- Sued for Debt by a Credit Card Company or Debt Collector in Texas
Attorney Shawn Jaffer talks about what happens and what to do if you are sued for a debt by a credit card company or debt collector. The importance of filing an answer for a debt lawsuit, possible counterclaims for Fair Debt Collection Practices Act FDCPA and affirmative defenses in debt collection lawsuits such as the statute of limitations on debt. Dallas, Texas based consumer protection attorney Shawn Jaffer.
You can try to just write an anti garnishment letter to your bank. Also, here in Texas, certain wages cannot be garnished, such as your SS income, and certain types retirement benefits.
No wages can be garnished in Texas, including regular wages from work. None of that can be touched except when the judgment is for child support, spousal support, student loans, or unpaid taxes. Those are the only debts wages can be garnished for.
I wouldn't mind going to jail
Got more time then money🤣
I learned that the Debt junk buyer filed in a different address I used to live 20 years ago. Different JP to where I live know and where I got that credit card 6 years ago. I do not have access to that property. What can be done? Isn't that a violation?
what about judgment proof?
Heard nothing about wage garnishments, in Texas
I'm a landlord who won a court case for back payment. I filled out a form for Writ of Garnishment and the court says I would need to find the former tenant's Bank Account Number... The tenant would pay me through Zelle or Cash. Does this sound reasonable?
If I can’t pay my debt how can I pay this lawyer?
You don’t discuss seniors on Social Security. It’s my understanding that only the IRS can garnish Social Security wages up to 15%, and nobody can freeze your bank account except for the IRS.
This is something I have looked into. Federal rules state that a bank account that has social security funds direct deposited into them has a minimum of double your monthly benefit which cannot be touched for any reason. Thus, if you get 1000 per month, a creditor can only attach any amount you have in that account over 2000.
@@califguy5344 is that true???
Creditors can't touch social security money
@@pearlperlitavenegas2023 How about state pension's? I hear they can not be touched either.
I used this firm. I had several bad debts. For the most part, they did help but it wasn't cheap. It not like it use to be long time ago, debt will follow you. Pay if you can.
What if you can’t pay your debt due to the losing you job because of Covid 19 and till this day you are still jobless?
You have contract. Excuses for not paying is not a defence. If you are in trouble, make temporary small amounts to show good faith. Once you’re back on your feet, you can then attempt to settle.
@@Predatus123 we know who you are, a debt attorney or debt collector. An honest living but don't pretend you are just some random guy.
@@vambo13257 you are truly blind. Good luck.
covy plus start again threatening now fucking quimotherapi
and this people dont stop
This guy is useless. What defence is he going to provide? That you can’t pay? That’s not a defence. Credit card companies pay thousands of dollars to have a solid cardholder agreement, you can’t escape. Just deal with the debt collector or the credit card company directly and negotiate a plan. This guy is just going to make you spend your money on his firm and for what? He’s useless.
Did this lawyer ever respond back to you?
@@ega0117 nope.
*defense
Right! useless
I had that on mind while he keep talking
Spoke to him before about a lawsuit…his first option was to settle with the debt collector …
I received a law suit from Bank of Omaha, but after looking at my Quicken accounts i have no loans or debts that I owe to the Bank of Omaha.
Interesting… the Bank of Omaha are they still trying to get you to pay them back? Do you hail in Texas?
It's a scam. Scammers scare people into sending them money by posing as debt collectors
So what if you have a joint bank account? How can they lock a joint bank account?
Is it 10 business days?
No. 14 at minimum, depending on specifics.
For a child's debt that I never knew that I had while in being hostage robbed and raped...?
What? Lol.

This guy sounds like a credit card collector... trying to scare people into using his services... He is only examining one side of the story and does not really give you any real advice to those who can't afford him... ... Seek help from someone else... never trusted a guy with a toupee...
