- After days of speculation about the identity of the squatter living in the basement of a viral Zillow listing, the woman has come forward to tell her side of the unusual story.
"That's not true what they're talking about me," Nelly told WUSA9. "I'm not a bad person."
And she's more than a social media mystery, says the woman who asked that her last name not be used in an attempt to maintain some privacy.
Last week, her Fairfax, Va., home - that is not her house - went viral when it sold for more than $800,000 with the condition that it came with a person living in the basement who did not have a lease.
"We have a really nice relationship," Nelly said about the arrangement with the now previous owner. The house, she says, is where she and her daughter formed a kind-of second family.
Sometime around 2017 Nelly says she started cleaning the house every other week for the owner who had emailed her cleaning business.

She’s not claiming to be a victim. She lived there at his bequest. They sold the house and she moved out. She had a place to go after the house was sold and was not “squatting.” End of story.

Families turn their backs on a family member who has an asset until it is time to dispose of that asset and that is when the so called family members crawl out from under the rock for their share. Where were the so called family members when this man was struggling. Now, they are here to shame this lady.

This is garbage. We all have challenges in life. Sitting in the challenge and doing nothing should never be an option. She needs to be evicted. There are family shelters and a lot of no profit organizations that can assist her with housing.
Did you even watch the video to the end? The lady agreed to basically be a live in maid and provide cleaning for shelter. In that case she clearly doesn't have money to just magically move her family out in a week. She also said that she has no plans of staying in the house amd that she is going to be out by Saturday now that she found a place to go.

I believe her. In addition to the entirely plausible explanation and her demeanor, another news piece did a video walk-through of the home and it was in excellent, clean condition. As the reporter said, her being characterized as a squatter set the expectation of major damage, graffiti, and missing appliances, and none of that is true. As far housing, it's not as easy as you make it out to be. Those in need of housing assistance have to wait years on a list, and the list is rarely even open to be added in the first place. She'll bounce back, but don't minimize the undeniable difficulty.
??? She didn’t even say anything about challenges were preventing her from leaving. The homeowner’s family put the house on the market without telling her they were selling it. SHE HAS MOVED OUT. You can’t expect people to leave their home immediately. There is an entire eviction process that needs to be followed. She had every right to be there until the eviction process was completed.
renting a basement is better for some immigrant family’s then going from dirty apartment to apartment in fairfax county. it’s to expensive. she did what she had to do.

Essentially, once someone is residing in the home lease or not you have to go through the eviction process. The police cannot remove them since it is a civil matter and you need a judge to give you an order that allows you to evict them.

@@bendixon1868 Only true if it's considered a separate unit with a separate entrance. If it's just considered the basement of the home then you can kick them out anytime, just as you can kick out roommates in a place you own. They're not considered tenants. The other way you can kick out a tenant is to say that you or a close family member want to move into their unit (cousins don't count but parents, kids or siblings do).

At least she didn't claim that the old man touched her or her daughter and she is the step mother and the lawful owner of the scary house.
If she was there to take care of the owner and the owner no longer lives there, then she became a squatter. Why is she still there if the reason for her being there is no longer necessary? As soon as it was clear the owner was not going to be around much longer, she should have started packing. As soon as he died, she should have been served a 30 day notice to clear out.
This is why you always use a property management company even if the rent is zero. You need clear terms and lawyers to enforce them.
1. He is not dead.
2. She moved out today, as planned.
3. She was there at the invitation of the LIVING homeowner. The absence of a written lease on its own does not equal squatting.
4. The owner's family, not the owner himself, chose to put the house up for sale without informing her. They chose to characterize her as a squatter, which she discovered through a third party who'd seen the news story.
5. Had she been served, she would have been removed. She was not served.

@@SheilaR.08 The absence of a written lease makes it unclear what the rules are about staying in a place and puts the owner and the occupant at risk. Laws generally favor the occupant to a degree.
Once the home was sold and the owner wanted her out, she had no choice but to leave or she would be a squatter. Usually you have 30-60 days to vacate under a new owner depending on local laws.
The owner's family should have figured out what was going on made the transition out of the home less confusing. They saw the hot market and didn't want to risk waiting 2 months and prices coming down.
She did nothing wrong and the owner's family are a bunch of turds. The owner should have protected her with a lease agreement.

From years of working as a social worker with the frail elderly my guess would be that the family ignored him. She took care of of him and made his life better and her life as well since she had somewhere to live. She probably resented the family and probably with good reason. She inappropriately prolonged his stay because when she's gone and they come in and they want their share of the estate that's it. If there's a bad guy it's probably the family members but she's not innocent either. She should have moved sooner. You can't fight the inheritance laws.
She had a place to stay, but no reason that should continue.

From the time the owner died, the Squatter family should had left or had communicated clearly with the relatives of the owner. It does not matter what previous agreement or relationship they had with the owner. They took advantage of the situation from the time the owner died. And during the selling of the property, they still did not left. No other explanation needed. They took advantage of the situation, PERIOD !

That happens sometimes. Many people believe in a mythical "stand your ground" law to where they think they have the right to kill someone the moment they step on your property and arnt welcome. Lots of families and lives ruined by this misunderstanding.

why if the sale of the house was that the purchaser could not go in the basement, or put the tenant out, is she "out"?
They are basically selling the house with an issue (in this case a squatter) and its up to the buyer to determine if he wants to buy it to deal with that issue. It will probably take a year after the purchase for eviction to happen.

I would ask her to leave, but if that didn't happen in a reasonable period, I'd go through eviction. In Virginia, you need to have been there far longer than she claims to have been to have squatters rights under adverse possession.
Simply go through the eviction process outlined in the Virginia Landlord Lease Tenant Act. Both parties would be better off.

Didn't you hear her say he is sick and hospitalized? He can't talk so his family has taken over his estate and are the ones who sold home. The family tried to kick her out previously but the homeowner objected. So while he is sick the family decided to take opportunity to sell house without his knowledge or give her notice

Not Really...of your last assumption... Velasquez. I'm an immigrant myself. I came to the USA when l was a child. I was 13 years old, I was already working 3 or 4 hours as a babysitter, in the library or after school activities. I SAVED all my very own money. As soon as l turned 18? I went all on my own to do my USA Citizenship papers to become one. Now a days, illegals immigrants give such a negative impression to the USA! Most of them come to this Nation to be aided, helped in a very demanded manner!!??? That's Not how things works!..I did house cleaning too. Most of the house owners gifted me with alot of things!? Some of them even offered me roof & shelter in exchanged of working like a maid.. I always declined. Why? Simple: You never mixed Work & Personal Life! Thats the American Way!.. Y'all have never been homeless. It's not uncommon for homeless people to take refuge in abandoned homes.
I'm not saying she is by any means a saint and didn't do anything wrong, but please don't think of her when you see someone struggling. Your colleagues, friends, and even family members could be in this exact same situation and you would never know based on how they carry themselves around YOU.
It's horrible that people will take advantage of their situations due to laziness, but the first opportunity a genuine person in need gets to have stability they will go for it like an oasis in the desert.

The predator will shower the victim with attention and begin to groom and drive a wedge between the elder and his or her family, making themselves indispensable. If the elder has control of their own finances, money will be often be diverted. The elder believes that the predator is the only one who truly cares. In this case, she could have convinced her victim that he invited her and her daughter by repeating it over and over as she did in this interview, which was full of leading questions.
I know how often this can happen because I have been appointed as Guardian as Litem for many, many adults who have been victims of just this sort of abuse.

She is not and never was a squatter. She is and always has been a resident. She didn't just move in without permission and take possession of the home. That is a squatter. She was asked to move in by the owner. That makes her a resident. By law she can stay and force the new owner to go through a lengthy eviction process to get her out. She has no intention of doing that and is willing to just leave now that the owner will not be returning.
