As long as the maintenance is done regularly, E92 M3s are solid cars. But I think the 'big failures' = throttle actuators + rod bearings are the ones you should look into if you wanted to cover all your bases. Otherwise, the 2008s have the older I-drive which is tedious to use, so go for the 2009+ if possible. Lastly, The M-button which allows you to change your suspension/throttle setting with one button + EDC (electronic damping control) to control the harshness of your damping were what I wanted. But it really depends on price/maintenance, because I would've bought a 2008 with no M-button/EDC as long as the maintenance was done + price was right :)
