Dallas Bans Airbnb. Who’s next?

- Dallas has banned airbnb. There are still so many details up in the air. But this goes far beyond dallas. Philadelphia placed heavy restrictions on STR. Detroit banned short term rentals but then reversed it due to host involvement.
What can we do as hosts to fight for our right to host? Find out in this video.

Great content Sean!! Truly appreciate it and needed this. The town where my STR just changed their ordinance and I was sited and summoned to pay a fine. At the same time my property booking was filling up rapidly. I am currently working with my attorney to have the fine waived. Thanks again you are the Mannn!
I forgot about that Texas governor signing HB 2127? On June 14, 2023 effective September first. The State now prevents any local government from enacting or enforcing any laws that restrict the business owners from operating within the local jurisdiction. Again I am skeptical that any Texas HOA, City or County government can enforce or prohibit STRs.
Please let me know if you have any legal authority that is opposite to the law in Texas.

mom and pop owned airbnb's are never a problem, its the "commercial" owners /hosts that are causing the problem.. IMHO
What data supports this? I could say the reverse based on anecdotes
@@canesforlifefor real though. I'd argue we professional hosts are a way better option than the second rate mom and pop who just took photos, listed, and have no idea what they are doing.
@@theairbnfree exactly. People with scale have usually scaled and had some failures and learned how to handle and prevent these issues, so that they could sustain their business and continue to grow.
@@canesforlifeorrect. Mom & pop are less likely to know stuff like noise monitors, or go through as much as us bigger hosts to create protocols to be good hosts

In Australia, one hotel apartment chain, quest appartments, have 10,000 units in Australia alone. These are the people that the government should attack. They have the power to make a real difference to the housing market.

So, the moral of the story is: Go only where there are regulations in place. Know who created them and work with these legislators to keep them up to date. Quality regulations keep fires and party houses from happening. They keep out the bad actors and ultimately limit the competition, which is good.

Ok.. in my area banning STRs would not help housing issues as the rent would be unaffordable because people paid too much for the houses in the last few years. Also, STR earnings are down here because too many people bought and joined the STR market. Not sure how things can get better but I think a big cause was super low mortgage rates and the idea of easy ROI.
I forgot to add that work related to STRs is easily the biggest employer in my area.

So now the average person wanting to make a business in hospitality has to raise money to compete against established hotel chains?
So now property owners who could make an extra $2000 of their own property are further restricted in what they can do with their own property. (I personally believe people should be allowed to even do commercial activity in their own house.)
So now we have to wipe out an entire industry because a few unregulated airbnb hosts allow the rare case on an unruly guest?
So now we have to wipe out an entire industry to what? Increase housing supply for the few months it takes to clear out the current airbnb rented houses? That will totally fix the housing problem as opposed to, you know, providing more supply.
I under the concerns of certain residences but the answer to again a rare occurrence of unruly guests is more effective regulation and standards not a blanket ban.
We should be encouraging people to build wealth, we should be celebrating the creation of jobs and feeding of families not attacking wealth creation and opportunities. This ban will be reversed.
Find another way to make money. We The People of these neighborhoods aren't putting up with this shit anymore. We are fighting back.
U airbnb investors are dumb af. The gravy train dont last forever even without a ban. The more people provide airbnb, you will have competition and wont be able to make as much from ur rentals. Either way, its not gonna end well for ya'll.
America was never designed to be the land of milk and honey or freedom for all. It was designed to keep the wealthy rich and the poor from becoming rich. However, the rich need labor so they sell a dream to get you here then put their foot on your back to keep you down using police and politicians.
Can you share a link to the current regulations governing short term rentals in Philly?
I’m skeptical that any Texas City Council will be able to enforce any ban on STRs. Please review Texas legal authority on this subject.
The Texas Supreme Court has ruled against a HOA in 2018, Tarr vs Timberwood case
And the 3rd Court of Appeals in Austin ruled against the City of Austin’s ban on STR2s in 2019,
In addition to the court’s decisions the Governor and the Texas Legislature are not fans of anything that infringes on owners property rights. My 2 cents.

Please let me know if you have any legal authority that overrides the Texas cases allowing for STRs. Again I am skeptical that Dallas or any other authority can enforce a ban against STRs. As long as they are collecting the taxes. It’s all about the money.
Congrats you are the new Segway. Don't forget to do the work on local regulations before you fund your investment. They don't have to collect penalties if they can put a lien on the property.
These two are in denial if they think it’s the hotels pushing for bans. It’s local communities fed up with out of town investors turning neighborhoods into theme parks.
And the audacity to expect the local govts to support these out of town hosts rather than protect their own local communities’ is pretty smug.

I'm a PM in Naples, NY. Myself and an employee from another PM in the area started the Finger Lakes Vacation Rental Alliance. After a woman came to the area and invited all of the Towns to a seminar to tell them they all need STR regulations, the amount of regulations & moratoriums being passed has snowballed. We've had rapid growth in the # of STR units, and we definitely have a shortage of affordable housing in our area. All of this has happened at once. It's been a lot. We're focused on keeping owners informed and educating owners and hosts on responsible ownership.
My first and only Air BNB experience was a nightmare. I booked one location when I got there the host directed me to totally different location. Very nasty location. The host tried to lie and make up all type of crap to keep my money. I contacted Air BNB and they sided with the host and didn’t give me my money back. Luckily I paid with my PayPal card and disputed the charge. Long story short, I proved my case and got a refund. I would rather just stay in a hotel which is what my wife and I end up doing and had a great stay.

LGB CA has a 3 strikes rule too. It is best to invest (or arbitrage) in a place where regulations are in place, and you KNOW what the regulations are, because you had an active voice in creating them.
Short term expert, your business, etc etc. This is why cities are cracking down. This was never suppose to be a money making business! It was never to be an industry! It should have stayed for owner occupied owners of small properties, who want to rent out in the building where they live. When owners and booking platforms got greedy, then this is why cities now what regulations! All of younwantingnto be real estate moguls, now hurts us small owners who just want to get a few extra bucks. You all want all these buildings, you're not on the premises, you're not even nearby. Owner occupied buildings of small properties should be allowed to do STR;s without a permit.

Hotels do not belong in private residential zones. If I have to join forces with hotels SO BE IT . I’m sick of being woken up by guests who do NOT respect my SLEEP! And those quiet parties of 10 cars are a little suspicious if you ask me.
When the Local resident can’t find a house to buy due to an aboundence of Airbnb is something to consider as a human being instead of feeling bad for the investor that bought a house to turn it into Airbnb
This is a myth concocted by hotel lobbyists. In my town, our active short term rentals (now 700) represent less than 0.33% of housing stock.
You have to be a little slow to actually believe this. Do some research and look up what percentage of housing stock in the US is solely for STRs (homeowners who put their property on Airbnb when they're away doesn't count). It's a very low, insignificant percentage.

Suggestion - move to a place with cheaper housing. I moved from PA when unemployment was at 16% there in the late 1970s (post Vietnam war) to the west coast for better job opportunities - got a 30% wage increase in one move. I will move to a new place again to maximize my retirement income.
@@JeanYoungmyphotos thank you!!! and this is the issue! People don’t want to move and think they deserve to live in places they can clearly no longer afford. Instead of moving they are trying to stagnate the growth of the area. It’s really sad because they could just move somewhere they can afford and have better opportunities. I moved from Cali to PR because it’s too expensive. I’ve been able to purchase my own multi family, work for myself and I’m working on another deal to purchase an 11 bedroom home on 33 acres of land located in the rain forest. I could’ve stayed in Cali and cried about it but I didn’t.
I hope all Short Term Hotel Homes are banned in every state and end up back on the market so that REAL families can purchase them and actually live in them. Want to own a hotel, buy or build a hotel. Stop bringing these randos into our neighborhoods. I don't care about your "investments". I care about the communities.
If all STRs paid their taxes, hotels would have no argument. They have a valid complaint about unfairness in tax compliance for local tax collection. The cheaters ruined this for everyone.
Airbnb collects and remits taxes from the guests for the City of Long Beach. If you do not have a permit to operate as a short term rental, your listing is auto-set to 31 days. That way everyone is equally responsible for paying taxes. I don't like taxes, but I want a level playing field with no cheaters.
Imagine thinking hotels are paying their fair share of taxes 🤣🤣🤣

@@lemuriangirl I don’t run airbnbs anymore. Mainly due to guests and the margins not being much larger than long term rental. I didn’t sell any of my properties and just converted them to furnished long terms. That further drove rent prices up and kept the house off of the market still. Regulations rarely work the way they are “intended” and they will push all of the money to Marriot instead of your neighbor. Destroy people trying to be middle class and have a retirement plan.

I own an Airbnb and my guests respect the house rules.
There is always going to be a an bad Apple that is going to try to bring you down but in general people are very thoughtful and respectful toward to house rules.
This is not an easy business and easy money like people would assume .

There are neighborhoods that just aren't appropriate, especially for STR. Arbitragers and property managers care about the bottom line. They have no real vested interest in the property or neighborhood. Arbitragers are the ones contributing to the housing shortage the most because they target regular rentals. The first part of banning should be arbitrage. That should address many of the issues that caused the bans in the first place. Owner operators have a whole different focus. We have a long term view and care about our property and neighbors which we have to deal with for the years to come.
Airbnb ruined my life, after around 143 verified bookings with them , they deleted me and if I tell you why you will cry for me. No loyalty in this game they are out for blood all these conglomerates and government entities…. Build u up to bring u crashing down , further down , until you give up hope yourself then they take everything back and provide u with. Coffin ⚰️
