    Breaking News! The ATF BRACE RULE is DEAD and now you all can go back to putting all the sweet SB Tactical braces on your AR and AK Pistols without worrying if you're breaking the law or having to pay a $200 dollar tax and waiting for three months. WELL Kind of!
    Judge Kacsmaryk in the Britto v. ATF case stated this:
    "The Court is certainly sympathetic to ATF's concerns over public safety in the wake of tragic mass shootings. The Rule " embodies salutary policy goals meant to protect vulnerable people in our society" But public safety concerns must be addressed in ways that are lawful. This Rule is Not. For the foregoing reasons, the court GRANTS the motion and STAYS the rule in it's entirety."
    HOWEVER, if you were one of those poor soles that Registered your gun during that 120 day period. Those guns are now officially considered SBR's which means you can put a stock on them but now you can't cross state lines with it unless you get permission from the ATF.

    How does a $200 tax stamp protect public safety from the same weapon? It's a ridiculous argument.

      Because it was never about public safety, it was about making NFA items prohibitively expensive. The $200 specified can never adjust for inflation because it's written into the Act, so the same $200 in June of 1934 would be $4,631.73 in 2024.

      Like how the poll tax prevented a certain group from exercising their constitutional right to vote. All restrictive laws are in place to prevent the poor and by default non whites from exercising their rights.

      Because no one else in the government will stop them from destroying you. The Supreme Court is quite flaccid and no one will carry out their decisions.

      On the grounds that the government has the monopoly on Violence. They can enforce whatever “rules” they want so long as nobody checks them. Nobody in the Government wants to hold the ATF accountable. Local Sheriff’s don’t want to stand up for their citizens and stop the ATF from enforcing these unconstitutional rules. We are supposed to have a system of checks and balances but that only works if the people we elect are willing to check the government when it over steps its boundaries. very few people in congress wants to “check” the ATF on their blatant over reach. So instead we are relying on the Court system to do it. Which takes time.

      Tbf that is about less than 7% of all pistol brace owners and there is a good chance those who registered were using this as a way to get SBRs (i.e. converting 9mm AR pistol into 5.56) without breaking their wallets.

      The justice system in America is hopelessly broken . Look at Trump being charged with fraud for over valuing his property to get a loan that he paid back back in full that no bank felt defrauded and somehow that lady got a case brought against him anyways . They say Maralogo is worth 17 mill when with it having almost a hundred rooms and a shit ton of prime land but all his neighbors little homes worth 17 or more millions compared to his that are on 1/ 6th the property. That is only 1 example out of millions of reasons our justice systems is f* cked . Dont get me started on pedophiles that get murders getting out of prision before small time drug dealers .

      No license or document fee from the government should ever cost more than the actual cost to handle paperwork, unless it is allowing you to use some limited resource like driving a car on a road, or hunting/fishing. You don't need a fishing license to fish in a stocked pond, or need a driver's license to drive on private property, but you need to pay to be allowed to have an accessory on a gun stored in your house, and used inside a private range.

    The atf should have never had the authority to make rules. Even rules should have to be voted on by Congress. Then again it really does say SHALL NOT BE INFRINGED.

      Any time there's a majority in Congress that matches the party of the President, Congress hands over more power to the executive branch because they might not keep their majority past two years, but the President will be in office for at least four years, and 75% of the time, eight years. It just shows that "our" Congressemen's first loyalty is to their party, not their constituents.

      @userJohnSmith It's really not complicated though. The only thing congress needs to vote on is an amendment to the Constitution. They either have the votes or they don't. Nothing else matters until they amend the "shall not be infringed" part out of it. Until then, there's no power to cede to illegitimate agencies because there's no power to infringe. 😂

EPA_ changed the Chevron Doctrine so that agencies have to be able to justify their changes based on the history and intent of the law they're "interpreting." They can't just make up whatever rules they want so long as they aren't directly contradicted by the law anymore.

      I'm sure that the ATF will reimburse them. Just like the people that spent hundreds on longer barrels. Then you have guys that took advantage of the grace period and registered their now SBR's with no $200 tax stamp. The problem is the fact that you, and your now NFA firearm, are now on a list, with pics and serial numbers and all. Oh, and keep it in state, or ask permission from your ATF daddy to take your second amendment across state lines. I'm sure they'll get back to you in no time at all...

So glad that the ATF pistol brace rule has been shot down; however, the fight is far from over. We all need to stick together and continue to support RUclips channels like this as well as letting our congress representatives know how we feel.     I think that the vast majority of ppl ignored the brace ruling and just layed low in the first place. I can imagine all of the braces that were stored just feet away from the pistols that they were formerly mounted on for months.

    It’s scary and sad that one judge was able to stay an order from the ATF, yet our actual lawmakers tried to overturn the ATF, they voted it down. Just goes to show how fragile our Right can be.

    The NFA is primarily based on safety and in many cases I've heard "concealability" argued in tandem with "safety". Meanwhile, pistols are by far the most concealable genre of firearm platform available to both governmental and civilian bodies. The "high capacity magazine" thing falls apart when an individual can do things like carry extra mags and train mag changes to the point of high efficiency (something all branches of the military trains even with 30rnd mags in rifles, as an infantryman myself this was a mark of skill with my peers). So what actually IS the argument against SBRs and SBSs anyway? I'm not gonna shove a 10" barreled rifle in my pants and walk around like a half-retarded pirate, nor is anyone else. Furthermore, safety controls on long-gun platform are more pronounced and user friendly by comparison to those found on handguns. They're trying to regulate the poor use of tools by legislating the tools themselves, that can only go so far until irrationality rears it's head and that's where we're at.
    In my mind the battle for gun control is a battle of general concepts and approaches. Do we outlaw the existence of things themselves, or do we outlaw actions? And individual can easily club someone with a small statue, do we outlaw small statues or do we outlaw clubbing people with them unprovoked?

      So Forgotten weapons has a really good video on it, but originally pistols were one of the main points of the NFA but the congressman (edit: who were sponsoring the bill) didn't think they could get it passed with pistols on it, so they removed it, which takes out the justification for SBR's and SBS's because like you said, pistols are much more concealable. They also had to shorten the length for rimfire rifles from the original 18 inches in '38 so that 16 inch .22 lr rifles didn't get the $200 tax stamp, which was actually a quick change considering the NFA went into law in '34. They also changed the length of centerfire rifles in '60 when they realized that all the m1 carbines that were being sold to the public as military surplus had a barrel length of 17.75 inches, so instead of making everyone who the government had sold these to felons, they instead shortened the barrel length requirements for centerfire rifles to match up with rimfire rifles. And that's where we stand today.

      Not possible. Illinois is in the 7th Circuit. The most the 5th Circuit could do would be to rule against a gun ban case in TX, LA, MS (their district), and then the SCOTUS would have a split amongst the circuits and might take up one of the cases.

    Oh its not over.. I can almost guarantee that the AFT appeals this ruling or wins another case in a "friendlier" jurisdiction and drives this to the Supreme Court.. Mass non-compliance will be the only way to win this in the end..

      nah, if it gets appealed it can only go to the 5th court of appeals which has CONSISTENTLY smaked the ATF's knuckles on this issue. THEN it goes to the Supreme court. the ATF is fried on this one. If they appeal it will get knocked down by the 5th.. their most likely choice of action is to pull the rule and then try and re-write it in a way that passes legal muster

      1.) don't answer your door.
      2.) if you never registered they don't know you own one.
      3.) if they do knock and you do answer, you don't need to consent to a search.
      4.) if you they do knock, you do answer, you do consent, and they see your stock, it's only criminal when added to the gun.
      Thus all you really needed to do was not leave the brace attached and wait on the outcome.

    Make no mistake. The ATF has a registry. They have a database of all gun purchases. How far back it goes we do not know at this time. They just claim that it isn't searchable so it doesn't constitute a registry. Do not believe for one moment that they don't know what you bought. Sure, there are many guns that they don't know about that but they will try to get the info on those as soon as they can figure out how to do it. Bet on that.

      ATF records all this information in a registry yet they claim it isn’t searchable and is thus “not a registry.”
      That doesn’t even make sense - the data is of literally ZERO utility and ZERO value if it isn’t searchable.
      This sounds similar to their obtuse “silencers are not ‘bearable arms’ so they’re not protected by 2A…yet ATF still asserts its right to treat them as firearms under the NFA.” WHAT ??!!

They aren’t supposed to keep that information but I’m sure you’ve seen the video of the woman taking photos of 4473’s sooooo… registry acquired.

    You don't NEED a response for permission to cross state lines with an SBR. You NEED to send the ATF an email with the notification. You are not required to officially notify them via BAFT form 5320.20 unless you are PERMANENTLY changing residency from one state to another.

    The most important part of this has been that the district judges are ruling on 2A grounds and not just APA. Outside of liberal circuits we’ve had very little opportunity to win on common use cases, which may help against hardware bans in liberal circuits. Also seems to nullify congressional action on weapons in common use, which would pre-empt AW and magazine bans.

      @@JamesS.254 it's due to the definition of pistol having something along the lines of "fired with one hand"
      So the additional grip means it's not a pistol by said definition. It's kinda dumb bc nobody is taught to fire a sidearm with one hand if a support hand is possible. And just bc the grip is there doesn't mean you have to use it 🤷‍♂️
      Means to an end and it's sure not to benefit We the People.

      Well I was going to put an underfolder on my DRACO anyway, so of course I registered "a brace" free of charge so I can do whatever with it down the road.
