Breaking News! The ATF BRACE RULE is DEAD and now you all can go back to putting all the sweet SB Tactical braces on your AR and AK Pistols without worrying if you're breaking the law or having to pay a $200 dollar tax and waiting for three months. WELL Kind of!
Judge Kacsmaryk in the Britto v. ATF case stated this:
"The Court is certainly sympathetic to ATF's concerns over public safety in the wake of tragic mass shootings. The Rule " embodies salutary policy goals meant to protect vulnerable people in our society" But public safety concerns must be addressed in ways that are lawful. This Rule is Not. For the foregoing reasons, the court GRANTS the motion and STAYS the rule in it's entirety."
HOWEVER, if you were one of those poor soles that Registered your gun during that 120 day period. Those guns are now officially considered SBR's which means you can put a stock on them but now you can't cross state lines with it unless you get permission from the ATF.

ATF all up in their feeling. 😂
ATF 😥😢😭, we the people 😁😆😅🤣
See what happens when WE ALL stand 2A STRONG 💪🏾
Now to work against the sbr ban
Non compliance was key😅
Boom! Love it! 🤘🏻
NOW IMAGINE WHAT ILLINOIS CAN DO!
@@derek3154 Uh... 255,000 turds registering their guns was NOT non-compliance. How many more stripped their pistols of the eViL plastic parts?
This was a court win... thankfully. But nothing more. Thanks FPC, GOA, etc. and donate to them instead of patting ourselves in the shoulder.
We must continue to fight for our Constitutional Rights. FRT's need to be released from ATFs Grasp.
And forced reset safeties
Thankful for FPC for doing their job
Uh why not just full auto, sbrs, etc. all these rules are infringement.
Yeah they need to abolish all of the sbr laws. It’s stupid to say you can put a brace on it but not a stock.
@@backyardbowhunting3818as if the stock makes it more dangerous, smh
How does a $200 tax stamp protect public safety from the same weapon? It's a ridiculous argument.
Because it was never about public safety, it was about making NFA items prohibitively expensive. The $200 specified can never adjust for inflation because it's written into the Act, so the same $200 in June of 1934 would be $4,631.73 in 2024.
You ever seen a T-shirt or bumper sticker that said Death & Taxes.
Like how the poll tax prevented a certain group from exercising their constitutional right to vote. All restrictive laws are in place to prevent the poor and by default non whites from exercising their rights.
It baffles me that accessories to firearms can be ruled on by the ATF. They should be investigating actual crime not taxing the public for their already taxed dollar.
Why would the government want to investigate themselves?
What kind of crime?
you mean them selves?
@@desert4seatmmm…crimes related to alcohol, tobacco, and firearms I’m guessing…
@@someoneelse1i1iyou mean like when the ATF got caught selling gun parts to the cartels?
Here's what I don't understand. If the ATF can make "rules", but those rules are not laws, then on what grounds can they even enforce these rules?
Because no one else in the government will stop them from destroying you. The Supreme Court is quite flaccid and no one will carry out their decisions.
On the grounds that the government has the monopoly on Violence. They can enforce whatever “rules” they want so long as nobody checks them. Nobody in the Government wants to hold the ATF accountable. Local Sheriff’s don’t want to stand up for their citizens and stop the ATF from enforcing these unconstitutional rules. We are supposed to have a system of checks and balances but that only works if the people we elect are willing to check the government when it over steps its boundaries. very few people in congress wants to “check” the ATF on their blatant over reach. So instead we are relying on the Court system to do it. Which takes time.
Very true.
They just do it, then leave it on you to argue the legality after the fact, knowing the actual lawmakers will just let it happen. Convenient for them since you get to pay for both your defense and theirs.
Type Discretionary authority and rule making authority of federal agencies in your favorite search engine. It’s pretty wild.
Thank you sir for being one of the only firearm channels ran by a lawyer to just give a short yes or no video on what we all want to know.
No kidding. Too many other people making videos of well it's ok but might not be ok. But for now it's ok unless you get caught. So basically use caution because I think it's ok based on these facts but you can still legally use them.......
Fucking shit, nobody can ever give a straight answer
This just proves the ATF is bracist.
😂😂😂😂😂😂😂😂 CLASSIC!
You win the internet today 😆
😂
I see what you did there
🤣
Now we just need to completely get rid of the SBR laws in general 🤦♂️ Wait and only 255,000 registered their pistols? 💀💀💀 Good job Americans.
That is 255,000 people too many.
Knowing there’s millions out there and only 255k registered speaks volumes. Go home ATF, do something useful like not kill your dog
thats too many, a rule is not a law so no one should have done it.
Tbf that is about less than 7% of all pistol brace owners and there is a good chance those who registered were using this as a way to get SBRs (i.e. converting 9mm AR pistol into 5.56) without breaking their wallets.
Should've been 0, not 255,000. Yeah granted there's millions of pistol brace's out there, but if you ask me that's way to much that basically handed over something that was completely legal.
I had almost lost faith in our justice system.
😂 how do u have any faith left in our justice system? U think THIS redeems the system?
It’s still gonna be appealed, still needs to be finalized by SCOTUS. Hopefully the injunction holds till then
Don't put to much faith in it yet.
You should have NO faith in our justice system. Just the fact that it took so long for this to be corrected is pathetic.
The justice system in America is hopelessly broken . Look at Trump being charged with fraud for over valuing his property to get a loan that he paid back back in full that no bank felt defrauded and somehow that lady got a case brought against him anyways . They say Maralogo is worth 17 mill when with it having almost a hundred rooms and a shit ton of prime land but all his neighbors little homes worth 17 or more millions compared to his that are on 1/ 6th the property. That is only 1 example out of millions of reasons our justice systems is f* cked . Dont get me started on pedophiles that get murders getting out of prision before small time drug dealers .
255,000 people @ $200 a piece is $51 MILLION in the ATF’s pocket… damn…
"It's all about safety...unless you pay me $200."
Unless you want a silencer then you pay $200 to help protect your hearing and others around you.
No license or document fee from the government should ever cost more than the actual cost to handle paperwork, unless it is allowing you to use some limited resource like driving a car on a road, or hunting/fishing. You don't need a fishing license to fish in a stocked pond, or need a driver's license to drive on private property, but you need to pay to be allowed to have an accessory on a gun stored in your house, and used inside a private range.
The atf should have never had the authority to make rules. Even rules should have to be voted on by Congress. Then again it really does say SHALL NOT BE INFRINGED.
Any time there's a majority in Congress that matches the party of the President, Congress hands over more power to the executive branch because they might not keep their majority past two years, but the President will be in office for at least four years, and 75% of the time, eight years. It just shows that "our" Congressemen's first loyalty is to their party, not their constituents.
@userJohnSmith It's really not complicated though. The only thing congress needs to vote on is an amendment to the Constitution. They either have the votes or they don't. Nothing else matters until they amend the "shall not be infringed" part out of it. Until then, there's no power to cede to illegitimate agencies because there's no power to infringe. 😂
The issue is that Chevron Deference gives them the authority to do so. Not just the ATF but other government agencies such as the EPA, FDA, etc.
@userJohnSmith Which was by design, to keep government small.
@@killerratchet1973 Except that _Sackett v. EPA_ changed the Chevron Doctrine so that agencies have to be able to justify their changes based on the history and intent of the law they're "interpreting." They can't just make up whatever rules they want so long as they aren't directly contradicted by the law anymore.

That's probably because the asst. Atf director or whoever from the Atf said during a hearing people could just simply remove them and put them aside. That video floated around for awhile.

Rights are inherent as an American citizen, they cannot be taken away or restored by anyone but you. Our rights aren't fragile, we are dealing with a corrupt government that's wiilling to step on them.

My local shop knew it was getting tossed out and kept selling the braces.
As should have every single damn person who owned one...
That was a bold move.
The brace itself was never illegal it was the configuration.
Otherwise leaving them on a getting a 16" barrel wouldn't have been an option.
It was never against the "rules" to sell a brace. It wasn't even against the "rule" to have a brace on a rifle with a 16" barrel.
So selling braces was never an issue.
Still a BS rule and I'm glad it is gone.
My bad in my head I thought they kept selling braced pistols.

Never happening. It is about money. The 1928 nearly mint Thompson my grandfather bought new was valued at 450.00 when it was passed on to me. As a transferrable item, it is worth considerably more than that now……full-auto has become a rich man game. That is what will keep the NFA in place.
*ahem* Ramaswamy. Let the comments begin...
The NFA is primarily based on safety and in many cases I've heard "concealability" argued in tandem with "safety". Meanwhile, pistols are by far the most concealable genre of firearm platform available to both governmental and civilian bodies. The "high capacity magazine" thing falls apart when an individual can do things like carry extra mags and train mag changes to the point of high efficiency (something all branches of the military trains even with 30rnd mags in rifles, as an infantryman myself this was a mark of skill with my peers). So what actually IS the argument against SBRs and SBSs anyway? I'm not gonna shove a 10" barreled rifle in my pants and walk around like a half-retarded pirate, nor is anyone else. Furthermore, safety controls on long-gun platform are more pronounced and user friendly by comparison to those found on handguns. They're trying to regulate the poor use of tools by legislating the tools themselves, that can only go so far until irrationality rears it's head and that's where we're at.
In my mind the battle for gun control is a battle of general concepts and approaches. Do we outlaw the existence of things themselves, or do we outlaw actions? And individual can easily club someone with a small statue, do we outlaw small statues or do we outlaw clubbing people with them unprovoked?
So Forgotten weapons has a really good video on it, but originally pistols were one of the main points of the NFA but the congressman (edit: who were sponsoring the bill) didn't think they could get it passed with pistols on it, so they removed it, which takes out the justification for SBR's and SBS's because like you said, pistols are much more concealable. They also had to shorten the length for rimfire rifles from the original 18 inches in '38 so that 16 inch .22 lr rifles didn't get the $200 tax stamp, which was actually a quick change considering the NFA went into law in '34. They also changed the length of centerfire rifles in '60 when they realized that all the m1 carbines that were being sold to the public as military surplus had a barrel length of 17.75 inches, so instead of making everyone who the government had sold these to felons, they instead shortened the barrel length requirements for centerfire rifles to match up with rimfire rifles. And that's where we stand today.
Thanks for breaking this down in a way for easy understanding. And thanks for keeping this in our feeds and following up with these court rulings.
Now let’s get the NFA ruled unconstitutional!
Our best bet is to use the rationale of "voter ID is racist, NFA is racist. Stop discriminating against minorities!"
And . . while we at it . . FJB and his drug lord son ____ That is guilty as hell as well

Thanks for the clear and concise explanation. Not we just need the 5th Circuit to toss the idiotic Illinois laws.
And Connecticut
Illinois’s is in the 7th circuit
Not possible. Illinois is in the 7th Circuit. The most the 5th Circuit could do would be to rule against a gun ban case in TX, LA, MS (their district), and then the SCOTUS would have a split amongst the circuits and might take up one of the cases.

Oh its not over.. I can almost guarantee that the AFT appeals this ruling or wins another case in a "friendlier" jurisdiction and drives this to the Supreme Court.. Mass non-compliance will be the only way to win this in the end..
There are a couple levels to go before SCOTUS. The good thing is that the injunction stands while the appeal happens. AFT should take its ball a go home rather than continue wasting tax money stealing rights.
Well according to an actual attorney this ruling is done, stick a fork it done. Even if the ATF does they will get shot down yet again. @@Yourmommyisbusynot enough though. Only 200k out of millions 👍
nah, if it gets appealed it can only go to the 5th court of appeals which has CONSISTENTLY smaked the ATF's knuckles on this issue. THEN it goes to the Supreme court. the ATF is fried on this one. If they appeal it will get knocked down by the 5th.. their most likely choice of action is to pull the rule and then try and re-write it in a way that passes legal muster

Thank you for your explanation of all this. You have put it in a way that is completely understandable. Better than the rest that have tried to explain it here on RUclips.
The fact they didn't give up when only 250k people bothered to comply despite the threat of jail still astonished me.
That's still a phuq load of people who complied.
@@gera2396all sheep that would bend the knee either way. They played themselves
@@gera2396 true but when the atf estimated there's 8 million guns with braces and congresses guesstimates 40 million 250k really ain't that many
@germerican2585 actually there weren't 250k people who registered them. The actual number of people were much less registering multiple weapons each. There were maybe only 89k people who did it. While there may be 250k guns, there weren't that many traitors among us.
I know a couple who were like “sweet, I was gonna SBR these anyway, now it’s free”.
Never, ever, trust a government agency for anything.
Amen !
The best and most straight forward explanation of this I have heard. well done.
Thanks Coloin for the breaking news update! Been waiting for this day for a long time! I really appreciate how you did a great job of summarizing the pistol brace rule change debacle in order to better understand the ruling that just came down! Now let's overturn the vertical fore grip rule next!
Glad I didnt destroy mine and follow that funky rule 😂
Don't worry, a lot of gimps likely did. 255K registrations is embarrassing.
Make no mistake. The ATF has a registry. They have a database of all gun purchases. How far back it goes we do not know at this time. They just claim that it isn't searchable so it doesn't constitute a registry. Do not believe for one moment that they don't know what you bought. Sure, there are many guns that they don't know about that but they will try to get the info on those as soon as they can figure out how to do it. Bet on that.
Of course they have an illegal registry. They're criminals, and they do what criminals do!
ATF records all this information in a registry yet they claim it isn’t searchable and is thus “not a registry.”
That doesn’t even make sense - the data is of literally ZERO utility and ZERO value if it isn’t searchable.
This sounds similar to their obtuse “silencers are not ‘bearable arms’ so they’re not protected by 2A…yet ATF still asserts its right to treat them as firearms under the NFA.” WHAT ??!!
Can’t the ATF do traces to find out where a gun was bought from? So how do they figure that out if there’s no registry?
@@DocMitchell69they run the serial number to find out what FFL sold the weapon then they send an agent out to that location to acquire 4473 records of that firearm transfer. They aren’t supposed to keep that information but I’m sure you’ve seen the video of the woman taking photos of 4473’s sooooo… registry acquired.
Rumor was they kept the registry on foreign soil (Canada) so searching it was not a U.S. crime technically.
I believe they supplied the UN with a list of American gun owners for "the proper time of disarmament".
I bought my pistol brace 2 years before the ATF changed their minds and issued the "Either destroy it, turn it in or else, you felon" order. So you're saying I can FINALLY take my gun back to the range with no hassle??
I’m so glad now we need to move on to our future 2a lives
Gettin spooky in Oregon. Trying to uphold magazine restrictions this week
You don't NEED a response for permission to cross state lines with an SBR. You NEED to send the ATF an email with the notification. You are not required to officially notify them via BAFT form 5320.20 unless you are PERMANENTLY changing residency from one state to another.
Thankful of FPC and the other companies fighting for our 2A rights. I will start donating money to them. Everyone needs to donate some money to them
I heard that “rule” and chuckled. No..I’m not taking the brace off and no…I’m not getting a longer barrel. I built it exactly for this reason. Accurate and great for close altercations. And HELL no am I paying any tax on it. Just stay quiet. The government shouldn’t know what guns you have. That gives away the element of suprise.
255,000 people who sold their rights to the ATF. To hell with those people
I was going to sbr mine anyway. May as well have done it for free.
It’s a laughably tiny number compared to the number of braced pistols out there, even by conservative estimates.
@@tehduke1776compliance to tyranny is support for tyranny
If you have a brace on your weapon and you're not disabled then you are complicit, basically, you complied. Don't be scared be free, just how the founders intended. "Yes master, I will put the brace on my personal property so that you won't punish me"...smh
@@CustomWeldingandFab sure Jan.
Colion, you're my favorite content creator, man! Thanks for all that you do, brother!!
Used to watch Mr Noir back in the day. He has morphed into a great 2A ambassador
That "Whooo Boy" sounded like Big Momma! 😅😂😂😂😂😂😂😂😂
255,000 ball-less souls now stuck with hard tracked SBRs
*deserved*
Congratulations you played yourself - DJ Khaled
That didn't age well did it ATF😂

@@fleatactical7390 Damn right!
The most important part of this has been that the district judges are ruling on 2A grounds and not just APA. Outside of liberal circuits we’ve had very little opportunity to win on common use cases, which may help against hardware bans in liberal circuits. Also seems to nullify congressional action on weapons in common use, which would pre-empt AW and magazine bans.
Always appreciate all you have to share, thank you!
I wonder how that applies to other "rules" about suppressors, vertical foregrips, muzzle devices, etc. that were all made for "safety."
The vertical grip on a pistol making it an AOW has always perplexed me. SO dumb.
@@JamesS.254 it's due to the definition of pistol having something along the lines of "fired with one hand"
So the additional grip means it's not a pistol by said definition. It's kinda dumb bc nobody is taught to fire a sidearm with one hand if a support hand is possible. And just bc the grip is there doesn't mean you have to use it 🤷♂️
Means to an end and it's sure not to benefit We the People.
@@matthewbeaver5026 Oh I know.
Damn, I'm so glad to hear this. Because it was also applied to my little airgun. These douchbags need to be stopped.
So, just to be clear.. I CAN put a brace on my AR Pistol...? 👀
The question I'd 100% love to know for sure
What do you mean “go back”? I never stopped lol
So now that this was ruled as unlawful, do those 250K people get thier $200 tax stamp back?
I'm going to just point out that alone was $50M in revenue through the ATF.
They complied with an illegal tax
it was a waived fee so they paid nothing it was just a free form 1 without a stamp
Glad you guys are having better luck with your court cases than us Canadians...
The 250k people who registered their braces, they are pathetic and what’s wrong with the 2A community.
i agree, what i don’t understand is how people that sold guns are advocating to register them so they can sell 3 thousand dollar honey badgers hahahaha
They are not part of the 2A community.
Liberals
Well I was going to put an underfolder on my DRACO anyway, so of course I registered "a brace" free of charge so I can do whatever with it down the road. Guess what, my Draco has an underfolder now and it was free. Call me pathetic, I have 93 weapons in my collection and that is something most "2A community" people only dream of...
@matyoka they'll do another freebie if they appeal n win ?
Hey there, I was one of the people who registered their SBR. 😂
