UCC in a cultural diverse country is bit difficult but still i would say that we can have a common ground for protection of our interest/rights. Religion should not play a role & also education/awareness would be more helpful. Thank you sir 🙏🏻❤️
Just as Khula give a muslim woman the right to get out of an abusive marriage, In the same way Talaq-e-Hasan gives a man, the right to get out of an abusive marriage. Being a muslim myself, I would say both these modes gives men & women some liberty. And therefore, they shouldn't be repealed. But, misuse of this authority by any individual should be punishable. So, If the man divorces the wife on the grounds of non-fulfillment of dowry demands, he should be punished. When hands are wounded, we get it treated rather than cutting it.

Unless UCC comes, Talaq-e-Hasan will not be considered as unconstitutional. Apart from that another recognized form of divorce is Talaq-e-Ehsan too in which pronouncement of only 1 time is required. But as far religious view is considered, in Quran, holy book of Muslims, has mention of Talaq-e-Hasan i.e 3 times in 3 months pronouncement so I think Supreme Court or Delhi High Court will refer the Muslim personal laws till UCC comes or gets implemented. As far as violence with women is concerned women are also putting fake cases on husband u/s 498A, DV act or even Maintenance and there are many judgement due to which immediate jail of husbands has been banned by Supreme court due to fake nature of cases. So at the end divorce is one of worst phase of any relationship and should b avoided at all costs but at the same time women shud also stop putting fake cases on her husbands too just to settle scores with them and abuse the process of law.

What's the use of personal law board when everytime women have to approach court for domestic violence and dowry demands, my cousin had her own wedding+Infront of magistrate too just to avoid this future misfortune.

Good points but all can be refuted as the problem is not the law, it is the misuse of law. Like sec 124A of Ipc was being misused. The law was good but it was misused to such an extent that it had to be suspended.
It also lowers the pressure on courts..less cases on them

A naive brain would think UCC is as simple as just dissolving muslim personal law in to hindu, the most stern opposition will come from muslim as well as hindu community. Also the political repercussions of such Code would be significant to ruling government as well. What is need for the hour is to specifically struck down some old retrospective laws that does not go in sync with current structure of society where women are vocal and demands indiscriminate hearing and justice delivery.
So many laws is complication to solve court cases and one law one solution will save time and as per religious diversity and rituals adoption, divorce , inheritance in property will be considered in UCC.

Vvv sadly i am a 50 years old woman my 56 year old husband sent me 1st talq i went through many tragedies and also i loved my family more than anything else..... Since my childhood i was very talented in paintings etc bt when i marry my husband i was 18 nd my father in law promised my dad to continue my further studies bt at the age of 19 bcz of my husband's some anger issues husbands family told me if a baby would come my husband's behaviour would be change nd at age of 19 i gave birth to a baby girl and i kept my painting and drawing my future everything aside for the sake of my kids and husband i did every thing for my family bt his suspicious behaviour anger issues never ended... First he doubted on me... He told everyone that iam misusing his money, i am very cruel to kids and finally he started to doubt that i going to kill him by given poison to him nd he started to live like i am a killer and now he wants divorse from me and send me his first talaq i am terrible sad bcz i lost my 32 years of life with him,suffered a lot of domestic violence but hide everything from outside....for the image of the family and my daughter's future. I lost my gold property my health my future everything. Nd now he wants divorce from me with Muslim sheriyat.... Its utterly cruelty towards me i dont have anyone to guide me... I dont know what to do?????
If women had not prevented four marriages they would not be so worthless.
This practice should continue because it provides both gender right to divorce. Government should also include in hindu marriages because if someone don't want to live with his wife, he should get divorce easily, there are many hindu man who are victim of domestic violence but they can't take divorce became strict rules and provissions of hindu court Bill. Law should not force somebody to live with someone if he don't want to live with her.
At least someone used brain, forced marriages end up on murders.

First of all if anyone wants to actually understand why Talaq e Hassan is morally (not legally) correct according to Islam, one must understand the scenario that Islamic society provides which might be different from our typical Indian mindset. we see divorce as a drawback for women and consider them vulnerable but actually in Islam MEN are vulnerable will divorcing because marrying a divorced women is acceptable rather appreciable in Islam so she could easily get married again to someone in which man have to give her (reverse) dowry whatever she demands, so its a win win situation for her, while if that male want to remarry he again have to give (reverse) dowry to another women. so according to our typical Indian mindset divorce is a tool men use to dominate women so they should be protected from divorce, while divorce is not a taboo in Islam and women are indirectly at an advantageous position, so i dont think that strict safegaurds are required. Triple talaq is banned because its actually suppressive and it was NEVER a part of Islam.
Three talaqs are THREE, nevertheless.

Demand is just one or two woment but majority followed it.
Nikah is basically a contract. And women can add its own condition before nikah. Suppose we abolish Talaq and Khulah. It means there no way to move on. After marriage. But it againts the human nature.( Eg. Relation between our pm and his wife.)

Court might consider them as individual cases of domestic violence and uphold the practice of talaq e hasan as part of Muslim personal law. Doing away with this will effectively restrict the legal recourse of Muslim men to file divorce and thus would be difficult for the SC unlike in Shayara Bano case. It might comment on need for UCC but won’t go to the extent of considering talaq e hasan illegal. Besides it, filing divorce to avoid incarceration under DVA is common practice and in this case, there is no direct causation with practice as such.

Sir,Here both men and women have equal choice of Talaq.In my point of view Talaq e ehsan is much upheld than triple Talaq becoz both partners get the chance to express their concern and reason of divorce before maulvis or head of the families. (though the age old practice of norms of menstrual period).

enough for the couple to think of their Talaq leading consequences

Madrasa teaches it and no one can buy it from the market because it doesn’t exist, the muslim scholars and rulers will apply basis times keeping the core foundations intact, just like any law on earth. If you want to know about any law in Islam, one should visit the source directly (Quran) and read the biography of the prophet to understand how certain commandments were executed.
The triple talaq widely followed is just one school of thought and divorce in Islam Is simple for both men and women, dowry is banned in Islam against women but women can claim dowry from men. Halala is categorically banned in Islam but some maulvis have justified it over the years.
