  • Attorney Ethan Shapiro delivered the defense's closing argument on Tuesday morning in the 'Take Care of Maya' trial. Maya Kowalski and her family accused Johns Hopkins All Children’s Hospital of false imprisonment when they brought their 10-year-old daughter, Maya, to the hospital, claiming she had a severe pain flare-up in October 2016. The hospital, in turn, accused Koswalski’s parents of abuse and removed their daughter from their home. This chain of events led to Beata Kowalski taking her own life. The Kowalski family is seeking justice by suing John Hopkins All Children’s Hospital for $200 million due to their actions, which they claim influenced Beata Kowalski's death.

      Right?!? Yet there’s still people saying that she was totally of sound mind and is the victim of bullying by the mean old hospital who wouldn’t OD her daughter! 🙄🤦🏻‍♀️ Gotta love it when people form their conclusion based on a Netflix documentary that was one-sided as all get out, rather than get actual FACTS from the medical records that the documentary didn’t show. They were available to the family and they could have used them…but that wouldn’t fit their narrative and would completely blow their obvious cash grab lolsuit.

      @@AlaFrigginBama I definitely watched the doc before this, and seeing Maya's emotional pain had me on her side. But I've enjoyed debating the facts in the case. I am interested to hear from the jury bc they are deffo less biased than me. And even I am leaning in favor of the defense at this point. But he's a good lawyer. So again, I'm just eager to see what they come up with.

    So why John Hopkin All Children Hospital denied Dr.Hana to do evaluation on Maya despite the court order? And after Beata hung herself and pass away, this hospital released Maya and she was taken to see Dr.Chopar for evaluation by the court order

    Holy crap!. That was a MASTERFUL defense closing!! As an attorney for 18 years...It doesn't get much better than this. The arguments were direct, concise, and compelling... AND they were delivered in the most respectful and compassionate way possible. I'm not really up on all of the details in this case, but I have to give this attorney his due respect for this closing.

    Ok, whatever you believe about Maya's condition, this case was certainly not as simple as the Netflix doc made it out to be. I used to like Netflix docs but this is not the first time they have made a completely biased piece. I'll take any others with a pinch of salt from now on.

      Here’s what you fail to understand. Let’s say her mom was overly medicating her and exaggerating her condition - the question isn’t who is right - mom or hospital. The question is, did the hospital harm Maya by removing her from her mother’s custody? The answer is yes. Maya is irrevocably traumatized. They did not help anyone. Sure, maybe the corrected a medical condition. But was it worth it, the absolute carnage in the wake of their “help?” The whole point of child protective services is to make sure they are doing what’s best in the interest of the child. In what world did Maya benefit? I’m 38 years old, and I believe my mother was similar to Maya’s. Every sneeze, every complaint, every upset stomach, my mom was convinced I had a sinus infection. I was constantly on antibiotics as a child, and doing these sinus irrigation procedures which she convinced me I’d have to do for the rest of my life. When I moved out for college, I never took another antibiotic in my life and never did another sinus irrigation in my life. Never had another sinus infection. I love my mom dearly and I know she loves me more than anything in the world. If a judge or hospital would have taken me away from her when I was Maya’s age, my mental health would have been irreparably harmed. I was an over medicated kid. So what? I’m alive, I’m healthy, and I have a good relationship with my mom. All of these armchair detectives trying to go into the minute details of whether Beata was right or wrong are missing the point entirely.

    Mr. Shapiro did a great job. He was clear, cogent, told a chronological story and his argument was very compelling.

    An excellent, sensitive, detailed- but not too detailed- closing by Shapiro. I hope the jury considers everything in this case. I think it was definitely conversion disorder.

      If the entire case was closing arguments from attorneys, the hospital would have won easily. But the testimony from both the plaintiffs witnesses as well as hospital staff pushed things very hard in the other direction. Its very hard to find the hospitals witness testimony credible when they have perfect memory for every detail the defense asks about, but have no recollection about things you would expect are very memorable when the opposing side is asking questions. It makes it look like they were coached on how to lie

    The other counsel looked distracted and unprepared (except for the person breaking down potential payments). If I was going to get the ridiculous payout that these lawyers are potentially getting, I would have been prepared. THIS guy is AWESOME!

    I’m glad I watched this. I knew something felt off. Beata truly was ill. My heart goes out to everyone on both sides in this case and especially to dear Maya. I hope she’s getting intense therapy for her psychological trauma.

    Part of the NEUROLOGY of RSD is that respiratory tract nerve endings are sensitised as well, hence the ongoing irritation cough

    The most shocking part of this case is that they held her in the hospital against her will, and instead of treating her, they tortured her to try and prove that she was faking CRPS. All while simultaneously billing their insurance for CRPS treatment. Does it get any more corrupt than that?

    Defense has an outstanding case and there’s no question that, if justice alone were observed, the Hospital would prevail.
    But I predict that the jury will fail in this and the Big Bad Hospital will pay, and pay big and unjustly.
    They (the Hospital) are the victims of two females, each of whom has/had significant, untreated psychiatric disorders.

      @@Evenyoubrutus333 Precisely. I’m sorry that I have such a low opinion of juries in civil cases, but I do.
      On the criminal side, American juries generally do well. Recently, a Florida jury properly convicted Charlie Adelson if murder. He is the fourth to be convicted in a conspiracy that involves two and possibly three more.
      So I take heart in that!

      When I saw the Netflix doc I knew their family was a bit odd. They withheld a lot of pertinent information. They really crossed their Ts and dotted their Is, the hospital, even the providers before. The husband was actually supporting the hospital and their therapy for weaning her off heavy medication. He even mentioned divorce in the documentary.

      @@christyl5481 I so agree. We saw the documentary well before the trial and my husband, who is a family practice physician, said there was something very wrong with this family.
      At the trial, they tried to suggest that a divorce was only for the purpose of bringing Maya home. I don’t buy that for a minute. Jack knew the score but he was no match for Beata.

Maya overcame a lot, not only her mom but once she realized that the treatment plan her mother insisted on was wrong. They feel loyal to their deceased mother but they also know in their mind that it was not the hospital’s fault.

      You need to see the whole trial. This is NOT the first family have problems with John Hopkin All Children and Dr. Sally Smith. The Kursnir family, the Graham (husband actually went to jail for 300 days before he was cleared because of wrong accusations from this hospital and Dr. Sally Smith) . These so called pediatrician are NOT expert of Neutrologist that's why they never said Maya have CRPS, while 3 different Neutrologist stated Maya has CRPS

    The fact is that her pain was real and had a script from a doctor for the medicine she used. Amazing how only the doctors that agreed with the hospital's diagnosis was mentioned.

    So if the parents don't have a problem with keeping her and treatment plan was agreed too then why did,the hospital put things in motion for create a shelter order? That's what doesn't make sence to me.

    This closing information and statements change the dynamics of this family, and Mayas mind during all this. I hate to say it but, all her symptoms and behavior and prior treatment, reveal severe withdrawal from these drugs her Mom has given here now for long enough to be detrimental to her health. Something seems off about the story from the family, as well as the mentality of the Mother, given her ultimate actions that indeed broke her away from her own daughter forever.

    I watched the Netflix Docu months ago and something didn’t sit well with me. Her husband came off as put off and insinuated divorce. The facts and science based therapy practices have finally come to light. I think the defense did extraordinary, no bitterness, just facts. I feel awful for Maya and her family. Clearly her mother was toxic and believed she was a doctor. I have had behavioral issues my whole life and am not a mother. I cannot comprehend a loving mother offing herself when all these facts are true. Maya is not there for closing arguments and that says a lot.

      Maya is there during closing arguments. & You're not a mother and therefore clueless. The power of that hospital, child protective services and the courts along with the lack of accountability they face is terrifying. It's called a power trip- they didn't like being questioned by a concerned MOTHER who had stood by and took good care of her daughter.

      @@abbeyball6890 Maya stood up and walked out of the Defense’s closing arguments. If you haven’t watched this I encourage you. They had a slide show and had exhibits of her previous dr’s notes and recommendation for treatment. It’s almost as if she doesn’t want to look at the whole picture. Within months of her being discharged she was walking, off K and narcotics. The hospital was able to wean a tiny child off heavy medication and her life is better than before admission. I think the defense did a great job at showing inconsistencies with what Beata was reporting to her family. Beata was the one having a power trip. Her husband tried multiple times to calm her down and not berate staff. She came into the hospital demanding they jam a needle into Maya’s arm and snow her with Ketamine. Ketamine helps with pain but you have to run your own tests to establish a baseline for the patient. Beata brought her daughter to the hospital because K therapy wasn’t cutting it. She wanted to keep her daughter sick.

    Beata definitely was an abuser… Plain and simple. Those facebook posts were disturbing. Its like she was pretending to be her daughter to receive the sympathy herself.

      She was definitely taking the drugs as well. I think she wanted Maya to be on such a ridiculously high-dose that if she stole some it would be hard to detect..
      Remember this is Florida, you can't put anything past anybody...

    The defense attorney did AN IMPECCABLE JOB IN HIS CLOSING! SADLY, MAYA WOULD EVENTUALLY BE DEAD & THE HOSPITAL SAVED HER LIFE! TRAGIC WHAT HER MOTHER PUT HER THROUGH. IMO OFC

    I was extremely emotionally effected by the documentary- as a mother of three, who wouldn’t be? But I always did find it suspicious that she did end up making a recovery after her mother died. It never sat right with me. After watching this this methodical defense, I am out that Netflix would present such a manipulated viewpoint.

      Here’s what you fail to understand. Let’s say her mom was overly medicating her and exaggerating her condition - the question isn’t who is right - mom or hospital. The question is, did the hospital harm Maya by removing her from her mother’s custody? The answer is yes. Maya is irrevocably traumatized. They did not help anyone. Sure, maybe the corrected a medical condition. But was it worth it, the absolute carnage in the wake of their “help?” The whole point of child protective services is to make sure they are doing what’s best in the interest of the child. In what world did Maya benefit? I’m 38 years old, and I believe my mother was similar to Maya’s. Every sneeze, every complaint, every upset stomach, my mom was convinced I had a sinus infection. I was constantly on antibiotics as a child, and doing these sinus irrigation procedures which she convinced me I’d have to do for the rest of my life. When I moved out for college, I never took another antibiotic in my life and never did another sinus irrigation in my life. Never had another sinus infection. I love my mom dearly and I know she loves me more than anything in the world. If a judge or hospital would have taken me away from her when I was Maya’s age, my mental health would have been irreparably harmed. I was an over medicated kid. So what? I’m alive, I’m healthy, and I have a good relationship with my mom. All of these armchair detectives trying to go into the minute details of whether Beata was right or wrong are missing the point entirely.

    Maya absolutely has a psychological component to this. I'm not saying that she was lying about what was going on but she was doing it and a lot of it was an act. I don't think her mom was at all involved in this make-believe illness, I think she truly believed her daughter and was trying to do what she could do that was best for her daughter. Unfortunately Maya's psychological illness caused all this to happen and now she's being rewarded for it.

It was all in her head and she played it up. Definitely was a psychosomatic situation whether you understand that now or not.

    Sorry to say but the mom, in my opinion, was a real danger to her child. Unfortunately, the hospital handled the situation all wrong. Myah should have had a guardian with her at all times and been allowed to play with the other children and practice her religion 😢.
    Because of this the hospital will loose even though they most likely prevented her death.😢
