is one part you got wrong. Because two of my conditions are psych related (PTSD and a TBI), they can't cut me off at all because my disability put me in the psych ward.
@seethebeauty Well, I knew a guy from the military psych ward, who ended up getting 30 percent disability, he was allowed to work, and in fact made over 100,000 dollars a year driving. He was not penalized for being able to work, later, he was at 70 percent, making 70 percent income from disability, still making over 100,000 a year. If a person is rated at 100 percent, it shouldn't be different for being more disabled. It would be quite unfair. P&T SHOULD mean that you simply don't require re-evaluations. I was considered 100 percent disabled for 10 years or so, before they gave me the P&T. Basically, just because you get disability doesn't mean you can't work, and vice versa, it's more along the lines of the military admitting that they caused you life long harm. It's not like with social security, or unemployment, which typically limits your disability to income ratio.
The difference would be P&T TDUI, which would imply that you are making FAAAAR more from your disability by granting you the 100 percent income rate, even if you only have 30 percent disability, which is the based on your ability to work, which would make your question, "If you can work, why would you want disability?". Well, 100 percent TDUI would likely make more money NOT working. The real question is, if 100 percent P&T, if you are collecting disability, why not work?
If you've been awarded a 100% TDIU just a few months ago, for a claim filed 7-8 years ago, can I expect a P&T determination ?
@kenndeaux317, TDIU is permanent in certain circumstances. However, VA must make this finding. If that is the case, VA will indicate that in your rating decision. @@kenndeaux317, yes. Once you are 70 years old, you will no longer have to submit VA Form 21-4140: Employment Questionnaire, which VA uses to determine your employment status and whether you have worked in the past 12 months.

@Jim Burnett not true I have my ID now. Some of the employees are still misinformed but as long as you get your 100 p & T status your scheduler doesn’t matter. A great indicator of P & T is chapter 35 if you receive this then you can receive all the benefits and percs

I have a question. Can a veteran get an increase on his regular rating to make it to 100% and get rid of the P&T? They want you to stay active and continue to move or find a hobby, but you're not allowed to make an extra income for your family on the days that you feel somewhat ok. Was offered a job subbing at the school (on my good days), but I can't even do that which is something that I used to do and enjoy doing, would keep my mind off of everything else that makes it race, and keep me somewhat moving. So being on P&T to some can be a silent killer in my opinion. I've developed more mental health issues because I "can't" do anything.

You can work a civilian job and still keep the 100 P&T, lots of people do. Now the SSDI (social security disability insurance) is different, you can't also work if you receive that.

if the vertigo is related to the service and there is something you can relate it back to the service then you will get a rating based on how severe the vertigo is. i have multiple sclerosis and vertigo is one of the symptoms. it is tracked back to my time in the marines and is rated on my va records. i get 40% for the entire illness and all that encompasses its symptoms.

@@JohnJohn-co9yz sorry for the late reply. what you need to do is make a physical appointment with your doctor and tell them you have balance problems and double vision. then get a referral to see a neurologist to get a neurologist to give you a neurology physical and a blood and mri and lumbar puncture. the mri will find scars on your brain. the lumbar puncture will find oligoclonal bands in your brain and spinal fluid.

I just had my exam for my severe persistent chronic asthma. It stated that my asthma precludes me from any physical occupation. Does that mean they find me totally or partially disabled?
Unless they state in writing you are "Totally" disabled or you are rated at "100%" you are not ""totally"" disabled. It will be on your award letter. Until then you will not know what you are. As of now it doesn't look like total. I would imagine you could find work sitting down in an office setting for example. That would not be total occupation impairment.

I am going for another c and p exam next year. I was awarded 70% but a week later 100% tdiu in 2016. Ptsd, anxiety disorder, panic attacks, flash backs. Serious memory loss problems, dissociation issues. I have been diagnosed sleep apnea since also. And no change in my condition even with medication and such. What are my odds of becoming permanent on my exam next year?

Samuel Hargrove they back dated me in 2017 to 2016. I reapplied since 2013 instead of appealing. Thought I was appealing. I got out in 1999 general under honorable conditions. But only have records of my medical problems since 2005. My va rep told me I’m going for another c and p next year. I guess they can re examine anytime but I thought it was 5 years. My psychiatrist at the va doesn’t know why they just didn’t make me permanent from the start. Don’t know if any of this is needed to tell but figured o would give you a little history. What action should I take if on 9/26/2013 I received a 100% rating only, but still had 6 pending claims overlook, and later they're withdrawn by the VA. My chronic insomnia, PTSD, Endometriosis, chronic groin pain, and left knee meniscus tear. I put in a NOD and they were all denied. Now my VF9 form is still pending at the VBA board. Well on 1/29/2021 I received a 100% P&T with an effective date of 9/26/2013. How can the VA give me an effective date of 9/26/2013 with this P&T but in the year 2013 I was only issued 100%. I missed out on all of the back taxes that I paid from 2013-2020 on my home and state taxes. Please advise thank you Wilson

Hello Larry, veterans who are rated Permanent and Total may work if they are able with no effect on their VA benefits. Veterans who receive Individual Unemployability are restricted in the amount they can earn in relation to continuing to collect VA benefits. Hope this helps!

im 100% for schizo service connected. its my understanding that after a couple reevaluations for disability rating if you are still found to be 100% without your disability not improving you can be rated p&t. i dont know how many reevaluations you need or how many years you need to wait but thats what i learned from research. keep seeing your dr for appointments. your reevaluations will rely on those records + any hospitalizations you may have.

Best advise from a currently disabled veteran: If you have 100% P&T, I don’t care if your arm falls off, DO NOT FILE ANOTHER CLAIM! It is just an opening for the VA to look at EVERYTHING in your file and they WILL go after a reduction. Someone who worked at VBA informed me that there are claims specialists there that specifically go after one hundred percenters that file for more. They are backed up on work and get pissed off be cause they see it as a “greed”move. Word to the wise LEAVE IT TF ALONE or you’ll be kicking yourself for poking the bear. You’ve been warned.
How does a veteran prove they have been awarded 100% P&T disability?
100% P&T Navy Vet here. They usually give you a paper called an Award Letter after you’re found service connected. If you have that you don’t have to prove anything, it’s all there on that letter
Go to va website. Download letters then download award letter. Says it on there.
Benefits has a letter generator that will print out all of that info for you in a letter form

@Frank Gonzales, VA categorizes amputation in terms of traumatic amputation or amputation by surgical removal. There are different VA disability ratings based on the different types of amputations. @bigmills525, to qualify for permanent and total disability, VA must determine your service-connected condition is totally disabling (rated at 100%) with zero or close to zero chance of improving.
