RED doesn't stop this driver. (Red Light)

I was debating this one with a friend today. If you are blocking an intersection and it's yellow most people typical just go(which you shouldn't even pull up there if it's not clear). The light cycle takes two seconds to flip from yellow to red, and me to get a green. Considering I get a green way before he is even through the intersection this makes the guy a captain dickbag. What do you guys thing?
